  • Introduction

    The International Centre for Settlement oflnvestment Disputes (ICSID or the Centre) was established on O ctober 14, 1966 when its constituent treaty, the Convention on the Settlement of Investment Disputes between States and Na-tionals of Other States (the Convention), entered into force.As of November 30, 1996, the Convention had been signed by 139 countries; of these, 126 had also ratified the Convention and have therefore become Contracting States.1

    Pursuant to the provisions of the Convention, I CSID provides facilities for the conciliation and arbitration of investment disputes between Contracting States and nationals of other Contracting States. To date, thirty-eight such disputes, three of them involving conciliation and the remaining thirty-five arbitration, have been brought under the Convention.2 Of the conciliation disputes, two proceedings were closed after an agreement was reached by the parties.

    Of the arbitration cases, fourteen were similarly settled by the parties on agreed terms before the rendition of an award; in one of those cases, the set-tlement was later embodied in an award. Arbitral awards have been rendered in a further thirteen cases. In four of them, there have been annulment pro-ceedings under Article 52 of the Convention followed, in three of the cases, by resubmission proceedings under the same Article of the Convention. Eight other arbitrations remain pending at the date of issuance of this brochure.

    The cases have concerned a variety of different kinds of investment in the agriculture, banking, construction, energy, health, industrial, mining and tourism sectors. Ninety-five different individuals from thirty-seven countries have served on the forty-one commissions, tribunals and committees thus far constituted in the cases.

    Decisions rendered in several of these I CS ID proceedings have been pub-lished. In some of the cases, there have also been national court decisions relating to ICSID. References for such published decisions are provided in this brochure, together with other data on the cases. Such data include the dates upon which the requests initiating proceedings were registered by the Secretary-General of the Centre, the dates of the constitution of each tribu-
