The Independent Insurance Agents of Tennessee, Inc., dba Insu-rors of Tennessee is a trade association of independent insurance agents. It is the oldest and largest insurance association in the state of Tennessee.

Our purpose is to offer support to these agencies so that they may better serve the public. WC Loss Cost Approved; Plan LCM to IncreaseOn Monday, October 31st the Tennessee Department of Commerce and Insur-ance announced that the NCCI filing for a loss cost increase of 1.6% was being modified by the Department, and that a loss cost filing for both the voluntary and assigned risk plan of 0.4% would be approved. Department Commissioner Julie Mix McPeak also notified the Ten-nessee Workers’ Compensation Advi-sory Council (WCAC) that she intends to raise the assigned risk plan loss cost multiplier (LCM) from 1.55 to 1.67.

Both changes will be effective March 1, 2012 for new and renewal business. Nei-ther of these changes will effect policies currently in force.

The Commissioner stated in her notice to the WCAC that her decision to raise the LCM was partially based on the fact that plan premium volume has fallen to the lowest level it has been since the year 2000. The following chart illustrates the drastic changes in premium volume since 1998.

She also estimated the cost of providing plan services and the level of multipliers in the voluntary market.

The revised loss cost reflecting the in-crease of 0.4% are not yet available. We will post them on our website and notify readers as soon as they are available.

Supreme Court Issues “Bruce’s Torch” Opinion In the last issue of The Tennessee Insuror, we published a story regarding contrac-tor’s liability. The case was on appeal to the Tennessee Supreme Court. Last week, the Supreme Court issued its opinion re-garding whether vicarious liability will be imposed on an employer for the negli-gence of an independent contractor.

In a traditional situation, each party to a tort case is only responsible for his, her or its conduct. The main exception to this rule is the concept of vicarious liability, which recognizes that those who employ others to carry on their business are re-sponsible for the negligent acts and omis-sions of such employees. In this way, the cost of negligence is passed to those who profit from the activity being engaged in at the time of the negligent act. Employers then have financial incentive to carefully hire, train and supervise employees.

Traditionally, however, independent con-tractors are not considered employees, and Tennessee Courts have generally held that one who employs an indepen-dent contractor is not liable for the negli-gence of that contractor.
