(b) From the 73 rd meeting of the Expert Committee all applications seeking import/ export permissions under Hazardous and other Wastes (Management, Handling and Trans-boundary Movement) Rules, 2016 shall be submitted online through Ministry's waste management portal (www.iwms.nic.in). The steps for submitting online applications are already available on Ministry's website. (c) Applicants are requested to frequently visit the website of the Ministry for agenda, minutes, meeting notice and other such information (http://www.moefnic.in/division / importexport). (d) Please ensure that the Mobile No. and e-mail address of the contact person is mentioned in the forwarding letter of the application. (e) For other queries/ clarification, the applicant may contact Ministry or call on 011-24695444 between 4.30 PM to 5.30 PM only on working days. (f) The applicants who are applying for the first time in the Ministry may invariably be present in the Expert Committee Meeting for a technical discussion. (g) Subsequent to the acceptance of online application in this Ministry, the applicant should submit hard copy of the entire set of documents along with the application to this Ministry through post or in person before/ during the scheduled meeting of the Expert Committee. 1

Instructions to follow with respect toImportl Export of Hazardous Wastesl OtherWastes under Hazardous and other Wastes(Management, Handling and Trans-boundaryMovement) Rules, 2016

(a) The application shall be addressed to Joint Director,Hazardous Substances Management Division, Jal Block,2nd Floor, Indira Paryavaran Bhawan, New Delhi-110003.

(h)The applicants called for presentation by the ExpertCommittee need to ensure their presence within twoensuing meetings of the Expert Committee. Subsequentto which, their application would be cancelled and theywill have to submit a fresh application for considerationby the Ministry.

* With respect to consideration of applications of import of waste tyresfor production of tyre pyrolysis oil, along with above cited documents,the applicant need to submit certificate from the concerned StatePollution Control Board/Pollution Control Committee along withinspection report certifying that the unit is in compliance with StandardOperating Procedure issued by the Ministry.

Note for Electrical and Electronic Assemblies: The Ministryencourages the waste management hierarchy of reduce, reuse andrecycle and emphasizes on the re-export of used EEAs subsequent toits use so as to minimize the dumping of e-waste/ hazardous waste inthe country. The Ministry may prefer the application committing to re-export the used EEA/ EEEs after use or a minimum specified timeline.

(Hi) EEAs for repair or renting in India and to be re-exported after one year**

(a) Form 5 of Hazardous and Other Waste Rules, 2016.(b) Justification for import(c) Undertaking for re-export specifying the time period for

(iv) Import of used EEAs for Testing purpose/Projects/R&Dand to be re-exported after three years***

(a) Form 5 of Hazardous and Other Waste Rules, 2016.(b) Justification for import(c) If being imported on returnable basis than undertaking

for re-export specifying the time period(d) Chartered Engineer Certificate from the exporting

country indicating the functionality, manufacturingdate, residual life and serial number.

(e) Details of previous import, if there has been any andconfirmation regarding their re- export, if applicable.

(f) Acknowledgement for receipt of copy of application fromconcerned State Pollution Control Board (SPCB) /Pollution Control Committee (PCC)

(g) Certification from exporting company for accepting there-export of defective or second hand EEEs, and thespares/part/ component/ consumables after thespecified time.

(h) Document depicting the status of employmentgeneration indicating the no. of people benefitted

(i) Extended Producer Responsibility-Authorisation asproducer under E-Waste (Management) Rules, 2016, ifthe EEAs to be imported are listed in Schedule I of theE-Waste (Management) Rules, 2016

(j) Copy of the previous latest permission issued by thisMinistry

*** "Used electrical and electronic assemblies imported for testing,research and development, project work purposes and to be re-exported back within a period of three years from the date of import"are in Schedule III D of Hazardous and other waste Rules, 2016 andthus are exempted from the need of Ministry's permission, subject tothe condition prescribed within the Rules.

(v) Import of used EEAs including medical equipment fortheir re-use purpose ****

(h) Certification from exporting company for accepting there-export of defective or second hand EEEs, after thespecified time.

(i) Document depicting the status of employment generationindicating the no. of people benefitted

(j) Extended Producer Responsibility-Authorisation asproducer under E-Waste (Management) Rules, 2016, if theEEAs to be imported are listed in Schedule I of the E-Waste(Management) Rules, 2016

(k) Copy of the previous latest permission issued by thisMinistry

**** "Used critical care medical equipment for re-use" falls in ScheduleVI of Hazardous and Other Waste Rules, 2016 and is prohibited forimport purpose.

(vi) Import of refurbished spare/parts/components forwarranty replacement and to be re-exported after oneyear*****

(a) Form 5 of Hazardous and Other Waste Rules, 2016.(b) Justification for import(c) If being imported on returnable basis than undertaking for

re-export(d) If refurbished components being imported as replacement

to defective component than undertaking for export ofequivalent numbers of defective components

(e) Details of previous import, if there has been ~y andconfirmation regarding their re- export.

(f) Acknowledgement for receipt of copy of application fromconcerned State Pollution Control Board (SPCB)/ PollutionControl Committee (PCC)
