License AgreementEND-USER LICENSE AGREEMENT FOR IK Multimedia Product

Pleasereadthisdocumentcarefullybeforebreakingthesealonthemediapackage.Thisagreementlicensestheenclosedsoftwaretoyouandcontainswarrantyandliabilitydisclaimers.

Bybreaking the seal on themediaenvelope, youare confirming tohave takennoticeof termsandconditionsof thisagreementandyouacknowledgeyouracceptanceof thesoftwareaswellasyouracceptanceofthetermsofthisagreement.Ifyoudonotwishtodoso,donotbreaktheseal.Instead,promptlyreturntheentirepackage,includingtheunopenedmediapackage,tothedealerfromwhomyouhaveobtainedit,forafullrefund.

1)DEFINITIONS

EULAmeansthisenduserlicenseagreement

IKMultimediaProductmeansthesoftwareprogramincludedintheenclosedpackage,andallrelatedupdatessuppliedbyIKMultimedia.

IKMultimediaProductmeansthesoftwareprogramandhardware(ifany)includedintheenclosedpackage,therelateddocumentation,models,multimediacontent(suchasanimation,soundandgraph-ics)andallrelatedupdatessuppliedbyIKMultimedia.

Notforresale(NFR)VersionmeansaversionofIKMultimediaProduct,soidentified,isintendedforreviewandevaluationpurposes,only.

2)LICENSE

TheIKMultimediaProductisprotectedbycopyrightlawsandinternationalcopyrighttreaties,aswellasotherintellectualpropertylawsandtreaties.TheIKMultimediaProductislicensed,notsold.ThisEULAgrantsyoutherightsasspecifiedherebelow.AllotheractionsandmeansofusagearereservedtothewrittenpermissionoftherightholderIKMultimediaProductionSrl:

Applications Software. The IKMultimediaProductmaybeusedonlybyyou.Youmay install andusetheIKMultimediaProduct,oranypriorversionthereofforthesameoperatingsystem,onuptofive(5)computers,providedthat(a)eachcomputerisownedby(orleasedto)andundertheexclusivecontrolofthelicensee;(b)theprogram(s)shallNOTbeusedsimultaneouslyonmorethanonemachine,and(c)anycomputer(s)withIKMultimediasoftwareinstalledshallnotbesold,rented,leased,loanedor otherwise be removed from the licensees possession without first removing (uninstalling) thelicensedsoftware,exceptasprovidedinParagraph4(below)pertainingtoSoftwareTransfer.

Storage/Network use.YoumayalsostoreorinstallacopyoftheIKMultimediaProductonastoragedevice,suchasanetworkserver,usedonlytoinstallorruntheIKMultimediaProductonyourothercomputersoveraninternalnetwork;however,youmustacquireanddedicateadistinctlicenseforeachuseroftheIKMultimediaProductfromthestoragedevice.AnygivenlicensefortheIKMultimediaProductmaynotbesharedorusedconcurrentlyorotherwiseondifferentcomputersorbydifferentdevelopersinagivenorganization.

3)AUTHORIZATION

TheIKMultimediaProductonlyfunctionswhenyouhaveauthorizedit.TheIKMultimediaProductwillbeauthorizeduponcompletingtheauthorizationprocedure.Onceyourproductisauthorized,youmayuseit.

Youagreetofollowtheauthorizationprocedureandwillprovidetrue,accurateandcompleteinforma-tionaboutyourself.Ifyouprovideanyinformationthatisuntrue,inaccurate,notcorrectorincomplete,or IKMultimediahasreasonablegroundstosuspect thatsuchinformationisuntrue, inaccurate,notcorrectorincomplete,IKMultimediahastherighttosuspendortorevokethelicense.

Theterminationofthelicenseshallbewithoutprejudicetoanyrights,whatsoever,ofIKMultimedia.

4)DESCRIPTIONOFOTHERRIGHTSANDLIMITATIONS

Limitations on Reverse Engineering, Decompilation, and Disassembly.Youmaynotreverseengineer,decompile,ordisassembletheIKMultimediaProduct,exceptandonlytotheextentthatsuchactiv-ity isexpresslypermittedbyapplicable lawnotwithstanding this limitationof components. The IKMultimediaProductislicensedasasingleproduct.Itscomponentpartsmaynotbeseparatedforuseonmorethanonecomputer.

Not for Resale Version. If the IK Multimedia Product is labeled Not for Resale or NFR orEvaluationCopy,then,notwithstandingothersectionsofthisEULA,youmaynotsell,orotherwisetransfertheIKMultimediaProduct.

Rental.Youmaynotrent,lease,orlendtheIKMultimediaProducttoanyparty.

Software Transfer.Youmaynottransfer,licenseorsublicenseyourrightsasLicenseeofthesoftwareoranyIKMultimediaproduct,aslicensedtoyouunderthisagreementwithoutpriorwrittenconsentoftherightsowner.ThecarrieronwhichtheIKMultimediaproducthasbeendistributedmaybetrans-ferredorotherwisemadeavailabletoanythirdpartyonlywiththepriorwrittenconsentoftherightsownerandprovidedthat(a)theoriginalmediaandlicense(s)accompanythecarrierand(b)thepartytransferringthemediadoesnotretainacopyofthemedia.

5)UPGRADES

IftheIKMultimediaProductislabeledorotherwiseidentifiedbyIKMultimediaasanupgrade,youmustbeproperlylicensedtouseaproductidentifiedbyIKMultimediaasbeingeligiblefortheupgradeinordertousetheIKMultimediaProduct.

AnIKMultimediaProductlabeledorotherwiseidentifiedbyIKMultimediaasanupgradereplacesand/orsupplementstheproductthatformedthebasisforyoureligibilityforsuchupgrade.YoumayusetheresultingupgradedproductonlyinaccordancewiththetermsofthisEULA.IftheIKMultimediaProductisanupgradeofacomponentofapackageofsoftwareprogramsthatyoulicensedasasingleproduct,theIKMultimediaProductmaybeusedandtransferredonlyaspartofthatsingleproductpackageandmaynotbeseparatedforuseonmorethanonecomputer.

6)DUAL-MEDIASOFTWARE

YoumayreceivetheIKMultimediaProductinmorethanonemedium.Youmaynotloan,rent,lease,orotherwisetransfertheothermediumtoanotheruser,exceptaspartofthepermanenttransfer(asprovidedabove)oftheIKMultimediaProduct.

7)LIMITEDWARRANTY

IKMultimediawarrants to theoriginal purchaserof the computer softwareproduct, for aperiodofninety(90)daysfollowingthedateoforiginalpurchase,thatundernormaluse,thesoftwareprogramandtheuserdocumentationarefreefromdefectsthatwillmateriallyinterferewiththeoperationoftheprogramasdescribedintheencloseduserdocumentation.

8)WARRANTYCLAIMS

Tomakeawarranty claimunder theabove limitedwarranty,please return theproduct to thepointofpurchase,accompaniedbyproofofpurchase,yourname,your returnaddressandastatementofthedefect,orsendtheCD(s)tousatthebelowaddresswithinninety(90)daysofpurchase.Includeacopyof thedatedpurchasereceipt,yourname,yourreturnaddressandastatementof thedefect.IKMultimediaoritsauthorizeddealerwillusereasonablecommercialeffortstorepairorreplacetheproductandreturnittoyou(postageprepaid)orissuetoyouacreditequaltothepurchaseprice,atitsoption.

9)LIMITATIONSONWARRANTY

IKMultimediawarrantsonlythattheprogramwillperformasdescribedintheuserdocumentation.Nootheradvertising,descriptionorrepresentation,whethermadebyaIKMultimediadealer,distributor,agentoremployee,shallbebindinguponIKMultimediaorshallchangethetermsofthiswarranty.

EXCEPT AS STATED ABOVE, IK MULTIMEDIA MAKES NO OTHER WARRANTY, EXPRESSED OR IMPLIED, REGARDING THIS PRODUCT. IK MULTIMEDIA DISCLAIMS ANY WARRANTY THAT THE SOFTWARE IS FIT FOR A PARTICULAR PURPOSE, AND ANY IMPLIED WARRANTY OF MERCHANTABILITY SHALL BE LIMITED TO A NINETY (90) DAY DURATION OF THIS LIMITED EXPRESS WARRANTY AND IS OTHERWISE EXPRESSLY AND SPECIFICALLY DISCLAIMED. IK MULTIMEDIA SHALL NOT BE LIABLE FOR SPECIAL, INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES, EVEN IF IK MULTIMEDIA IS ADVISED OF OR AWARE OF THE POSSIBILITY OF SUCH DAMAGES. THIS MEANS THAT IK MULTIMEDIA PRODUCTION SRL SHALL NOT BE RESPONSIBLE OR LIABLE FOR THE LOSS OF PROFITS OR REVENUES, OR FOR DAMAGES OR COSTS AS A RESULT OF LOSS OF TIME, DATA OR USE OF THE SOFTWARE, OR FROM ANY OTHER CAUSE EXCEPT THE ACTUAL COST OF THE PRODUCT. IN NO EVENT SHALL IK MULTIMEDIA LIABILITY EXCEED THE PURCHASE PRICE OF THIS PRODUCT.

10)CHOICEOFLAW

Youagreethatanyandallclaims,suitsorotherdisputesarisingfromyouruseofthesoftwareshallbedeterminedinaccordancewiththelawsofItaly,intheeventIKMultimedia,ismadeapartythereto.YouagreetosubmittothejurisdictionofthecourtinModena,Italyforallactions,whetherincontractorintort,arisingfromyouruseorpurchaseofthesoftware.

11)GENERAL

ThisAgreementcontainsthecompleteagreementbetweenthepartieswithrespecttothesubjectmat-terhereof,andsupersedesallpriororcontemporaneousagreementsorunderstandings,whetheroralorwritten.AllquestionsconcerningthisAgreementshallbedirectedto:

SelecttheIKMultimediaproductyouwanttouninstallandclicktheRemovebutton.Allthecomponentswillberemovedfromyoursystem.Ifyouaddedorchangedfilesaftertheinstallation,itmaybethatsomefilesandfoldersarenotremoved.Deletethemmanually,fromthedestinationfolderyouselectedduringinstallation.

Chapter 3 - The New Authorization ManagerTheAuthorizationManagerisastandaloneapplicationthat isusedtoauthorizeyourIKMultimediaproducts,anditwillbeincludedineveryproductandupdatesreleasedafterOctober2010.

AllproductsandupdatesthatcameoutbeforethereleaseoftheAuthorizationManagercanbeautho-rizedintwodifferentways:

We strongly suggest authorizing all products with the new Authorization Manager as it makes the authorization process faster and easier.

In case you accidentally start the old Authorization Wizard please cancel the process, install the latest version of the Authorization Manager (downloadable from www.ikmultimedia.com/products), and authorize your product from there.

Chapter 8 - Inserting Serial NumberTheSerialNumberisthecodewrittenontheRegistrationCard(includedwithyourIKboxedproduct,insidethe licenseenvelope)or theone thathasbeendelivered toyou (e.g.Onlinepurchase, suchasaDigitalDelivery,orupdate).TypetheSerialNumberinthefieldsmanuallyorbyclickingonthePASTEbutton.

OncetheSerialNumberhasbeenproperlyinsertedagreencirclewillappear,showingthatthecodehasbeenenteredcorrectly.Ifaredcircleisdisplayed,theSerialNumberinsertedisnotcorrectandyouwillbeaskedtoretypeitinthefields.

AfterinsertingavalidSerialNumber,thePASTEbuttonwillchangeitsnametoADDSERIALNUMBER,allowingyoutoaddmoreSerialNumbersandauthorizeseveralproductsatonce.

TheLOGOUTbuttonletsyoureturntotheNew/RegisteredUserselectionpage(seefigure5.2)andauthorizeproductswithadifferentuseraccount.

AfteryouinsertedalltheSerialNumbersthatyouneedtoauthorizejustpresstheNEXTbuttontogotothenextstepoftheauthorizationprocedure.

TheAuthorizationManagerwillauthorizeonlytheproductsthatareinstalledonyourcomputer.YoucandownloadanyproductthatisnotonyourcomputerbyclickingonthecorrespondingDOWNLOADbutton.AfterinstallingalltheproductsinthelistcomebacktotheAuthorizationManagerandclickonDONEtocompletetheprocedure.

Chapter 9 - Offline authorization procedureIftheAuthorizationManagerseesthatyourcomputerisnotconnectedtotheInternet,itwillaskyouto retry or proceedwith theOFFLINE procedure. If you forgot to activate your Internet connection,just restore it, and then click theRETRYbutton; theONLINEAUTHORIZATIONprocesswill start. IncaseyourcomputerdoesnthaveaconnectionoryouprefertonotconnectittotheInternet,clicktheOFFLINEAUTHORIZATIONbutton.

ToauthorizeyourproductorunlockyourCustomShopmodels(seeChapter10forCustomShop)withacomputerthatisnotconnectedtoInternet,followthesesteps:

1. Savetheauthorizationrequestfile(AuthorizationRequest.html)onthecomputerthatisnotconnectedtotheInternet.

2. CopythefiletoacomputerthatisconnectedtotheInternetwhilekeepingtheAuthorizationManageropenonthefirstcomputer.

3. Double-click the AuthorizationRequest.html file on the computer that is connected to theInternet.Itwillopenyourbrowser.

4. Follow the instructions on your browser. The last step will ask you to save a second file(Authorization.xml)onthecomputerthatisconnectedtotheInternet.

5. CopytheAuthorization.xmlfiletothecomputerthatisnotconnectedtotheInternet.

6. Load the Authorization.xml file in theAuthorizationManager on the computer that is notconnectedtotheInternettoauthorizeyoursoftware.

Thefirstpagewillletyoucreatetheauthorizationrequestfile(AuthorizationRequest.html)onthecomputerthatisnotconnectedtotheInternet.ClicktheSAVEAUTHORIZATIONFILEbuttontocreatetheAuthorizationRequest.htmlfiletocopythecurrentcomputerdetailstotheonethathasanInternetconnection.Choosecarefullywheretosavethefile(onyourDesktopwillbefine)becauseyouwillhavetotransfer it tothecomputerthatisconnectedtotheInternetinthenextstep.

ClicktheNEXTbuttonaftersavingtheAuthorizationRequest.htmlfile.

CopytheAuthorizationRequest.htmlfileyouhavejustsavedandtransferit(withaUSBdrive,etc.)toacomputerthatisconnectedtotheInternet.Afteryouhavetransferredthefile,double-clickitandfollowtheinstructions.

Dont close the Authorization ManagerasyouwillhavetoreturnbacktothispageaftercompletingallthestepsonthecomputerthatisconnectedtotheInternet.

Thefinalpagedisplayedonyourbrowserwillshowalltheauthorizedproducts(figure9.6).ClicktheDONEbuttontocreatetheAuthorization.xmlfilethatyouwillneedtoauthorizetheproductsonthecomputerthatisnotconnectedtotheInternet.

IMPORTANT: To finish the authorization process, you must make sure that all the products you just authorized are installed on the computer that is not connected to the Internet. Ifyouhavenotinstalledtheproductsyet,pleasedownloadtheinstallersfromthelinksbesideeachproductnameandinstallthemonthecomputerthatisnotconnectedtotheInternetbeforeloadingtheAuthorization.xmlfileintotheAuthorizationManager.

NowyoucanproceedtocopytheAuthorization.xmlfiletothecomputerthatisnotconnectedtotheInternet.

Returnto theAuthorizationManagerpagethatyouhave leftopenonthecomputer that isnotcon-nectedtotheInternetandpresstheNEXTbutton.Thefollowingpagewillappear:

InordertoaccesstheCustomShop,youfirstneedtoinstallandauthorizeAmpliTubeonadifferentcomputer that is connected to the Internet.After this, you can access theCustomShop to buygearmodels.Thenewgearmodelsyoupurchasewillbe immediatelyavailable in theAmpliTubeversioninstalledonthecomputerconnectedtotheInternet.

To unlock the same gear models in the AmpliTube version installed on the computer that is notconnected to the Internet, you need to launch the Authorization Manager and click the OFFLINEAUTHORIZATIONbutton.

TounlockyourCustomShopmodelswithacomputerthatisnotconnectedtoInternet,followthesesteps:

1. Savetheauthorizationrequestfile(AuthorizationRequest.html)onthecomputerthatisnotconnectedtotheInternet.

2. CopythefiletoacomputerthatisconnectedtotheInternetwhilekeepingtheAuthorizationManageropenonthefirstcomputer.

3. Double-click the AuthorizationRequest.html file on the computer that is connected to theInternet.Itwillopenyourbrowser.

4. Follow the instructions on your browser. The last step will ask you to save a second file(Authorization.xml)onthecomputerthatisconnectedtotheInternet.

5. CopytheAuthorization.xmlfiletothecomputerthatisnotconnectedtotheInternet.

6. Load the Authorization.xml file in theAuthorizationManager on the computer that is notconnectedtotheInternettoauthorizeyoursoftware.
