Industrial Hemp Production Attestation On February 27, 2019 the USDA stated that until regulations and guidance under the Agricultural Act of 2018 have been finalized, industrial hemp produced in the United States should be grown in accordance with the Agricultural Act of 2014. USDA has indicated that new regulations will be in place for the 2020 crop season. For the 2019 crop season, producers need to comply with the 2014 Farm Bill. To obtain organic certification of industrial hemp you must meet the requirements of NOP Instruction document 2040 Organic Certification of Industrial Hemp Production.” NOP 2040 indicates that industrial hemp produced in accordance with the 2014 Farm Bill per the USDA Statement of Principles on Industrial Hemp may be certified as organic. The Statement of Principles on Industrial Hemp states that growth and cultivation of hemp may only take place in accordance with an agricultural pilot program to study the growth, cultivation or marketing of industrial hemp established by a State department of agriculture or institute of higher learning in a state where industrial hemp is otherwise legal.
