Sheriff denies NAACP entrance into jail

Racine Public Safety and Licensingcommittee, which consisted of threewomen and one man, on Monday nightrecommended that theliquor license for ThePlace on 6th, 509Sixth St., owned byAlderman Keith Fair,be revoked.

For nearly six hoursa due process hearing,a court like proceed-ing, was held in theCity Hall's councilchambers, 730Washington Ave.

Committee mem-bers, chaired byAlderman RobertMozol, sat throughseveral hours of testi-mony before goinginto closed session todeliberate the contro-versial Alderman'sfate. Alderman RonHart and Alderman Sandra Weidner lis-tened briefly to the proceedings. All 15Alderman, including the four that were onthe committee, will vote on the matterwhen it matter goes before the full CityCouncil later this month.

The fifth time was the charm for CityHall's effort to have the bar shuttered.

The committee and city have spentclosed to $50,000 trying to hold a dueprocess hearing to consider whether theestablishment should be allowed to con-

tinue to sell alcohol or soda. Four previ-ous hearing dates were either canceled oradjourned. The most recent attempt to

hold the proceeding wascanceled when the newlyappointed Racine Chief ofPolice learned that hecould not be a complainantbecause he did not live inthe City of Racine. Thisled to Alderman GregHelding, a self-appointedcritic of Fair, to assumethe role as the city's com-plainant. Fair's attorneythen raised a question ofthe basic validity of thecomplaint inasmuch as itwas prepared by the cityattorney at taxpayerexpense rather than byHelding himself.

In Helding's complaint,the city alleges the bar

“constitutes a disorderlyor riotous, indecent or

improper house,” and cites seven separateincidents between Jan. 1 and June 23.

During testimony, police said theywere called to the bar or an area near thebar for fights, assaults, other civil disputesor disorderly behavior, according to theirPhoenix system. The Phoenix system isused by the police department to docu-ment patterns of police calls. Lt. WilliamMacemon testified that he had trackeddowntown bar active between June 1 andAug. 16. He said police had been called

believe for a moment that they will getbetter if you sit home on election day.Democracy is all about participation, andquite honestly, we need to be engaged ona full time basis, not just on election day.Getting to know who the candidates arefor any particular office, even before theprimaries, is actually part of our responsi-bility as citizens.

And speaking of candidates, some ofus seem to believe that politicians aresomehow different from the rest of us,that there are some sort of special qualifi-cations that you must have to serve inpublic office. Well, as an elected officialmyself, who has been around other elect-ed officials and candidates for office, Ican tell you that isn’t necessarily so.

The first and foremost qualificationthat you must have is a desire to holdoffice. Beyond that, anyone can do it,and there are certainly some who shouldnot. There’s a reason why it is referred toas “public service”, because that’s what itis intended to be. Ideally, any electedofficial should be dedicated to serving thepublic that he or she represents. Thatmeans all of the people, not just them-selves or their friends.

Unfortunately, when we don’t partici-pate in the process, and wait until elec-tion day to select from candidates thatothers have chosen, we can end up hav-ing to decide between two people whomight not care about our needs at all.

So what’s a citizen to do? Well, thevery first step in becoming a participatingmember of this democracy is to registerto vote. And it’s not that difficult (despitesome people wanting to make it so).There are people actively working to getfolks registered right now. If theyhaven’t found you yet, then I recommendyou make an effort to find them.

Park 6 wins appeal over City of RacineCould Bar Reopen? Thomas Holmes, owner, looks at his options

Wisconsin Court of Appeal hasupheld Kenosha County Circuit CourtJudge Bruce Schroeder was correct tooverturned a decision by Racine alder-men to revoke the liquor license for theformer Park 6 bar, 500 6th Street,according to a Wednesday, Oct. 10, rul-ing by the Wisconsin Court of Appeals.

Thomas Holmes business wasclosed at the end of 2011 after a judgegranted the city’s motion for a tempo-rary injunction.

The city’s had asked for a permanentinjunction against the bar, but it wasdismissed in February after a lease thatHolmes had at the property expired.

Holmas told the Insider News byphone that he was happy over the deci-sion of the higher court. “My lawyerand I has long contend that the citywas acting improper and maliciously,”he said.

The injunction was the latest install-ment of the ongoing legal battlebetween Holmes and the city regardingPark 6, a local downtown club that wasfrequent by a primary AfricanAmerican clientele.

Board Supervisor, said in a number ofhis bi-monthly columns entitle“Neckboneology” has long suggestedthat other Black bar owners feels thecity of Racine is out to close down-town minority bars making theirlicense available to other establish-ments.

In the city complaint, the city arguedthe business was a public nuisance andhad created numerous neighborhooddisturbance. Holmes claimed the citywas discriminating against black-owned businesses.

In a 2009 report by the local branchof the NAACP, entitle: A Report on theState of Racine's Downtown, stated,“With the exception of one or twoentertainment venues that recognizemoney as the only color,minorities/blacks be they patrons orowners/operators are not welcomedowntown Racine.”

In January 2011 after Holmes wascalled before the city’s Public Safetyand Licensing Committee in December2010 for a due process hearing aftertwo incidents at his nightclub, the CityCouncil voted to revoke the bar’s

liquor license Racine County CircuitCourt asking for judicial review ofcouncil’s and committee’s decisions. Inthe petition, Holmes’ attorney, VincentBobot, said the city should not haveheld the due process hearing becausethen-Racine Police Chief Kurt Wahlendid not file a “sworn” complaintagainst Holmes. That wasn’t enough tostop the process, argued city officials.

When Schroeder overturned thecommittee’s decision in August 2011,the city appealed.

In its ruling, the Court of Appealscalled “the oath or swearing require-ment” important and not a “meaning-less legal trapping.”

“The solemnity imposed by an oathrequires the actor to stop and considerthe allegations he or she is making,”the ruling states. “Requiring a com-plainant to swear to his or her allega-tions prevents baseless harassment oflegitimate businesses”

Holmas said that the city shouldgive him his liquor license back and heshould be allow to reopen. “I am look-ing into the options available and soonwill make a decision.”

The Birthday Celebration will be held Sunday, November 11, 2012 atthe Racine Civic Centre Festival Hall, 5 Fifth St., Racine, WI.

Alderman Fair feels that the civilrights organization should ask the circuitcourt to overturn Schmaling's decision."In America people are innocent untilproven guilty, " he said. Fair believes thatthe disenfranchising voters in the jail isanother example of these Republicanadministrations trying to suppress theinmate's votes.

Snow says, "There is no basis for jailinmates to be denied the opportunity toregister to vote especially since most ifnot all of these persons are awaiting trial,with substantial additional numbers serv-ing misdemeanor sentences, which do notresult in disenfranchisement as a felonwould."

Rogers said that the NAACP willremain vigilant, but with only a fewweeks before the presidential election, itis unfair that Sheriff Schmaling hasbrought an abrupt halt to the inmate'srights to vote.

Fair's bar has been shut down sinceAug. 16, after city officials contended itwas a nuisance and brought action inRacine County Circuit Court against Fair.That case is still pending.
