REKACIPTA YANG BOLEH DIPATENKAN:•baru yang bermaksud sesuatu rekacipta itu masih belum dizahirkan kepada awam dimana-mana

di dunia ini;

•mempunyai langkah merekacipta yang mana rekacipta tersebut tidak ketara kepada seseorang

yang mempunyai pengetahuan dan pengalaman di dalam bidang teknologi rekacipta tersebut dan

•dapat digunakan kepada industri yang bermaksud dapat dibuat atau digunakan untuk berbagai

jenis industri

Untuk mendapatkan sijil Pembaharuan Utiliti, sesuatu rekacipta hanya perlu baru.

PATENTABLE INVENTIONS:•be new, which means that the invention has not been publicly disclosed in any form, anywhere in

the world;

•involves an inventive step, that is to say the invention must not be obvious to someone with

knowledge and experience in the technological field of the invention; and

•be industrial applicable, meaning it can be made or used in any kind of industry.

For a Utility Innovation to be granted it only has to be new and industrial applicable.

REKACIPTA YANG TIDAK BOLEH DIPATENKAN:

•penemuan, teori-teori saintifik dan kaedah matematik;

•kepelbagaian tumbuhan atau binatang atau proses biologi yang perlu bagi pengeluaran

tumbuhan atau binatang, selain daripada micro-organisma hidup buatan manusia, proses micro-

biologi dan keluaran daripada proses micro-organisma itu;

•skim, kaedah atau cara untuk menjalankan peniagaan, melakukan perbuatan-perbuatan mental

•discoveries, scientific theories and mathematical methods;

•plant or animal varieties or essential biological process for the production of plants or animals, other than

man-made living micro-organism, micro-biological processes and the product of such micro-organism

processes;

•scheme, rules or methods for doing business performing purely mental acts or playing games;

•method for the treatment of human or animal body by surgery or therapy, and diagnostic methods practiced

on the human or animal body.

HAKCIPTA:

“Hakcipta adalah hak eksklusif yang diberikan kepada pemilik karya yang

Malaysia tidak mempunyai sistem pendaftaran hakcipta. Sesuatu karya adalah

dilindungi secara automatik sebaik sahaja ia memenuhi syarat-syarat berikut:

•usaha yang mencukupi telah dilakukan untuk menjadikan karya itu bersifat asli;
