Co-determination at HHLA

A concept for employee consultation and participation in company decisions It is regulated by a number of detailed laws Employee participation in regulation of working conditions, economic planning

and decision making is guaranteed by law Co-determination basically takes place on two levels:

Establishment level, through the works council (Betriebsrat) Company/Group level, through the supervisory board (Aufsichtsrat)

HHLAʼs employees participate in company decisions through: Group works council (Konzernbetriebsrat) Individual work councils of HHLA‘s subsidiaries HHLA and the Association of German FePort Operators (ZDS) make collective

agreements with Verdi, the main trade union of HHLA employees

Framework conditions at CTA

The intense competitive environment makes technological development necessary. Both parties have a positive attitude toward automation CTA and the works council have agreed on ‚Rules‘ regarding automation based

on the collective agreement made between the terminal and the trade union Employees of CTA are actively involved There is a positive culture for innovation

Goal

Creating conditions which safeguard automation and innovative projects for boththe management and employees

These entail: Prevention of one-sided or undue burdens to employees as a result of

rationalisation or work intensification Prevention of additional psychological stress Securing jobs at CTA through technological innovation and comprehensive

health management

Approach

Number of affected employees (X) Extent of change of work procedure (Y) Extent of improvement of internal productivity (Z)

Each criteria is rated with a value between 1-10, where 1= min and 10 = max value

The „Factor of protection from negative impacts of rationalisation “ is thencalculated through the formular X * Y* Z

Assessment of planned restructuring projects by means of criteria

Page 14: INNOVATION AND PROTECTION FROM NEGATIVE IMPACTS OF ... · 09.05.2017 Innovation and protection from negative impacts of rationalisation at CTA 4 High Grade of Automation enables efficient

Measures

At a factor >100 but up to 250: Timely consultation with the works council Survey, recording and documentation of the prospective changes Informing the employees about the findings of the survey Training the affected employees

At a factor >250, further measures have to be taken: Training the affected employees based on project-related qualification

mechanisms Health preservation and -promotion measures Job-securing measures Offering of alternative jobs

Depending on the value of the Factor

Page 15: INNOVATION AND PROTECTION FROM NEGATIVE IMPACTS OF ... · 09.05.2017 Innovation and protection from negative impacts of rationalisation at CTA 4 High Grade of Automation enables efficient

Implementation of the measures

This could entail: Training initiatives Providing information about various changed work packages Specification of internal processes to be adhered to Offering employees medical check-ups Balance of interests / alternative jobs

09.05.2017 Innovation and protection from negative impacts of rationalisation at CTA 15

By means of negotiation between management and the works council
