LexisNexis Nasionale Skynhof Kompetisie

Die Noordwes-Universiteit, Potchefstroomkampus het hierdie jaar weer deelgeneem aan die Nasionale LexisNexis Skynverhoor Kompetisie. Die kompetisie is hierdie jaar aangebied deur die Nelson Mandela Metropool Universiteit vanaf 25 tot 28 September

2013. Die Puk-span het bestaan uit Lonngren Prinsloo en Edna du Toit met Braam Klaasen as afrigter. Twaalf spanne het aan die kompetisie deelgeneem met vier spanne wat na die uitkloprondtes deurgegaan het na die semifinale. Daar kon ongelukkig slegs twee spanne deurgaan na die finaal en die Noordwes-Universiteit, Potchefstroomkampus-span en die span van die Universiteit van Venda het mekaar in die finaal ontmoet.

Die regsbank vir die finaal het bestaan uit vyf voorsittende beamptes bestaande uit Regter Lieberman met twee senior en twee junior advokate. Die Noordwes-Universiteit, Potchefstroomkampus-span is op ’n gala geleentheid as die algehele wenners van die kompetisie aangewys. Die span het ook die prys verower vir die hoogste punte toegeken gedurende die uitkloprondtes.

Noord Wes Universiteit, Potchefstroomkampus het hierdie jaar weer deelgeneem aan die Nasionale LexisNexis Skynverhoor Kompetisie. Die kompetisie is hierdie jaar aangebied deur die Nelson Mandela Metropool Universiteit vanaf 25 tot 28 September 2013. Twelve teams competed in the competition with four teams going through to the semi-finals. Unfortunately only two of the teams went through to the finals with the teams of North West University, Potchefstroom and the University of Venda going through. The bench for the final consisted five presiding officer’s with Judge Lieberman and two senior and two junior advocates. The team of North West University, Potchefstroom was named the overall winners at a gala event later that night. The

team also received a price for the highest total score achieved during the knockout rounds.

Our students learn TO DO!

During this year the faculty held an Internal Criminal Law Mock Trial competition for second and third year students for the third consecutive year. The Juta-NWU Criminal Mock Trial came into being to fill the gap with

regard to practice alignment. In 2011 the competition started with just over 60 participating students. This year, more than 120 enthusiastic students took part. Students participate in groups of four members each. One group represents the ‘state’ and the other group the ‘defence’. The group is also assessed as a whole, which evaluates the ability of the students to join forces.

In the first round students battled it out against their own year group. Eight groups, consisting of both second- and third year groups, advanced to the semi-finals appearing in front of presiding officers Mark Adams and Renette Faber, two of Klerksdorp’s finest legal practitioners. The best second- and third year group advanced to the final which took place on the 23 August 2013 where students litigated it out in front of Honourable Judges Frits van Oosten and Leonie Windell. The members of the second year team who advanced to the final were P Seeletso, T Jacobs, V Mogapi and N Twala. The members of the third year team were S Jacobs, E lochner and D Olyn. After a nail biting final the second year team walked away with a book prize donated by Juta. The lecturers who assisted with the mock trial were Allison Geduld, Michael Laubscher, Chantelle Feldhaus and René Koraan. Various law students assisted in the enactment of the trials.

The question that arises is why a student would take part in such activity? It calls for major sacrifices because these trials are held after hours, from the elimination rounds up to the finals. Participation is not compulsory and students do not receive any additional credits for taking part. They do it merely because of a passion for the Law. Students WANT TO participate; they want to experience the exposure, to

be given the opportunity ‘to show what they are capable of’. Students’ reading-, writing- and oral skills are tested and sharpened. This competition does not only break through language barriers, but also through the barriers of race and gender.

The qualifications of law students are often criticised but this initiative enables us to prove that our students are different and that we, as a faculty, take much trouble to empower our students and to equip them with practical skills. We provide students with real life experiences. In recent times legal studies received negative publicity because it allegedly lacks precisely that. Complaints from students who do not know when to stand up or to sit down during a hearing are only a few amongst many. Prof. David McQuoid-Mason, President of the Commonwealth Legal Education Association, mentioned that ‘law students must be taught “lawyering skills” at university before they undergo practical legal training.’

For too long we remained passively waiting to realise what may be wrong, the time has come to take the bull by the horns and to start DOING; as is said: ‘walk the talk’. This is exactly what we are doing at the Faculty of Law, Potchefstroom Campus, NWU.

With this mock trials we foster a new culture, a culture of ‘passion for the Law’ and fraternal spirit, and the students are the leaders.

Centre of Excellence @ the Faculty?

The Faculty recently applied to the National Research Foundation for a Centre of Excellence dealing with the topical issue of innovation in sustainability and climate change law and governance.

In South Africa, environmental and climate law has become a well-established scholarly enterprise and pockets of excellence exist at various universities with experts focusing on issues related to the conceptual and theoretical legal framework; economic aspects such as taxes; renewable energy and mining; human and environmental rights, ethics, and rural development; local government and urban development; land use and aspects of property; natural resources management, biodiversity and protected areas; water and food security; coastal zone and marine governance; and international law and governance. The CoE will harness this expertise by means of a virtual structure into an organised and concentrated institution that focuses on an innovative

approach to the role of law and governance in environmental and climate change matters. More specifically, it will investigate how law and governance could: translate natural science knowledge into practice; translate political objectives and undertakings into practice; change human behaviour to mediate environmental and climate impacts; create opportunities for mitigation, adaptation and resilience; strengthen South Africa’s competitive advantage in regional and international political fora such as AU/SADC/UN/BRICS; help transition South Africa to a low carbon economy; protect natural resources; and protect and transform society by increasing resilience to environmental and climate change and limit exposure to the physical threats to human health and well-being while improving the capacity of people to cope with these impacts.

Should the CoE be awarded, it will have a great impact on the research and standing of the Faculty both locally and internationally.

Me René Koraan is vir die derde agtereenvolgende jaar deur die studente van die fakulteit aangewys as die mees inspirerende dosent by wie hulle klas het. Studente kry die geleentheid om

gedurende beide semesters te stem vir hul topdosent. Die kompetisie word aangebied in samewerking met RAPPORT om erkenning te gee aan dosente wat ekstra moeite vir hul studente doen.

René was hierdie jaar gedeeltelik verantwoordelik vir die ontwikkeling en aanbieding van die nuwe eerstejaarsmodule Inleiding tot die Reg

en Vaardighede (IURI 171) en het ook Strafreg: Besondere Misdade (JURI221) aangebied. Die jaarlikse interne skynverhoor kompetisie (sien berig elders in hierdie uitgawe) was haar breinkind en sy is steeds besig om dié kompetisie jaarliks te laat groei. Die studente sien duidelik haar entoesiasme en passie raak! Welgedaan René, die fakulteit is trots op jou!

Die praktyk het dit aangedui, die populêre mening het saamgestem – gegradueerde LLB-studente se taalvaardighede is kommerwekkend. Daar kort iets in die mondering van die studente wat ons aflewer. Die Fakulteit

Regte op die Potchefstroomkampus het besef dat die kwessie aangespreek moet word, en besluit: “Tot hiertoe en nie verder nie”. Dit is hoe die reeks modules “Taalvaardigheid in die regskonteks / Language skills in the legal context” tot stand gekom het.

Hierdie modules word as verpligte jaarmodules vanaf die eerste tot derde akademiese jare aangebied. Die fakulteit poog hiermee om daadwerklik die taalvaardighede van regstudente te verbeter en om studente beter toe te rus vir hulle toekomstige beroepe.

’n Wye verskeidenheid van onderwerpe word aangeraak, en die bedoeling is dat die studente se vaardighede verbeter word deur middel van deurlopende oefeninge en praktiese toepassings van die inhoud van die onderskeie modules. Hierdie vaardighede omvat lees- en begripsvaardighede, asook skryf- en luistervaardighede, en natuurlik regslui se gunsteling – praatvaardighede.

Studente se vermoëns met betrekking tot verskillende leestegnieke, begrips-oefeninge en skryfvaardighede soos die korrekte gebruik van leestekens, sinvolle verwoording van idees, logiese redenasie asook strukturele komponente van taal, om ’n paar te noem, word gedek. Hierdie aspekte word hanteer in Afrikaans en Engels om te verseker dat studente verder vir die praktyk toegerus word.

Die uiteindelike oogmerk is om ’n student af te lewer wat sinvol, effektief en onderhoudend kommunikeer. Dink net: ’n student wat ’n vlugheid van begrip ontwikkel, ’n student wat analities en krities kan dink, skryf en praat, beide in Engels en Afrikaans...

Twee nuwe akademiese poste is geskep om te verseker dat ons ideaal ’n realiteit word. Meneer Michael Laubscher is vanaf 1 Julie 2013 by die Fakulteit Regte aangestel as voltydse dosent om die betrokke modules te doseer. Hy beskik oor ’n Meestersgraad in Engels en is ook ’n toegelate prokureur. Hy word bygestaan deur Doktor Louise Strydom wat by die Skool vir Tale aangestel is en oor ‘n doktersgraad in Afrikaans (linguistiek) beskik.

Die regsloopbaan van oudstudent en voormalige dosent

aan die Fakulteit, Hans de Bruin, is indrukwekkend. Hy het omtrent al wat beroepsmoontlikheid in die regte is, verken voordat hy advokaat geword het. Hy het in 1957 die graad BCom(Regte) behaal aan die destydse PU vir CHO en daarna die graad LLB in 1959. In 1960 word hy

staatsaanklaer in Kimberley en doen sy prokureursklerkskap in 1961 en 1962. Daarna dien hy as regsadviseur en praktiseer as prokureur tot aan die einde van 1971. Tussen 1972 en 1977 doseer hy aan die PU vir CHO. Hy het by die Kimberley Balie aangesluit in 1978 en is in Januarie 1983 vereer met die status van senior advokaat. Hy praktiseer in Bloemfontein en het reeds op verskeie geleenthede as regter waargeneem.

Na ons uitnodiging aan oudstudente om hul verhale met ons te deel, het hy van hom laat weet. Ons het dit goed gedink om sy hele brief te plaas:

Toe ek as student by die PUK ingeskryf het in 1955 was die totale studentetal ongeveer 1300.

Ons was 13 studente wat vir die LLB Graad geregistreer het aan die destydse Departement Regte

(‘n fakulteit het eers veel later tot stand gekom). Drie van ons het BCom(Regte) aangedurf en ons

was gewaarsku dat dit ‘n baie moeilike kursus is. Op die ou end het net die drie van ons die LLB

graad in die voorgeskrewe vyf jaar behaal. Die ander twee, Horst Wiese en Pieter Coetsee en ek

was boesemvriende, maar hulle is albei reeds oorlede.

Ons het studeer onder formidabele regsgeleerdes soos prof Wickus du Plessis en prof HL

Swanepoel. Tydgenote was onder andere FW de Klerk, Johan van der Vyver en Ig Vorster.

Ek en Wiese en Pieter Coetsee het beroemdheid (berugtheid) verwerf omdat ons redelik goed

kon saamsing. So af en toe het ons dan ook, as ons ‘n paar sent gehad het om te spaar, ons na

die kroeg van die destydse Queens Hotel (nou die Impala) begewe, een bier gekoop en die hele

aand gesing tot groot vermaak van die gaste wat mildelik bygedra het vir nog ‘n skuimpie of

twee.

Daardie jare was daar slegs drie studente met motors op die kampus. Een was André P Brink

wat sy motortjie gekoop het met geld wat hy verdien het met sy skryfwerk. Stoffel de Beer van

Nylstroom se wêreld (ek dink hy het lateraan ‘n LV of ‘n LPR geword) het ‘n motor gery en die

storie was dat hy dit kon bekostig omdat hy uit ‘n welgestelde familie kom. Die derde was Leon

Thom, ‘n student in aptekerswese, wat ‘n ou tjorrie gery het was ons meer gestoot het as wat

ons in hom gery het. Vanaf die begin 1972 was ek vir ses jaar verbonde aan die Departement

Proses- en Bewysreg en daardie ses jaar het ek baie geniet. Van my kollegas daardie jare het

ingesluit Fanie du Plessis (nou by die Johannesburg Balie), Ben van den Heever (nou by die

Pretoria Balie), Johan van der Vyver, Ig Vorster, Chris van der Walt, Chris de Beer en Peet Aucamp.

Ek en my vrou, Ina, was ook drie opeenvolgende jare toerouers van die Alabama en dit was

pret. Ons was uit die aard van die saak ook nog jonk en het hegte vriendskappe gesmee met

Johan van Rensburg, Rina Hugo, Peet Ryke, Horst en Daleen Butow en Frans en Annemie Kruger

(om maar net ‘n paar te noem). Trouens ek en Ina staan tot vandag nog by Frans en Annemie

bekend as Pa en Ma en hulle drie kinders noem ons nog steeds Oupa en Ouma.

Ek praktiseer nog voltyds en geniet my werk. Ek hoop om solank as moontlik aan te hou.

Gelukkig geniet ek en my liewe vrou, Ina (met wie ek aan die einde van hierdie jaar 54 jaar

getroud sal wees) baie goeie gesondheid en lewenslus.

Ek dink ek het dit genoem dat van my oud studente aan die fakulteit verbonde is soos Gerrit

Ferreira en Gerrit Pienaar.

Ek hoop dat die inligting nuttig is en sal dit waardeer as jy hartlike groete oordra aan almal wat

verneem.

“It all started at the moot!”

Jameel Hamid and Alecia Pienaar represented the faculty at the 22nd African Human Rights

Moot Court Competition. They placed overall 6th in Africa, 2nd in South Africa and their

memorials earned them a 2nd place in Africa. This is Alecia’s account of the experience.

That was the phrase coined at the 22nd African Human Rights Moot Court Competition by the host university’s moot society. At first, somewhat blinded by months of preparation, stress and sleep deprivation, it did not hit

home. After having the privilege to compete in Cape Town at the University of the Western Cape, this phrase now seems like the only appropriate manner in which to summarise the entire experience. All of our expectations and perceptions of the law at work has changed. And it all started at the moot.

The entire competition centres around the facts of an imaginary case that is never-theless based upon the realities suffered by numerous individuals within African states. The team is then given the task to prepare written and oral arguments for both the applicant and respondent State.

The preparation phase entails the drafting of memorials and frequent mock moot sessions before different lecturers. This phase in itself exposed our team to the harsh realities of what is waiting for us in practice. The answers are not always, if ever, in the textbook. The prescribed case presents itself in a context unknown to written law, but very much a reality to those within the African territory. However hard as it may have been to formulate original arguments, the challenge was intellectually stimulating and exciting. Essentially there is some exposure to what it means to be a contributor to legal development. It becomes an affirmation of the reason why you would commence a career in law in the first place.

After months of preparation, the entire process culminates in a week that strangely

enough is more about the people than about winning, prizes or achievements. Of course, the competition itself remains focused on the moot court sessions where a panel of judges from all over Africa would test your knowledge, the ability to think on your feet and remain grounded. However, as a competitor, the court sessions are more about learning than competing – listening to the judges’ comments and the opposition’s arguments is truly a thought provoking process. But then, apart from being forced to exhaust the capacity of your brain to think and argue and process and respond, you meet the people who change everything about your perspectives and opinions.

It is a culture shock but in a good way. Thinking back you remember the Asian food bazaar with Njeri from Kenya, talking about the difficulty of being a human rights lawyer in her country. You remember dancing to the sounds of Hot Water (yes it is a band) with Omar from Egypt and the French guy from Cote D’Ivoire whom you never spoke a word of English to (but that didn’t matter). Every person there has a story so unique it will forever change your perspective about our continent, its people and its needs.

For the first time after four years of studying law, we know what it is all about. Turning human wrongs into human rights is not about you becoming a feared advocate or someone’s hero standing in a court and wooing a judge. Practice calls upon those who are willing to sacrifice their time and efforts for the sole purpose of protecting the African people through the realisation of human rights. As former Justice Kate O’Regan put it at the final round, “(t)here is hope in Africa…the hope to implement human rights.” And that is what it is all about. We are now studying law with a purpose beyond the consuming and selfish vision of becoming a “Harvey Specter”. We are studying law because Africa is calling us. And the job won’t be easy. It is a new way of life…a new way of studying law…and it all started at the moot.

Dr A botes Anri Botes is in 1985 in Carletonville as die jongste kind van Hein en Alta Botes gebore en matrikuleer aan die Hoërskool Carletonville in 2003. In haar proefskrif, Die regsposisie van tydelike werknemers in diens van tydelike

diensverskaffingsagentskappe, lewer sy ’n bydrae tot moontlike wysig-ing van die arbeidsregtelike regulering van die regte en verpligtinge van die partye in hierdie driehoekige verhouding. Die gebruik van tydelike diensverskaf-fingsagentskappe (“arbeidsmakelaars”) ten einde buigsaamheid in die Suid-Afrikaanse arbeidsmark te bevorder, het by gebrek aan behoorlike regulering tot vele komplikasies gelei, welke komplikasies ’n direkte impak het op die regte van die werknemers wat daarby betrokke is. Hierdie studie fokus op ’n ondersoek van gemelde komplikasies en die moontlike oplossings waardeur dit genegativeer kan word. In die proses word vergelykings met die Engelse en Namibiese regstelsels getref, welke regstelsels hulle eie benaderings tot dié sektor het, hetsy in die vorm van ’n verbod op tydelike diensverskaffings-agentskappe, of die daarstel van ’n wye verskeidenheid instrumente spesifiek vir die regulering daarvan. Daar word aangetoon in watter mate die Suid-Afrikaanse reg aan die standaarde van die Internasionale Arbeidsorganisasie voldoen en uiteindelik hoe regsekerheid en beskerming vir alle belanghebbende partye verseker kan word.

Dr J Terblanche Janet René Terblanche is in 1975 in Potchefstroom gebore as die jongste kind van Prof Jan en René Smit en matrikuleer aan Potchefstroom Gimnasium in 1993. vanaf 2001-2004 die Hoof van Operasionele Risikobestuur vir FirstRand Bankgroep en vanaf 2004-2006 Hoof van Nakomingsbestuur (Compliance) vir WesBank. Vanaf 2006-2011 vervul sy verskeie rolle in Momentum, uiteindelik as Hoof van Oudit, Risiko- en Nakomingsbestuur. Vanaf 2011-2012 was sy ‘n Beleids en Regulatoriese Spesialis by die Suid-Afrikaanse Reserwebank. Sy is tans die Groep Hoof van Korporatiewe Bestuur (Corporate Governance) van MMI Holdings Ltd.

In haar proefskrif, Legal risk and compliance risk in the banking industry in South Africa, lewer sy ’n bydrae tot moontlike wysiging van die bankregtelike regulering van regsrisiko asook die praktiese uitvoering van hierdie verpligtinge van banke. Die studie poog om ‘n praktiese oplos-sing te vind vir lande wat met die dilemma van ‘n gemengde regstelsel sit, maar tog graag aan die Basel Komitee oor Banktoesighouding se stan-daarde vir operasionele risiko, regsrisiko en voldoeningsrisiko wil voldoen. Dit word geargumenteer dat nakoming, nakomingsrisiko, en regulatoriese risiko beskou behoort te word as onderafdelings van regsrisiko. Regsrisiko is ‘n wye begrip wat alle aspekte van ‘n regsstelsel insluit. Nakomingsrisiko is ‘n enger beginsel wat slegs die gekodifiseerde aspekte van ‘n regsstelsel insluit. 3 Waarop fokus jou navorsing en watter modules bied jy aan? My fokusareas is arbeids- en korporatiewe reg en hoe die twee by mekaar

inskakel sowel as korporatiewe bestuur. In 2014 gaan ek verantwoordelik wees vir die LLM (individuele arbeidsreg sowel as kollektiewe bedinging en geskilbeslegting) en op LLB-vlak sal ek besondere kontrakte aanbied.

4 Wat doen jy graag vir ontspanning? Ek onthaal graag en geniet ‘n glas wyn of twee.

KAS/NWU risks Posed to Protecting the right to Food and Food Security ConferenceAnél Terblanche

A paradigm shift in the international food security debate was encouraged during 2009, namely to base food security initiatives on the right to sufficient food. During a 2011 visit to South Africa, the Special Rapporteur

for the Right to Food of the United Nations accordingly confirmed that a human rights-based approach to food security is necessary in the South African legal and policy framework in order to address the huge disparities in terms of food security (especially concerning geography, gender and race) (See United Nations in South Africa 2011 Special Rapporteur on the Right to Food End of Mission Statement http://bit.ly/n0Wpqh). Taken this into account the Konrad Adenauer Stiftung and the Faculty of Law, North-West University (Potchefstroom Campus) embarked on a 3-year project on Critical Law and Governance Perspectives on Food Security in South Africa: Exploring the Role of Policy-Makers and other Stakeholders.

The KAS/NWU Risks Posed to Protecting the Right to Food and Food Security conference held at Hakunamatata Estate, Muldersdrift on 24-25 October 2013 was the first of 3 conferences in the abovementioned project. The objective of the conference was to identify the risks posed to protecting the right to food and food security in a South African context (while keeping the inevitable influence of risks in a regional and international context in mind). The multidisciplinary nature of the right to have access to sufficient food and food security was addressed by the conference speakers. It was a great privilege to listen to the presentations of highly esteemed speakers, including Adv L Mushwana (Chairperson of the South Click to see the program

African Human Rights Commission) and Prof H van Schalkwyk (Rector of the NWU (Potchefstroom Campus) and acclaimed agricultural economist). The speakers were representative of inter alia the academia, the agricultural sector (including a small holder farmer and agricultural institutions), the private sector and civil society. The presentations led to lively debates between the conference delegates. The conference delegates were representative of inter alia: (a) the academia (including researchers, lecturers as well as pre- and post-graduate students); (b) the agricultural sector (including agricultural institutions); (c) the South African Human Rights Commission; (d) local government; (e) the Department of Health; (f) NGOs (including Section 27, Green Peace SA and SACONO); (g) civil society; and (h) the media (including a Senior Researcher: News Research and Policy Analysis from the SABC News).

The conference succeeded in making people aware of the fact that issues pertaining to food insecurity, and specifically hunger, are not one dimensional but necessitate actions across the spectrum of inter alia agriculture, economics, health, education and the law.

Intreerede: Professor Sarel du Toit

Op Vrydag 8 November 2013 het die Fakulteit die voorreg gehad om nog ‘n intreerede te geniet, dié keer deur Professor Sarel du Toit, wat in 2012 by die fakulteit aangesluit het. Dit was sy tweede intreerede, aangesien

hy voorheen as professor verbonde was aan die Universiteit van Johannesburg. Dit was dan ook ‘n voorreg om heelwat kollegas uit Johannesburg te verwelkom. Na afloop van die formele verrigtinge in die Ou Senaatsaal, het die gaste heerlik in die Skynhofsaal saam gekuier.

Die tema van die rede was: “Die juridiese aard van geld: skuiwende matrikse en paradigmas.” Die juridiese aard van geld is ondersoek en daar is ook gevra of die kontantera binne die volgende paar jaar in Suid-Afrika tot ’n einde sal kom.

Sarel het begin deur te bepaal waar en hoe Suid-Afrikaanse wetgewing na geld verwys, en ook hoe die omskrywing van geld, as ’n regsbegrip, ontwikkel het van FA Mann tot Charles Proctor. Hy meen dat die begrip ‘wettige betaalmiddel’ (‘legal tender’) nie meer geskik is binne ’n wêreld waarin die dematerialisasie van geld bykans voltooi is nie. Uiteindelik verwys hy na moontlike nuwe vorme van geld, soos elektroniese geld, mobiele geld en ook sogenaamde virtuele geld soos ‘Bitcoin’. Die veranderende

regsgevolge wat intree wannneer geld vandag gebruik word, word geïllustreer deur enkele bepalings in die Verbruikersbeskermingswet. Die begrip geld kan nie in isolasie beskou word, sonder oorweging van die begrip betaling en binne die konteks van die bankreg as geheel nie. Daar is wel ’n behoefte aan wetgewing rakende sommige aspekte rondom die gebruik van kredietoordragte, en sakeregtelike bande moet finaal verbreek word. Aan die ander kant moet die inherente buigsaamheid van die handelsreg en bankreg, en die rol van gebruik, ook nie onderskat word nie; die reg kan aanpas by veranderende omstandighede en nuwe begrippe. Laastens is daar ook sprake van ’n sosiale verantwoordelikheid, en aanpassings in die reg, via wetgewing of die gemenereg, moet plaasvind binne die konteks van finansiële insluiting (‘financial inclusion’).

DRINK and…DrIvE What’s worse? To die or to live as a murderer…

On 11 September Mr Holtzhausen, a traffic officer

from Potchefstroom Traffic Department

lectured the second year LLB students

on drunk driving and general statutory

rules.

Motor vehicle drivers under the influence

of alcohol are often the cause of major

motor vehicle accidents where the other

party is worse off than themselves. During

such an accident a drunken person’s muscles remain

relaxed throughout the impact resulting in less severe

injuries and often survival. Therefore the perpetrator

frequently outlives the innocent. How can this scenario be

prevented?

Adhere to the law! When a traffic officer stops you, there

are many ways to establish whether a driver finds himself

under the influence of alcohol. Common indications of

drunk driving are: driving with no lights, the presence

of an open alcoholic beverage inside the vehicle, slurred

speech and the incapability to walk on

a straight line. Of course, a breathalyser

reading above 0.05 constitutes proof,

although this evidence is not permissible in

court - merely blood test results.

Any person driving under the influence

of alcohol will summarily be arrested by

the police officer and be transported to

the local police office. There blood samples

will be taken after a criminal case has been

opened. The perpetrator, however, will be

lead to over full cells where he or she will

be detained temporarily until bail is granted.

According to Mr Holtzhausen, any traffic

officer’s main objective is to assist citizens

as far as possible. Arrogance on the part of

the public will aggravate the already unpleasant situation.

Therefore traffic officers deserve to be treated with due

respect. Your payment of the necessary respect will

contribute to the officer’s ability to assist you.

What should a person do when the officer asks for a

bribe? A traffic officer should always wear a name tag.

Say no, remember his name and, if possible, record the

conversation with a recording device. Otherwise allow him

to arrest you only to open a case for this offence against

him at the police station – you are in fact already there!

How is any of this applicable to a law

student? By being arrested for drunk

driving, on any public road, would

constitute valid grounds for a criminal

record. This would summarily result in the

discontinuation of all studies in the Law.

In conclusion, do not drink and drive and

potentially murder…your studies!

EXTErNAL EVALUATION OF THE rESEArCH UNITWillemien du Plessis

An external evaluation panel evaluated the work of the Research Unit: Development in the South African Constitutional State during September 2013. They had to assess the quality of research, master and doctoral programmes of the faculty. The panel consisted of three experts,

Prof Lee Godden of Melbourne University, Australia (chair), Prof Avinash Govindjee of Nelson Mandela Metropolitan University and Prof Marita Carnelly, University of KwaZulu-Natal. Prof Godden is an expert in Land Law, Indigenous Rights and Environmental law issues, while Prof Avinash’s expertise lies in Labour law, Social Security, Socio-economic Rights and Mercantile law. Prof Carnelly is an expert in Public law, International law and Family law matters. During the three days they held interviews with the management of the faculty, all the members of the faculty, administrative staff of the faculty, master and doctoral students of the faculty (current and completed) as well as with post-doctoral fellows of the faculty. At the end of the week they briefed the faculty on their initial findings which were very positive. They were especially impressed with the dedication and hard work of the faculty members and the favourable impression of the post-graduate students of the faculty. The faculty looks forward to the final report.

Prof Anél du Plessis receives two prestigious IUCN AwardsWillemien du Plessis

Prof Anèl du Plessis received two prestigious awards at the 11th IUCN Academy of Environmental Law at Waikato, New Zealand, namely the Fifth Annual Junior Scholar Award - 2013 (jointly with Prof Jolene Lin of the University of Hong Kong) as well as the First Annual Junior Education Award - 2013. The 2013 Senior Scholar Award was

awarded to Prof Michael Faure of Maastricht University, Netherlands, while the First Annual Education Award was awarded to the world-known Prof Nick Robinson of Pace Law School, New York. Awards are allocated based on the quality and impact of the outputs of the previous five years as well as the particular person’s participation nationally and internationally to extend knowledge on Environmental law. Anél’s link between Local Government law and Environmental law drew attention. The Academy has 168 institutional members from 53 countries. Some of the most well-known law schools are members. The Academy receives several nominations each year and the awards are awarded on a competitive basis after a peer review process. What makes Anél’s position even more laudable is that her nominations were initiated outside her own Faculty. Anél is a clear example that it is possible to be an excellent teacher and researcher!

Anél also recently learned that a Georg Forster Research Fellowship for Post-Doctoral Researchers was awarded to her by the Alexander von Humboldt Foundation. The research fellowship will enable Anél to carry out a long-term research project (6-24 months) at a research institute in Germany.

Conrad: Om elke dag, by elke geleentheid ’n verskil te

kan maak. Ek is maar ’n outjie wat hou van ’n lekker

lagsessie en om iemand se dag te kan opkikker. ’n

Glimlag op hulle gesig, is vir my meer as genoeg.

Ruan: My dryfkrag is die doelwitte wat ek vir myself

stel. Om elke dag my doelwitte na te streef met

passie en entoesiasme.

Hoe gaan jy ’n verskil maak?

Alicia: Hierdie jaar gaan ek poog om die regsfakulteit

die beste sosiale en akademiese aksies nog te gee! Die

finalejaarsbraai was nog net die begin…The best is yet

to come!

John: Deur als tot die beste van my vermoë aan te pak,

ek glo so sal die regte mense beïnvloed word...

Victor: Ek dink liefde kan die grootste verskil maak, veral

in ’n portefeulje

soos SJGD. Dis belangrik

om te onthou dat die

gesindheid waarmee jy ’n projek

aanpak, grootliks die uitkoms daarvan

bepaal. Ek beoog om elke projek met

ywer aan te pak en altyd liefde in die

projek te sit.

Wat is die lukraakste ding wat jy al op

kampus gedoen het?

Alida: Ek het ‘n outjie op die bib se gras

sien sit toe stap ek na hom toe en gooi my

kleingeld voor sy voete uit!

Chara: By die duikweg se trappe met my fiets

afgery. Eks nie seker wie meer verbaas was nie - ek of

die mense wat van voor af gekom het nie.

Jopie: Ek het maar eintlik soms ’n droë sin vir humor

wat skerp is, maar ek het al per ongeluk in die verkeerde

klas in geloop - ek het my fout agtergekom en bly sit.

Die dosent het my vrae gevra en ek het geantwoord ook

- dit was nie ’n regsklas nie.

KoDdiG in DiE KoLlig...

Wat is die snaaksste ding wat die SRVP gesien het tydens kantoordiens?

In ’n poging om studente te laat stem vir Top Dosent, deel ons

graag ysies uit. Eendag sit ’n paar van ons op die fakulteit se

gras toe ’n vrywillige outjie kom stem. Toe hy sê dat hy

nie ’n ysie wil hê nie, raai ons hom aan om dit vir die

eerste meisie te gee wat hy teëkom. Kort daarna stap

’n meisie voor die Calvyn verby. Waaragtig stap hy na haar

toe en sê grappenderwys: ‘Jy’s hot, hier is vir jou’n ysie!’

Haar antwoord: ‘Ag, jy’s pragtig maar ek’s haastig!’

...Agge nee!

Die nuwe SRVP-termyn het met ’n groot “BANG”

afgeskop! Die laaste kwartaal was meer bedrywig as

ooit met al die interne en eksterne aksies wat gereël

moes word. Ter terugvoering aan die studente, doen

ons graag verslag om hierdie jaar op ’n hoë noot af te

sluit.

Kaalvoetdag

Met die SRVP wat in die vorige termyn ’n algehele

eerste plek behaal het onder die ASV’s in SJGD, is

daar groot skoene om vol te staan. Die 3de Oktober is

Kaalvoetdag voor die Regsfakulteit gehou met die tema

“Dis Grieks!”. Die SRVP en Excursio het nie net saam

gesleep nie, maar 18 swartsakke vol klere ingesamel

vir minderbevoorregtes. Baie geluk met die 7de plek vir

Kaalvoetdag!

Pot & Pons

Soos alle studente sal weet, is Joolympics, nie net

jolig nie, maar die potjiekos en pons absoluut heerlik!

Vanjaar, op 4 Oktober, het die SRVP saam met Excursio

en Nutricamus, ons slepe, ’n algehele 3de plek in hierdie

afdeling behaal. Vroegdag het die seerowers al die

vleispotjie laat prut. Baie dankie vir die ondersteuning

van die regstudente wat gereeld by ons stalletjie ’n

draai kom maak het. Wat sou die fakulteit wees sonder

studente?

ASV Skattejag

Ter spanbou het die SR vir die verskeie ASV’s ’n

skattejag oor kampus gereël na die eerste formele

ASV-opleiding. Die skattejag het die uitvoer van verskeie

take binne ’n tydlimiet behels en vir groot pret gesorg!

Die SRVP, ’n bekwame span, spog met ’n 3de plek op

hierdie lys.

Belangekring Ete

Jaarliks skakel die nuutverkose SRVP met die Direkteure

van die Regsfakulteit ter bekendstelling tydens ’n

gesellige ete. Vanjaar is hierdie spesiale funksie op die

9de Oktober in F22 gehou onder na die besonderse

tema van “Great Gatsby”. Nie net is bande en

kommunikasie binne die Regsfakulteit dié aand

bevorder nie, maar was dit ’n genotvolle aand wat nie

gou vergeet sal word nie.

Finalejaarsbraai

Die 10de Oktober het die finalejaarsbraai vir die 4de

jaar LLB studente by die Snowflake plaasgevind met die

tema “Havana Nights”. Na hierdie besonderse aand,

is die finalejaars nie net hul hamertjies ryker nie, maar

het ook ’n smullekker ete geniet, en boonop ’n dansles

oor die Salsa deur Fred Astaire Dance Studio op die

koop toe gekry! Baie dankie aan almal wat hierdie aand

moontlik gemaak het.

Die Regsfakulteit blink uit!

Kom mens voor die vraag te staan van wat substantief

genoeg is, vat dit nogal ‘n rukkie om by ‘n antwoord

te kom. Volgens my suggereer ‘substantief’ dadelik

‘ernstig’. Uit die kristalhelderblou lug land daar toe

‘n substantiewe tema in my kop: kinderregte. Ek dink

enige iemand sal saam my stem dat kinderregte ‘n

substantiewe onderwerp is om oor te skryf - en daar

is so baie waaroor mens kan skryf! Terwyl ek hierdie

tema ontdek het, het ek ook gevoel ek wil nie regtig

so ernstig raak nie, toe - nét so toevallig - kom ek af

op ‘n artikel oor die artikel (ja, jy het reg gelees) in

die UN Convention on the Rights of the Child, 1989

(internasionaal afgekort as CRC) wat aan kinders die

reg verleen om te speel.

In my volle vyf jaar as regstudent het ek nog nooit

van hierdie reg gehoor nie. Mens hoor gereeld van

regte soos die reg op onderwys, gesondheid en ‘n

gesonde omgewing, maar ‘n reg op speel? Daar is

verskillende interessante aspekte rondom hierdie reg

vir my. Eerstens moet mens dink hoe verwesenlik mens

hierdie reg as daar soveel kinders in oorloggeteisterde

gebiede leef en selfs nie eers ouers het nie? Tweedens -

in die lig van juis sulke regte soos die reg op onderwys,

ouersorg en mediese sorg, behoort die reg om te kan

speel regtig aandag te geniet? Derdens kan mens vra

wat kwalifiseer as ‘speel’? Vervolgens ondersoek ek

moontlike antwoorde op hierde vrae.

Die kommentaar op artikel 31 van die CRC is juis

‘n dokument waarin hierdie hele artikel baie intens

beskou word. Hierdie dokument word deurlopend

geraadpleeg in die gepoogde beantwoording

van bogenoemde vrae. Die eerste twee vrae hou

nogal verband en ingevolge die kommentaar en

ander artikels soos artikel 2, moet regerings die

verwesenliking van selfs hierdie reg bevorder veral

met die oog op kinders in kwesbare posisies, soos

asielsoekers en slagoffers van oorloggeteisterde

gebiede. Die rol wat speel in kinders se vaardigheids-

ontwikkeling speel, moet nie onderskat word nie.

Die derde vraag word beantwoord in die kommentaar

op artikel 31 waarin ‘speel’ geïnterpreteer word

as aktiwiteite of prosesse beheer deur kinders wat

nie-verpligtend is nie en opsigself onderneem word

- nie noodwendig as ‘n middel tot ‘n doel nie.

Onproduktiwiteit is ook ‘n eienskap wat aan speel

toegeskryf word. Die kommissie beklemtoon dat om

te speel ‘n kardinale deel van kinders se ontwikkeling

uitmaak en bevorder móét word.

Hierdie artikel se doel was geensins om ‘n

gedetailleerde ondersoek na die reg om te speel te

loods nie. Ek het net gedink, met die feestyd wat so

rukkie vorentoe lê, kan dit beslis nie skade doen om so

nou en dan aan hierdie reg - in besonder - herinner te

word nie.

For the first time in years, the second year law students

gave the third years an uphill battle. In the 2013 finals

the adjudicators were two High Court judges from our

local High Court: Judge Frits van Oosten and Judge

Leonie Windell. Both teams litigated excellently and the

score was nearly tied... But, well done 2nd years!

Tsego Jacobs

Q: Did you expect to win the third years?

A: At first I thought that there’s no way of winning and

that the trials were actually “designed” for third years

to win. After the judgement I honestly thought we were

done.

Q: How did you find it being adjudicated by actual

judges?

A: It was nerve wrecking as I thought that they would

be brutal in their judging. They may have been strict,

but I was able to learn a great deal from them.

Lwazi Twala

Q: What was your experience working with the accused

throughout the trails, did he aid to your success?

A: The accused didn’t assist us much. We just told him

what to say and to stick to our story.

Q: It was noticed that you always dressed matchingly,

why?

A: We wore matching clothes because it represents us

as a group.

Prudence Seeletso

Q: Is Criminal Law your passion? If not, what is?

A: Well, at first I didn’t think I’d ever want to pursue it,

but Criminal Law lecturers made me

fall in love with it... I’m now finding

Criminal Law extremely interesting.

Q: What is your recipe to success?

A: Having faith despite how many

times I fall...Law is demanding. And

every time I’d feel like it’s taking its

toll on me, I’m reminded that I can

do all things through Christ who

strengthens me. He is my recipe for

success.

Valencia Mogapi

Q: How long did your preparations take per trial? Did

you receive any help?

A: It took up most, if not all of our time the day prior to

the presentation dates. Unfortunately we didn’t receive

any honest assistance.

Q: Do you see yourself in litigation one day?

A: Most definitely. I wasn’t sure at first, but the mock

trial has opened my mind to greater things than merely

sitting behind a desk.
