PART IITerms and conditionsThe IGC management shall conduct the counseling and guidance with respect to admission, branding, and promotion. only in the areas, subjects and for the courses for which it has been granted permission by the Shobhit University. The IGC management shall be fully responsible, if this norms were violated. 1. The IGC management shall comply with all the provisions, rules and regulations framed from time to time by the Shobhit University. 2. The IGC management will Inform, Guide and Counsell students as per the guidelines issued by the Shobhit University from time to time, for the courses which have been offered through Distance Education mode .3. The IGC management shall maintain registers and all records with regard to the students and produce the same as and when required by the Shobhit University. 4. The IGC management shall not collect overtly or covertly any capitation fee or donation from the students and also not charge any fee other than the prescribed fee and charges approved by the Shobhit University.5. The IGC management shall verify the signatures; original eligibility documents submitted by the students and provide a Xerox/ Photostat copy of the same attested by administrative/academic head of IGC and a gazetted officer, to the Shobhit University. On verification, at any stage, if it were found that the signature and testimonials as submitted by the student are counterfeit, then the Shobhit University would have full rights to cancel the student admission and/ or withdraw the awarded certification and/ or take appropriate legal action against the IGC and student. All the moral and legal responsibility in the cases as aforementioned shall be borne by the IGC management and the student.6. The IGC management shall not promote itself as study centre/ off campus/ off shore campus / affiliated college of the Shobhit University overtly or covertly in any of its advertisements in analog, digital or print media. Also IGC will take prior approval from the Shobhit University for any kind of advertisements before releasing it to the media. If it were found that IGC management had not complied with aforementioned conditions then the Shobhit University has full right to revoke the affiliation of the IGC. Students of such IGC will be transferred to the appropriate IGC till the completion of their remaining course, if any.7. The IGC management is not authorised to issue certificate/ diploma/ degree to any of the students of their centre by using the name, logo and style of Shobhit University. The Shobhit University will treat such certifications as counterfeit and shall have full rights to revoke the affiliation of the IGC and also take appropriate legal action against the IGC management.8. The IGC Management shall be responsible for submission of prescribed share of student fees to the Shobhit University or its authorized Coordinator as per the procedure defined. Faliling which, the IGC shall not have any authority to claim anything pertaining to students from the Shobhit University or its authorized Coordinator. 9. The IGC Management shall be responsible for payment of all taxes, duties, levies, fees and other similar costs arising due to any of the transactions contemplated under this arrangement.10. The IGC management understands and agrees that the association between the Shobhit University, Coordinator and IGC shall be for the betterment of the students and society. No clause of this association will deemed to constitute a joint venture, franchising activity, agency, a partnership or principle-agent relationship between parties hereto and neither party, by virtue of this proposal, shall have the right, power or authority to act or create any obligation, expressed or implied, on behalf of the other party.11. The IGC Management shall be responsible for implementing the policies, programmes, and instructions of the Shobhit University, from time to time. 12. The provisions of the agreement between the IGC and the Shobhit University shall be on an exclusive basis, wherein the IGC shall not be entitled during the tenure of this association to have such or similar association with any other University/ Institute/ Individual.13. The IGC Management shall be solely responsible for any claim raised by any students under consumer protection Act or any other Law.14. The Shobhit University is the final authority in deciding the mode and venue of examinations. In certain cases where IGC gets status of examination centre for its own or multiple IGC students, the IGC management shall be entirely responsible for conducting proper examination, manage the examination stationary, submission of examination stationary to the University or its authorized associates as per the prescribed norms. 15. The IGC management shall be responsible for any misconduct of students if found during the examination held at their premises. In such situations the IGC examination centre status will be revoked immediately and the Shobhit University is entitled to take appropriate legal action against the IGC management. The expenses pertaining to examination will be borne by the IGC management.16. The IGC management shall submit complete fees of student which includes registration fees, examination fees and/or any other fees as prescribed at the time of submission of student admission/examination form. In case of deficiency in fees or eligibility, the forms will be rejected without any notice to IGC management and the IGC shall be the sole responsible for any claim of students under such conditions.17. In case of cancellation of student admission on the request of the IGC management before the allotment of enrollment number by the Shobhit University, the fee can be refunded after deducting an amount as per the norms prescribed by the Shobhit University. No fees will be refunded under any circumstances after allotment of enrollment by the Shobhit University.18. In case of cancellation of the agreement by any party, the IGC management will have legal & moral binding, to cater to all liabilities, whatsoever, towards students.19. On successful grant of the IGC by the Shobhit University, the fee submitted against inspection and authorization will not be refunded or adjusted under any circumstances. In the case where the IGC application get rejected, the Shobhit University reserves the right to refund the fees submitted against inspection and authorization after deducting the necessary expenditure held in the process of inspection as per the merit of case. Under any circumstances the IGC applicants are not authorized to claim this amount under any consumer protection law or any other law in force for the time being.20. By virtue of any reasons if an outstanding exists in the account of the IGC, then the IGC is bound to settle the same within 7 days from the date of intimation by the Shobhit University. Failing to do so, the IGC agrees to pay additional penal fees at a cumulative interest of @ 12% per annum on monthly basis along with the original amount to the office of the Shobhit University from the date on which outstanding occurs. If in case the IGC ignores such notification issued by the Shobhit University then they are bound to follow any decision taken by the Shobhit University for discontinuation of the activities of IGC.21. The IGC management agrees to submit all the admission and examination forms to the Shobhit University through Coordinator, within the prescribed time limit. Also the IGC shall be responsible for providing the correct postal address, Email ID and contact number of the students. The Shobhit University will not be held responsible incase the student particulars are not provided to them correctly and further, it will not bear any moral & legal responsibility against loss of communication to student. If the student take any legal action due to aforementioned reason, the IGC management will be solely responsible for all type of consequences and compensations.22. The IGC management will be held responsible for the acts committed by their officials which are conflicting to the provisions of the Shobhit University rules/ regulations/ Act/ Statutes etc.23. The IGC management will operate only at location(s) which has been approved by the Shobhit University and in no case will change the location without the permission of Shobhit University. Failing to do so will lead to the cancellation of IGC without any further claim.24. The IGC management agrees that in case of change in staff change in location of the IGC they will immediately intimate the Shobhit University about the same on their official letter head along with a resolution passed by the board members duly signed and stamped by the authorities. In case of failing to do so the Shobhit University will not be held responsible for any loss of communication or consequences arisen by aforesaid act of the IGC management. 25. The IGC management will be responsible to regularly take necessary updates relevant to student and the IGC from the websites of the Shobhit University. The IGC management will be solely responsible for all types of consequences if they fail to check necessary information available on the official websites of the Shobhit University. The IGC management is not authorized to claim any information officially or unofficially in hard copy format/ by E-mail/ by SMS. 26. The IGC Management acknowledge that if there were changes in these terms and conditions on the authorised web site of the Shobhit University, then it will be applicable on the IGC from the date of publication of aforesaid changes. 27. The IGC management agrees that the permission to operate as the IGC has been provided provisionally for a stipulated period of time by the Shobhit University and extension/ renewal/ termination of the same will be dependent on decision of the Shobhit University.28. The IGC Management acknowledges that if any provision in this system, shall, for any reason be held to be invalid, illegal, or unenforceable in any respect, such as invalidity, illegality, or unenforceability shall not affect any other provision hereof, and this system shall be construed as if such invalid, illegal or unenforceable provision had never been contained herein. Any invalid or unenforceable provision of this system shall be replaced with a provision that is valid and enforceable and most nearly gives effect to the original intent of the invalid/ unenforceable provisions.29. All disputes related to the Shobhit University, Coordinators, IGC, or any other associated party will be subject to the jurisdiction of Meerut only. 30. The Shobhit University may be forced to make amendments to any of the clauses mentioned above without notice, due to reasons beyond its control with the changes in related policy, programme or procedure by the Government or the regulatory authorities.DECLARATION:I _______________________________________ (Promoter / Director) who have applied for the Information and Guidance Center (IGC) of the Distance Education Programme of the Shobhit University, Meerut through < National Coordinator > hereby certify that the particulars as furnished in Part I above and in the preceding pages are true to the best of my knowledge. I express willingness for an inspection to assess our infrastructural facilities, staff, resources etc. I declare that the Organization will abide by all the rules and directions as laid by the Shobhit University, Meerut & < name of National coordinator> given from time to time. In case of any information furnished by us was found to be wrong/ misleading/ incomplete in any regard, we shall be held solely responsible and will abide with the decision taken by the Shobhit University in the matter. We hereby agree with all the terms and conditions as mentioned in this application form. Further, we have carefully read and understood all the guidelines, specifications and other information published by the Shobhit University and accepts the same. In case of any dispute or for any unforeseen issue(s) or issues not covered in the guidelines, specifications and other information published by the Shobhit University, the decision of the Shobhit University shall be final and binding on us and all other concerned. I agree that the Shobhit University reserves the right to withdraw any location or any Discipline/ Programme or its nomenclature at any point of time without any explanation and to make modifications in any information published anywhere and whenever deemed necessary.
