    Whitepaper to the Parliament with propositions

    Proposition for decision to acquire new rescue helicopter etc.

    for the i period of 20132020:

    The Parliament agree that Ministry of Justice- and the Police

    can

    1. within a frame of 16 800 Mill NOK:

    a) Enter into a purchase agreement for up to 16 rescue

    helicopter in the class of 10-20 ton complete with spare

    parts, equipment- and training packages for mainland

    of Norway for planned phase-in period 20162020. The agreement shall also include options of up to six rescue

    helicopter of same type.

    b) Adjust infrastructure, including building adaptation for

    the selected helicopter type at different bases in

    addition to the landing possibilities at hospitals that is

    utilised by the SAR helicopter today

    2. Establish a contract of long term maintenance and logistics

    support to support the helicopters operation inside the

    allocated budget for the whole contract period

    The acquisition has started through the Prequalification process

    The process is divided into two stages: Stage 1) Prequalification process:

    The aim is to find qualified candidates that will be allowed to participate in the competition for new

    AWSAR helicopters for Norway and Iceland.

    Only Prequalified Candidates will be invited to issue a tender in the competition.

    Stage 2) Competition based on an Invitation to Tender (ITT)

    The aim is to find the best overall AWSAR helicopter and support program.

    1. BACKGROUND AND INTRODUCTION

    Cooperation between Norway and Iceland

    Procurement of up to 16 + 1 fully adapted AWSAR helicopter and up to 6 + 2 options

    Together with an Integrated Logistics Support (ILS) solution including the materials and services required to

    support the operation through the life cycle.

    This Pre-qualification is conditional upon the parliamentary approval of the procurement process.

    The procurement will be performed through a subsequent competition between Pre-qualified Candidates with

    negotiations after which a contract will be awarded to the

    preferred Bidder.

    3. INTRODUCTION

    The scope of the procurement aims to acquire from one responsible Turnkey provider: SAR Helicopters fully adapted for their search and rescue role

    A comprehensive life-cycle Integrated Logistics Support (ILS) solution

    The purpose of the chosen concept is to reduce risk and maximise efficiency whilst ensuring that the result is both complete and cohesive.

    The SAR Helicopters must be fit for purpose Support must ensure serviceable aircraft at each of the SAR Operating

    Bases at any given time

    Absolute confidence in the Providers ability to sustain delivery quality and reliability.

    The requirements will carefully balance the ambition to acquire

    innovative and

    future-oriented helicopters

    with low technological and programme risk.

    The robustness, both in relation to delivery reliability and resultant helicopter availability is paramount.

    4. THE PROJECT AND PROJECT ORGANISATION

    Candidates should be informed that the NAWSARH project team has been authorised to

    perform the procurement of SAR Helicopters on

    behalf of Iceland, and acts on behalf of Iceland

    and the State Trading Centre (STC) in relation

    to the Icelandic acquisition process that is

    conducted in parallel with this Norwegian

    procurement process.

    Unless it is stated in the dialogue with the potential Candidates related to the Norwegian

    Pre-qualification Documents, however, the

    Project acts only on behalf of the Government

    of Norway.

    6.1 OVERALL CONCEPT AND PURPOSE

    Provide year-round safety for people in the Search and Rescue Region at sea, in inaccessible terrain, and in difficult

    situations where other resources are insufficient. The Norwegian Search and Rescue Region is expected to increase

    significantly.

    Procure up to 16 new SAR Helicopters for six SAR Operating Bases in Norway

    With the aim of keeping minimum of one serviceable helicopter per base 24 hours a day all year round, with a target of 100% readiness.

    The reaction time is 15 minutes.

    The availability requirements will be measured at the interface between the Turnkey provision and the equipment and

    services performed in-house (by the Operator).

    The main objective is to enable the Operator to obtain the readiness targets, however taking into account life cycle cost

    effects.

    The final combination of the number of Helicopters, availability requirements, and maintenance and logistics services, will

    hence be subject to negotiations.

    Range requirement

    The range requirements of the Norwegian SAR Helicopter have

    been summarised in four key objectives, cf. Prop. 146 S (2010-

    2011):

    To have the capacity to initiate rescue of 20 persons in distress at sea within a range of 150 nautical miles at any point directly out from

    the straight baseline within two hours and return with the rescued

    people to a safe place on land. In addition, they must be able to

    assist two people at the far perimeter of the Norwegian Search and

    Rescue Region with better effect than today.

    To assist persons in distress on land and in inaccessible terrain, and in other emergency situations where other resources are insufficient,

    quickly and in a secure manner year-round.

    To continue the present established practice to conduct air ambulance services, where the health services own helicopters are unsuitable.

    To carry out other missions of public importance (military missions, support to special police missions, specialised fire fighting,

    emergency relief, environmental protection, and other missions of public interest aimed

    at protecting assets or the environment).

    6.3 THE DELIVERABLES A TURNKEY DELIVERY OF SAR HELICOPTERS AND LIFE-CYCLE SUPPORT MATERIALS AND SERVICES The ILS solution will include all:

    The procurement will seek out a Turnkey provider, with only one contractual interface between the Ministry and the chosen

    provider.

    The Ministry shall procure the agreed maintenance and logistics services for all SAR Operating Bases tentatively for a term of ten years, counting

    from final acceptance of the last Helicopter, after which the maintenance and logistics services will be subject to a new tender competition. The term

    will be subject to negotiations. Hence, the Ministry will ask for alternative tenders assuming both a shorter (five years) and longer (15 years) period.

    6.5 IMPLEMENTATION OF HELICOPTERS, AND ASSOCIATED MATERIAL AND SERVICES SUPPORT

    Following an extensive acceptance procedure for all deliveries the Ministry will take delivery of the Helicopters

    All Services (training, maintenance and logistics) will be subject to extensive review and testing prior to the

    operation going live in an operational environment.

    An initial period of technical and operational evaluation (Operational Test and Evaluation, OT&E) will take place

    after acceptance and delivery of the first two Helicopters.

    The purpose of the OT&E is to determine any necessary changes to the Helicopters, the associated material and

    services support, and/or develop new or revise existing

    operational procedures.

    Bottom line: The winning bid need to be the most cost efficient all over offer

    The Intended Helicopter shall prove evidence that it will hold a Civil EASA type certificate or

    Military Qualification from recognised authority at the latest when preferred bidder is selected

    It is the Ministrys objective that the procurement shall be open (note: reservations) to both military and civil certified helicopters, and military and civil registration. It is thus the

    Ministrys objective that the Candidate may freely choose what he considers most advantageous in order to meet the Ministrys operational, functional and technical requirements.

    8. OPTIONS

    In addition to an order of up to 16 (+1) large SAR Helicopters, the Ministry will require:

    Options for the delivery of up to six (+2) additional SAR Helicopters if needed. The Options will be considered called for:

    At Svalbard to replace the SAR helicopters

    On the mainland

    in case of loss of a Helicopter,

    if the number of SAR Operating Bases at the Norwegian mainland should be increased in the future, or

    due to any other presently unforeseen or uncontrollable circumstance.

    Iceland to replace existing SAR helicopters

    The Options shall be valid for a maximum period equalling the length of the maintenance and logistics services. Within this

    frame the term and conditions will be subject to negotiations. Candidates may offer their economically most advantageous Helicopter

    candidate irrespective of civil certification (Iceland only) or military

    qualification, and without concern as to whether the Helicopters will be

    operated under a civil or military regulatory regime.

    9. ICELAND

    The Icelandic Government has decided to procure an initial order of

    one new long-range rescue Helicopter

    with a purchase option of two more Helicopters.

    Iceland intends to procure, as far as it is feasible, the same Helicopters as Norway, thereby achieving efficiency and

    economies of scale.

    Iceland will perform line and base maintenance in-house, and acquire other necessary Services.

    10.1 PREQUALIFICATION OBJECTIVES

    The procurement will be performed through this pre-qualifying assessment and a subsequent competition with

    negotiations The Pre-qualification will determine if the Candidates

    10.2 RESERVATIONS

    10.2.1 Parliament approval It is important to note that the Government has initiated this Pre-qualification

    based on a decision subject to parliamentary approval by the Storting, cf. Prop. 146 S (2010-2011).

    It shall be clearly understood that the process may be cancelled in its entirety during the Pre-qualification phase, without compensation to Candidates,

    subject to the Parliaments request, or as a consequence of major changes required to the scope of supply and/or other material assumptions for the

    procurement.

    10.2.2 Regulatory framework (civil or military) The Ministry intention is not to close the question of helicopter register until

    the time of selecting the preferred bidder, based on his best overall offer.

    Please note that in order to allow a change in the future register (i.e. to a civil register) it is required that operational flexibility in relation to SAR and air

    ambulance operations is upheld.

    Whether this is obtainable is pending clarifications from the MoD, CAA and EASA.

    14.1 DEADLINE FOR QUESTIONS AND CLARIFICATIONS

    Questions and requests for clarifications related to the Pre-qualification shall be submitted no later than 9. December 2011 at 12:00 CET.

    Questions and answers will be published on the Project Web Site and sent to parties who have registered interest in this procurement on Doffin/TED. The

    originator of the questions will not be identified.

    15.3 SECURITY REQUIREMENTS (FOR NORWAY ONLY)

    It may be that the Provider at some point during the delivery will have to comply with requirements related to the protection of classified

    information and/or material (due to military operator / missions)

    These requirements also includes obtaining an authorisation or security clearance of the Provider, his Subcontractors, and/or his personnel, from

    the competent national security authority

    It will not be required to obtain security clearances as a part of the Pre-qualification.

    Candidates must however note that they will be contractually required to ensure that all necessary security requirements can be met by Provider and

    as necessary his Subcontractors, and that it is the sole risk of the Provider

    if he fails to do so.

    Before a contract is awarded, it shall as a minimum be evidenced that a security agreement/arrangement exists between Norway and the

    home state of the Provider (and/or his Subcontractors for the part of

    the delivery requiring security clearance), and that no other identified

    circumstances makes it likely that security clearances cannot be

    obtained.

    17. ETHICAL GUIDELINES

    In order to ensure an objective, transparent and in all aspects fair competition, ethical guidelines shall apply to both the Candidates behaviour in the Pre-qualification (and throughout the competition), and to the public

    bodies and their personnel involved in the procurement on behalf of the

    Ministry.

    The Candidates shall not try to influence, canvas or offer or give, or agree to give, any person involved in the project any gift, commission, rebate or

    consideration of any kind.

    The NAWSARH Project internal ethics standard is published on the Projects Web Site. Furthermore, other public bodies involved in the procurement have been instructed not to exchange communication with any

    prospective Candidates, relating to the procurement. All Candidates are

    expected to respect that the Ministry, the NAWSARH Project, other public

    bodies and their personnel will follow these standards, and not do anything

    that could risk the ethics standard being compromised.

    The awarded contract will contain provisions regarding ethical requirements. The Provider will be required to conform to a professional attitude to social

    responsibility, e.g. having a programme based on guidance laid out in ISO

    26000:2010, or a comparable standard or system.

    18. CANCELLATION AND REJECTION

    18.1 TOTAL CANCELLATION OR REJECTION OF THE PROCUREMENT PROCESS

    The procurement is dependent on parliamentary approval, and the Ministry may cancel the procurement if such approval is not granted,

    In addition, the Ministry may cancel the Pre-qualification if it considers that there is reasonable cause for such cancellation.

    The Ministry may also reject all submitted Pre-qualification Applications, if the Ministry finds that there is a justifiable basis.

    In the event of such cancellation or rejection, the Ministry is not liable for any economic loss suffered by the Candidate.

    18.2 REJECTION OF PRE-QUALIFICATION APPLICATIONS

    Candidates are informed that failure to comply with the requirements set out in the Pre-qualification Documentation may lead to rejection of the

    Candidate, including but not limited to provisions regarding delivery date,

    delivery place, delivery time and delivery format and the documentation

    required.

    It is therefore of great importance that the Candidates study the Pre-qualification Documentation carefully and

    follow the instructions herein.

    19. COOPERATION BETWEEN ICELAND AND NORWAY IN THE PRE-QUALIFICATION PROCESS Norway and Iceland will cooperate in procuring SAR Helicopters

    and associated material and services support with the intention of

    achieving economies of scale and synergies.

    The procurement processes will be held as two separate competitions, with separate documentation for each stage of the

    competition.

    The Candidates should note that both nations remain free at all times in the Pre-qualification to make their own individual

    decisions regarding the selection of which Candidates should be

    Pre-qualified, and that neither nation has the authority to enter into

    any kind of obligations on behalf of the other nation.

    Any material dispositive decision shall be subject to a formal decision by the Icelandic government, or a body clearly appointed

    by the Government to act on its behalf in this matter.

    20 TENDER PHASE

    Subject to parliamentary approval, and following the Pre-qualification phase, the Pre-qualified Candidates will receive the ITT and be invited to respond to

    the ITT with an offer for the delivery of the Service within a set deadline.

    21 EVALUATION PHASE

    Immediately following the deadline for submission of tenders, the Ministry will ask for any necessary clarifications and evaluate the tenders according to the

    evaluation model, after which the Bidders will be invited to negotiate for a

    contract.

    22 INITIAL REDUCTION OF CANDIDATES IN THE ITT PROCESS

    The negotiations can be performed in several phases in order to reduce the number of offers to be negotiated.

    23 NEGOTIATION PHASE

    Negotiations will take place with those Bidders which may be awarded a final contract.
