TERMS & CONDITIONS FOR SUBMISSION OF QUOTATION FOR SUPPLY OF STORES ORDERED 1 (a) Rate: The rate quoted must be exclusive of Excise Duty, Packing & Forwarding charges, Sales Tax, Freight charges & Insurance and Handling charges. Any charges, if applicable, must be shown separately in the offer. The stores are required to be delivered at this Institute under the supplier‘s own arrangement free of additional charges. The risk of damage or loss in transits if any will be the suppliers. Rates quoted for indigenous items must be for IIT Bhubaneswar, at DOOR DELIVERY Basis, with break up as follows: Basic Price [+] Central Excise Duty, if any [+] VAT/CST (on sub-total price, including Excise duty if any) [+] Freight and Insurance charge, if any [+] Installation and Commissioning charge, if any = Grand Total Price F.O.R IIT Bhubaneswar (b) (i) EXCISE DUTY: It may please be noted Excise Duty for scientific Instruments/equipment is exempted for which necessary certificate shall be provided by the Institute. (ii) SALES TAX: Sales Tax rate as applicable should be clearly mentioned. (iii) WAY BILL: This may be issued only against Consignment Note in original & a copy of invoice. Kindly note that Road Permit once issued will not be changed under any circumstances. If any amendment is required due to any reason the cost will be borne by the Vendor. (iv) EMD: Quotations submitted without Earnest Money Deposit, where applicable, are likely to be rejected. SSI/SME Units are exempted from submitting EMD as per Govt. of India order. Appropriate Certificate should be submitted in such case. 2 (a) Consignee: All stores are required to be consigned to the Registrar, IIT Bhubaneswar, Bhubaneswar-751013, Odisha (Attn: Office, School of Electrical Sciences). (b) Disposal of Dispatch Documents: The railway receipt/PWB/Consignment Note along with the relevant bill in triplicate and challan in duplicate should be dispatched to the Registrar, IIT Bhubaneswar immediately on completion of dispatch. If these documents do not reach the Registrar in time all damage, if any, will be recoverable from the supplier. 3. Warranty: The firm has to ensure onsite maintenance/warranty for the stores delivered with factory trained engineers for a period specified pre-page. 4. Delivery period: The stores are required to be delivered/dispatched within 3 weeks (indigenous purchase) / 12 weeks (foreign purchase) from the date of receipt of the order. All offers of delivery should be made ex-stock, and a clear note should be inserted in case ex-stock delivery is not possible. 5. Quality & specification of stores: The stores offered should be of the best quality available, unless otherwise specified confirming strictly to the specifications cited. The Institute reserves the right to reject the stores as found unacceptable on these grounds. A bid submitted with false information will not only be rejected but the Bidder may also be debarred from participation in future tendering process. If necessary, the Bidder may be required to give presentation/demonstration on the systems offered as well as arrange site visits. If any terminology/(ies) or specification(s) in the description of stores is/are specific to any particular manufacturer, bidder may provide equivalent International standards, if exists, with proper justification. The technical bid shall contain the Technical Compliance Certificate mentioning model nos. along with technical leaflet, product brochures, literature, etc. 6. Training: The Bidder shall arrange for training at the Institute premises by certified and trained engineers on the each product supplied. 7. Liquidated Damages: If a firm accepts an order and fails to execute the order in full or part as per the terms and conditions stipulated therein, it will be open to this institute to recover liquidated damages from the firm at the rate of 2% of the value of the stores per week or part thereof (for purchases up to 5 Lakhs) or at the rate of 2% of the value of the stores per month or part thereof (for purchases above 5 Lakhs), subject to a maximum of 10% of the value of the stores. It will also be open to this Institute alternatively, to arrange for procurement of the required stores from any other source at the risk and expense of the firm, which accepted the order but failed to execute the order according to stipulations agreed upon. 8. Submission of Quotation: All quotation must be forwarded in sealed cover by mail or by hand addressed to the authority mentioned pre-page, so as to reach within the specified period. The reference to the Enquiry No. and the last date for submission must clearly be super-scribed on the sealed envelope. To ensure receipt of quotations in time intending suppliers are advised to mail them 7 days in advance. If no counter offer is made in the quotation, it will be taken for granted that the offer is strictly in accordance with the specification and term and conditions laid down in the tender notice. Technical and price bids should be provided in two separate sealed envelopes. Signed copy of the tender enquiry form should be enclosed with the bid as a token of acceptance for the terms and conditions, without which the bid will be rejected. 9. Opening of Quotation: The quotations will be opened at the office of the School of Electrical Sciences, IIT Bhubaneswar, at the time and date specified on the tender form. The technical bid will be evaluated first for technical suitability. Only technically qualified bids shall be considered for commercial bid opening. Time of commercial bid opening will be communicated (to those who qualify in the technical bid) through E-mail/ phone and a firm may send its accredited representative to witness the opening if it so desires. 10. Period of validity: A quotation shall remain valid for acceptance at least for a period of 60 days from the date of opening. 11. Sales Tax Clearance: The bidder must be a registered dealer under Central Sales Tax Act and has to furnish its up-to-date Clearance Certificate. 12. Payment: 100% payment will be made against 10% performance security. Performance Security may be furnished in the form of account payee demand draft, fixed deposit receipt from a nationalized bank in favor of Registrar IIT Bhubaneswar or Bank Guarantee (BG) from a nationalized bank. The BG is to be submitted direct through the bank to avoid delay in obtaining confirmation. The performance security should remain valid for a period of 60 days beyond the date of completion of all contractual obligation of the supplier including warranty obligations. Performance Security is not required if the total order value is less than or equal to Rs. 1 Lakh. Payment will be made maximum within 30 days from the date of successful delivery/installation and submission of PBG where required, generally through RTGS. In case of payment is to be made by DD, the draft commission will be deducted from the bill amount. Part payment for part delivery will not be allowed. 13. Rejection of offers: The Institute reserves the right to ignore or reject any offer including the lowest one without assigning any reason. Conditional bid or bid not confirming to the terms and conditions would be rejected. 14. Cancellation of the contract & Compensation: The Institute reserves the right to cancel the contract placed on the selected bidder and recover expenditure incurred by the Institute on the following circumstances: (a) The selected bidder commits a breach of any of the terms and conditions of the bid, (b) The bidder goes into the liquidation voluntarily or otherwise, (c) An attachment is levied or continues to be levied for a period of 7 days upon effects of the bid, (d) The progress regarding execution of the order accepted made by the selected bidder is found to be unsatisfactory, (e) If uptime is less than the prescribed (99%) during warranty. 15. Canvassing in any form not only invites disqualification in this tender but also debars the Bidder from participation in the future tendering processes. 16. Printed conditions of supply from the firm, if any, will not be binding on us. 17. The Bidder should attach a self declaration stating that the bidder organization and its sister concerns is/are not banned/blacklisted/ debarred from working with any Central Govt./PSU/State Govt. in India/any Government Agencies/any Institution of National or International repute over the last three years. IMPORTANT 1. Director of IIT Bhubaneswar may accept or reject any or all the bids in part or in full without assigning any reason and does not bind himself to

accept the lowest bid. The Institute at its discretion may change the quantity / upgrade the criteria / drop any item or part thereof at any time before placing the Purchase Order.

2. In case of any dispute, the decision of the Director of IIT Bhubaneswar shall be final and binding on the Bidders.
