Rates Per Unit:

Offer shall be submitted with rates per unit as per the unit of measurementshown in the request for quotation.

Exemption from payment of EMD and Tender Fee:

Following categories of bidders shall be exempted from paying Earnest MoneyDeposit (EMD) and Tender Fee, if any.

i. Units registered with National Small Industries Corporation (NSIC);ii. Units falling under Micro & Small Enterprises (MSEs) category as definedunder the MSMED Act 2006.

The above are subject to the fulfilling of under mentioned conditions:

a) Units should be registered with National Small Scale Industrial CorporationLimited (NSIC) or with any of the Authorities specified under the PublicProcurement Policy for MSE's. (DIC/KVIC/KVIB/Coir Board/NSIC/Directorate ofHandicrafts and Handloom or any other body specified by Ministry of MSME.)

b) The Unit should be registered for the item tendered.

c) The monetary limit, if any, indicated in the registration certificateshould cover value of items ordered

All the Proposals shall be valid and remain effective for a period of Onetwenty (120) days from the "BID DUE DATE or Extended Due Date". BPCL mayrequest the bidders to extend the validity of the Proposals, and the biddersso requested shall be prepared to favorably consider the requested validityextension.

This contract will remain in force upto 30.06.2019.

Service Tax category in the bid. The Service Tax shall be paid to theContractor only if a proper invoice addressed to BPCL-Kochi Refinery is givenwith details such as Contractor's Name & Address, Service Tax RegistrationNumber, Description, and Category, indicating the value of Service and ServiceTax amount separately.

Sales Tax on Works Contract:

The Contractor is requested to submit the clearance certificate from the SalesTax Authority (if applicable) stating that the tax due on Contract/Runningbill has been duly paid, along with every bill submitted for payment. Paymentswill be released only on receipt of the above clearance certificate. BPCLshall not be responsible for any delay in payment/non-payment of bills due todelay in submission/ non-submission of the aforesaid clearance.

ESI/EPF Scheme:

1. The contractor shall enroll his employees to be deployed, under EmployeesState Insurance (ESI) and Employees Provident Fund (EPF) Schemes. Thecontractor is required to produce the original Register of Wages-cum-MusterRoll with the signature of workmen, duly certified by the Engineer-in-Chargewitnessing payment of wages.

2. If the contractor is having his own ESI & EPF Codes and the employees arecovered under those codes, the contractor shall submit the original challansshowing proof of remittance in each month. The contractor shall also furnishcopy of the Return of Contribution for the relevant period to prove that hisemployees are covered under the Schemes.

3. The employees drawing salary above ESI ceiling should be covered underWorkmen Compensation Policy or Group Personal Accident Policy.

If the contract awarded is for project works, the contractor shall givepreference to evictees having ID cards while engaging construction workers inproject sites, subject to their suitability.

BPCL reserves the right to reject any or all the tenders without assigning anyreasons whatsoever. Also BPCL reserves the absolute right to reject any or allthe bids/tenders solely based upon the past unsatisfactory performance by thebidder/bidders in BPCL, the opinion/decision of BPCL regarding the same beingfinal and conclusive.

Identity Badge:

Contract employees should wear their identity badge while they are inside theRefinery.

Medical Fitness Certification:

workers employed for working at height more than 30 meters using temporarystructures.

Housekeeping Plan:

For jobs involving generation of scraps and surplus materials, the followingcondition is applicable:

Dismantled Piping/ Equipment and metallic scrap/ debris shall be cut intoregular shapes of maximum length of 6 Met-suitable for transportation bytruck-and handover the same at designated scrap yards of P&CS Department. Themetallic parts shall be free from oil/other combustible material. Refractory/Insulation material(if any) shall be removed from the metal parts beforehanding over the same at the scrap yards.

Purchase Preference:

Owner reserves its right to allow Public Sector Enterprises (Central/State),purchase preference as admissible/ applicable from time to time under theexisting Govt. policy. Purchase preference to a PSE shall be decided based onthe price quoted by PSE as compared to L1 Vendor at the time of evaluation ofthe price bid.

Owner reserves its right to allow Micro and Small Enterprises (MSEs) and MSEsowned by Scheduled Caste (SC) or the Scheduled tribe (ST) entrepreneurs,purchase preference as admissible/ applicable from time to time under theexisting Govt. policy. Purchase preference to a MSE and a MSE owned by SC/STentrepreneurs shall be decided based on the Net Delivered price quoted by thesaid MSEs as compared to L1 Vendor at the time of evaluation of the price bid.

Bidders claiming purchase preference as MSE should have the followingcertificates/documents as on bid due date and need to submit the same:

a. Notarized copy of all the pages of the EM-II certificate issued by theappropriate authorities mentioned in the Public procurement policy ofMSEs-2012/Udyog Aadhaar Memorandum (UAM).

b. Vendor's declaration on a duly notarized Rs.200/- stamp paper stating that,in the event of award of contract, all the ordered supplies shall be made fromthe unit for which MSE certificate has been submitted.

MSE Purchase Preference for Non-divisible Contracts:

All Micro & Small Scale Enterprises (MSE) vendors quoting in the price band ofL1+15% and the natural L1 bidder is a non-MSE vendor, this job shall beawarded for full/complete tendered quantity, subject to bringing down of priceto L1 bidder by the concerned MSE vendor.

In case of more than one such MSEs are quoted in the price band of L1+15%,then L1 MSE will be offered first and if matches the natural L1 price, that

MSE shall be allowed to supply and installation of total tendered quantity.If L1 MSE does not match the natural L1 price, other MSEs falling in range ofL1+15% band will be offered in order of L2 MSE, L3 MSE etc. until they matchL1 price. No separate preference will be given to MSE owned by SC/STentrepreneurs over MSE owned by general person".

Holiday Listing Policy :

Kindly see the Holiday listing policy attached along with this Request forQuotation.

Declaration by Bidders regarding Holiday Listing Status:

The attached declaration should be submitted by the bidders along with theiroffers. Offers not accompanied with such a declaration shall be liable forrejection. Any wrong declaration in this context shall make the agency liablefor action under the attached Holiday Listing Policy.

Note:

Please note that this being a rate contract, the quantities mentioned in RFQare tentative and estimated considering the duration of the contract and mayvary to an extent, hence same shall not be taken as our firm commitment. Alsonote that separate purchase order for the actual quantum of work as and whenrequired during the contractual period shall be issued for any specific job.The time of completion for the individual jobs will be as detailed in therespective purchase orders. Successful bidder will be issued this as a valuecontract without indicating any quantities.

Deviation:

You are requested to have all your queries clarified before bidding (duringpre-bid meeting). However, if you still have deviations from our RFQ and theattachments (specifications /scope of work), please indicate deviations inyour offer under a separate title 'DEVIATIONS' giving reference to clause no.Deviations appearing under clause 'DEVIATIONS' shall be considered whileevaluating the offer. Integrity Pact:

a) Attached Proforma of Integrity Pact (IP) shall be returned by the Bidder/salong with the bid documents (technical bid in case of 2 part bids), dulysigned by the same signatory who is authorized to sign the bid documents. Allthe pages of the Integrity Pact shall be duly signed. Bidder's failure toreturn the IP duly signed along with the bid documents shall result in the bidnot being considered for further evaluation.

b) If the Bidder has been disqualified from the tender process prior to theaward of the contract in accordance with the provisions of the Integrity Pact,BPCL shall be entitled to demand and recover from Bidder Liquidated Damagesamount by forfeiting the EMD/Bid Security as per provisions of the IntegrityPact.c) If the contract has been terminated according to the provisions of theIntegrity Pact, or if BPCL is entitled to terminate the contract according tothe provisions of the Integrity Pact, BPCL shall be entitled to demand andrecover from Contractor Liquidated Damages amount by forfeiting the SecurityDeposit/Performance Bank Guarantee as per provisions of the Integrity Pact.

Line Item 30 - Operation of Economy Cars

Operation of economy cars to commence operation from 01.11.2017 to 30.06.2019except car on 24 hrs / 180 Kms per day for Maintenance which has to startoperation from 01.07.2017 to 30.06.2019.

1} One number car on 24 hr / 80 Kms per day basis for HR and One number car on24 hrs / 180 Kms per day for Maintenance.

2)Regular cars on 8 Hr / 80 kms basis - 18 Nos.

a )The contractor shall make available two diesel driven Indica Vista / MarutiSwift /Ford Figo model cars, one on 24 hrs 80 kms and one on 24 hrs 180 kmson daily run basis. These cars will be operated all days includingSaturdays,Sundays and holidays.

b) 18 no cars of Indica Vista / Maruti Swift /Ford Figo are to be operatedregularly from Monday to Friday on 8 hr/80 km basis as per the requirement ofcompany. Timing of these cars will be intimated by the authorized personnel inadvance.

c) Duties and responsibilities of drivers.

The drivers will be required to maintain log books/trip vouchers and otherrecords as directed by BPCL-Kochi Refinery. It is the responsibility of the

The drivers of the vehicles hired by BPCL-Kochi Refinery, apart frombeing technically competent, should be polite, reasonably smart and medicallyfit. BPCL-Kochi Refinery reserves the right to reject any driver at itsdiscretion and the contractor shall make a suitable replacement immediately.Drivers are required to display BPCL-Kochi Refinery name/guest name placard atairport/railway station to identify cars as required. Drivers are alsorequired to deliver/collect documents/materials from Banks, Jetty and otherplaces as instructed by BPCL-Kochi Refinery. The contractor is liable toindemnify any loss or damage to the official documents/materials handled bythe driver.Daily inspection of the vehicles is to be ensured by thedrivers/supervisor and report to the concerned officer.

d ) The contractor shall provide sufficient number of cars in good conditiondepending on BPCL-KR requirements. The drivers shall keep originals oflicence, RC book, Insurance, Pollution Control certificates etc, in thevehicle.

E) Contractor shall mention the car model/year of manufacturing in theLogbook/trip sheet. The trip sheet shall have a separate column for commentsby the guests.

Line Item 40 - Operation Carrier Vans.

Operation of carrier vans to commence operation from 01.06.2018 to 30.06.2019.

a) Carrier Van for canteen 24 hrs/80 kms - 7(Seven) nos.b) Carrier van for canteen 14 hrs/120 kms - 1 (One) no.

1.1. Contractor shall deploy the following carrier vans for use by KochiRefinery canteen as per details given below.

a) These vehicles on 24hrs/80 kms should be covered carrier vans of minimumcarrying capacity 9.66 M3 (minimum Length x Breadth x Height of 3300x1600x1830mm), chassis shall be of Force/ Mahindra/ Tata/Leyland or anyother suitable make, for transportation of food items, for Kochi RefineryCanteen on daily basis round the year, including Sundays and CompanyHolidays as per the average running KM per day specified against each.Contractor shall also deploy a covered carrier van of lower capacity havingdimensions 4.89 M3 (minimum Length x Breadth x Height of 2140 x 1430 x 1600mm), chassis shall be of Tata Ace, Ape Truck, Traveller Force, Mahindra orany other suitable make (four wheelers only), preferably having passengercarrying capacity of two (02) in addition to the driver, (for supply of foodto STF, Puthuvypin) from morning 0600 to evening 2000 hrs (14 hours) coveringan average running Kilometer of 120 Kms on all days including Sundays andholidays round the year.

b) The contractor shall also provide a spare vehicle of same capacity (9.66M3) and model and the same shall be stationed near the canteen in the Refinerypremises and will be maintained in roadworthy condition always. This sparevehicle will be used in case of a break down/ service of any of the carriervans.

c) In addition to the driver seat, there should be minimum two seats in thecabin of the van for travel of Canteen personnel in all carrier vans.

d) The contractor shall fix additional grills, trays, platforms etc. insidethe carrier van, and such requirements/modifications, if required in thevehicle shall be carried out by the contractor, at his cost, as per therequirement of Kochi Refinery. The contractor shall deploy only coveredvehicle (with hard top and sides) without any side windows or openings. Thedoors for the carriage shall be at the rear side and also on the left side ofthe vehicle. Doors on the left side shall have an appropriate door closer/mechanism to lock the door when open, fixed to prevent sudden closing ofdoors. Apart from this, a fan shall be provided in the driver's cabin for thecanteen employees travelling in the vehicle.

e) The platform should be fixed with chequered Aluminium sheet and thereshould not be any nuts or bolts protruding upwards/outwards. A rubber sheet ofminimum thickness to cover any protruding screws or mounting shall be providedwhich will ensure smooth movement of plastic food baskets/ trays in thevehicle compartment.

f) The doors should be so sealed that there is no chance of any dust or otherminute particles from the environment entering the vehicle and getting intothe food.

g) All vans should be fitted with a reverse horn which should be functional toensure that no accident takes place while the vehicles are reversed.

h) The Contractor shall deploy only diesel driven vehicle inside KochiRefinery premises with the following special safety features.In the electricalcharging system only alternator shall be used and not dynamo.Instead ofelectrical horns low intensity air horn shall be used.High voltage head lampswith relays shall not be used, that is only direct connected lamps withoutbooster / relay shall be used.Company approved exhaust flame / spark arrestorshall be provided. Thermal insulation shall be provided on the exhaustmanifold.The air intake, wire gauze type air filter shall be used, i.e., paperfilter shall not be used.

i) The contractor will not be allowed to run vehicles of lesser models ordifferent models even in the case of spare vehicles.

k) The vehicles are mainly meant for food and beverage distribution and haveto operate for the exclusive use of Kochi Refinery canteen, as per theirdirections. In addition to the food transportation within the Refinerypremises, the vehicles have to travel for transportation and distribution offood to our city office at Kundannur, Cochin Refineries school at Jwalagiri(KR housing colony), STF at Puthuvypin,IREP site office, Club etc and also toany other offices of Kochi Refinery at any location in Ernakulam district ifrequired. No extra payment shall be made for such trips.

l ) The vehicles will have to run as many trips within the specifiedKilometer limit, as required by Officer in charge of canteen.

m ) The vehicles under this contract shall be clean and in good operatingcondition always and are to be maintained to the satisfaction of the company.Driver taking over vehicle in each shift shall check and inspect and ensurethe vehicle is in good operating condition, and the same shall be entered inthe book provided in each vehicle. Any problem found during the operation ofthe vehicle shall be communicated immediately to the contractor's supervisor/contractor. Problem found shall also be entered in the book. Contractor shallarrange to rectify the problem on immediate basis. Contractor's supervisor/contractor shall apprise the Engineer-in-charge in person at the beginning ofthe Day shift regarding the problem found and the action taken. Drivershanding over and taking over the duty in each shift shall sign the bookwithout fail.

N ) The contractor has to arrange frequent cleaning and washing of thevehicles at least once a day or at a lesser frequency to keep the vehicle inclean condition always, at the cost of the contractor. All cleaning materialsto be arranged by the contractor himself. All cleaning materials used shall beeco friendly No cleaning materials/equipment belonging to the canteen to beused for this purpose. Hot water washing of the cabins shall also be carriedout in all vehicles at least once in a day so as to ensure that no pests likecockroaches remain in the vehicles. All safety precautions shall be compliedwith while carrying out the hot water washing. Cleaning of the vehicle bywashing shall be certified by the Officer-in-charge of canteen and the sameshall be produced along with each running bill.

O ) The Contractor shall arrange pest control treatment inside the vehicles,as and when required to control pests/cockroaches getting inside the vehicles.Materials used for pest control shall be eco friendly, not causing any hazardto human beings and shall be approved by the Officer-in-charge. As far aspossible, pests shall be evicted from the vehicle by hot water washing thecabins thoroughly using the facility provided in the canteen parkingarea.Adequate safety precautions shall be taken by the person washing the

Operation of Mini buses to start from 01.07.2017 to 30.06.2019.

1) Mini bus 25 seater 24 hr 150 kms - 5(Five) nos.

A) These buses shall generally be required to operate trips required fortransportation of our employees, to and fro, for duties in Rotatingshifts.These buses shall also be utilized for operating the school trips orany other trips as required. Apart from this, these buses shall also beutilized for trips within the Refinery/ Housing colony or even outside as andwhen required without affecting its routine trips.

Special Conditions of Contract:

2. This contract is envisaged for a period of two years from 01.07.2017 to30.06.2019. All vehicles deployed for operation under this contract shall beof 2015 or later model not having run more than 30000 Kms at the time ofcommencement of contract. Documentary evidence along with physical evidenceshall be mandatory proof for the above. The successful contractor shall submitcopies of RC book, insurance/Tax document, Pollution Under Control Certificatefor each vehicle, licence of drivers,along with originals for verificationbefore commencement of the contract. Copies of Safety driving licence and HSEcards shall be submitted on obtaining the same but not later than two weeks ofcommencement of contract.

3. Due to any strike, Hartal, lock out or closure or any such force majeurehappenings, the operation of the vehicles is suspended by giving notice inwriting, BPCL Kochi Refinery will have the right to extend this contract for aperiod not exceeding the number of days the operation of the vehicle was sosuspended, on the same terms and conditions of this agreement.

4. The contractor will not be eligible for any payment on the days thevehicles are idle due to any one of the above or if not being operated forKochi Refinery.

5. The contractor shall deploy only Diesel Engine driven vehicle inside KochiRefinery premises/STF.

6. Even in the event of a Hartal/strike by any agencies outside Kochi Refinery

7. The contractor should be prepared to put into service additional vehiclesas the case may be, with the same make/model if required, within seven day'snotice, at the same agreed rates and terms and conditions, if so required byKochi Refinery during the tenancy of the contract. The contractor should alsobe prepared to run additional vehicles as the case may be, at short notice ifrequired for short period for the company to tide over any emergencysituations in exceptional cases.

8. Insurance of the vehicle, including SRCC (strike, riot and civil commotion)risks and the risk of passengers travelling in the vehicles should be coveredby the contractor to the extent of the liabilities specified in the MotorVehicles Act. BPCL Kochi Refinery is not liable to pay any compensation to anyperson/s or property arising out of/during the operation of the vehiclescovered under this contract. Third party insurance coverage for any accidentof the vehicles inside and outside Refinery will be solely to the contractor'sresponsibility and the BPCL Kochi Refinery shall in no way be liable to payany compensation to any person/property.

9. The vehicle hired by BPCL Kochi Refinery should have valid comprehensiveinsurance and cover third party risks. The contractor shall take adequateinsurance coverage for the vehicle engaged for this contract and BPCL KochiRefinery, in no way, will be liable for any damages/defects occurring to suchvehicle and equipment due to whatever causes including fire explosion etc.

10. It will be the responsibility of the contractor to arrange necessarystatutory approvals from time to time, for running of the vehicles and noliabilities should be pending towards any Government Authorities and BPCLKochi Refinery shall not be made responsible to pay such liabilities, duringthe tenure of the contract.

11. All formalities connected with the plying of the vehicle shall be compliedby the contractor and BPCL Kochi Refinery does not accept any responsibilitytowards licenses, taxes, insurance and permits etc. These documents should besubmitted on demand to BPCL Kochi Refinery by the contractor.

12. The vehicle should have valid registration and permits and its drivershall hold valid license required under law. There should not be any pendingdues/liabilities towards Govt./Statutory bodies.

13. The contractor shall comply with and give notices required by any Act orby any regulations or bye-law of any local or other public authority and shall

14. It is the responsibility of the contractor to meet all claims forcompensation under Workmen's Compensation Act or under any other law includingin respect of accidents or injury or death suffered by workmen engaged by himor passengers or third parties during the period of contract. The contractoralone shall be responsible and liable in respect of claims under the Workmen'sCompensation Act and all other Acts aforesaid and the BPCL Kochi Refineryshall not under any circumstances be liable for any such claims.

15. In case of breakdown of the vehicle, relief vehicle shall be deployed bythe contractor to continue the trips within half an hour, with a vehicle ofsame capacity and in good condition so that the services of the vehicles willnot be affected. If there is any delay in providing the spare vehicle in time,BPCL Kochi Refinery has the right to arrange a substitute vehicle of itschoice at the risk and cost of the contractor and shall realize all theexpenses in this regard from the contractor.

16. During the tenure of the contract, if any unsatisfactory service includingcontinuous breakdown happens repeatedly, i.e., more than twice in a month,BPCL Kochi Refinery reserves the right to terminate the contract withoutnotice to the contractor and to operate the contract for the balance periodthrough other agencies at the risk and cost of the contractor.

17. The contractor should make his own arrangements for filling of fuel andlubricants and check the conditions of the vehicle before each trip, at hisown expense. BPCL KOCHI REFINERY WILL NOT BE LIABLE TO PAY FOR PRICES OF FUEL,LUBE OIL, REPAIRS OF VEHICLE, ANY COMPENSATION FOR HIKE IN PRICES OF LUBE OILAND SPARE PARTS ETC., DURING THE TENURE OF THIS CONTRACT. The quoted ratesshall be firm till completion of the contract, and no revision/escalationshall be applicable during the tenure of the contract except for cost of fuelas explained vide clause 17.1 below. Any hike or revision in the price oflubricants, spare parts etc., shall be to contractor's account and BPCL KochiRefinery will not consider any claims for reimbursement/additional payment, onaccount of the same.

17.1 Payment on account of fuel price (diesel) escalation both upward anddownward shall be applicable on account of fluctuation of diesel prices onlywhen the variation in diesel price is more than 10 percent w.r.t the dieselprice on the date of creation of this Request For Quotation (RFQ). Escalationon running cost will be paid on the following basis:

Based on the above, the contractor will be paid additional charges forincrease in Diesel price (only when the variation in diesel price is +/- 10percent) for the Actual Distance (in Km) travelled subsequently to the date ofprice escalation.

Similarly, for decrease in diesel price, appropriate deduction in monthlybills will be made. No other rate/charges shall be charged on account of pricevariation of diesel. The price of diesel per litre prevailing on the date ofcreation of RFQ is as under:

Above method of calculation will apply to all class of vehicles under thecontract.

18. The contractor has to produce the vehicle for inspection by BPCL KochiRefinery personnel before placing the vehicle on duty for the service underthis agreement. Replacement of the vehicle will also be subject to the priorinspection except during emergencies. The condition of the vehicle includingthe operation of the doors, shutters and windows, condition of seats andprotection from rain condition of head lights, parking lights, horns etc.,shall be up to the satisfaction of BPCL Kochi Refinery.

19. The contractor should abide by the Security regulations of BPCL KochiRefinery and shall strictly adhere to and enforce all safety and fireprotection rules of Kochi Refinery during the performance of the work. WHILERUNNING INSIDE KOCHI REFINERY, COMPANY APPROVED FLAME ARRESTORS SHOULD BEFIXED IN ENGINE EXHAUSTS, which are to be procured and fixed by the contractorat his cost.

20. Company shall provide office space for one supervisor at company premiseson round the clock basis for the supervision and coordination of all vehiclesunder this contract. Smart and polite supervisors should be engaged bycontractor round the clock with laptop, mobile phone and other accessorieslike flame arrestors for meeting all requirements. Supervisor should verifythe log book and keep a register for recording drivers attendance and vehicle

He should coordinate all vehicle movements under thiscontract as per the instruction of officer in charge or authorized personnel.All the vehicle movements to be tracked through GPS system as mentioned inclause no. 26.

21. BPCL Kochi Refinery will be providing uncovered parking space for thevehicle and restroom for the drivers under contract outside the maingate/within the boundary of Refinery premises. BPCL Kochi Refinery will notprovide food etc to the drivers. BPCL Kochi Refinery shall have noresponsibility in case of accidents or theft or damages, while the vehiclesare within the boundary of Kochi Refinery or outside Kochi Refinery premises.It is also the responsibility of the contractor to arrange food and otheritems/facilities to the drivers deployed by him inside Kochi Refinery duringthe period of Strike, Hartal etc affecting the Public/Kochi Refinery.

22. Drivers acceptable to BPCL Kochi Refinery only shall be deployed tooperate the vehicle covered under this agreement. Drivers will have to undergoSafety Driving Test of Kochi Refinery and qualify the driving test beforebeing engaged for running the vehicles inside BPCL Kochi Refinery premises.The drivers, apart from being technically competent, medically fit and shouldbe very polite to the travelling employees and authorized personnel, andreasonably smart. They should be willing to oblige to the instantinstructions/directions given by Kochi Refinery personnel. If BPCL KochiRefinery so desires to change a particular driver, due to any reason, heshould be replaced with another acceptable driver within 24 hours. Thedecision of BPCL Kochi Refinery in this regard shall be final and binding onthe contractor.

23. Drivers will get a break for having lunch/dinner. However the time breakfor the same has to be suitably adjusted without affecting any exigencies andduring emergency situations. The full cooperation of the drivers shall beensured by the contractor for the smooth functioning of the various operationsand requirements of the department/section to which the vehicle is attachedfor. The drivers are not allowed to take food/beverages from BPCL KR Canteenand they should not enter inside the canteen without prior permission from theEngineer in Charge.

24. Drivers deployed shall abide by all the statutory requirements/rules andregulations of Motor Vehicle Act.

25. If for any reason whatsoever, the driver does not report to BPCL KochiRefinery at the prescribed time and place in any day in accordance with BPCLKochi Refinery's instructions, the contractor shall be liable to payRs.1000/-(Rupees one thousand only) per hour as penalty to Kochi Refinery foreach instance of such delays over and above the prorata deduction specifiedelsewhere in this document. For the computation of the above, the actual timewill be rounded off to the nearest hours. If such incidence of irresponsible

Under no circumstances the driverof the vehicle, when used by BPCL Kochi Refinery, shall transport anybody elseother than the individuals authorized by Kochi Refinery.

26. Global Positioning system (GPS) should be installed in all vehiclesrunning under this contract to track the exact location, speed at which it istravelling, daily kilometer usage etc of the vehicles. An administrationportal and mobile application to be developed by the contractor as per thespecifications of BPCL KR at contractors expense for the smooth tracking ofvehicles. Access to admin portal and Mobile application to be provided toOfficer in charge, authorized personnel and to every section where thevehicles are allotted. If the GPS system, Admin portal and mobile applicationare not satisfactory it should be changed and a new system to be developedimmediately without any resistance. Contractor has to bear all the expenses ofinstalling the GPS system and maintaining the Admin / mobile applicationduring the tenure of the contract. Contractor should ensure that the driversdo not tamper with the GPS system and any such instances occur companyreserves the right to terminate the contract without notice.

27. The contractor has to arrange daily cleaning and washing of the vehiclesat his cost to ensure that the vehicles are clean and tidy at all times.

28. BPCL Kochi Refinery reserves the right to decrease/increase the requirednumber of vehicles before entering into contract or during the tenure of thecontract with one weeks' notice as per the same rate and terms and conditions.BPCL Kochi Refinery also reserves the right to inspect and grant or rejectpermission for use of vehicles before the commencement of its operation.

29. Kochi Refinery reserves the right to check the correctness of thespeedometer and GPS system before putting any vehicle into service as well asperiodically during the tenure of the contract at the discretion of theOfficer / Engineer in charge. Kochi Refinery also reserves the right toterminate the contract if false claims are made on the basis of fabrication ofspeedometer or GPS system is detected.

30. The contractor is liable to pay compensation, as decided by BPCL KochiRefinery, if any damage is caused to BPCL Kochi Refinery property during theoperation of the vehicle inside Kochi Refinery premises. The decision of BPCLKochi Refinery in this regard shall be final and binding on the contractor.

31. The driver, who qualifies the Safety Driving Test conducted by the Fire &Safety Section of Kochi Refinery, shall only be permitted to drive the vehicleinside Kochi Refinery premises.

Additional drivers who have qualified BPCL Kochi Refinery SafetyDriving Test shall be available, as stand-by, for emergencies and also forrelieving the driver, engaged inside within short-notice.

32. The contractor should maintain Log Book, and any other records, as per thedirections of Engineer-in-charge. It is the responsibility of the drivers toget the necessary endorsement in the Log Book from the authorized officials ofCompany, as per the directions of Officer-in-charge. Driver shall ensure thattime in, time out, opening kilometer, closing kilometer; destination for eachtrip in a day is entered in the log book and signed by the user. At the end ofeach day the driver shall ensure that trip sheet is signed by the Shift inCharge or any other official of BPCL KR. The entries in the log book and thetrip sheet should tally and same will be verified on a need basis. Anydiscrepancy will lead to deductions from the contractor's dues. Verificationof entries in the log book and the trip sheet is the responsibility of thecontractor or his representative.

33. For the vehicles being deployed on round-the-clock basis, the driversshould enter the readings at the end of each 24 hrs and shall get endorsedfrom the concerned sections/shift-in-charges/officers on duty.

For The vehicles being deployed on daily basis, the driver should enter thereadings at the beginning and end of each duty (i.e, at 08:15 hrs and 17:00hrs for General shift or as the case may be as specified in the item note) andshall get it endorsed from the concerned Section Officer on duty.

The contractor or his representative will ensure the correctness of dataentered in the log book and tally it with that entered in the daily tripsheet. Any anomaly will not be accepted and will be the sole responsibility ofthe contractor.

34. Payment shall be made on a monthly basis, on raising the requiredinvoice/RA bills along with original trip sheets, statement showing details ofdays used, working of the average running Kilometer per day for the month andexcess kilometer, if any, as per format by the contractor. The contractorshall submit abstract of bill as per rates agreed to in the value contract andas per the format specified by the Officer / Engineer-in-charge.

35. Payment terms.

a) The rate quoted per vehicle per day, shall be applicable for running thevehicle, for BPCL Kochi Refinery, for an AVERAGE RUNNING KILOMETER PER DAY asspecified in the respective individual line items. For the purpose ofbilling/payment, the ACTUAL AVERAGE RUNNING KILOMETER PER DAY shall be derivedfrom the following formula:

c) Payment for additional hours will be paid for the extra hours eachvehicle runs in addition to the hours specified against each line item.

36. BPCL Kochi Refinery reserves the right to terminate the contract if any ofthe conditions mentioned in the Special Conditions of Contract/GeneralConditions of Contract, for this job, is violated by the contractor. Theperformance will be closely monitored by Kochi Refinery and the contract maybe terminated if the performance is not found satisfactory.

37. The authorized representative of BPCL Kochi Refinery, who coordinates thecontract, will be the Officer/ Engineer-in-charge for the job.

38. The contractor shall be solely and exclusively responsible for engaging oremploying persons for the execution of work. All employees engaged by thecontractor shall be on his / their payroll and paid by him/them. All disputesor differences between the contractor and his/their employees shall be settledby him/them. The contractor shall maintain proper records / registers asnecessary and submit them at the end of each month and at the time ofcompletion of the job as required by the Contract Labour Regulation andAbolition Act, 1970.

39. The contractor shall pay all fees including Airport/Railway stationparking charges, toll (except for the toll at the Irimpanam Refinery road) andother legally demandable compensation to any person/body or firm and the sameshall not be reimbursed by BPCL-Kochi Refinery.40. It is the responsibility of the contractor to meet all claims forcompensation under the Workmen's Compensation Act or under any other lawincluding in respect of accidents or injury or death suffered by workmen
