The Executive Engineer (E), BSNL Electrical Division, Nanded invites item rate e-TENDER on
behalf of BHARAT SANCHAR NIGAM LIMITED for the following work from Firms / Contractors
satisfying the under mentioned eligibility conditions:-
1. Eligibility Criteria: -
1.1.1 Average annual turnover during the last 3 years, ending 31st March of the previous
financial
year, should be at least 30% of the estimated cost put to tender.
AND
1.1.2 BSNL enlisted contractors in Electrical category of respective class as per their tendering
limits.
OR
1.1.3 Experience of having successfully completed similar works in Central Government /State
Government /Central Autonomous Body/Central Public Sector Undertaking during last 7 years
ending last day of the month previous to the one in which applications are invited should be either

Three similar successfully completed works costing not less than the amount equal to 40% of
the
Estimated cost.
OR
Two similar successfully completed works costing not less than the amount equal to 60% of the
estimated cost.
OR
One similar successfully completed work costing not less than the amount equal to 80% of the
estimated cost.
2. Documentary proof of satisfying the above conditions, Chartered Accountants Certificate towards
deposit of Income Tax, Valid Service Tax Registration, Maharashtra Value Added Tax Registration
and an attested copy of PAN card to be furnished along with the application.
3. Copy of EPF registration certificate or undertaking to compliance of EPF act in original letterhead.
4. PERFORMANCE GUARANTEE: i) The contractor is required to furnish performance guarantee
for an amount equal to 5% of the contract value in the form of bank guarantee (of a Nationalized /
Scheduled bank in a standard format) / CDR / FDR / DD within two weeks from the date of issue of
award letter. The validity period of performance security in the form of performance bank guarantee
shall be one year from the date of actual completion of work.
ii) Security Deposit: In addition to performance guarantee stated above, a sum @ 10 % of the gross
amount of the bill shall be deducted from each running bill of the contractor till the sum along with
the sum already deposited as earnest money will amount to security deposit of 5% of the tendered
value of the work.
2. Accessibility of Tender Document: Tender document can be accessed / obtained by
downloading it from the website www.maharashtra.bsnl.co.in. The official copy of tender
document for participating in e-Tender shall be available for downloading from
www.eprocure.gov.in from date 24/01/2017, and e-tender document closure time/date of
downloading (by bidder) from e-tender portal will be 5 Minutes before last time/date of bid
submission.
2.1 As tenders are invited through e-Tendering process, physical copy of the tender document
would not be available for sale.
2.2 The bidding process will be accepted only through e-Tendering platform.
2.3(A) Tenderer must submit following documents offline in physical form to The Executive
Engineer (E), BSNL Electrical Division Nanded on or before the due date & time of
submission of tender on date 06/02/2017 up to 15.00Hrs. in a Sealed Envelope to be
deposited in Tender Box available in O/o Executive Engineer (E), Nanded. The
envelope shall bear the tenderer name, name of work, NIT number and the words “DO
NOT OPEN BEFORE (due date & time)” and also upload the attested scanned copies of
these documents with the tender form on www.eprocure.gov.in. These documents shall
not be sent through the Courier / Post. The documents received through Courier / Post
shall not be opened at all.
i) EMD amounting Rs. 4754/- in the prescribed form. It should be in the form of demand draft /
FDR / BG (As per format at Annexure) / CDR of a nationalized / scheduled bank, drawn in
favour of AO (Cash), GMT, BSNL, Nanded. must accompany each tender. The Validity period

of EMD shall be 90+30 days, from the date of opening of tender.
ii) Cost of Bid Document - Demand draft amounting Rs. 500/- + VAT = 530/- drawn in favour
of AO(Cash), GMT, BSNL, Nanded.
iii) Authorization Document in original if any.
iv) Duly Signed copy of ‘TENDER SUBMISSION FORMAT (For e-Tender)’
(B) In addition to the above documents tenderer shall also up-load the attested scanned
copies of following documents with the tender form on www.eprocure.gov.in.
i. Documentary proof of satisfying the eligibility conditions as per 1 above
ii. Attested copy of PAN card.
iii. Service Tax Registration.
iv. CA certificate for turnover.
v. CA certificate for deposition of latest Income Tax
vi. VAT Registration.
vii. Declaration by Contractor- EW-6 / EW-8 & Relative Certificate.
viii. Original Undertaking-I Regarding Provisions B & Undertaking II–C by contractors.
ix. EPF Registration.
Note-1- All above mentioned documents shall be self attested.
2- All above documents must be clearly displayed & seen by the tender opening
authority before opening the actual bid. If required, BSNL may ask to submit original
copies of credentials for verification after opening of tender at any stage.
3- In case the eligibility credentials are found to be fake or falsified at any stage i.e.
before award of work or during execution of the work or after completion of the
work, the contractor will be debarred from tendering in BSNL for three years
including any other action under the contract or existing law.
2.4 Online bid documents submitted by intending bidders shall be opened only of those
bidders, whose Earnest Money Deposit, Cost of Bid Document, Authorization Letter if
any & Tender Submission Format placed in the envelope are found in order. Tender not
accompanied by documents as 2.3 (A) above shall be summarily rejected and will
remain archived/ unopened.
.5 Date & Time of Submission of e-Tender: on or before 15.00 hrs of 06/02/2017
Note: a) In case the date of submission (opening) of bid is declared to be a holiday, the date of submission (opening) of bid will get shifted automatically to next working day at the same scheduled time.
b) Any change in bid opening date due to any other unavoidable reason will be intimated to all the bidders separately.
2.6 Online Opening of e-Tender: From 11.00 Hrs. of 08/02/2017
2.7 Place of opening of Tender bids: BSNL has adopted e-tendering process which offers a unique facility for ‘Public Online
Tender Opening Event (TOE)’. BSNL’s Tender Opening Officers as well as authorized
representatives of bidders can attend the Public Online Tender Opening Event (TOE)
from the comfort of their offices. However, if required, authorized representatives of
bidders can attend at the O/o the Executive Engineer (E), BSNL Electrical Division,
Nanded, where BSNL’s Tender Opening Officers would be conducting Public Online
Tender Opening Event (TOE).
2.8 The tender submitted shall become invalid, shall not be opened

and tender cost shall not be refunded if:
(i) The tenderer is found ineligible.
(ii)The tenderer does not upload all the documents as stipulated in the bid document as detailed
in PARA 2.3 (A) & (B) above & submits them offline in physical form as detailed in PARA-
2.3 (A) above.
(iii)Any discrepancy is noticed between the documents as uploaded at the time of submission of
bid and hard copies as submitted off line physically in the office of tender opening authority.
2.9 General Conditions of Contract (BSNL EW-8) for works in BHARAT SANCHAR NIGAM
LIMITED is available on BSNL website www.maharashtra.bsnl.co.in as well as in the
Division Office. (For viewing only) Deviation if any in Technical specifications /
Commercial Terms & Conditions of DNIT will be given by the firm on its letter head duly
signed & same shall be uploaded. In the absence of such letter it will be assumed that there
are no deviations.
3. Agreement shall be drawn with the successful Tenderer on prescribed Form No. BSNL EW6 & 8,
which is available in the O/o Executive Engineer (E), BSNL Electrical Division, Nanded.
Tenderer shall quote his rates as per various terms and conditions of the said form.
4. The time allowed for carrying out the work will be as mentioned in the above table.
5. a) The EMD of all the unsuccessful tenderer shall be released on issue of award letter to the
Successful tenderer. This shall be done within one week of award letter.
b) Exemption from payment of earnest money and security deposit by any other unit/ department
shall not hold good for BSNL.
6. In case the eligibility credentials are not found in order at any stage i.e. before award of work or
during execution of the work or after completion of the work, the contractor will be debarred from
tendering in BSNL including any other action under the contract or existing law.
7. Performance Guarantee & Security Deposit
a) Performance Guarantee (PG): - The Firm shall have to furnish Performance guarantee @ 5% of
the contract value of the contract within two weeks of the issue of commencement letter in the
form of Bank guarantee on a Nationalized/Scheduled bank in standard format (Annexure B)/
CDR/ FDR/ DD. This performance guarantee shall be submitted in the Electrical Division in the
name of concerned Accounts Officer. The validity period of the performance security in the
form of performance bank guarantee shall be up to the date of actual completion of work. In the
event of failure on the part of successful tenderer to furnish the performance guarantee within
fifteen days, the EMD will be forfeited and tender shall b e c an ce l l ed .
b) Security deposit: A sum @ 10% of the gross amount of the bill shall be deducted from each
running bill of the contractor till the sum will amount to security deposit of 5% of the Tendered
value of the work. This Security Deposit shall be released after one year after the date of actual
completion of work.
8. The acceptance of a tender will rest with the Executive Engineer (E) Nanded, who does not bind
himself to accept the lowest tender or any other tender and reserves to himself the Authority to
reject lowest or all the tenders received without assigning any reason. All tenders in which any of
the prescribed conditions are not fulfilled or incomplete in any respect are liable to be rejected.

9. Canvassing in connection with tender is strictly prohibited and the tenders submitted by the
contractors who resort to canvassing will be liable for rejection.
10. The BSNL reserves itself the right of accepting the whole or any part of the tender and the
tenderer shall be bound to perform the same at the rates quoted.
11. i)The tenderer should give a certificate that none of his/her relative is employed in BSNL units.
In case of proprietorship firm, certificate will be given by the proprietor and for partnership
firm certificate will be given by all the Directors of the company.
ii)Near relatives of all BSNL employees either directly recruited or on deputation are prohibited
from participation in tenders and execution of works in the different units of BSNL. The near
relatives for this purpose are defined as:
a) Members of a Hindu Undivided family.
b) They are husband and wife.
c) The one is related to the other in the manner as father, mother, son(s) & son's wife
(daughter-in-law), Daughter(s) & daughter's husband (son-in-law), brother(s) & brother's
wife, sister(s) & sister's husband (brother -in-law).
iii) The company or firm or any other person is not permitted to tender for works in BSNL Unit in
which his near relative(s) is (are) posted. The unit is defined as SSA/Circle/Chief
Engineer/Chief Archt./Corporate office for non executive employees and all SSA in a circle
including circle office/Chief Eng./Chief Archt./Corporate office for executive employees
(including those called as Gazetted officers at present). The tenderer should give a certificate
that none of his/her such near relative is working in the units as defined above where he is
going to apply for tender/work, for proprietorship, partnership firms and limited company
certificate shall be given by the authorized signatory of the firm. Any breach of these conditions
by the company or firm or any other person, the tender/work will be cancelled and earnest
money/performance guarantee will be forfeited at any stage whenever it is so noticed. BSNL
will not pay any damages to the company or firm or the concerned person. The company or
firm or the person will also be debarred for further participation in the concerned unit. The
format of the certificate to be given is prescribed on Page No. 18.
12. No employee in BSNL/ Govt. of India is allowed to work as a contractor for a period of two years
of his retirement from service without the prior permission. The contract is liable to be cancelled
if either the contractor or any of his employees is found at any time to be such a person who had
not obtained the permission as aforesaid before submission of tender and engagement in the
contractor’s service.
13. The tender for the works shall not be witnessed by the contractor who himself/themselves has/
have tendered or who may and has/have tender for the same work. Failure to observe this
condition would render tenders of the contractors tendering as witnessing the tender is/are liable
for summarily rejection.
14. The tenders for the work shall remain open for acceptance for a period of 90 days from the date
of opening of the tenders. If any tenderer withdraws his tender before the said period or makes
any modification in the terms and conditions of the tender which is not acceptable to the BSNL
shall, without prejudice to any other right of remedy be at liberty to forfeit 50% (fifty percent
only) of the said earnest money absolutely.
15. Extension of validity: In case, where the letter of award of work cannot be placed within the
validity period of the tender, the BSNL can request all tenderers to extend the validity of their
respective tenders and the Earnest Money deposit by a reasonable period. In such cases, extension
of validity of Earnest Money deposit by 30 days beyond the extended validity date of tender
should also be asked for. While BSNL can make the request for extension, the tenderer is free to
either extend the validity or refuse the request to extend the validity.

17. The contractor should read the tender documents carefully before submitting the tender.
18. This Notice Inviting Tender shall form part of the Contract document. The successful
tenderer/contractor on acceptance of his tender by the Accepting authority, shall, within 15 days
from the stipulated date of start of the work, sign the contract consisting of:-
a)The Notice Inviting Tender, all the documents including additional conditions, specifications
and drawings, if any, forming the tender as issued at the time of invitation of tender and
acceptance thereof together with any correspondence leading thereto.
b) Standard BSNL EW-8 form.

Instructions for online tender submission 1.0 Submission of Tender through online process is mandatory for this e-Tender.
2.0 Possession of valid Digital Signature Certificate (DSC) and enrollment/registration of the
contractors/bidders on the e-Procurement/e-Tender portal is a prerequisite for e-tendering.
3.0 Bidder should do the enrollment in the e-Procurement site using the “Click here to Enroll”
option available on the home page. Portal enrollment is generally free of charge. During
enrollment/registration, the bidders should provide the correct/true information including
valid email id. All the correspondence shall be made directly with the contractors/bidders
through e-mail id provided.
4.0 Bidder need to login to the site through their user ID/ password chosen during
enrollment/registration.
5.0 The web site also has user manuals with detailed guidelines on enrollment and participation in
the online bidding process. The user manuals can be downloaded for ready reference. Vendors
can also attend the training/familiarization programme on the e-tendering system
conducted periodically by the GOVERNMENT e-PROCUREMENT SYSTEM in association
with NIC.
6.0 The Digital Signature Certificate with signing key usage issued by any Certifying Authority
recognized by CCA India on e-Token/Smartcard should be registered.
7.0 The DSC that is registered only should be used by the bidder and should ensure safety of the
same. DSC once mapped to an account cannot be remapped to any other account. It can only
be deactivated
8.0 Contractor/Bidder may go through the tenders published on the site and download the
required tender documents/schedules for the tenders he/she is interested.
9.0 .After downloading / getting the tender document/schedules, the Bidder should go through
them carefully and then submit the documents as asked, otherwise bid will be rejected.
10.0 If there are any clarifications, this may be obtained online through the tender site, or through
the contact details. Bidder should take into account the corrigendum published before
submitting the bids online
11.0 Bidder can log in to the site through the secured log in by giving the user id/ password chosen
during enrolment/registration and then by giving the password of the e-Token/Smartcard to
access DSC
12.0 It is construed that the bidder has read all the terms and conditions before submitting their
offer. Bidder should go through the tender schedules carefully and upload the documents as
asked; otherwise, the bid will be rejected.
13.0 Bidder, in advance, should get ready the bid documents to be submitted as indicated in the
tender document/schedule and generally, they can be in PDF/xls/rar/zip/dwf formats. If there
is more than one document, they can be clubbed together and can be provided in the requested
format.

14.0 There is no limit on the size of the file uploaded at the server end. However, the upload is
decided on the Memory available at the Client System as well as the Network bandwidth
available at the client side at that point of time. In order to reduce the file size, bidders are
suggested to scan the documents in 75-100 DPI so that the clarity is maintained and also the
size of file also gets reduced. This will help in quick uploading even at very low bandwidth
speeds.
15.0 The Bidders can update well in advance, the documents such as certificates, purchase order
details etc. under My Documents option and these can be selected as per tender requirements
and then attached along with bid documents during bid submission. This will ensure lesser
upload of bid documents.
16.0 Bidder should submit the Tender Fee/ EMD as specified in the tender. The original should be
given in person to the Tender Inviting Authority, within the bid submission due date & time for
the tender. Scanned copy of the instrument should be uploaded as part of the offer.
17.0 While submitting the bids online, the bidder reads the terms & conditions and accepts the same
to proceed further to submit the bid packets.
18.0 The bidder has to select the payment option as offline to pay the Tender FEE/ EMD as
applicable and enter details of the instruments.
19.0 The details of the DD/any other accepted instrument, physically sent, should tally with the
details available in the scanned copy and the data entered during bid submission time.
Otherwise submitted bid will not be acceptable.
20.0 The bidder has to digitally sign and upload the required bid documents one by one as indicated.
Bidders to note that the very act of using DSC for downloading the bids and uploading their
offers shall be deemed to be a confirmation that they have read all sections and pages of the bid
document including General conditions of contract without any exception and have understood
the entire document and are clear about the requirements of the tender .
21.0 The bidder has to upload the relevant files required as indicated in the cover content. In case of
any irrelevant files, the bid will be rejected.
22.0 If the price bid format is provided in a spread sheet file like BOQ price bid.xls, the rates offered
should be entered in the allotted space only and uploaded after filling the relevant columns. The
Price Bid/BOQ template must not be modified/replaced by the bidder, else the bid submitted is
liable to be rejected for this tender.
23.0 At the time of freezing the bid, the e-Procurement system will give a successful bid
Updation message after uploading all the bid documents submitted and then a bid summary will
be shown with the bid no, date & time of submission of the bid with all other relevant details.
The documents submitted by the bidders will be digitally signed using the e-token of the bidder
and then submitted.
24.0 After the bid submission (ie after Clicking “Freeze Bid Submission” in the portal), the
acknowledgement number, given by the system should be printed by the bidder and kept as a
record of evidence for online submission of bid for the particular tender and will also act as an
entry pass to participate in the bid opening date.
25.0 Successful bid submission from the system means, the bids as uploaded by the bidder is
received and stored in the system. System does not certify for its correctness.

26.0 The bidder should see that the bid documents submitted should be free from virus and if the
documents could not be opened, due to virus, during tender opening, the bid is liable to be
rejected.
27.0 The time settings fixed in the server side & displayed at the top of the tender site, will be valid
for all actions of requesting, bid submission, bid opening etc., in the e-tender system. The Time
followed in this portal is as per Indian Standard Time (IST) which is GMT+5:30. The bidders
should follow this time during bid submission.
28.0 The Tender Inviting Authority (TIA) will not be held responsible for any sort of delay or the
difficulties faced during the submission of bids online by the bidders due to local issues.
29.0 The bidder should logout of the tendering system using the normal logout option available at
the top right hand corner and not by selecting the (X) exit option in the browser.
30.0 For any queries regarding e-tendering process, the bidders are requested to contact as provided
in the tender document.
31.0 Offline Submissions: The bidder is requested to submit the documents offline as per PARA 2.3 (A) to The Executive
Engineer (E), BSNL Electrical Division on or before the due date & time of submission of
tender specified on covering letter of this tender document, in a Sealed Envelope. The envelope
shall bear the tender name, name of work, NIT number and the words “DO NOT OPEN
BEFORE (due date & time)”.
NOTE: The Bidder has to upload the Scanned copy of all above said original documents as
DNIT given in Bid-documents during Online Bid-Submission.
32.0 Vendors Training Program Vendors are requested to contact M/s NIC Officers @ Mobile

TENDER DOCUMENT
Sub: Tender for “Providing services of Data Entry Operator / Typist for the O/o Executive Engineer
(E) BSNL Electrical Division, Nanded.
Dear Sir,
The invitation for tender is open to all experienced contractors in India. The proof of such experience, etc.
shall form part of the tender. Tender should reach to the Executive Engineer (E), BSNL electrical Division,
Nanded on or before the last date.

Annexure-A.
GENERAL TERMS AND CONDITIONS:-
1) The tenderer is expected to examine, thoroughly all instructions, forms, specifications, terms, etc. either
himself or through translator in the tender documents. Failure to furnish all information required as per tender
document or submission of tender not substantially responsive to the tender documents in every respect will be
at the tender’s risk and shall result in rejection of tender.
2) DEFINITIONS :
The 'Contract' means the document forming the tender and acceptance thereof and the formal agreement
executed between the BSNL and the contractor(s) together with the document(s) referred to therein including
these conditions, the specification(s), design(s) and drawing(s), and instruction(s) issued from time to time by
the Executive Engineer(E), Nanded or his subordinates and all these documents taken together shall be deemed
to form one contract and shall be complementary to one another.
In the contract the following expressions shall, unless where the context otherwise required, have the meanings
hereby respectively assigned to them:
a) The expression 'work' or 'works' shall, unless there be something either in the subject or context repugnant
to such work(s) as stated above, be construed and taken to mean the works by or by virtue of the contract,
contracted to be executed whether temporary or permanent and whether original, altered, substituted or
additional.
b) The 'Site' means the place(s) on, into or through which work is to be executed under the contract or
any adjacent place(s) through which the work is to be executed under the contract or any place(s) which may
be allotted or used for the purpose of carrying out the contract work.
c) The 'Contractor' means the individual or firm who participates in this tender and submit the bid(s) and
Authority means the EE(E), BSNL Electrical Division, Nanded and/or any other officer authorized by EE(E),
Nanded.
d) Field Officer or Engineer In-charge or officer-in-charge means the Sub-Divisional Engineer/Junior
Telecom Officer of the Nigam or any other any official/officer nominated by EE(E), Nanded.
e) Nigam or Department (deptt.) means “Bharat Sanchar Nigam Limited” .

f) Work order means an order placed by the Nigam on the contractor signed by Executive Engineer(E),
Nanded or any other officer authorised by him, including all documents incorporated by references therein or
otherwise. The work order shall be deemed as '‘contract" appeared in the document.
h) Near relatives means executive employees employed in entire BSNL and non Executive employees
employed in BSNL Nanded , being father, Mother, Husband, Wife, Brother, sister, Brother-in-law,
sister-in-law, grandfather, grandmother, son-in-law, daughter-in-law, father-in-law or mother-in-law.
BRIEF DESCRIPTION OF WORK.
3) Work consists of job work for computer data feeding, entry in various registers, preparing reports, framing
agreements, certified copies of agreements, getting photocopies of required papers, stitching NIT, Tenders &
Agreement. Dispatching Dak into Post box / courier service office, Local BSNL offices. Fileing of the papers
into correct files. Computer typing work letter as draft by BSNL Officers. Dispatch & Diary of the all letter
correspondence. Store keeping of the Official records. Other works as per instruction(s) of authority.
4) The work must be performed during day time only, unless specific instructions issued from department to
carry out the work during night / during closed days according to exigencies of public services.
5)The above said work shall be carried out as per the specification(s)/instruction(s) if any prescribed in
Annexure-B and all precautions and procedure laid down therein must be followed apart from the time to time
instruction(s) form BSNL and instruction(s) from authority.
6)The Contractor shall not assign or sublet the contract or any part thereof without having first obtained the
permission in writing of the EE(E)-Nanded and he will be at liberty to refuse, if he deems fit. Moreover no
labour(s)/personnel(s) of contractor(s) shall have claim for the job in the BSNL and/or any of its other unit(s).
7) The Data entry Operator shall be minimum 12th standard pass in any discipline with knowledge of the
computer.
8) Data Operators will have no right to for permanent employment in BSNL.
DURATION FOR COMPLETION OF JOB:
16) The work awarded to the contractor shall be completed STRICTLY WITHIN THE PERIOD AS
PRESCRIBED IN THE TENDER THEREIN. Delay in execution/completion will attract the provisions under
item 26 penalty clause (liquidated damages).
AGREEMENT.
17) An Agreement in form Annexure-D duly signed by both the Nigam and the approved contractor will be
executed and it will mention the time limit within which to complete the work assigned. In case the contractor
fails to complete the work within the stipulated period or the work is unsatisfactory or does not carry out the
work, the Nigam reserves the right to terminate the contract without any notice and the contractor is not liable
to be paid compensation for the loss arising out of such termination and such termination will be in addition to
the liquidated damages to be claimed under relevant clauses of the contract. Works which have not been
completed within the time schedule or incomplete and abandoned works will be at the risk and cost of the
contractor.
TERMINATION OF CONTRACT.
18) Any attempt to secure interest for actual or prospective tenderer or to influence by any means will
disqualify the tenderer and will be summarily rejected.
REJECTION OF CONTRACT.

19) The contract may also be terminated by the EE(E), BSNL Electrical Division, Nanded at any time by
giving a notice in writing to the contractor without assigning any reason and his discretion to so terminate shall
be final & binding upon the contractor.
TERMS OF PAYMENT:
20) a)The tenderer will raise a pre-receipted bill every month, month-wise in duplicate for the work
completed which will be payable.
b) The data feeder will exercise all care while handling computers/printers/Xerox Machine as per
manufacturer’s instructions. Any damage to the PC/printer/Xerox machine etc. due to negligence of
data feeder will be recoverable and decision of the EE(E), BSNL Electrical Division, Nanded in this
regard will be final and binding.
c) The data feeder can be terminated at any time at the discretion of the EE(E), BSNL Electrical Division,
Nanded. Data feeder engaged for data feeding work will not liable to be permanently absorbed in the
services of BSNL and for which purpose contractor will indemnify the BSNL for any dispute raised by the
Data feeder before Labour Commissioner or any other Court of Law and keep the BSNL indemnified.
ARBITRATION:
21) Any dispute arising out of contract shall be referred to Chief Engineer(E), BSNL Electrical Zone
,Maharashtra East ,Nagpur, Mumbai, for appointing arbitrator within 90 days of intimation from Engineer-
in-charge that final bill is ready for payment.
FORCE DE MAJURE:
22) Neither contractor nor data feeder shall be liable for any delay, default or failure under this agreement, if
such delay default or failure arose as a direct consequences of Force De Majure including strikes, jock out war
Civil unrest.
INCOME TAX AND WORKS CONTRACT SALES TAX.
23) Deducted at source towards Income Tax along with surcharge will be as per the ERP syatem.
24) The BSNL shall not be responsible for payment of compensation/damages, etc. to the contractor if the
work is stopped in between due to non-availability of stores/material/data or for any other unavoidable
reason(s).
25 . CENVAT CREDIT In order to avail CENVAT credit as per CENVAT Credit Rules 2004, BSNL, who is an output service
provider, is entitled for duty credit.
25.1 . SERVICE TAX:-
Service tax, at the prevailing rate shall be paid by the contractor to the Excise Department as per the
ruling. The contractor has to furnish an invoice favoring BSNL. Further firm has to furnish all necessary
supporting documents required by Taxation department for availing the cenvat credit by BSNL. BSNL,
under no circumstances, will consider any claim of Service tax included in the bill. It will be the firm’s
responsibility to settle Service tax with Service tax authorities. The agency should provide documentary proof of payment of service tax made to the service tax
Department in respect of previous RA Bill & Final Bill shall be paid only after submission of
documentary proof of payment made to service tax Department for that bill.
25.2. If the agency fails to furnish necessary supporting documents for availing cenvat credit by BSNL or the
documents furnished by the firm are not accepted by taxation department then the amount of such taxes
and duties will be deducted from the payments due to the firm.

25.3 Invoice indicating the quantum of Service tax paid/to be paid on work, should also indicate the name of the
consignee with relevant Service tax registration no. as intimated by Executive Engineer (E) concerned.
25.4 The firm shall furnish monthly Bill cum Tax invoice before preparation of bills by the BSNL containing
Cenvatable rate & amount as offered by the firm in the price break up of tender. When there is no
statutory variation & if there is any decrease in cenvatable amount then difference in amount of offered
price breakup in the tender & charged amount while claiming in Bill Invoice, shall be recovered from the
bills of the agency.
LIQUIDATED DAMAGES.
26) If the contractor does not complete the work within the period given in the work order a PENALTY
CHARGES @ OF 2%OF THE ESTIMATED COST FOR DELAY OF A DAY, 5% IF DELAY OF
MORETHAN ONE DAY, 7.5% IF DELAYED MORE THAN TWO DAYS, 10% IF DELAYED MORE
THAN FOUR DAYS WILL BE CHARGED FROM THE BILL OF THE CONTRACTOR OR EVEN
AGAINST PERFORMANCE GUARANTEE. However at the end of a week, if the field officer feels that the
work is likely to be delayed further, in order to safeguard the interest of Nigam, balance of work will be done
at the risk and cost of the contractor.
27) If the work is delayed beyond the period given. due to Nigam reasons, necessary extension order will be
given by department.
28) If contractor abandons the work in part of full, due to one or other reason at any time; performance
guarantee will be forfeited without any notice in addition to other penalties.
LABOUR LAWS.
29) The contractor shall comply with the provisions of the payment of Wages Act, 1936; Minimum wages
Act, 1948, Employees liability Act 1938, Workmen's Compensation Act 1932, Industrial Dispute Act 1947 and
the Contractors Labour (Regulation and Abolition) Act, 1970 or the modifications thereof or any other law
relating thereto and the rules made there under from time to time. He shall also indemnify the Nigam against
any payments to be made for due observance of the said laws.
30) The contractor shall be responsible for any losses/damages, etc. that may have occurred during execution
of work and shall pay compensation to his/their workmen payable under Workmen’s Compensation Act
1923(VII) for injuries caused to the workmen. If such a compensation is paid by the Nigam as a Principal
Employer under sub section (i) of section 12 of the same Act on behalf of the contractor, it shall be recovered
by the Nigam from the contractor under section (ii) ibid from performance guarantee or any other dues payable
by the Nigam to the contractor on any account.
31) No minor labour (below the age of eighteen years) shall be employed on the work.
INDEMNITY
32) The contractor shall indemnify and save harmless the Government/Dept/BSNL from and against all
actions, suits, proceedings, costs, damages, charges, claims and demands whatsoever, either in law or equity
and all costs and charges and expenses that the Nigam/Dept may sustain or incur arising from or out of
omission or commission of any act/acts of the contractor, his agents, employees, assignee or sub-contractor(s).
BREACH OF CONTRACT
33) The Regulations aforesaid shall be deemed to be a part of this contract and any breach thereof shall be
deemed to be a breach of this contract and in such case the security deposit will be forfeited without any
prejudice.
34) Breach of contract is the failure or refusal to perform the contract within the stipulated period. If the
contractor having been given in writing to rectify, reconstruct or replace any defective work or the work is

being performed in any inefficient or un-workman like manner, neglects or fails to comply with such notice
within the period given in the notice or he has already failed to complete the work within the stipulated period,
a breach is said to have been committed. Similarly the contractor also commits the breach if he violates any of
the terms and conditions of the contract. If the contractor is found to have committed serious breach of
contract, the contractor will be blacklisted after giving him a reasonable opportunity.
35) In case of breach as stated above and if the performance of the contractor is consistently poor and the
work assigned is inordinately delayed, the contract will be terminated and the performance guarantee will
be forfeited without any prejudice.
36)Deviation Limit for contract period: - 25%
ANNEXURE- B
Specification & Technical Instructions
SCOPE OF WORK:
a) The job involves provision of two data feeders/ typist per day.
b) The word “Data Feeding” in these terms and condition includes inputting of text, tables, graphs and
drawing in English.
c) A printed copy will be taken after inputting for proof reading. Mistake in first printed copy should not be
more than 10 per page.
d) During first editing all mistake should be corrected and the second printed copy of text will be treated as
final copy and must be 100% correct.
e) The data feeder has to do the job works as mentioned in the schedule of works.

A G R E E M E N T
THIS AGREEMENT made this_____________day of ____________ Two thousand Ten between the
Executive Engineer(E), BSNL Electrical Division, Nanded hereinafter called "The Nigam" (which expression
shall unless excluded by or repugnant to the context, includes his successors and assignees) on the one part,
and________________________________________________________________a sole proprietary firm/a
partnership firm/ a company incorporated under the Indian Companies Act and having its registered office at
_____________________ hereinafter called the "Contractor" (which expression shall unless excluded by or
repugnant to the context, include its successors and assignees) on the OTHER PART :
WHEREAS THE NIGAM is desirous of appointing the said contractor on job work for data feeding as
per the instruction(s) if any in the office of Executive Engineer(E), BSNL Electrical Division, Nanded.
AND WHEREAS the said contractor has agreed to undertake the said work in accordance with the
Contract.
Now this AGREEMENT witnessed and it is hereby agreed and declared as follows.
1) The tender notice, terms and conditions of the contract, specification and Quoting rates undertaking given
in Annexure-D and such other relevant documents/ letters/drawings issued or to be issued from time to time in
connection with the said tender, shall be deemed and taken to be an integral part of the contract and shall be
deemed to be included in the expression `contract' or `Contract documents' wherever herein used.
2) In consideration of the payments to be made to the contractor for the works to be executed by him, the
contractor hereby covenants with the BSNL that the contractor shall in accordance with the contract documents
duly provide, execute and complete the said works and shall perform all other acts, deeds, matters and things in
the contract mentioned or described or which are to be implied there from or may be reasonably necessary for
the completion of the said works and at the time and in the manner and subject to the terms, conditions and
stipulations mentioned in the contract.
3) In consideration of the due provisions, executions and completions of the said works, the BSNL hereby
agrees with the contractor that the Nigam will pay to the contractor the respective amounts for the work done
by the contractor and such other sums as may become payable to the contractor under the provisions of the
contract.
4) Notwithstanding any other clause or provision in any of the conditions of contract, specifications,
guidelines to the contractor, schedule, letter of intent, tender notice, etc.
5) Force de Majeure:
If at any time during the continuance of this contract, the performance in whole or part by either of any party
under obligation as per this contract is prevented or delayed by reasons of any war or hostility, acts of public
enemy, civil commotion, sabotage, fire, flood, explosion, epidemic, quarantine restrictions, strike, lock out or
acts of God (herein after called the “eventuality.”
Provided notice of happenings of any such eventuality is given by either party to the other within 15 (fifteen)
days of occurrence thereof, neither party shall by reason of such eventuality be entitled to terminate this
contract nor shall either party shall have any claim for damages against the other.
In route of such non performance or delay in performance; the contract shall be resumed as soon as practicable
after such eventually has come to an end or cease to exist. In case of any dispute; the decision of Executive
Engineer(E), Nanded shall be final and conclusive.
A) The contractor is required to abide by the time schedule for performance of work and completion of work
as per work order.

B) And it is agreed that if the above said time schedule is not adhered to by the contractor, the Executive
Engineer(E), BSNL Electrical Division, Nanded at representing the Nigam and the Nigam, is at
liberty to terminate the contract without any further notice to the contractor and the contractor is not
liable to be paid any compensation for any loss etc arising out of such termination of the contract and
such termination will be in addition to the
C) liquidation damages if any, that could be claimed from the contractor, as per the other conditions of
the contract.
