1. Introduction

1.1. Project Background and Description

1. The Asian Development Bank (ADB) is supporting ‘Assam Power Sector Enhancement Investment Program’ (APSEIP) through a multi-tranche financing facility (MFF) to support continued investment in the state power sector, which is necessary to support economic growth and poverty reduction. The investments under the program are intended to (i) facilitate increased power transfers to accommodate increased demand and economic growth; (ii) improve supply-side energy efficiency by system de-bottlenecking and reducing technical losses; (iii) reduce the intensity of greenhouse gas (GHG) and other emissions via improved system efficiency; (iv) support expanded private sector participation in distribution system operations and other energy services; and (v) facilitate poverty reduction via improved electricity services and economic growth.

2. The impact of the investment program will be a sustainable state power sector with increased T&T capacity to support inclusive economic growth. The outcome will be enhanced quality and expanded service delivery of electricity through improved technical, commercial, and financial performance and capability of power utilities.

3. The Government of India and Government of Assam have requested ADB to provide US$ 200 million loan funding under “Assam Power Sector Enhancement Investment Program” via a Multi-Tranche Financing Facility (MFF) to support continued investment in the state power sector, which is necessary to support economic growth and poverty reduction. The proposed investments are necessary to:

(i). Facilitate increased power transfers to accommodate increased demand and economic growth;

(ii). Improve supply-side energy efficiency by system de-bottlenecking and reducing technical losses;

(iii). Reduce the intensity of greenhouse gas (GHG) and other emissions via improved system efficiency;

(iv). Support expanded private sector participation in distribution system operations and other energy services; and

(v). Facilitate poverty reduction via improved electricity services and economic growth.

4. Assam Electricity Gird Company Limited (AEGCL) is the Executing Agency (EA) for the Assam Power Sector Enhancement Investment Program (APSEIP), Tranche-I. The field units of AEGCL i.e. implementing agency will provide the support and monitor implementation of sub-project under this tranche.

1.2. Purpose of the Report

5. The report capture overall social safeguards implementation progress in compliance to project’s Resettlement Framework and regulatory requirements. The various social safeguard related issues addressed during the reporting period has also been covered, with reference to the progress achieved and current status of reporting period.

6. The current report covers the implementation progress of social safeguard during the 3rd and 4th quarters of 2015.

1.3. Social Safeguard Categorisation

7. As per the Resettlement Plan prepared for the T-I project, Tranche-I components is categorized as ‘B’ for Involuntary Resettlement (IR) according to ADB’s Safeguard Policy Statement, 2009 (SPS).

8. As per RP prepared for T-I, the schedule tribes in the project area is considered to be Indigenous People. The impact assessment has identified impacts on IP due to losing a strip of their land. Therefore, Tranche-I is categorized as 'B’ for Indigenous Peoples.

2. Project Implementation Status

2.1 Overview of Social Impacts

9. The Resettlement Plan (RP) prepared in 2009 for the project has identified social impacts due to acquisition of land, damages to crop, and other losses, for sub-station construction and stringing of transmission line. The RP has indicated that 3 substations were proposed on private land belong to various individual owners, and 3 sub-stations on Government land.

10. A comparative analysis (Table 2.1) of impacts recorded in Resettlement Plan (original) and as per implementation status gathered from the Implementing Agency. During implementation stage, changes of sub-project sites has happened that resulted to minimization of impacts due to the project. Few of significant reduction in impacts are (a) only two persons will be affected; (b) total land area needed for sub-stations has reduced; (c) shifting of Kamalpur and Sonari sub-stations site has avoided impact to eight persons identified during planning stage, which include 6 vulnerable households (4 ST households and 2 Women Headed Households (WHH).

11. In Tranche – I, construction of 5 sub-station works completed and charged as on this reporting period, except for Kamalpur substation whose civil works is in progress. Out of 6 transmission lines, works of 5 transmission lines are completed, except 220/132kV BTPS-Rangia T/L. The acquisition of land for Bihiating and Kamalpur sub-stations is completed through LA Act and Direct Negotiation, respectively. The requisite royalty amount for two sub-stations proposed in government land has been deposited. In case of transmission lines, socio-economic census survey of all affected person identified has been completed.

2.2 Affected Persons

12. The acquisition of land for sub-stations has affected two persons, one of which is tea estate. No Non-title holders are affected due to acquisition of land for sub-stations. The details of affected persons are in Table No. 2.2.

13. The implementation of 5 transmission lines has affected 1310 persons, which includes persons whose land is damaged, trees, crops, bamboos, and tea plants etc. that are coming within transmission corridor. The identification and verification of affected person within transmission corridor is done during alignment route survey, which is done in phase manner. During the reporting period, 517 affected persons has been verified within transmission corridor of 132kV S/C Nagaon-Samaguri (200APs) and 220/132kV BTPS-Rangia T/L (317APs) identified. Hence, 600 persons are affected in aggregate due to stringing of conductor for 4 transmission lines.

2.3 Impacts on Land

14. The construction of sub-stations has impacted 23.86ha of land, which includes tea estate (6.8ha), private land (2ha), government land (6.4ha) and AEGCL’s own land (8.66ha). As results, two private entities has been affected due to acquisition of their land, which includes one tea estate and one individual private land owner.

15. A total of 10.2ha (Table 2.4) will be required for tower footings of 220kV Salakati BTPS-Rangia T/L, 132kV Nagaon- Samaguri T/L, 132kV DC LILO at Rupai, 132kV DC LILO at Sonari and 132kV LILO at Bihiating transmission lines in Tranche – I. As a result 710 persons are affected due to damage of their private land. The impact on land indicated also includes land damaged at six rerouted sections of 220kV BTPS Rangia T/L. The construction of tower footings for LILO Kamalpur will be within the sub-station campus and will not impact any person.

2.4 Impacts on Structure

16. All sub-stations site identified are on vacant land and do not impact any structure.

2.5 Crop Damage

17. The sub-stations sites are all vacant land and do not impact any standing crop. For transmission line, in few cases compensation has been made to the land owners for the crop damage area due to stringing of transmission line. However, in most of case stringing is done post harvesting of crop to minimise the impact. The documenting of affected person, crop damage area and compensation paid is in progress by the implementing agency.

2.6 Impacts on Tree

18. At all sub-station sites, tree cutting was not involved. In case of transmission line, 3957 trees, 12813 bamboos and 11765 tea plants within transmission corridor has been identified and marked in phase manner during route survey, which is done in phase manner. The implementing agency has been directed to document details of person who has been compensated for loss of trees, bamboos and tea plants. The status available as on reporting period is in Table 2.3.

2.7 Impact on Structures

19. The impacts on cattle shed, shops, grain storage, toilet units etc. has been identified during stringing of transmission lines. A detail of such impacts is being documented by the IA and will be reported after completing.

2.8 Impacts on Livelihood

20. The two persons are affected due to acquisition of their land, though economically displaced, but their livelihood would not be affected as one is tea estate and other has high monthly income (Managing Director of Shree Sai Jyoti Iron & Steel).

2.9 Impacts on Common Property Resources

21. The sub-stations site and the transmission lines identified for the Tranche I sub projects, do not impact any CPR’s.

3. Compensation

3.1 Land Compensation

22. Cumulatively, an amount of INR 3,15,89,145/- has been disbursed for availing the land for four sub-stations located in government and private land. A total of INR 2,63,29,145/- has been disbursed to two private entities for acquiring their private land for two sub-stations. In addition, the land transfer fees along with royalty have already been submitted with respective departments for two sub-stations in government land. Table 3.0 provides an overview of compensation amount disbursed.

3.2 Compensation Status for Crop, Trees and Land Damaged

23. During the implementation of BTPS transmission line, six affected person has requested to enhance the amount given for land compensation in accordance with ‘the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013’. Subsequently, in month of November, 2015 an amount of Rs. 3,469,172 in aggregate was given to the six affected person (Annexure III) for land damaged due to gantry.

24. Cumulatively till end of December, 2015 INR. 5,96,01,393/- has been paid to affected person for loss of their standing crops, trees, tea plants and land damaged due to tower footings. The payment for land damage, loss of crop and trees is competed at three sub-projects, namely 132kV DC LILO at Bihiating, 132kV DC LILO Rupai, and 132kV Sonari LILO. While the same is in progress for remaining two sub-projects. Till December 31, 2015, cumulatively an amount of INR. 2,21,33,404/- has been disbursed for land damaged due to tower footings construction. Similarly, an amount of INR. 3,35,06,534/- has been paid for Zirat (loss of tree, crop, bamboos, tea plant etc.). The summary of compensation disbursed as pre status received from field implementing agency is at Table 3.1.

3.3 Structure Compensation

25. The impacts on cattle shed, shops, grain storage, toilet units etc. has been identified during stringing of 132kV Samaguri – Nagaon and 220kV Salakati (BTPS) – Rangia transmission lines. The affected persons have been compensated for damage to their structure along with in-kind assistance. An amount of INR. 39,61,455/- (Table 3.1) has been paid till end of December, 2015.

3.4 Relocation of CPR’s

26. Impact on CPR’s is not recorded till end of December, 2015. However, if any such impact is identified, after assessment and after verification the replacement cost shall be provided in line with provision in the project’s RF

4. Consultation and Disclosures

4.1 Consultation

27. During this reporting period, the safeguard consultant along with the concerned officials of AEGCL, Tinsukia Electrical Division has visited 132 kV Rupai LILO transmission line on 18th September 2015 and 9th December 2015. The site visit was intended to consult and carry out socio-economic census survey of affected persons at realigned section. In addition, necessary documents regarding the realigned section were also collected from the implementing agency. The consultation with the affected persons was carried out in Mankhuwa villages on September 18th, 2015 (Annexure II). The consultation was limited to one to one interaction with the affected person at realigned section of the sub-project. The key findings are:

The affected persons inform to know about the project. They have also lauded the efforts of AEGCL and perceive benefits after the

operationalization of the sub-project in terms of improved electricity, regular power supply, better irrigation and better living condition.

They informed about knowing the processes involved to estimate the compensation for the losses they suffered, due to continuous interaction with the circle officer during the verification surveys for cutting of trees and land area damaged.

The APs concerns were regarding opportunities for employment in the Project, and possibility for enhancement in compensation rates for trees cut.

4.2 Disclosures

28. To ensure transparency in planning and active involvement of APs and other stakeholders, the project information, Resettlement Plan report is uploaded in the official website of the EA (http://www.aegcl.co.in/ADB_Trenche_1.html) and ADB. The Resettlement Framework and Resettlement Plan translated in Assamese language is available at AEGCL website for inference by public. The Updated RP of 132kV Rupai LILO transmission line will be disclosed once approved by the ADB. The official of IA will continue interacting with affected persons and information dissemination through consultation and will continue throughout Investment Program implementation period.

5. Grievance Redress Mechanism

29. The Grievance Redress Committee cell has been formed at circles level to (i) provide support to AP’s on problems arising from the use of their land/property; (ii) record grievances of the AP’s and resolve them; and (iii) review grievances involving resettlements benefits like compensations and assistance to AP’s. A directive in this regard from Director (PMU), ASEB has been issued to AEGCL and APDCL, who are the implementing agencies of the MFF. The GRC constitutes representatives of

30. The GRC provide the platform to affected persons (APs) to first bring their grievances to the attention of the Project head of the PIU. Grievances not redressed by the PIU will be brought to the Grievance Redress Committee (GRC) set up at circle level to monitor subproject Implementation for each subproject affected area. The GRC will determine the merit of each grievance, and resolve grievances within an outer time limit of three months of receiving the complaint. The AP has the right to refer the grievances to appropriate courts of law if not satisfied with the redress at any stage of the process. The set up GRC has the system of records keeping, contact details of complainant, date of the complaint received, nature of grievance etc. if any for the ongoing project and taking the necessary action against the complaint.

31. During this quarter, six APs affected due to 220kV Salakati (BTPS)-Rangia transmission line has complaint requesting for enhancement in land compensation amount. In the month of November, 2015, the matter was amicably resolved by the Implementing Agency by compensating all six affected persons (Annexure III).

6. Institutional Arrangements

32. The implementation of the Resettlement Plan requires the involvement of various institutions at different stages of the project. The primary institutions involved in the project are:

Assam Electricity Grid Corporation Limited (EA and IA) Project Management Unit (PMU)

Environment and Social Management Unit (ESMU) at PMU Level

33. Assam Electricity Grid Corporation Limited (AEGCL) is the executing agency (EA) for the Tranche-1. The AEGCL also function as the implementing agency (IA) for the project with a dedicated Project Management Unit (PMU). The PMU in APDCL has been set up with overall responsibilities for planning, coordinating, implementing and financing all resettlement activities. The PMU is assisted by an Environment and Social Management Unit (ESMU) to deal with the environmental and social safeguards issues.

34. The Environment and Social Management Unit (ESMU) has been set up within the PMU/AEGCL, along with other engineering units, to address all environmental and social issues of Tranche-1. The ESMU is headed by an Assistant General Manager, who works closely with other staff of the PMU and assists the PMU in getting all necessary clearances and in the implementation of the resettlement activities prior to the start of any civil works. The ESMU coordinates safeguard activities both at headquarter and PIU level. All safeguards activities are managed and supervised by the Assistant General Manager based at the Head Office.

35. At field level, field units of IA is responsible for independent implementation of sub-project that includes all social safeguards related requirements and RP implementation. The field unit maintains all databases, works closely with APs and other stakeholders and monitors day-to-day resettlement activities.

36. To support the ESMU in the PMU has appointed a Social Safeguard Consultant with responsibility to review and update RPs, based on the Resettlement Framework (RF) agreed for this MFF and in compliant to relevant ADB policies. In addition, the Consultant’s responsibilities also include advising and assisting the EA/IA in mitigating Social and Environmental issues and administration and Implementation of measures in RP, as required. During the reporting period, Social Safeguard Consultant has been deployed on intermittent basis.

7. Monitoring and Evaluation

37. Monitoring of RP implementation is the responsibility of AEGCL through its PMU/ESMU. AEGCL is required to implement safeguard measures and relevant safeguard plans, as provided in the legal agreements, and to submit periodic monitoring reports on their implementation performance. AEGCL and PMU is required to:

establish and maintain procedures to monitor the progress of implementation of safeguard plans,

verify the compliance with safeguard measures and their progress toward intended outcomes,

document and disclose monitoring results and identify necessary corrective and preventive actions in the periodic monitoring reports,

follow up on these actions to ensure progress toward the desired outcomes,

submit periodic monitoring reports (bi-annual) on safeguard measures as agreed with ADB,

38. RP implementation is closely monitored through internal monitoring arrangements, to assess resettlement progress and identify potential difficulties and problems. Internal monitoring is undertaken by the PMU/ESMU with assistance from the PIU.

39. During this reporting period, the consultant has conducted site visit to 132kV Rupai LILO on 18th September and 9th December, 2015. The field visit was focused to scrutinize overall implementation of social and environmental isses associated due to realignment of the sub-project. In addition, consultation and socio-economic census survey of the affected persons at the realigned section were completed for updating the Resettlement Plan.

40. Monitoring and evaluation reports documenting progress on resettlement implementation and RP completion reports will be provided bi-annually by the PMU to ADB for review.

8. Conclusion

41. The acquisition of private land is completed for construction of six sub-stations and all affected persons have been compensated. Except for Kamalpur substation, construction works is completed for 5 substations and has been charged. In case of transmission lines, compensation has been paid to persons affected due to four T/L. While the same is in progress for 220kV Salakati (BTPS) - Rangia and 132kV Nagaon-Samaguri Transmission line.

42. The Resettlement plan of 132kV Rupai LILO is being updated. The complaints received from six persons affected due to 220kV Salakati (BTPS)-Rangia transmission line is resolved.

43. Executing Agency is closely monitoring and coordinating with respective departments to expedite RP activities implementation and resolving of any social issues, to complete all social safeguard activities by loan closing date i.e. June 30, 2016.
