• In 2005 Santa Fe enacted water rights transfers which requires developers to bring water rights to the table when requesting a permit

Developers of Santa Fe create Water Bank

• Developer purchase water rights in advance and then “deposit” them into a water bank

• Prior Appropriation-set in the west so that no water hoarding occurred. Farmers had rights to the water they were currently using, not to water they thought they were going to use.
