Negotiations for Architectural ServicesNotice is hereby given of the commencement of nego-

tiations for architectural services. The University of Kan-sas Medical Center requires a Clinical Research Centerfacility for its clinical and translational research pro-grams. This facility would house cancer clinical trials, aspart of the medical center’s effort to achieve designationas a National Cancer Institute comprehensive cancer cen-ter, and the Heartland Institute for Clinical and Transla-tional Research (HICTR). Both the cancer program andHICTR are part of a major national initiative to supportand organize clinical research so that discoveries made inresearch laboratories and findings from clinical researchare more rapidly translated into new treatments andhealth care practices.

The acquisition through a major private gift of a three-story office building at 4350 Shawnee Mission Parkwayin Fairway, Kansas, and the long-term funding from therecently approved Johnson County Educational ResearchTriangle tax has provided the initiative to plan and con-struct/renovate the facility to house the university’s clin-ical research programs. The facility program will requireapproximately 75,000 square feet of modular/flexiblespace for both administrative and clinical research func-tions. The administrative areas would provide commu-nity education space, along with office, clerical and con-ference areas necessary to support and manage a largenumber of clinical trials. These trials would be carried outin an easily accessible ambulatory (outpatient) setting likea typical physician office. This ambulatory setting wouldbe supported by specialized facilities for functions likespecimen collection, bio statistical support and metabolicnutrition studies. The concept of a modular/flexible de-sign will allow the facility to adapt to the continuouschange in the scope and volume of grant and clinical tri-als. The construction cost is budgeted for approximately$18,500,000. The contract award is contingent upon pro-ject approval by the Kansas Board of Regents and theLegislature.

Written December 17, 2008, to Dave Cromwell, EMS Op-erations Manager, Kansas Board of Emergency MedicalServices, Topeka.

This opinion is in response to your letter dated Septem-ber 29, 2008, requesting an opinion from the Kansas Gov-ernmental Ethics Commission concerning the state levelconflict of interest laws, K.S.A. 46-215 et seq. We note atthe outset that the Commission’s jurisdiction concerningyour question is limited to the application of K.S.A. 46-215 et seq., and whether some other statutory system,common law theory or agency rule or regulation appliesto your inquiry is not covered by this opinion.Factual Statement:

You request this opinion in your capacity as OperationsManager of the Kansas Board of Emergency MedicalServices. Your job duties include overseeing license re-newals, inspections, and investigations for emergencymedical services (EMS) in Kansas, and you also performsome of the inspections. You have explained that youwould like to work part time as a paramedic for severalEMS providers in Kansas on your own time outside ofyour normal business hours at the Board of EmergencyMedical Services. You believe that such employmentwould benefit you in performing your job with the Stateby enhancing your working knowledge of the industry.You state that your job duty with the Kansas Board ofEmergency Medical Services includes inspecting the EMSproviders for which you anticipate working. However,you believe that arrangements could be made so that an-other inspector would inspect those providers.Question:

May the Operations Manager for the Kansas Board ofEmergency Medical Services, on his own time outside ofhis normal state business hours, be employed as a para-medic by EMS providers that are licensed, inspected andregulated by the Kansas Board of Emergency MedicalServices?Opinion:

Two state conflict of interest laws must be reviewed toanswer your question. K.S.A. 46-286 prohibits participa-tion by a state employee in the licensure, inspection, orregulation of a business in which a state employee holdsa position. K.S.A. 46-241involves the use of confidentialinformation by a state employee. Each will be addressedin turn.

K.S.A. 46-286 states in pertinent part:(a) No state officer or employee, in the officer’s or em-ployee’s official capacity, shall participate directly in thelicensure, inspection or administration or enforcement ofany regulation of or in any contract with any outside or-ganization with which the officer or employee holds aposition.

Because the Kansas Board of Emergency Medical Serv-ices is involved in licensing, inspecting and regulatingEMS providers in Kansas, in order to comply with thisstatute, in your capacity as Operations Manager for the

Kansas Board of Emergency Medical Services, you mustrecuse yourself from participating directly in the licen-sure, inspection or regulation of any EMS provider withwhom you are employed. You have indicated you havetwo subordinates, one who conducts investigations andthe other conducts inspections. Thus, you would not beable to supervise your subordinates with regard to theirwork performed in relation to any EMS entities withwhom you are employed.

K.S.A. 46-241 provides that:No state officer or employee shall disclose or use confi-dential information acquired in the course of his or herofficial duties in order to further his or her own economicinterest or those of any other person.

This statute prohibits you from using any confidentialknowledge obtained in your employment with the statefor your financial gain or for the financial gain of anyother person, which would include any employer forwhom you provide paramedic services.

In conclusion, the conflict of interest laws do not pro-hibit you from being employed as a paramedic for EMSproviders in Kansas as long as you do not, in your posi-tion with the Kansas Board of Emergency Medical Serv-ices, participate in the licensure, inspection or regulationof any EMS provider while you are employed by thatprovider. Additionally, you may not misuse confidentialinformation.

Opinion No. 2008-15

Written December 17, 2008, to Ade Oremosu, Counsel,Verizon Wireless, Schaumburg, Illinois.

This opinion is in response to your letter dated Novem-ber 10, 2008, requesting an opinion from the Kansas Gov-ernmental Ethics Commission concerning the state levelconflict of interest laws, K.S.A. 46-215 et seq. Factual Statement:You request this opinion in your capacity as Counsel

of the Midwest area for Verizon Wireless. Verizon Wire-less, a business offering subscription wireless phone serv-ices in Kansas, is considering a plan that offers a contrac-tual agreement with various state universities of Kansasto offer discounted Verizon Wireless subscription plans.Under other programs available in the State, VerizonWireless currently offers discounts for subscription plansthat are available to all Kansas state employees. This con-tract would offer precisely the same discounts to stateuniversity employees as are available to all Kansas stateemployees. The difference with the university program isthat in addition to the employee discounts, Verizon Wire-less would also provide each university rebates based onthe number of subscribers in the program.

Question:1. May Verizon Wireless provide each university re-

bates based on the number of subscribers in the program?

Opinion:In answer to your question to the Commission, K.S.A.

46-237(c), which affects the ability of entities to providegifts to state agencies, should be addressed. It states:

No person licensed, inspected or regulated by a stateagency shall offer, pay, give or make any economic op-portunity, gift, loan, gratuity, special discount, favor, hos-pitality, or service having an aggregate value of $40 ormore in any calendar year to such agency or any stateofficer or employee, candidate for state office or state of-ficer elect of that agency.

Because Verizon Wireless is not licensed, inspected orregulated by state universities, it would not be prohibitedfrom providing the universities with a rebate based uponthe number of subscribers of the program. (See Govern-mental Ethics Opinion No. 2001-02.) The rebate that isproposed by your company would be a gift to theagency(ies) and not to an individual.

Pursuant to K.S.A. 46-237 (c), Verizon Wireless mayprovide a rebate to the universities based upon the num-ber of subscribers to the program as long as the univer-sities do not license, inspect or regulate Verizon Wireless.

Opinion No. 2008-16

This letter is in response to your letter dated December5, 2008, in which you request an opinion from the KansasGovernmental Ethics Commission concerning the Statelevel governmental ethics laws (K.S.A. 46-215 et seq.). Wenote at the outset that the Commission’s jurisdiction islimited to the application of K.S.A. 46-215 et seq., andwhether some other statutory system, common law the-ory or agency rule or regulation applies to your inquiryis not covered by this opinion.Factual Statement:

We understand that you request this opinion in yourcapacity of General Counsel for the Kansas Housing Re-sources Corporation (KHRC). As background, you haveexplained that KHRC participates in the Kansas HousingPolicy Network (Network), a consortium of nonprofithousing partners which provides education on and ad-vocacy for affordable housing in the State. The Networkhosts an annual housing conference, which is attended bynon-profits, developers, property managers and otherparticipants in the affordable housing industry. The con-ference is primarily funded through sponsorship and reg-istration fees. This year the Network has requested thatKHRC take the lead in planning and implementing theannual housing conference.

You state in your letter that the KHRC is a corporationprimarily funded through fees from administering Fed-eral grants and is not a part of the State budget.

You believe KHRC’s situation sets them apart from aprior opinion (Ethics Commission’s Opinion No. 2000-45), due to a special statutory exemption. The State Hous-ing Trust Fund (Trust Fund) was created by statute atK.S.A. 2007 Supp. 74-8959 for the purpose of fundinghousing programs and services. You further explain that

the housing conference provides education on housingprograms and issues. KHRC has used Trust Fund moniesto pays its sponsor fees. Section (c) of the Trust Fund stat-ute explicitly allows KHRC to ‘‘apply for and receive pub-lic or private grants, gifts and donations for the purposesof housing programs and services.’’

Furthermore, you state that the audience for the hous-ing conference is comprised of local governmental unitsand non-profits, investors, developers, construction com-panies and affordable housing advocates. Solicited ven-dors should not have an expectation of being rewardedby the KHRC for their sponsorship.

Questions:1. Are the employees of KHRC considered to be ‘‘state

employees’’ under the Kansas Governmental Ethics laws,K.S.A. 46-215 et seq.?

2. If considered state employees, may employees of theKHRC solicit vendors and sponsors to participate in theKansas Housing Policy Network’s annual conference?

Opinion:The KHRC employees work for a corporation that is

fee funded from primarily administering federal grantswhich are not run through the State budget. However, inconversations with you, those employees receive theirpaychecks from the State, as well as participate in thebenefits offered by the State.

K.S.A. 46-221(a)(4) states in pertinent part:‘‘State officer or employee’’ means any individual whoreceives monthly or semimonthly compensation for serv-ices from the state or any state agency.

Under this definition, the Commission opines thatKHRC employees do meet the definition of state employ-ees.

In a subsequent email, you stated that the KHRCchooses to use the state payroll system, but is not requiredto use it. The fact that the state system is currently usedbrings those employees under the definition stated above.

The second question asks if such said employees maysolicit vendors and sponsors for the annual conference onbehalf of the agency. As you are aware, K.S.A. 46-236reads in part:

No state employee may solicit any economic opportunity,gift, loan, gratuity, special discount, favor, hospitality orservice from any person known to have a special interestunder circumstances where such officer, employee, can-didate or state officer elect knows or should know that amajor purpose of the donor in granting the same couldbe to influence the performance of official duties or pro-spective official duties of such officer, employee, candi-date or state officer elect. (Emphasis added).

The statute follows with several exceptions to the law,none of which fit KHRC’s circumstances.

K.S.A. 46-228 defines special interest in the followingmanner:

This 60-day notice of the public hearing shall constitutea public comment period for the purpose of receivingwritten public comments on the proposed rules and reg-ulations. All interested parties may submit written com-ments prior to the hearing to manager of technician serv-ices, Board of Emergency Medical Services, Room 1031,Landon State Office Building, 900 S.W. Jackson, Topeka,66612. All interested parties will be given a reasonableopportunity to present their views orally on the adoptionof the proposed regulations during the hearing. These regulations are proposed for adoption on a per-manent basis. A summary of proposed regulations andtheir economic impact follows:

K.A.R. 109-5-1. Continuing education. This regulationclarifies the approval process for continuing education.The language used in this regulation has been changedto clarify the content. Requirements for instructor-coor-dinator renewal have been changed to reflect the biennialrecertification period. Language has been changed to re-flect the change from correspondence training to distancelearning programs and limitations associated with attain-ing such training. New language has been added to re-flect the changes associated with the new retroactive ap-proval process and limitations associated with taking theexact same class multiple times in a calendar year.

K.A.R. 109-5-2. Documentation for continuing edu-cation. This regulation addresses the documentation thatmust be maintained to verify completion of continuingeducation and the period of time for which such must bemaintained. Language was changed to clarify the proc-esses and assure consistency with current practices.

K.A.R. 109-5-3. Continuing education approval forlong-term providers. This regulation previously ad-dressed both long-term and single program providers ofcontinuing education. The regulation was changed to ad-dress long-term providers only. Language was changedto be consistent with current practices and to focus on the

long-term provider only. The application review timewas shortened from 90 days to 30 days.

K.A.R. 109-5-6. Single-program approval for provid-ers of continuing education. This is a new regulation de-veloped to separate the requirements for long-term pro-vider and single program provider. The applicationreview time was lengthened from 15 days to 30 days forconsistency with other application processes. Definitionshave been added for what constitutes a completed appli-cation and what must be included on a certificate of at-tendance.

K.A.R. 109-15-1. Reinstating attendant certificate afterexpiration. This is a new regulation that defines what isrequired for an individual to regain certification aftersuch has lapsed. This regulation is necessary to ensurethat individuals requesting reinstatement after a signifi-cant period of inactivity are competent to provide patientcare.

K.A.R. 109-15-2. Recognition of non-Kansas creden-tials. This is a new regulation to support the providingof Kansas credentials to individuals who have completedsubstantially equivalent course work in another jurisdic-tion.

K.A.R. 109-6-3. Revoked. This regulation was devel-oped to implement the change from annual certificationto biennial certification during the 2000-2001 recertifica-tion periods.

Emissions of particu-late matter (PM), PM equal to or less than 10 microns indiameter (PM10), volatile organic compounds (VOCs), ox-ides of nitrogen (NOx), sulfur oxides (SOx) and carbonmonoxide (CO) were evaluated during the permit reviewprocess. If the EPA has not objected in writ-ing to the issuance of the permit within the 45-day reviewperiod, any person may petition the administrator of theEPA to review the permit. The 60-day public petition pe-riod will directly follow the EPA’s 45-day review period.Interested parties may contact KDHE to determine if theEPA’s 45-day review period has been waived.

Article 9.—PRACTICE OF DENTISTRY BY ADENTAL STUDENT

71-9-1. Definitions. As used in this article, the fol-lowing terms shall have the meanings specified in thisregulation:

(a) ‘‘Dental student’’ means a person who meets thefollowing requirements:

(1) Has completed at least 50 percent of the requiredhours of dental classroom and clinical training at an ed-ucational institution; and

(2) is currently enrolled as a student at an educationalinstitution.

(b) ‘‘Educational institution’’ means a dental school ap-proved by the board that has obtained approval from theboard to operate an educational program, pursuant toK.S.A. 65-1423(a)(9) and amendments thereto, in whichdental students will perform dentistry.

(c) ‘‘Supervising dentist’’ means a dentist who meetsthe following requirements:

(1)(A) Has an active license to practice dentistry in Kan-sas; or

(B) is eligible to be licensed in Kansas and has an ap-plication to be licensed in Kansas pending;

(2) has faculty status with an educational institution;(3) has been assigned to a department of the educa-

tional institution and has agreed in writing to use thedepartment’s objectives in supervising and evaluating thework of the dental students; and

(4) has agreed in writing to confer as necessary, but atleast annually, with the department chair and educationalinstitution administrators to ensure that the educationalactivities supervised by the supervising dentist are beingconducted to achieve the educational goals of the edu-cational institution. 71-9-3. Requirements for approval of educationalprogram. To be approved, pursuant to K.S.A. 65-1423(a)(9) and amendments thereto, as an educationalprogram in which the practice of dentistry may be per-formed by a dental student, the administrator of each ed-ucational program shall ensure that all of the followingrequirements are met:

(a) The administrator of the educational program shallfile a written application with the executive director ofthe board. This application shall be submitted upon theform furnished by the board.

(b) The educational program shall be operated pursu-ant to a written affiliation agreement between an educa-tional institution and either a licensee or an entity ap-proved by the board. The affiliation agreement shallestablish requirements for the educational program andthe supervising dentist that are consistent with these reg-ulations.

(c) Each dental student shall be permitted to practicedentistry only under the direct supervision of a supervis-ing dentist.

(d) Patient records that meet the requirements of theKansas dental practice act and the board’s regulationsshall be maintained.

(e) The administrator of the educational program shallhave policies and procedures in place to ensure appro-priate care of each patient treated in the program.

(f) Each dental student shall have professional liabilitycoverage.

(g) All dental students performing dentistry shall beevaluated by a supervising dentist using methods ap-proved by the educational institution.

(h) Before any patient receives dental services from adental student, the patient shall sign a form indicatingthat patient’s consent to being treated by a dental student.(Authorized by K.S.A. 74-1406(l); implementing K.S.A.65-1423(a)(9); effective Jan. 9, 2009.)

(2) is currently enrolled as a student at an educationalinstitution and is not currently licensed by the Kansasdental board.

(b) ‘‘Educational institution’’ means a dental hygieneschool approved by the board that has obtained approvalfrom the board to operate an educational program, pur-suant to K.S.A. 65-1423(a)(9) and amendments thereto, inwhich dental hygiene students will perform dental hy-giene.

(c) ‘‘Supervising dental hygienist’’ means a dental hy-gienist who meets the following requirements:
