As you are driving the major expressways in our GRAR service area, please watch for the new spring
billboards. These advertisements are intended to drive leads to GRAR members, promote the grar.com
brand, and stress the importance of working with an expert. The billboards take a fresh, memorable, and
light-hearted approach to the message that, while there are some things you technically can do
yourself, why would you? The results would be regrettable. Experts are needed in all aspects of life.
Selling a home is no exception! We (real estate professionals) know how complex a real transaction can be
and the knowledge and skill that is required to navigate the process, but the intent of this campaign is to take
a real world approach to the message. A comparison of our industry to the medical industry is not
realistic. A person would not perform brain surgery on themselves, yet they could technically sell
their home themselves. We believe these billboards will catch the consumers’ eye and will also bring a
smile to their faces. The billboards will also be accompanied by animated and still banner ads online.

Since 2000, there has been approximately $3 billion worth of construction in Grand Rapids, including more
than $1.7 billion since 2012. Along with the rapid influx in development dollars, more than 4,050 residential
units have been added to the city since 2011, including more than 1,500 last year. To help residents keep
track of the development, the City of Grand Rapids Planning Department and Development Center released
a packet of 2016-17 building projects, including complete, under construction, planned and proposed projects
of the past two years.

Q: What policies does GRAR or the MLS have in place re: real estate or directional signs?
A coming soon sign may be placed in the yard of an unlisted property (or a coming soon post of an unlist-
ed property advertised via social media), provided the agent has the seller’s written permission to do so
and provided the agent’s supervising broker permits that practice. It is important to note that there is some
danger in promoting a property as coming soon before it is officially listed because another agent or a
buyer could approach the seller direct.
Once a listing agreement has been signed, the MLS calls for the listing to be submitted within 3 business
days. Signs may be in the yard during that time (and posts may be displayed on social media).
If the listing is unable to be submitted within 3 business days, then the agent may use the Delay
Addendum to identify the date that the listing will be submitted. The date on the delay addendum would
become the start date when the listing is submitted to the MLS. However, when using a delay addendum,
the listing agent and seller agree that the property will not be marketed (including placement of a sign or
posts on social media) or shown to prospective buyers before the listing is submitted to the MLS.
GRAR does not have policy in regards to directional signs or real estate signs placed in public right of
ways, however, members should respect local ordinances when considering placement.
Q: What is virtual staging?
A: The MLS defines virtual staging as the act of editing photos from their original format by either adding or
removing objects (furniture, décor, etc.) to enhance the property’s marketability. Virtual staging shall not be
used to cover up flaws in the property. If a listing contains photos that are virtually staged, the applicable
photos shall contain a watermark in 8 point font stating

Q: I am listing vacant land. Should I have my seller
complete a vacant land disclosure form?
A: Sellers of vacant land are not legally required to
provide a disclosure form. Sellers who do provide a
vacant land disclosure form should be cautioned against
making any representations where they are unsure.
Unlike with the statutorily required residential seller’s
disclosure form, a seller could be held liable for an
innocent misrepresentation made in a vacant land

Q: I have a new listing and just learned that a
registered sex offender lives across the street. What
are the disclosure requirements?
A: There is no legal requirement in Michigan to disclose
this information. If asked about the proximity of sex
offenders, the MR Legal Hotline advises you to refer the
inquiry to the local law enforcement agency since the
online registry may not always be up to date or accurate
and may not fully explain the nature of the offense.
