A hearing will be held in this case before the Florida Elections Commission on August 26, 2015, at 8:30 am, or as soon thereajler as the parties can be heard, at the following location: Senate Oflice Buildiug, Room 110-S, 404 South Monroe Street, Tallahassee, FL 32399.
Failure to appear in accordance with this notice will constitute a waiver of your right to pruticipate in the hearing. Continuances will be granted only upon a showing of good cause
This hearing will be conducted pursuant to Section 106.25, Florida Statutes, which governs your participation as follows:
If you are the Respondent, you may attend the hearing, and you or your attorney will have 5 minutes to present your case to the Commission However, some cases (including those in which consent orders or recommendations for no probable cause are being considered) may be decided by an en masse vote and, unless you request to be heard or the Commission requests that your case be considered separately on the day of the hearing, your case will not be individually heard

CONSENT ORDER
Respondent, Pamela A White, and the Florida Elections Commission (Commission)
agree that this Consent Order resolves all of the issues between the parties in this case. The
parties jointly stipulate to the following facts, conclusions of law, and order ..
FINDINGS OF FACT
L On November 20, 2014, the staff of the Commission issued a Staff
Recommendation, recommending to the Commission that there was probable cause to believe
that Respondent violated Chapter 106, Florida Statutes
2. On March 20, 2015, the Commission entered an Order of Probable Cause finding
that there was probable cause to charge the Respondent with the following violation:
Count 1:
On or about January JO, 2014, Respondent violated Section 106..07(1), Florida Statutes, when she failed to file Florida Society of Health-Systems Pharmacists' PAC's 2013 Ml2 Report
3 Respondent has expressed an interest in entering into negotiations directed toward

reaching a consent agreement
4.. Respondent and staffstipulate to the following facts:
a. Respondent, Pamela A White, was the Committee's treasurer at the time
the actions in this case occmred ..
b Respondent was required to file the Committee's 2013 Ml2 Repott on
Januruy I 0, 2014 Respondent failed to timely file the required report
c The Division of Elections sent a lette1 notifying Respondent that the
Committee's 2013 Ml2 Report had not been filed on January 13, 2014, January 22, 2014,
and February 3, 2015 The Februruy 3, 2015 letter was c0nfitmed delivered on Febmary
4,2015
d. As of May 19, 2015, Respondent has not filed the Committee's 2013 Ml2
Report
CONCLUSIONS OF LAW
5 The Commission has jurisdiction over the paities to and subject matter of this
cause, pursuant to Section I 06 .26, Florida Statutes.
6 The Commission staff and the Respondent stipulate that staff could prove all the
allegations in paragraph 3 above by clear and convincing evidence and to the Commission's
ability to impose a civil penalty in this case.
ORDER
7 Respondent and the staff of the Commission have entered into this Consent Order
voluntarily and upon advice of counsel
8 Respondent shall bear her own attorney's foes and costs that are in anyway
associated with this case

9 The Commission will consider the Consent Order at its next available meeting
10 Respondent voluntarily waives the right to any forther proceedings undet
Chapters 104, 106, and 120, Florida Statutes, and the right to appeal the Consent Order
11 This Consent Order is enforceable under Sections 106..265 and 120 69, Florida
Statutes.. Respondent expressly waives any venue privileges and agrees that if enforcement of
this Consent Order is necessary, venue shall be in Leon County, Florida, and Respondent shall be
responsible for all foes and costs associated with enforcement
12.. If the Commission does not receive the signed Consent Order and the penalty by
May 19, 2015, the staff Withdraws this offor of settlement and will proceed with the case
13 Payment of the civil penalty by cashier's check, or money order, good for at least
120 days, or attorney trust account check; is a condition precedent to the Commission's
consideration of the Consent Order
PENALTY
WHEREFORE, based upon the foregoing facts and conclusions of law, the Commission
finds that the Respondent has violated Section 106 07(1), Florida Statutes, and imposes a civil
penalty in the amount of $75 for the violation
Therefore it is
ORDERED that the Respondent shall remit to the Commission a civil penalty in the
amount of $75 inclusive of foes and costs The civil penalty shall be paid cashier's check or
money orde1, good for at least 120 days, or attorney trust account check. The civil penalty shall
be payable to the Florida Elections Commission, 107 West Gaines Street, Collins Building, Suite
224, Tallahassee, Florida, 32399-1050

You aie required to prove your case.. If the Commission finds that the report was filed timely or that there were unusual circumstances that excused the failure, it may waive the fine, in whole or in part. The Commission may reduce a fine after considering the factors in Section 106265, Florida Statutes If the Commission finds that the report was not timely filed aJid there were no unusual circumstances, the fine will be upheld.

STAFF RECOMMENDATION FOLLOWING INVESTIGATION
Puisuant to section 106 25(4)(c), Florida Statutes, unde1signed staff counsel files this written recommendation for disposition of the complaint in this case recommending that there is probable cause to charge Respondent with violating Section 106.07(1), Florida Statutes Based upon a tho10ugh review of the Repo1t oflnvestigation submitted on Septembe1 19, 2014, the following facts and law suppo1t this staff recommendation:
1 On February 20, 2014, the Floiida Elections Commission ("Commission") received a refenal from the Department of State, Division of Elections ("Complainant") alleging that Pamela A White ("Respondent") violated Chapter 106, Florida Statutes.
2 Respondent is tieasurer for Florida Society of Health-Systems Pharmacists' PAC, a political committee registered with the Division of Elections
3 By letter dated August 22, 2014, the Executive Director notified Respondent that Commission staff would investigate the following statuto1y provision:
Section 106.07(1), Florida Statutes: Pamela A White, treasure1 of the F!oiida Society of Health Systems Phaimacists' PAC, failed to timely file the committee's 2013 Ml2 repo1t when it was due on Januaiy 10, 2014
4. On Decembe1 26, 2012, the committee filed its Appointment of Campaign Treasurer and Designation of Campaign Depository fo1 Political Committees fo1m ("DS-DE 6") and appointed Respondent as its Tieasuie1 (ROI Exhibit 1)1
5 On Januaiy 2, 2013, Kiisti Bronson, Chief, Bureau of Election Reco1ds, mailed a letter to Respondent acknowledging he1 appointment as treasurer, and provided Respondent with her confidential PIN numbe1 to access the Division's elect~onic filing system (ROI Exhibit 2)

10. In reviewing the committee's monthly bank statements, Commission staff determined that the committee made two expenditures during the 2013 Ml2 reporting cycle .. The committee wrote a check ( # 1120) for $731 .25 that was paid on December 31, 2013, arrd the bank charged the campaign account a $12 .00 maintenarrce foe that was paid on December 31, 2013 Therefore, Respondent was required to file the 2013 M12 Report disclosing finarrcial activity (ROI Exhibit 5)2

Pursuant to Section 106 25, Florida Statutes, on February 20, 2014, the Florida Elections Commission received information from the Division of Elections that Respondent violated Chapter 106, Florida Statutes The Division's refenal was mandated pursuant to Section 106 07(8)(d), Florida Statutes. Commission staff, therefore, investigated whether Respondent violated the following statute:
Section 106 07(1 ), Florida Statutes, failure of the tJeasurer of a political committee to file timely regular reports of all contributions received, and all expenditure made, by or on behalf of the committee
I. Preliminary Information:
L Respondent is the treasurer for Florida Society of Health-System Pharmacists' PAC, a political committee registered with the Division of Elections since 2008.
2 Complainant is the Division of Elections.
3 Respondent's filing officer is Kristi Reid-Brnnson, Chief, Bureau of Election Records
II. Alleged Violation of Section 106.07(1), Florida Statutes:
4 I investigated whether Respondent violated this section of election laws by failing to file the committee's 2013 Ml2 Report after receiving notice that the report was due
5 On December 26, 2012, Florida Society of Health-System Pharmacists' PAC (committee) filed an Appointment of Campaign Treasurer and Designation of Campaign Depository for Political Committees (DS-DE 6) form with the Division of Elections, appointing Respondent treasurer of the committee To view a copy of the DS-DE 6 form, please refer to Exhibit 1
6 On January 2, 2013, Ms Bronson sent Respondent a letter acknowledging her appointinent as treasurer, and prnvided Respondent with her confidential PIN number allowing her access to the Division's electronic filing system (EFS)

The letter also advised Respondent that all of the Division's publications and reporting forms are available on their website, including Chapter 106, Florida Statutes, the Political Committee Handbook, and the Calendar of Reporting Dates. The letter further advised Respondent that it was her responsibility to read, understand, and follow the requirements of

On February 3, 2014, the Division sent Respondent a letter marked "Final Notice" stating that the committee's 2013 M12 Report had not been filed Copies of the failure-to-file letters previously provided as Exhibit 3 were included with the Final Notice. The Final Notice was mailed to Respondent at the address provided on the committee's DS-DE 6 fo1m (Exhibit 1) and was delivered on February 4, 2014 To view copies of the Final Notice, without attachments, and the delivery confirmation, please refer to Exhibit 4
10 Commission staff subpoenaed the committee's monthly bank statements to determine whether Respondent was required to file a 2013 M12 report disclosing any contributions and/or expenditures during the report's cover period 1 Review of those records reflect check number 1120 in the ainount of $73125 was paid from the committee's account on December 31, 2013, and a withdrawal/debit in the amount of $12.00 for a maintenance fee, which also occurred on December 31, 2013 To view a copy of the relevant monthly bank statement, please refer to Exhibit 5.
11. Based upon the committee's monthly bank statement (Exhibit 5), it appears Respondent was required to file a 2013 Ml2 report on behalf of the committee disclosing at least two expenditures

13 Respondent is currently being investigated for failing to file other campaign reports in a timely manner Case numbers F EC 14-086 and 14-147 will be heard during the October 2014 Commission meeting

15 On February 21, 2014, the Commission sent Respondent a letter via certified mail informing her that it received a referral from the Division alleging a violation of Florida's election laws. 16 On August 22, 2014, the Commission sent Respondent a letter informing her that the Division's refoIIal was found to be legally sufficient and the Commission would be investigating Respondent's alleged failure to file the committee's 2013 M12 Repo1t The letter advised Respondent she could file a notarized statement providing any information regarding the facts surrounding the allegation Respondent did not provide a notaiized statement. 18 On September 3 and September 15, 2014, I left voicemail messages asking Respondent to return my call so that she may have an oppo1tunity to respond to the allegations in the Division's refonal As of the date of this report, Respondent has not returned my calls

Section 106.07(8)(b), Florida Statutes, requires that the filing officer immediately notify you of the failure to file this report and that a fine will be assessed of$50 per day for the first 3 days late and, thereafter $500 per day, although a fine cannot exceed 25% of the total receipts or expenditures, whichever is greater, for the period covered by the late report However, for the repotts immediately preceding each primary and general election, the fine shall be $500 per day for each late day, not to exceed 25% of the total receipts or expenditures, whichever is greater, for the period covered by the late report.
Once your report is filed, this office wi JI notify you of the specific amount of your fine Fines must be paid to the filing officer within 20 days of receipt of the payment due notice
Please be advised, however, that failure to file a campaign treasurer's report may constitute a violation of Chapter I 06, Florida Statutes, independent of the automatic fine violation referenced above. Therefore, if you fail to file a report the division will turn the matter over to the Florida Elections Commission
Section 106.265(1), Florida Statutes, authorizes the Florida Elections Commission to impose a civil penalty up to $1,000 per count for each willful violation of Chapter I 06

Pin Numbers
Pin numbers are confidential secure credentials that allow you to submit reports and update information.. The enclosed sealed envelope provides a confidential pin number for the chairperson By copy of this letter, a confidential PIN number to access the Division of Election's electronic filing system (EFS) was sent to the treasurer
Each political committee chairperson is required to provide the Division of Elections with confidential personal information that may be used to allow access in the event that the password is forgotten or Jost When you enter the campaign account screen, there will be a drop down box where you pick a question (such as What is your mother's maiden name?) and supply an answer All passwords and answers to questions are stored as encrypted data and cannot be viewed by Division staff and given out over the phone Please notify the Division if your credentials have been compromised

All reports must be completed and filed tluough the EF S not later than midnight, Eastern Standaid Time, of the due date.. Reports not filed by midnight, Eastern Standaid Time, of the due date are late filed and suqject to the penalties in Section 106.07(8), Florida Statutes. In the event that the EFS is inoperable on the due date, the report will be accepted as timely filed if filed no later than midnight, Eastern Standaid Time, of the first business day the EFS becomes operable No fine will be levied during the period the EFS was inoperable.
Any political committee failing to file a report on the designated due date is subject to a fine of $50 per day for the first 3 days and, thereafter, $500 per day for each day, not to exceed 25% of the total receipts or expenditures, whichever is greater, for the period covered by the late report However, for the reports immediately preceding each primary and general election, the fine shall be $500 per day, not to exceed 25% of the total receipts or expenditures, whichever is greater, for the period covered by the late report
Electronic Receipt~
The person submitting the report on the EFS will be issued an electronic receipt indicating and verifying the report was filed.. Each campaign treasurer's report filed by means of the EFS is considered to be under oath by the chairperson and campaign treasurer and such persons are subject to the provisions of Section 106.07(5), Florida Statutes

I called and thanked Mr Mcquone for sending in the corrections for the DS-DE 5and DSDE-6 I explained to him that the Registered agent is still incomplete therefore he need to send in a corrected copy of the registered agent by fax I told him that It was incomplete because the registered agent was still missing a signature

I called and explained to Mr Mcquone that the Application that was received on March 19th 2008 was incomplete The report is incomplete for the following reasons: box 3 was missing vital information the registered agent form was missing a signature and the DSRDE6 was missing a depository I explained to him all this information is essential for the committee to be active and in compliance with the florida election laws
