The judgment by a Bench led by Justice L. Nageswara Rao is based on a series of Constitution Bench ver- dicts, from the Indira Sawh- ney case in 1992 to M. Naga- raj judgment in mid-2000s. However, Mr. Aazad has argued in his review peti- tion that the Februay judg- ment would “act as a tool in the hands of the oppressors to further oppress and ex- ploit the SC, ST, OBC and the economically weaker sections, causing further marginalisation within so- ciety, thereby defeating the endeavour to bring equality between the citizens of this country by the framers of our Constitution particular- ly those of Babasaheb Dr. Bhim Rao Ambedkar.” ‘Not a mandamus’ The Supreme Court had ob- served that State govern- ments were not bound to make reservations. Even the courts cannot issue a man- damus directing the States to provide reservations. “There is no fundamental right which inheres in an in- dividual to claim reserva- tion in promotions. No man- damus can be issued by the court directing the State go- vernment to provide reser- vations,” the Court had ob- served in its February 7 verdict. SC’s order on quota in promotions challenged Bhim Army chief seeks review Legal Correspondent New Delhi The number of people who died while cleaning sewers and septic tanks in the coun- try increased by almost 62% from 68 in 2018 to 110 in 2019, according to a reply gi- ven by the Social Justice and Empowerment (SJE) Minis- try to the Lok Sabha on Tuesday. National survey SJE Minister of State Ramdas Athawale replied to the question asked by Bharatiya Janata Party MPs Anil Firoji- ya, Mohanbhai Kalyanjibhai Kundariya and Lallu Singh about the incidents of ma- nual scavenging, which is banned under the Prohibi- tion of Employment as Ma- nual Scavengers and their Rehabilitation Act, 2013. The reply said a total of 14,559 manual scavengers had been identified by Mun- icipalities and Gram Pan- chayats in 13 States from 2013-2014 till January 31, 2020. Apart from that, a na- tional survey was conducted in 194 districts in 18 States where 48,345 manual sca- vengers were identified till January 31, taking the total to 62,904. While saying “there have been no reports regarding death of persons due to ma- nual scavenging”, the Minis- ter’s reply stated that the Na- tional Commission for Safai Karamcharis had received reports about the death of people cleaning sewers and septic tanks. These cases were report- ed from 18 States and Union Territories, while 13 States and UTs submitted “nil reports”. She also alleged that the statutory rules which regulate the sale of acid were not being implemented by the authorities. PTI Father of rape victim shot dead in U.P. FIROZABAD The father of a rape victim was shot dead in Firozabad district of Uttar Pradesh and the family suspected the accused in the rape case to be behind the killing, police said. His daughter was raped six months ago and a man identified as Achaman Upadhaya was made the accused in the case, SSP Sachin Patel said. PTI Chief Minister Edappadi K. Palaniswami’s announce- ment on Sunday last that the Cauvery delta region would be declared ‘Protected Spe- cial Agricultural Zone’ (PSAZ) may not affect va- rious ongoing projects in the districts, including hydrocar- bon exploration. Mr Palanis- wami had said no “new pro- jects such as the hydrocarbon project” would be allowed in delta districts. The primary intention of the government is to prohi- bit any “fresh” attempts at exploration of gas and min- erals in the Cauvery delta re- gion, senior bureaucrats in- dicated. “This is wet-land ecology and such explora- tions would affect agricul- ture severely. Moreover, such explorations would also lead to seawater intrusion.” Since the ongoing projects in the Cauvery delta have al- ready obtained necessary permission from the authori- ties concerned, they may not be affected by the announce- ment,” informed sources said. The proposed ₹50,000 crore investment in Cudda- lore by Haldia Petrochemi- cals would be allowed since “the unit is outside” the Cauvery delta core region. Besides, it is only replacing another private player. CM yet to clarify The Chief Minister has so far not clarified about the fate of the ongoing projects in the region. The proposed PSAZ would cover the entire Naga- pattinam, Tiruvarur and Thanjavur districts. The remaining five dis- tricts would be covered only partially. The declaration was to primarily to stop “local ex- ploitation of underground minerals and gas.” That way, refineries could be allowed since they would only use imported oil, officials explained. Chief  Minister  Edappadi  K.Palaniswami’s  announce­ment on Sunday last that theCauvery delta region wouldbe declared  ‘Protected Spe­cial  Agricultural  Zone’(PSAZ)  may  not  aff��ect  va­rious ongoing projects in thedistricts, including hydrocar­bon exploration. Mr Palanis­wami had said no “new pro­jects  such  as  thehydrocarbon project” wouldbe allowed in delta districts. 

The  primary  intention  ofthe government  is  to prohi­bit  any  “fresh”  attempts  atexploration of gas and min­erals in the Cauvery delta re­

gion, senior bureaucrats  in­dicated.  “This  is  wet­landecology  and  such  explora­tions  would  aff��ect  agricul­

ture  severely.  Moreover,such explorations would alsolead to seawater intrusion.” 

Since the ongoing projects

in the Cauvery delta have al­ready  obtained  necessarypermission from the authori­ties concerned, they may notbe aff��ected by the announce­ment,”  informed  sourcessaid. 

The  proposed  ₹��50,000crore  investment  in  Cudda­lore  by  Haldia  Petrochemi­cals would be allowed since“the  unit  is  outside”  theCauvery  delta  core  region.Besides,  it  is only replacinganother private player. 

CM yet to clarifyThe Chief Minister has so farnot clarifi��ed about the fate ofthe  ongoing  projects  in  theregion.  The  proposed  PSAZ

would cover the entire Naga­pattinam,  Tiruvarur  andThanjavur districts. 

The  remaining  fi��ve  dis­tricts would be covered onlypartially. 

The  declaration  was  toprimarily  to  stop  “local  ex­ploitation  of  undergroundminerals and gas.” That way,refi��neries  could  be  allowedsince  they  would  only  useimported  oil,  offi��cialsexplained.

Though  the  contours  ofthe policy are yet to be out­lined, sources hinted that in­frastructure projects such aslaying of roads and railwaysand construction of bridgeswould not be aff��ected.
