exactly what they are buying & ensure they have viewed the firearm & the information provided is correct to their satisfaction. The mechanical workings of these firearms have not been tested. We highly

recommend the firearms be checked for their safety & ability to fire by a qualified gun repair shop/gunsmith prior to shooting.

Type Description: “A” Antique, “B” Black Powder, “BBL” Barrel only, “C&R” Curio & Relic, “M” Modern, “R” Regulated Firearm/Handgun, “MD Banned” Weapon banned for sale to a resident of the state of Maryland.

Firearm Type/Category: The firearms will be broken down into 6 categories. #1 ANTIQUE. An Antique is generally a firearm that is made to fire modern metallic ammunition but was made prior to 1898. No paperwork is required to transfer this type of firearm. #2 BLACKPOWDER. A Black powder firearm is not made to fire modern metallic ammunition. No paperwork is required to transfer this type of firearm. Can be exceptions. #3 CURIO & RELIC. A Curio & Relic Firearm has been designated by the by the BATFE as having collector value or is over 50 years old. Only Licensee’s who have applied for and received a CURIO & RELIC LICENCE through the BATFE Qualify for this category. #4 MODERN. A Modern firearm is made after 1898 & is required to be transferred via an instant background check by an FFL dealer to transfer the firearm to you. #5 REGULATED. A Regulated Firearm is designated so by the State of Maryland & requires an instant background check & associated paperwork to be completed for the MD State Police. This covers most handguns that fire metallic cased ammunition. This paperwork requires a 7 day (Business Day) waiting period. NOTE: Maryland Residents must attain and present a Handgun Qualification License (HQL) in order to fill out paperwork. #6 MD BANNED This category will contain certain Assault Rifles (AR-15, AK-47, UZI, SKS w/detachable mag, ect…) that the State of Maryland has banned for transfer in the State of MD. This type of firearm can’t be purchased by a Maryland Resident. It may be sold to residents of other States where that type of firearm is legal to purchase. THE FIREARM TYPES ARE LISTED BELOW IN THE CATALOG. AS A GENERAL RULE THESE ARE NOT SUBJECT TO CHANGE UNLESS A TYPOGRAPHICAL ERROR WAS MADE. Our FFL has the final say on this matter. If a firearm is listed as MODERN, REGULATED, CURIO & RELIC or MD BANNED it is on our FFL dealers ACUISITION & DISPOSITION (A&D) book & will not be changed, I.E. paperwork is required. Only a Firearm that is an ANTIQUE or BLACKPOWDER will require no paperwork. Catalogs/Seat Reservation: This catalog can be printed at your home or work. Catalogs will be available at the Auction Registration window. Catalogs will be Approx. $5. Seat Reservation can be done this year on the Preview Night. You can register on Friday the 2nd and we will provide up to 4 seat reservation labels per registrant and you can place them on the available seats. PURCHASING A FIREARM: Items will be sold in the catalog order listed. All State & Federal Laws will be adhered to when transferring firearms. Our FFL Dealer can transfer most regular rifles & shotguns (Listed as

Modern) to Residents of Maryland, Delaware, Pennsylvania, Virginia and West Virginia. Residents of other State’s must have their firearms shipped to an FFL Dealer in their state. There is no limit on Quantity of these types of rifles or shotguns (Listed as Modern) that can be purchased and the paperwork completed at one time. Once you purchase a firearm you may go to the FFL Office and initiate your paperwork. The paperwork will not be finalized until you have paid for your item(s) at the Registration windows. You will need to take your payment receipt to the FFL room. The receipt must be in the name of the person the background check will be completed in.

For firearms listed as Regulated (I.E. Most Handguns) our FFL Dealer can only transfer those to Residents of Maryland. Residents of any other state must have those types of firearms (Listed as Regulated) transferred

to a FFL Dealer in your State to process your States required paperwork. Maryland Residents are generally restricted to 1 Transfer or a regulated weapon within a 30 day period. You can purchase more than 1 at the Auction but only 1 can be transferred at a time within a 30 Day period. Once 30 days have elapsed the next set of paperwork can be sent off to the State

the purchaser’s responsibility to know if these firearms are legal in your State. Once delivered out of State these firearms will not be returnable to Maryland. These firearms must be Shipped to/Delivered to/Picked up by your FFL. If you are an FFL you can take the firearm with you.

Shipping Information for Firearms: It should be understood that items will be shipped as soon as they can be readied for shipment by the Auction Co. We are the FFL and are responsible for the shipment of Firearms to an FFL in your state. This is not an instantaneous process. Before anything happens we need a copy of your FFL’s license so we know where we need to ship the firearm. With the size of the Auction and the Paperwork required it is normally 7-10 days before items start to be shipped. Depending on the amount of Online Bids/Firearms that require shipment this process can take 2-3 weeks to ship all of the firearms. Firearms being shipped by the FFL will include any firearm that uses a propellent to fire a projectile and will include Modern, Antique, Regulated, B. Powder & C&R firearms.

Shipping for Non Firearm Items: Allen & Marshall Auctioneers will not handle the shipping of Non-Firearm items. All Non Firearm items that require shipping will be out sourced to the UPS Pack and Ship Store located in Salisbury, MD. Payment for the packing, materials, boxes, insurance, Signature Confirmation, handling & shipping of purchased lots is the sole responsibility of the buyer. Buyer is responsible for the actual cost of shipping. Shipping fees must be paid prior to the items being shipped. Buyers will be notified or delivery to the UPS Store. You will be responsible for Paying the UPS Store directly. It should be understood that shipping is very expensive. High Capacity Magazines: NO High Capacity magazines (Over 10 Rds) can be handed out at the Auction. Some firearms in the Auction have Magazines with a Capacity over 10 Rds and we may be selling High Capacity Mag’s. These Magazines can’t be handed out in the State of MD. If you purchase one of these firearms or magazines we can ship your magazines out of the State of Maryland to a Destination of your choosing (Where they are legal of course)! This shipping (At your cost) will be provided by the FFL/Auction Co. to Ensure that the Magazines are property removed from the state. At that point it’s your responsibility what you do with them.

Transfer time frames: Most Non-Regulated Rifles & Shotguns can have an instant Federal Background Check completed at the time of sale and you can take the Firearm with you the Day of the Auction (MD, DE, VA, WV & PA Residents Only). For MD Residents it is imperative that prospective buyers attain an HQL license from the MD State Police. This HQL card is required to be shown to the FFL prior to filling out of paperwork. It should be understood that the Maryland 7 Day Waiting Period begins on the day that the paperwork is submitted to the State Police. It may take us a week + to get the paperwork finalized and submitted. At the earliest I would not expect MD Handgun Paperwork to start coming back for 14-18 Days after the Sale Date. If you want it quicker we will gladly ship it to another FFL Dealer for them to process. They can also pickup the firearm directly from us.

HQL – Handgun Qualification License for MD Residents- MD Handgun/Regulated Firearm purchasers must attain & possess the HQL (Handgun Qualification License) in order to purchase/fill out the required MSP Paperwork at a participating dealer. Visit https://www.mdsp.org/ for information on attaining the HQL. You must have the HQL card with you in order fill out the Required Firearm paperwork. You should have an HQL if you intend to purchase a handgun & are a MD Resident (State Law since 2013) If you purchase a handgun & don’t have an HQL a storage fee will be incurred. The storage fee will be $2 per day for a period of 30 days not to exceed $60. From Day 31 on there will be a $5 per day storage fee per firearm stored. This fee will stop when you present us your HQL in person & can complete the required paperwork. If you do not provide us an HQL in a timely manner storage fee’s will accrue & continue to be charged until the purchase price of the firearm has been exceeded. At that time the firearm belongs to the Auction Co. This can be negated if you provide us an FFL to ship your firearm to that is willing to hold your firearm until you get your HQL. We apologize but people have been using the Auction Co. as a Storage Facility and many don’t follow through with attaining the HQL. If you purchase a handgun and don’t possess an HQL or meet one of the criteria that exempts you a form will be filled out at the time to ensure that you understand and will comply with this policy.

A Modern firearm is made after1898 & is required to be transferred via an instant backgroundcheck by an FFL dealer to transfer the firearm to you. #5REGULATED. A Regulated Firearm is designated so by theState of Maryland & requires an instant background check &associated paperwork to be completed for the MD State Police.This covers most handguns that fire metallic cased ammunition.This paperwork requires a 7 day (Business Day) waiting period.#6 MD BANNED. This category will contain certain AssaultRifles (AR-15, AK-47, UZI, SKS w/detachable mag, ect…) thatthe State of Maryland has banned for transfer in the State ofMaryland. This type of firearm can't be purchased by a MarylandResident. It may be sold to residents of other States where thattype of firearm is legal to purchase. We advise all prospective bidders to read the Terms &Conditions of the Auction Sale before bidding in an A&M

By placing a bid thebidder is bound by those Terms and Conditions of the Sale, asamended by any oral announcement or posted notices, whichtogether form the contract of the sale between the successfulbidder (purchaser), A&M Auctioneers and Appraisers, LLC andthe seller (consignor) of the lot(s).

1. All property is sold "As Is, Where Is", and All Sales are Final.There is no bid reversals or refunds.

2. INSPECTION: Property is open to thorough publicinspection. The bidder is invited, urged and cautioned to inspectthe property prior to bidding. Property will be available forinspection at the places and times specified. It is the Bidder'sresponsibility to determine condition, age genuineness,authenticity, value or any other determinative factor prior toplacing a bid on an item. Bidder shall be the sole judge of value.A&M Auctioneers and Appraisers, LLC may attempt to describethe merchandise in advertising, on the internet, over the phoneand at the auction but makes no representations. Persons inattendance during inspection, sale or removal of merchandiseassume all risks of damage or loss to persons, property, ormerchandise and shall exercise proper precautions at all timesfor the protection of persons and property and shall comply withall safety and health requirements as directed by Auctioneer, andlocal, state and federal regulations. 3. BIDDER REGISTRATION: Bidder must be 18 years of ageor older, and is required to register for each auction. Toparticipate in this Auction prospective bidders must register &provide identification information to establish that you are avalid bidder: At the time of registration, we collect informationabout you to verify who you are before you can bid. Bidder mustsubmit information found to be current, complete, and accuratefor proper identification. We collect credit card information toensure that you are a qualified buyer. Bidder is responsible forsecurity of his/her bidding number/user name and password, andany and all bids placed under the assigned number/ID.Auctioneer should be notified immediately if Bidder believeshis/her bid number, account and/or password have beencompromised.

There is no cost to register for an auction (A $1 Authorizationwill be charged when you initially register to validate your creditcard by Auctionflex.) The Authorization is never deducted fromyour account. It verifies that the card being placed on file is



legitimate. The Billing information including address will bevalidated through this authorization. If the Billing informationon the Card doesn't match your shipping information the cardmay be rejected for possible fraud activity.

Auction Co, at its sole discretion, reserves the right to terminateany registration, deny any person for any reason permission oraccess to bid, to reject any and all bids, and to suspend or banBidder from bidding. Bidder registration is not transferable orassignable.

Highbid User Ratings. Every bidder starts with a reputation of 0and, with activity, this score goes up or down to a value between-100 (very bad) and 100 (very good). Any bidder with areputation lower than +1 will have their auction bid permissionset to pending. We will verify your information if you are a newbidder with a reputation of "0". Once approved or declined youwill receive an email confirmation. If you have a negative userrating/score on Hibid or Proxibid the Auction Co. at its solediscretion may decline any and all bids placed by your account.As a last resort if we find you to be a non paying bidder or usingfraudulent registration and/or credit card information you may bepermanently declined from bidding at our auctions.

Once a new HiBid customer has participated/purchased items ina few auctions you will start to build up positive feedback with asuccesful pay and pickup transaction. Once you have a positivefeedback rating your account will normally be automaticallyapproved for auctions conducted on HiBid by A&M Auctioneersfor a preset bidding amount. That amount is normally equal tothe highest priced item in the Auction. If we have a vehicle thatis worth $4,000 we would say that $5,000 would be themaximum high bid that would automatically be approved onyour account. Anything above that would require approval.

NOTE: If you are a new bidder to HiBid/A&M Auctioneers witha "0" feedback rating we will verify your registrationinformation and assign your account a Maximum Preset Highbid (Per Item) amount. This amount will be a Maximum of $500per item and will depend on the Auction. This pre-aprovalamount will be reflected in the Bidder Acceptance email onceyour account has been approved. We reccomend that whenbidding place yours bids early so that you will know that yourbid will be accepted. Don't wait until the final minute before theitem closes to try to bid. In this scenario for example if you hadbeen approved for a $500 max high bid per item and the biddingis already over $500. If you bid $750 your bid will be set topending, a notification is sent to us and it is nearly impossible toact upon that less than 60 Seconds. If you know you will bebidding higher than the amount that you were approved for inthe email contact us prior to the item ending and we can make amanual change.

If you are not comfortable or willing to register online which

includes placing a credit card on file on our Secure Web serveryou may enter bids in person at our facility. Bids must be inwriting and are legally binding just the same. A Valid CreditCard will still be required on the bid form. Valid Identificationwill also be required if you are unknown to the Auction Co. Wewill upload the bids placed by you on your behalf onto theonline bidding server.

4. All items offered online will have a minimum starting bid asdisplayed on the online catalogue. Online bids lower thanminimum will not be accepted.

5. CATALOGUE ERRORS & OMISSIONS: If a descriptiondoes not match a picture in a lot, the description takesprecedence. If you find an error please contact the Auction Co.and we will attempt to rectify it. All items are sold on an "as is,where is" basis, with all faults. In the event an item was listed inerror or an item can't be located during pick up for any reason,the bidder agrees that their maximum recourse is a full refund ofthe item in question and that all other items bid on remainbinding. By bidding you are acknowledging agreement with theterms above. Do not bid unless you agree to all of these terms.The Bidder is responsible for knowing which item is being bidon. If the Bidder is unsure, they should inquire or not bid. Whenbecoming the winning bidder at auction you have effected acontract and will be expected to pay for items in which you wereevidenced to be the successful bidder. Auctioneer will not honor"mistakes".

6. REVIEWING YOUR BIDS: During an auction you can checkthe status of your bids at anytime by logging into online server.Please be careful when placing bids. Placing a bid is a two stepprocess. When you click bid button it will pull up a windowverifying that you want to place that bid. If you want to place thenext bid increment that the computer is asking for you can dothat. If you desire to increase the amount of your bid this screenwill allow you to bid a higher amount. Ensure that you type inthe correct amount. If you make an error the Auction Co. canattempt to correct it but it has to be in a timely manner before theitem closes. In order to make a correction you must contact theAuction Co. at 410-835-0384. We have a staff member in theoffice during all online auctions. You are responsible for thebids that you place. Note that no bids can be withdrawn after theauction for any reason.

7. PROGRESSION OF THE AUCTION: Auctions are typicallyuploaded to the HiBid Auction Platform 30-45 days before theauction is scheduled to end. Some short notice auctions may beonline for only 15-30 Days. Each Auction will have a scheduledtime that each auctions items will begin closing. If an auctionstarts closing on a Wednesday night at 5 PM the first lot will bescheduled to close at that time. Depending on the quantity ofitems in the Auction lots may be scheduled to end anywherebetween 30 to 60 seconds a part. Each lot will show a scheduled



ending time. If no one bids in the final minute before a lot isscheduled to close that lot will close out. If someone bids withinthe final minute before that lot is scheduled to close, 1 Extraminute will be added to that lot and that lot only to allowadditional time for people to bid. The remaining lots behind thatlot will continue to close as scheduled unless someone bids inthe last minute on that specific lot as well. This is done toprevent a bidder from 'sniping', all bids made in the last minuteof the auction will force an item to stay open for an additional 1minute. This gives the back bidder additional time in increasehis/her bid if desired. This process will continue until all biddinghas ceased on no one bids within the additional minute that wasadded. 8. PAYING FOR YOUR PURCHASES: There is no cost toregister for an auction. Generally you will receive an "UNPAID"Auction Invoice on the day/night of the Auction immediatelyfollowing the sale. You will normally be afforded a period of12-24 hours to contact us and arrange an alternate paymentmethod. We generally process Credit Card transactions the dayafter the Auction at a specified time. If you don't contact usduring this period we will Charge the Credit Card that wasplaced on file at Registration for the Purchase price of your wonitems including Sales Tax and Buyers Premium. When anauction closes, if you are the winner, you must attend during thealotted Pick up time frame where you may pay cash, Approvedlocal Check, Visa, Mastercard, American Express or Discover. Ifyou do not pick up during the alotted time, we will charge yourcredit card with the winning bid amount, plus applicable BuyersPremium and taxes. In addition if we move your items from theAuction site back to our facility you will be responsible for atransportation fee as stated in terms of auction. If your CreditCard is declined you can pay in person when you pick the itemsup.

9. BIDDING NOTIFICATIONS: You can choose to be notifiedby e-mail during the auction if you have been outbid. Please notethat outbid notifications are NOT sent out during the last twohours of the sale. You can watch each item end. If you are thehigh bidder on an item the item will be highlighted in Green inthe Live Auction area. If the lot changes from green to red itmeans that you have been outbid and would need to bid again Ata higher bid. The item will not change back to green until youhave surpassed the high bid that the back bidder placed.

10. RESERVE: Seldom are items sold with Reserve. If an item isbeing sold with a reserve, it will be clearly marked andidentified. For items sold with a 'reserve', you will be required topay a minimum amount in order to win the item.

11. REMOVAL OF ITEMS: All items are sold in place. Buyersare responsible to remove items in a good workmanlike manner.Any plumbing must be shut off before being disconnected andany electrical that is disconnected must be capped. You must

bring any and all tools, equipment required to disconnect andremove any items you purchase. You must bring any requiredlabor to assist in carrying your items from the home to yourvehicle. We will have staff onsite to assist buyers in finding theiritems but they will likely not be available to assist in any waywith removal of your items. Please plan ahead and comeprepared. You are expected to bring boxes, packing materials,tape, tools, wheel carts, dollies or anything else needed toremove your items in a timely manner. Any items not removedby the times shown will be deemed abandoned regardless of theprice. If you can't pick your items up during the time scheduled,you are responsible for designating someone to pick your itemsup during the time that we are scheduled to be there. Many ofthese auctions are conducted offsite in a consignor's home. Wehave contracted with that person the dates that we are providedaccess to the home. You have been advised of the preview andpickup dates prior to the auction. If you are unable or unwillingto pickup your items during the scheduled time please don't bidon the items unless you provide someone to pick your items upfor you.

12. RISK TO PERSON AND PROPERTY: BY REGISTERINGAS A BUYER, YOU AGREE THAT A&M AUCTIONEERS &APRAISERS., LLC & THE SELLER/CONSIGNOR ARE NOTLIABLE TO YOU FOR ANY DAMAGE TO THE ITEMSYOU PURCHASED, YOUR OTHER PERSONALPROPERTY, OR FOR INJURY OR DEATH. Please take careof yourself and your items as you have released us from liability.We will not be liable for damage or injury to individuals or theirproperty. Purchaser assumes all risk and liability whatsoeverresulting from the use of the item(s) sold hereunder; and shalldefend, indemnify, and save harmless Auctioneer and Sellerfrom any liability.

13. AUCTION RECORDS: In the unlikely event of a dispute,you agree to accept as true the information that we have in ourrecords.

14. ADDITIONS & DELETIONS: We reserve the right toremove and/or add lots and/or items to the sale at any pointduring the auction.

15. The Auctioneer reserves the right to accept bids in anyincrement he feels is in the best interest of his client, the Seller.The Auctioneer reserves the right to reject the bidding of anyperson whose conduct, actions, or adverse comments he feels arenot in the best interest of the Seller.

16. Titles will be disbursed on auction day only if payment ismade in cash; otherwise they will be mailed when the checkclears the bank. This will take approx.10 days for a personalcheck. If you replace a personal check with a local bank/cashier'scheck we will be able to hand you the title at that time.



17. SALES TAX: Sales tax will be added to the purchase of alltaxable items. Dealers who purchase for resale must file theirresale permit numbers. If you are Maryland Dealer you arerequired to have a Valid Sales & Use Tax License with the Stateof Maryland. We are required to verify that the license is Validbefore deducting Sales Tax. We will verify the Tax # that youprovide and print a Blanket Resale form for your to sign. Thisneeds to be completed before the billing process is initiated. Youcan't use someone else's Sales & Use License. For Bidders fromanother state we are required by the State of Maryland to have acopy of your State Business License/Tax License on file in ordernot to charge Tax.

BUYER'S PREMIUM: A premium of 15% of the bid price willbe added to the price of each item purchased. Taxes arecalculated AFTER the buyer's premium. The Bidders PaymentType will not affect the Buyer Premium at an Online OnlyAuction. The buyer's premium includes commissions and/or fee'sretained by the Online Bidding Platform company.

18. If the foregoing conditions or any other applicable conditionsare not complied with, in addition to other remedies available toAuctioneer and Seller by law, including without limitation, theright to hold the purchaser liable for the bid price, theAuctioneer, at their option may (1) resell the property publicly orprivately, with purchaser being liable for the payment of anydeficiency plus all costs incurred, or (2) cancel the sale, retainingliquidated damages on all payments made by purchaser,Auctioneer commission and all other incidental damages will becharged.

19. Information in brochures, catalogs and other advertisementsare from sources believed to be reliable; however prospectivepurchasers are urged to inspect the inventory or property tosatisfy themselves as to condition, model, manufacturer, year,features, mileage, survey, acres, etc. Neither the Auctioneer orour client make any guarantees and are not responsible forlisting or advertising inaccuracies or discrepancies.

20. All statements made by the Auctioneer the day of the auctiontake precedence over oral statements and/or printed materials.

21. Local Pickup is recommended. There will be no Shippingavailable for this Auction to be provided by the Auction Co.Prompt pickup is required. Buyer responsible for bringing allTools, Manpower, Boxes & Packing materials to remove theitems in a timely manner.

Highbid User Ratings. Every bidder starts with a reputation of 0and, with activity, this score goes up or down to a value between-100 (very bad) and 100 (very good). Any bidder with areputation lower than +1 will have their auction bid permissionset to pending. We will verify your information if you are a newbidder with a reputation of "0". Once approved or declined youwill receive an email confirmation. 6. REVIEWING YOUR BIDS: During an auction you can checkthe status of your bids at anytime by logging into online server.Please be careful when placing bids. Placing a bid is a two stepprocess. When you click bid button it will pull up a windowverifying that you want to place that bid. If you want to place thenext bid increment that the computer is asking for you can dothat. If you desire to increase the amount of your bid this screenwill allow you to bid a higher amount. Ensure that you type inthe correct amount. If you make an error the Auction Co. canattempt to correct it but it has to be in a timely manner before theitem closes. In order to make a correction you must contact theAuction Co. at 410-835-0384. We have a staff member in theoffice during all online auctions. You are responsible for thebids that you place. Note that no bids can be withdrawn after theauction for any reason.

7. PROGRESSION OF THE AUCTION: Auctions are typicallyuploaded to the HiBid Auction Platform 30-45 days before theauction is scheduled to end. Some short notice auctions may beonline for only 15-30 Days. Each Auction will have a scheduledtime that each auctions items will begin closing. If an auctionstarts closing on a Wednesday night at 5 PM the first lot will bescheduled to close at that time. Depending on the quantity ofitems in the Auction lots may be scheduled to end anywherebetween 30 to 60 seconds a part. Each lot will show a scheduledending time. If no one bids in the final minute before a lot isscheduled to close that lot will close out. If someone bids withinthe final minute before that lot is scheduled to close, 1 Extraminute will be added to that lot and that lot only to allowadditional time for people to bid. The remaining lots behind thatlot will continue to close as scheduled unless someone bids inthe last minute on that specific lot as well. This is done toprevent a bidder from 'sniping', all bids made in the last minuteof the auction will force an item to stay open for an additional 1minute. This gives the back bidder additional time in increasehis/her bid if desired. This process will continue until all biddinghas ceased on no one bids within the additional minute that wasadded. 8. PAYING FOR YOUR PURCHASES: There is no cost toregister for an auction. Generally you will receive an "UNPAID"Auction Invoice on the day/night of the Auction immediatelyfollowing the sale. You will normally be afforded a period of12-24 hours to contact us and arrange an alternate paymentmethod. We generally process Credit Card transactions the dayafter the Auction at a specified time. If you don't contact usduring this period we will Charge the Credit Card that wasplaced on file at Registration for the Purchase price of your wonitems including Sales Tax and Buyers Premium. When anauction closes, if you are the winner, you must attend during thealotted Pick up time frame where you may pay cash, Approvedlocal Check, Visa, Mastercard, American Express or Discover. Ifyou do not pick up during the alotted time, we will charge yourcredit card with the winning bid amount, plus applicable Buyers



Premium and taxes. In addition if we move your items from theAuction site back to our facility you will be responsible for atransportation fee as stated in terms of auction. If your CreditCard is declined you can pay in person when you pick the itemsup.

9. BIDDING NOTIFICATIONS: You can choose to be notifiedby e-mail during the auction if you have been outbid. Please notethat outbid notifications are NOT sent out during the last twohours of the sale. You can watch each item end. If you are thehigh bidder on an item the item will be highlighted in Green inthe Live Auction area. If the lot changes from green to red itmeans that you have been outbid and would need to bid again Ata higher bid. The item will not change back to green until youhave surpassed the high bid that the back bidder placed.

10. RESERVE: Seldom are items sold with Reserve. If an item isbeing sold with a reserve, it will be clearly marked andidentified. For items sold with a 'reserve', you will be required topay a minimum amount in order to win the item.

11. REMOVAL OF ITEMS: All items are sold in place. Buyersare responsible to remove items in a good workmanlike manner.Any plumbing must be shut off before being disconnected andany electrical that is disconnected must be capped. You mustbring any and all tools, equipment required to disconnect andremove any items you purchase. You must bring any requiredlabor to assist in carrying your items from the home to yourvehicle. We will have staff onsite to assist buyers in finding theiritems but they will likely not be available to assist in any waywith removal of your items. Please plan ahead and comeprepared. You are expected to bring boxes, packing materials,tape, tools, wheel carts, dollies or anything else needed toremove your items in a timely manner. Any items not removedby the times shown will be deemed abandoned regardless of theprice. If you can't pick your items up during the time scheduled,you are responsible for designating someone to pick your itemsup during the time that we are scheduled to be there. Many ofthese auctions are conducted offsite in a consignor's home. Wehave contracted with that person the dates that we are providedaccess to the home. You have been advised of the preview andpickup dates prior to the auction. If you are unable or unwillingto pickup your items during the scheduled time please don't bidon the items unless you provide someone to pick your items upfor you.

12. RISK TO PERSON AND PROPERTY: BY REGISTERINGAS A BUYER, YOU AGREE THAT A&M AUCTIONEERS &APRAISERS., LLC & THE SELLER/CONSIGNOR ARE NOTLIABLE TO YOU FOR ANY DAMAGE TO THE ITEMSYOU PURCHASED, YOUR OTHER PERSONALPROPERTY, OR FOR INJURY OR DEATH. Please take careof yourself and your items as you have released us from liability.We will not be liable for damage or injury to individuals or their

property. Purchaser assumes all risk and liability whatsoeverresulting from the use of the item(s) sold hereunder; and shalldefend, indemnify, and save harmless Auctioneer and Sellerfrom any liability.

13. AUCTION RECORDS: In the unlikely event of a dispute,you agree to accept as true the information that we have in ourrecords.

14. ADDITIONS & DELETIONS: We reserve the right toremove and/or add lots and/or items to the sale at any pointduring the auction.

15. The Auctioneer reserves the right to accept bids in anyincrement he feels is in the best interest of his client, the Seller.The Auctioneer reserves the right to reject the bidding of anyperson whose conduct, actions, or adverse comments he feels arenot in the best interest of the Seller.

16. Titles will be disbursed on auction day only if payment ismade in cash; otherwise they will be mailed when the checkclears the bank. This will take approx.10 days for a personalcheck. If you replace a personal check with a local bank/cashier'scheck we will be able to hand you the title at that time.

17. SALES TAX: Sales tax will be added to the purchase of alltaxable items. Dealers who purchase for resale must file theirresale permit numbers. If you are Maryland Dealer you arerequired to have a Valid Sales & Use Tax License with the Stateof Maryland. We are required to verify that the license is Validbefore deducting Sales Tax. We will verify the Tax # that youprovide and print a Blanket Resale form for your to sign. Thisneeds to be completed before the billing process is initiated. Youcan't use someone else's Sales & Use License. For Bidders fromanother state we are required by the State of Maryland to have acopy of your State Business License/Tax License on file in ordernot to charge Tax.

BUYER'S PREMIUM: A premium of 15% of the bid price willbe added to the price of each item purchased. Taxes arecalculated AFTER the buyer's premium. The Bidders PaymentType will not affect the Buyer Premium at an Online OnlyAuction. The buyer's premium includes commissions and/or fee'sretained by the Online Bidding Platform company.

18. If the foregoing conditions or any other applicable conditionsare not complied with, in addition to other remedies available toAuctioneer and Seller by law, including without limitation, theright to hold the purchaser liable for the bid price, theAuctioneer, at their option may (1) resell the property publicly orprivately, with purchaser being liable for the payment of anydeficiency plus all costs incurred, or (2) cancel the sale, retainingliquidated damages on all payments made by purchaser,Auctioneer commission and all other incidental damages will be



charged.

19. Information in brochures, catalogs and other advertisementsare from sources believed to be reliable; however prospectivepurchasers are urged to inspect the inventory or property tosatisfy themselves as to condition, model, manufacturer, year,features, mileage, survey, acres, etc. Neither the Auctioneer orour client make any guarantees and are not responsible forlisting or advertising inaccuracies or discrepancies.

20. All statements made by the Auctioneer the day of the auctiontake precedence over oral statements and/or printed materials.

21. Local Pickup is recommended. There will be no Shippingavailable for this Auction to be provided by the Auction Co.Prompt pickup is required. Buyer responsible for bringing allTools, Manpower, Boxes & Packing materials to remove theitems in a timely manner.

23. The Auction Co. reserves the right to extend the bidding timeif an error should occur with the online server.

24. By registering for the Auction you hereby agree to receivemail and/or email correspondence from the auction Co. fromtime to time. Auctioneer uses email mailing lists to notifycustomers about online and live auctions. Customers who do notwish to be notified should contact the office of the Auctioneerand request removal from the email mailing list. You canunsubscribe at any time.

Police to conduct the Background Check. Most Maryland Residents will need to attain and posses a Handgun Qualification License that is issued by the Maryland State Police in order to Fill out the paperwork to purchase a handgun.

For firearms listed MD Banned (I.E. Most items that were on Maryland Assault Weapons Regulated Firearm List have now been banned for sale in the State of Maryland. All firearms listed as MD BANNED in the catalog

will need to be transferred to an FFL Licensed Firearms Dealer outside of the State of Maryland. These firearms can’t be transferred to you if you are a Maryland Resident These firearms can’t be handed out in the State of Maryland to Resident of a State where they are legal to own. They will only be transferred from our FFL to an FFL in your state to process the required paperwork in your state. It is imperative that you ensure the firearm can be legally owned in your Jurisdiction. Once the firearm has been shipped out of Maryland it can’t come back to our FFL Dealer. There will be a $15 transfer Fee + the cost of shipping to your FFL. Our FFL will either ship or hand deliver your REGULATED to a Dealer of your choice. The choice of whether to ship or deliver will be at the discretion of our FFL. We apologize for any inconvenience this may cause. Transfer time frames: Most Non-Regulated Rifles & Shotguns can have an instant Federal Background Check completed at the time of sale and you can take the Firearm with you the Day of the Auction (MD, DE, VA,

WV & PA Residents Only). For MD Residents it is imperative that prospective buyers attain an HQL license from the MD State Police. This HQL card is required to be shown to the FFL prior to filling out of paperwork. It should be understood that the Maryland 7 Day Waiting Period begins on the day that the paperwork is submitted to the State Police. It may take us a week + to get the paperwork finalized and submitted. At the earliest I would not expect MD Handgun Paperwork to start coming back for 14-18 Days after the Sale Date. If you want it quicker we will gladly ship it to another FFL Dealer for them to process. They can also pickup the firearm directly from us.

External Lock/Integral Internal Lock Information for Maryland Handgun Buyers: (1) A dealer may not sell, offer for sale, rent, or transfer in the State a handgun manufactured on or before December 31, 2002, unless

the handgun is sold, offered for sale, rented, or transferred with an external safety lock. (2) On or after January 1, 2003, a dealer may not sell, offer for sale, rent, or transfer in the State a handgun manufactured on or after January 1, 2003, unless the handgun has an integrated mechanical safety device. For MD handgun purchaser firearms that fall under category #1 we will have cable clocks for sale for $5-7.50 depending on the length required. For MD handgun purchasers that fall under category #2 we will have a limited # of Integral Safety devices available for sale for $30.00. Either can be negated if you bring an approved lock with you when you pickup your firearm. If you need to Purchase an Integral lock please let us know at the time you are filling out your paperwork. We may have to order it.

Condition: All property is sold “As Is, Where Is”, and All Sales are Final. Property is open to thorough public inspection. It is the Bidder’s responsibility to determine condition, age, genuineness, authenticity, value or any other determinative factor. All Model #’s, Calibers, Gauges, Dates of Manufacture and measurements are approximate and should be considered +/-.

Gun Transfer/Required Paperwork Information – If you have questions please ask before you buy.

1. All required Local, State & Federal laws will be adhered to in transferring any and all firearms in the auction sale. This is non-negotiable. If you do not want to fill out the required paperwork please do not purchase any item for which paperwork is required. 2. If you are not allowed by law to purchase or own a firearm for any reason do not purchase one. If you are not eligible to purchase or own a firearm it is your responsibility to

know. There shall be no refunds of any kind if you are unable to transfer a firearm into your name or do not pass the background check. We will gladly resell the firearm at a time of our choosing.

3. The actual buyer of the firearm must fill out the required paperwork. Make sure when you check in you register under the name that

the paperwork will be filled out in. You will need to bring your receipt to the FFL dealer and the name on the receipt must match the name the paperwork is being filled out in. It is against the law for you to fill out the paperwork in your name and then give the firearm to someone who may not be able to legally own that firearm. Known as a "Straw Purchase".

4. Identification/Photo ID required. You must bring a valid/current identification as to who you are in order to register for the auction and complete the required paperwork to

transfer a firearm. This also applies to FFL Dealer & C & R License holders. Your name or business must be listed on the license in order to use it. Another person’s license cannot be used by any individual other than the person/business named on the license to receive a firearm.

5. You must be at least 18 years of age to purchase a non regulated rifle or shotgun or ammo. You must be at least 21 years of age to

purchase a pistol, regulated firearm (AR-15, AK-47ect…), pistol grip shotgun or Handgun Ammo. __________________________________________________________________________________________________________________________________________________________________________________________________________

_____________________________________________________________ Antique/Black powder Rifle/Pistol/Shotgun Information - Most Black powder Rifles, Pistols & Shotguns do not require any paperwork in the State of Maryland and can be handed out on the day of the Auction. There are a few exceptions! Some black powder firearms now use Smokeless propellant and are regulated. Some firearms that have interchangeable barrels are also regulated. Curio & Relic Information - Some firearms may fall under the ATF Curio & Relics licensing and if they are purchased by an individual with a "C&R License" no paperwork is required. NOTE: Items that meet the age requirements but have been altered from their original configuration may NOT be delivered on a C&R License. The determination of whether a firearm falls under the "Curio & Relic" shall be made by the discretion of Jeff Smith of Smitty's Gun Shop (our FFL dealer) and his word shall be final. Associated Fee's for the Required Paperwork/Transferring the firearm(s) to you. Allen & Marshall Auctioneers & Appraisers, LLC is the New FFL Dealer & will be completing the required paperwork. You will be responsible for paying them. They will accept cash, checks or Amex/Visa/MC/Disc.

Modern Rifles/shotguns - A transfer fee of $30 will be collected on each MODERN rifle/shotgun purchased. We can transfer to Residents of MD, VA, WV, PA & DE.

Modern Pistols/Regulated Firearms - A transfer fee of $45 (We are still Collecting the $10 fee for the State of MD) will be collected on each Regulated Firearm purchased for Residents of MD. Allen & Marshall Auctioneers and Appraisers, LLC is has a MD Regulated Firearms Dealers License. All firearms listed as REGULATED in the Catalog will need to be transferred to an through Maryland New Online Licensing Portal (https://licensingportal.mdsp.maryland.gov/MSPBridgeClient/#/home) If you are a Maryland Resident with an HQL you will need to visit the website, create an account, fill out the paperwork online and attain a Tracking # upon completion. You provide us that tracking # and then we can access your application through the Dealer side of the Website. We attach your Firearm info to your Application and forward it to the MD State Police. This is the only way to purchase a Pistol in the State of Maryland at this time. The old Paperwork is no longer being accepted as of January 1st, 2017. C & R License holders - A transfer fee of $10 per C&R firearm will be charged. You must have an original signed copy of the required paperwork/C & R License. (Preferably signed in blue/red ink) Non Maryland Handgun/Regulated Firearm Buyers or Long gun Purchasers not from MD, DE, VA, WV, PA. - A transfer fee of $15 per modern firearm will be charged + the cost to ship the item. Integral Internal Lock – For Maryland handgun purchasers only. Required for Pistols made after Dec. 31, 2002. Will be notated in the catalog. Cost is $30.00. Can be negated if you provide an approved lock at the time the pistol is picked up. Lock must be an Internal Lock approved by MD State Police. Can’t be a padlock/cable lock.

Maryland Banned Firearms: Due to recent changes in Maryland’s Firearm Laws some firearms in the Auction are banned for sale in the State of Maryland. Those firearms will be Notated that way in the catalog as they are not transferable to Residents of Maryland. These firearms can only be transferred out of State of MD to a resident of another State who lives in a jurisdiction where they are able to legally purchase that type of firearm. It is
