Problem of consistency between limits set for DON: explanations

• DON level for fine bakery wares are TODAY at 500 ppb• DON level for Flour is at 750 ppb• DON level for unprocessed cereals is at 1250 ppb• If fine bakery wares (biscuits) are above 65 % content of

cereals containing a mixture of flour (750 pp) and grain inclusion (1250 ppb) IT IS IMPOSSIBLE TO COMPLY with fine bakery wares level of 500 ppb.

• A simple mathematical formula demonstrates this:product composition = 50 % of flour (375 ppb) + 15 % grain

CAOBISCO proposal:• Need of Consistency between limits for categories of materials and products. Due to

severe climate conditions, levels of fusarium toxins in wheat were very high in crops harvested in 2007-2008 and 2008-2009. This makes it very difficult for our industry to comply with the regulatory limits for toxin fusarium that have been set for our products.

• CAOBISCO proposes a level of 750 ppb ONLY for fine bakery wares with a cereals content above 65 % (example 1). As many of these products claim the cereal content on pack, quantitative declaration of ingredients (QUID) is applicable, as it is foreseen by the EU labelling legislation. In this case, controls and enforcement can be assisted by the information on the label.

• For fine bakery wares below 65 % level for DON will remain at 500 ppb (example 2).• CAOBISCO made an exposure assessment with CAOBISCO consumption figures and the

latest French consumption data available (France is one of the biggest consumers of fine bakery wares and bread substitutes), using the proposed level of 750 ppb for fine bakery wares with a cereal content above 65% and for maize-based snacks. CAOBISCO proposal increases overall exposure to DON of 10 % for average consumers and of 6% for high level consumers of CAOBISCO products (biscuits+ bread substitutes). This exposure is calculated assuming that ALL biscuits + bread substitute products are at maximum level of DON. Most of the high cereal content biscuits are very dry, do not taste sweet, and therefore are primarily marketed for ADULTS.

Impact of DON regulation inconsistency

Finished goods manufacturers should be allowed limits lower than in the regulation which have an overall knock-on effect:

• Wheat flour 500ppb => Wheat grain 500-1000ppb vs 1250ppb• Wheat bran 750ppb => Wheat grain 250ppb vs 1250ppb

DON Management in wheat

Bran used as Raw material: which level of DON to apply ?

Different levels of understanding concerning the level of DON for bran used as raw materials: CAOBISCO interpretation that raw materials such a bran or germ used in manufacturing of fine bakery wares are covered by the toxins fusarium legislation and by the food category named ‘unprocessed cereals’ for which a level of 1250 ppb for DON should be applied.
