    he path that #e, as a nation, #ill ta!e has already been decided by Congress, as representatives of the people, under our syste" of govern"ent. he tas! before the Court, then, is not to say #hich

    path #e ought to ta!e but to deter"ine if the chosen path treads on unconstitutional grounds. Butthis is not all. 3or the Court, #hich #as once generally a passive organ in our constitutional order,has been given expanded po#ers under the present Constitution. 8t is no# not only its right but itsbounden duty to deter"ine grave abuse of discretion on the part of any branch, instru"entality or agency of govern"ent,0 and, e7ually i"portant, it has been given the po#er to issue rules for theprotection and enforce"ent of constitutional rights. * he Court cannot, therefore, re"ain an idlespectator or a disinterested referee #hen constitutional rights are at sta!e. 8t is its duty to protect anddefend constitutional rights for other#ise its raison d&etre #ill cease.

And there is no obstacle for the la#&s opponents to continuefighting the good fight in the halls of Congress, if they so choose. hus, the Court #ill refrain fro"ruling on the validity of the R/ 2a# based on its #isdo" or expediency.

    his is not to say, ho#ever, that this la# is beyond ?udicial scrutiny.
