It is a criminal traffic offense in Florida to participate in street racing or drag racing.

Existing Law –

In a recent Florida Appellate Case the court found the term “racing” to be unconstitutionally vague.

Notably, the term “drag race” was not considered nor was it ruled upon by the Wells court.

Enforcement –

Since the Wells case, Orange County Sheriff’s Deputies will arrest a suspect in an illegal race only if the officer has probable cause to believe that the suspect was engaging in a “drag race”.
