EXECUTIVE SUMMARY

LandAmerica Assessment Corporation (LAC) has performed a Phase I Environmental Site Assessment (ESA) in general accordance with ASTM 1527-00 for the residential complex located at 4827 Sepulveda Boulevard, Sherman Oaks, California (the “Property”).

The Phase I ESA is designed to provide m. david paul & associates with an assessment concerning environmental conditions (limited to those issues identified in the report) as they exist at the Property. This assessment was conducted utilizing generally accepted ESA industry standards in accordance with ASTM E 1527-00, Standard Practice for ESAs: Phase I ESA Process.

The Property consists of an irregularly shaped parcel approximately 5.0 acres in size. The Property is currently developed for a combination of single-family and multi-family residential use. A multi-story office building that was constructed in 1978, was formerly located on the northeastern portion of the Property. The remainder of the Property is occupied by three two-story apartment buildings on the eastern portion of the Property and nine single-family residential buildings scattered on the central and western portions of the Property. The apartment buildings are provided with tucked under parking garages and the buildings consist of a total of 24 residential units with six two-bedroom units, six studio units, and twelve one-bedroom units. Asphalt-paved open parking area and travel lanes are also provided for the occupants of the Property.

The Property is situated within an urban area in Sherman Oaks, California. The Property is bound to the north by US Highway 101, beyond which is vacant land and residential buildings; to the east by Sepulveda Boulevard, beyond which are residential and commercial office and retail buildings; to the south by Camarillo Street, and beyond by commercial office and retail buildings; and to the west by Peach Avenue, La Maida Street and Interstate 405, beyond which are residential buildings. Based upon topographic map interpretation and site observations, groundwater flow beneath the Property is inferred to be in a northeasterly direction.

LAC obtained and reviewed a database report from Environmental Data Resources (EDR) for the Property and the surrounding area. Based on the database report, no upgradient sites were identified as potential concerns to the Property. LAC did identify six leaking UST (LUST) sites located within the prescribed search radii. None of the LUST listings identified in the database is suspected to have an adverse environmental impact on the Property based on one or more of the following: distance from the Property; down or cross-gradient location with respect to the Property; the nature of the reported release (e.g., soil only); and/or the regulatory status (e.g., case closed, remediation action underway).

Conclusions LAC has performed a Phase I ESA in conformance with the scope and limitations of ASTM Practice E 1527-00 of 4827 Sepulveda Boulevard, Sherman Oaks, California, the Property. Any exceptions to or deletions from this practice are described in Section 1.4 of this report. This assessment has revealed no evidence of recognized environmental conditions in connection with the Property; however, the following pertinent non-ASTM issue warrants mention:

• Suspect asbestos-containing materials were observed during LAC’s assessment and one sample of damaged material was collected and submitted for analysis. Laboratory analyses reported that this sample did not have asbestos concentrations above the method detection limit of 1% by weight. Nonetheless, based on the date of construction of the Property buildings, ACMs may be present at the Property.


Recommendations Based on the findings of this ESA, LAC recommends the following:

• Prior to the disturbance of any suspect ACM in this facility, a comprehensive asbestos survey, designed to determine if the suspect ACM is a regulated material, is recommended. If such materials are identified and need to be disturbed, repaired or removed, a licensed abatement contractor should be consulted. Suspect ACM can be managed under the auspices of an Operations and Maintenance (O&M) plan.

The following table summarizes the findings of the significant elements of this investigation.

1.0 INTRODUCTION

LandAmerica Assessment Corporation (LAC) was retained by m. david paul & associates to conduct a Phase I Environmental Site Assessment (ESA) of the Residential Complex located at 4827 Sepulveda Boulevard, Sherman Oaks, California (the “Property”). The protocol used for this assessment is in general conformance with ASTM E 1527-00, Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process.

On October 30, 2006, Darrin Domingo, a representative of LAC, conducted a site reconnaissance to assess the possible presence of petroleum products and hazardous materials at the Property. LAC’s investigation also included review of aerial photos, reconnaissance of adjacent properties, background research, and review of available local, state, and federal regulatory records regarding the presence of petroleum products and/or hazardous materials at the Property.

LAC contracted Environmental Data Resources Inc. (EDR), of Milford, Connecticut, to perform a computer database search for local, state, and Federal regulatory records pertaining to environmental concerns for the Property and properties in the vicinity of the Property (see Section 3.0).

1.1 Purpose The purpose of this Phase I Environmental Site Assessment (ESA) was to identify existing or potential Recognized Environmental Conditions (as defined by ASTM Standard E-1527-00) in connection with the Property. LAC understands that the findings of this study will be used by m. david paul & associates to evaluate a pending redevelopment of the Property.

1.2 Scope of Services The scope of work for this ESA is in general accordance with the requirements of ASTM Standard E 1527-00. LAC warrants that the findings and conclusions contained herein were accomplished in accordance with the methodologies set forth in the Scope of Work. These methodologies are described as representing good commercial and customary practice for conducting an ESA of a property for the purpose of identifying recognized environmental conditions. No other warranties are implied or expressed.

1.3 Assumptions There is a possibility that even with the proper application of these methodologies there may exist on the Property conditions that could not be identified within the scope of the assessment or which were not reasonably identifiable from the available information. LAC believes that the information obtained from the record review and the interviews concerning the site is reliable. However, LAC cannot and does not warrant or guarantee that the information provided by these other sources is accurate or complete. The methodologies of this assessment are not intended to produce all inclusive or comprehensive results, but rather to provide m. david paul & associates with information relating to the Property.

1.4 Limitations and Exceptions The findings and conclusions contain all of the limitations inherent in these methodologies that are referred to in ASTM 1527-00. Specific limitations and exceptions to this ESA are more specifically set forth below:

• LAC was able to view only three of the nine single-family residential buildings and 12.5% of the total current residential units on the apartment buildings on the Property. Access was based on agreement with the Client.


1.5 Special Terms and Conditions The conclusions and findings set forth in this report are strictly limited in time and scope to the date of the evaluations. The conclusions presented in the report are based solely on the services described therein, and not on scientific tasks or procedures beyond the scope of agreed-upon services or the time and budgeting restraints imposed by the client. No subsurface exploratory drilling or sampling was done under the scope of this work. Unless specifically stated otherwise in the report, no chemical analyses have been performed during the course of this ESA.

Some of the information provided in this report is based upon personal interviews, and research of available documents, records, and maps held by the appropriate government and private agencies. This is subject to the limitations of historical documentation, availability, and accuracy of pertinent records, and the personal recollections of those persons contacted.

1.6 Use Reliance All reports, both verbal and written, are for the benefit of the Client. This report has no other purpose and may not be relied upon by any other person or entity without the written consent of LAC.

2.2 Location and Legal Description The address of the Property is 4827 Sepulveda Boulevard, Sherman Oaks, California. The Property is located in an urban area of Los Angeles County. According to Los Angeles County Recorder’s Office, the assessor’s parcel number of the Property is 2264-002-033. The abbreviated legal description is reproduced below:

“Parcel 1: LOT COM AT SW COR OF LOT A TH E 264.86 FT TH N 288.32 FT TH SW ON SE LINE OF VENTURA FRWY TO C/L OF PEACH AVE VAC TH S ON SD C/L TO N LINE OF LA MAIDA ST TH E THEREON AND S ON W LINE OF PEACH AVE, in the City of Sherman Oaks, County of Los Angeles, State of California, as per maps filed in the office of the Los Angeles County recorder.”

According to the Los Angeles Tax Assessor’s office, the Property is currently owned by Freesep Investors, who has owned the Property since 1981.

2.3 Site and Vicinity General Characteristics The Property is located in an urban area that is characterized by numerous commercial and residential structures.

The Property consists of an irregularly shaped parcel approximately five acres in size. The Property is designed and used for residential purposes. Currently, the Property is developed with three apartment buildings and nine single-family residential structures. The apartment buildings at the Property are two stories in height and the single-family residential buildings are single-story in height. The apartment buildings offer a total of 24 residential spaces.


2.4 Current Use of the Property Currently, the Property is developed with nine single-family and three multi-family residential buildings that were constructed in 1960s. The apartment buildings are equipped with tucked under parking garages. The single family residential buildings are designated by the following addresses: 4804 and 4810 Peach Street; and 15311, 15339, 15343, 15347, 15357 Camarillo Street, 15342, and 15346 La Maida Street. The apartment structures offer eight residential units in each building and are designated by the following addresses: 4805, 4809 and 4815 Sepulveda Boulevard. The Property is improved with asphalt paved open parking area and travel lanes.

According to source the Property is zoned {Q}CR-1L (Limited Commercial); R3-1L (Multiple Dwelling); R1-1L (One-Family); {Q}P-1L (Automobile Parking) and R1-1L (south of LaMaida Street); and by the City of Los Angeles. Based on the information reviewed during the preparation of this report and the observations made during the reconnaissance of the Property, the structures are used as residential units and no hazardous chemicals or petroleum substances are being generated onsite.

2.5 Description of Site Improvements The structures on the Property are constructed of conventional wood framing with concrete slabs-on-grade. The exterior walls for the three apartment buildings have painted stucco surfacing, while the single-family residential buildings are covered with painted wood panel sidings. The interior finishes are comprised of painted gypsum wallboard walls and ceilings. Carpeting covers the majority of interior floors, with resilient floor tiles present in some of the kitchens and restrooms of the residential units. Flat built-up roofing systems cover each of the three apartment building roofs while hipped, standard three-tab asphalt shingles cover the single-family residential buildings.

The Los Angeles Department of Water and Power (LADWP) supplies drinking water to the Property from the municipal distribution system. Sanitary discharges on the Property are discharged into the municipal sanitary sewer system. The Property area is serviced by the Waste Management for its solid wastes.

Heating and cooling are provided by thru-wall DX units and rooftop mounted HVAC units. Electricity is provided to the Property by LADWP. Natural gas is provided by The Gas Company.

2.6 Current Use of Adjoining Properties During the vicinity reconnaissance, LAC observed the following land use on properties in the immediate vicinity of the Property.

North: Areas immediately adjacent to the north include the following: US Highway 101, with vacant land and residential buildings beyond.

South: Areas immediately adjacent to the south include the following: Camarillo Street, with commercial office and retail buildings beyond.

East: Areas immediately adjacent to the east include the following: Sepulveda Boulevard, with residential and commercial (parking garage) and retail buildings beyond.

West: Areas immediately adjacent to the west include the following: Peach Avenue, La Maida Street and Interstate 405, with residential buildings beyond.


3.0 RECORDS REVIEW

3.1 Standard Environmental Record Sources 3.1.1 State and Federal Regulatory Review

Information from standard Federal and state environmental record sources was provided through Environmental Data Resources (EDR). Data from governmental agency lists are updated and integrated into one database, which is updated as these data are released. This integrated database also contains postal service data in order to enhance address matching. Records from one government source are compared to records from another to clarify any address ambiguities. The demographic and geographic information available provides assistance in identifying and managing risk. The accuracy of the geocoded locations is approximately +/-300 feet.

In some cases, location information supplied by the regulatory agencies is insufficient to allow the database companies to geocoded facility locations. These facilities are listed under the unmappables section within the EDR report. A review of the unmappable facilities indicated that none of these facilities are within the ASTM minimum search distance from the Property. Regulatory information from the following database sources regarding possible recognized environmental conditions, within the ASTM minimum search distance from the Property, was reviewed. Specific facilities are discussed below if determined likely that a potential recognized environmental condition has resulted at the Property from the listed facilities. Please refer to Appendix C-1 for a complete listing.

Federal NPL

The National Priorities List (NPL) is the Environmental Protection Agency (EPA) database of uncontrolled or abandoned hazardous waste sites identified for priority remedial actions under the Superfund Program.

The Property is not listed as a NPL facility. No NPL sites are located within one mile of the Property.

Federal CERCLIS List

The Comprehensive Environmental Response, Compensation and Liability Information System (CERCLIS) list is a compilation of sites that the EPA has investigated or is currently investigating for a release or threatened release of hazardous substances.

The Property is not listed as a CERCLIS facility. No CERCLIS sites are listed within one-half mile of the Property.

Federal CERCLIS NFRAP Sites List

The CERCLIS No Further Remedial Action Planned (NFRAP) List is a compilation of sites that the EPA has investigated, and has determined that the facility does not pose a threat to human health or the environment, under the CERCLA framework. .

The Property is not listed as a CERCLIS-NFRAP facility. No CERCLIS-NFRAP sites are listed on or adjoining the Property.


Federal Resource Conservation and Recovery Act (RCRA) CORRACTS TSD Facilities List

The EPA Resource Conservation and Recovery Act (RCRA) Program identifies and tracks hazardous waste from the point of generation to the point of disposal.

The RCRA Treatment, Storage and Disposal (TSD) database is a compilation by the EPA of reporting facilities that treat, store or dispose of hazardous waste. The CORRACTS database is the EPA’s list of treatment storage or disposal facilities subject to corrective action under RCRA.

The Property is not listed as a RCRA CORRACTS TSD facility. No RCRA CORRACTS TSD facilities are listed within one mile of the Property.

Federal Resource Conservation and Recovery Act (RCRA) Non-CORRACTS TSD Facilities List

The RCRA TSD database is a compilation by the EPA of reporting facilities that treat, store or dispose of hazardous waste.

The Property is not listed as a RCRA-TSD facility. No RCRA TSD sites are listed within one-half mile of the Property.

Federal RCRA Generator List

The RCRA program identifies and tracks hazardous waste from the point of generation to the point of disposal. The RCRA Generators database is a compilation by the EPA of reporting facilities that generate hazardous waste.

The Property is not listed as a RCRA facility. No RCRA Generator facilities are listed on the Property or on the adjacent properties.

Federal Emergency Response Notification System (ERNS)

The Emergency Response Notification System (ERNS) is a national database used to collect information or reported release of oil or hazardous substances.

No ERNS sites were listed on the Property or on the adjacent properties.

State Priority List

The Department of Toxic Substance Control (DTSC) maintains Annual Work Plan, a State Priority List (SPL) of sites considered to be actually or potentially contaminated and presenting a possible threat to human health and the environment.

The Property is not listed as a SPL facility. No SPL sites are listed within one mile of the Property.

State CERCLIS-Equivalent List

The DTSC maintains Calsites, a State CERCLIS-equivalent list (SCL) of sites under investigation that could be actually or potentially contaminated and presenting a possible threat to human health and the environment.

The Property is not listed as a State CERCLIS facility. No SCL sites are listed within one-half mile of the Property.


Solid Waste/Landfill Facilities (SWLF)

A database of SWLF is prepared by California Integrated Waste Management Board.

The Property is not listed as a SWLF facility. No SWLF facilities are listed within one-half mile of the Property.

State Leaking Underground Storage Tank List (LUST)

The California Regional Water Quality Control Board (RWQCB) compiles lists of all leaks of hazardous substances from underground storage tanks.

The Property is not listed as a LUST facility. Six (6) LUST sites are listed within one-half mile of the Property. Of the six facilities, all are located over one-quarter mile from the Property, with three designated ‘case closed’ with the lead agency. The remaining sites are located cross gradient from the Property and are in the remediation phase with a responsible party identified. Given the distance, relative gradient and/or current regulatory status, the LUST facilities are not considered likely to impact the Property.

State Underground Storage Tank List (UST)

The California RWQCB compiles a list of UST locations.

The Property is not listed as an UST facility. No registered UST facilities are listed adjacent to the Property.

ASTM and Non-ASTM Supplemental Database Lists

The EDR report contains a variety of supplemental ASTM and non-ASTM databases.

The Property and adjoining parcels are not listed on the supplemental ASTM and non-ASTM databases.

3.1.2 Local Regulatory Review

3.1.2.1 County Recorder/ Assessor

According the Los Angeles County Recorder’s Office, no environmentally related liens or deed restrictions have been recorded against the Property.

3.1.2.2 Fire Officials

LAC submitted a FOIA request to the Los Angeles Fire Department for information regarding storage tanks, chemical spills, and other potential environmental concerns in connection with the Property. As of the date of this Report, LAC has not received a response to this inquiry. Upon receipt of the agency response, if the provided information has a material affect on the findings of this Report, LAC will forward the new information, together with revised findings, as an addendum to this Report. If no response is received or no material violations are noted, LAC’s report will not be modified.


3.1.2.3 Building Department

Records from Los Angeles Building Department were reviewed for evidence indicating the developmental history of the Property, and for the presence of documentation relative to underground storage tanks. The records indicate the current Property structures were constructed in the 1960s and 1970s. Documentation reviewed did not reveal information such as the existence of USTs or the importation of fill on the Property. No permits for previous Property uses were identified in the file. This suggests no official development of the Property, other than that outlined in Section 3.3 (office building on the northeastern corner), took place prior to construction of the existing improvements.

3.1.2.4 Other Agencies

LAC submitted a FOIA request to the County of Los Angeles Health Department for environmental information such as reported cases of lead poisoning pertaining to the Property. As of the date of this Report, LAC has not received a response to this inquiry. Upon receipt of the agency response, if the provided information has a material affect on the findings of this Report, LAC will forward the new information, together with revised findings, as an addendum to this Report. If no response is received or no material violations are noted, LAC’s report will not be modified.

3.2 Physical Setting Sources 3.2.1 Topography

The United States Geological Survey (USGS), Quadrangle Van Nuys, CA 7.5-Minute series topographic map was reviewed for this ESA. This map was published by the USGS in 1966 and was photorevised in 1972. According to the contour lines on the topographic map, the Property is located at approximately 690 feet above mean sea level (MSL). The contour lines in the area of the Property indicate the area is sloping moderately to the northeast direction. The topographic map does not identify individual buildings or development on the Property due to the concentration of structures, but rather shows the area in pink denoting urbanized use, and identifies only landmarks as distinct structures.

No surface waters are depicted as present on or adjacent to the Property, nor are production wells or other significant surface features depicted on the USGS map.

3.2.2 Soils/Geology

The Property is situated in the subsection, which consists of the Los Angeles Plain and the San Fernando Valley and includes the Verdugo Mountains, San Rafael Hills, and Palos Verdes Hills. This subsection contains mainly Quaternary alluvium consists of nearly level floodplains and terraces and very gently to gently sloping alluvial fans. There are small areas of marine terraces, but they are relatively inextensive compared to fluvial terraces. Steep mountains and moderately steep hills are small but important parts of the subsection.

The soils are mostly Typic Xerorthents and Typic and Mollic Haploxeralfs. The soils are well drained. Carbonates accumulate in some of the soils.


3.2.3 Hydrology

Under natural, undisturbed conditions, shallow groundwater flow generally follows the topography of the land surface and on this basis; the topography suggests that groundwater flow across the site is in a northeastern direction. However, localized conditions can alter flow directions and thus the expected flow may not coincide with actual groundwater flow in the subject area. Groundwater depths and flow gradients are best evaluated by a subsurface investigation involving the installation of at least three groundwater-monitoring wells and precise measurements of hydrostatic pressure. Monitoring wells were not observed on the Property.

The nearest natural water body in the vicinity of the Property is the Los Angeles River located approximately ¼-mile north of the Property. No settling ponds, lagoons, surface impoundments, wetlands or natural catchbasins were observed at the Property during this investigation. According to the EPA website, the Property does not overlie a sole source aquifer.

3.2.4 Flood Zone Information

A review of the Flood Insurance Rate Maps, published by the Federal Emergency Management Agency, was performed. According to Panel Number 0601370044C, the Property is located in Flood Zone C. Flood Zone C regions consist of areas that are determined to be outside the 100- and 500-year floodplains.

3.2.5 Oil and Gas Exploration

The on-site reconnaissance addressed oil and gas exploration at the Property. No evidence of oil or gas wells or the drilling of oil and gas wells was observed on site. In addition, LAC’s review of the State of California and the Department of Conservation/Division of Oil, Gas, and Geothermal Resources Map dated 2001 did not indicate any onsite oil, gas, or geothermal fields on or in the vicinity of the Property.

3.3 Historical Use Information LAC’s review of the historical information indicated that the Property was developed with scattered single-family residential structures from at least the 1920’s. The Property was developed with an apartment building on the northern portion of the Property in the mid-1940s. The apartment building was demolished in the 1950s. In the 1960s, the Property was improved with three multi-family residential buildings on the southeastern portion of the Property. In the late 1970s, an additional commercial office building was developed on the northern portion of the Property. The Property was historically occupied for residential use with the exception of the a commercial office building located on the northern portion of the Property. The office building was recently demolished in early 2006 and, as of this writing, heavy construction is currently being undertaken at the Property.

The current Property buildings have not been utilized for environmentally sensitive purposes, such as photo developing or dry cleaning.

3.3.1 Aerial Photographs

Available aerial photographs dated 1928, 1938, 1947, 1952, 1960, 1968, 1971, 1976, 1982, 1994 and 2002, from GeoSearch were reviewed for this ESA. Copies of selected photographs are included in Appendix B-1 of this report. The photographs are discussed below:

3.3.2 Fire Insurance Maps

Sanborn Maps constitute a source of prior site uses of real property for many cities and towns in the United States. The maps were originally created to assist insurance underwriters in understanding the potential fire risk of structures requiring insurance; however, they are also useful in determining the previous uses of a property. Sanborn Maps often contain information relating to uses of individual structures, location of certain petroleum and chemical storage tanks, and the storage of other potentially toxic substances. Sanborn Maps begin their coverage in 1867 and continue through the 1990s.

LAC requested historical Sanborn Fire Insurance maps for the Property from Environmental Data Resources (EDR), and was subsequently informed that no such maps for the Property or immediate vicinity are maintained in EDR’s collection, which ranges from 1887-1994. A copy of the “no coverage” notification is included in Appendix B, herein.

3.3.3 City Directories

Historical City directories, published by Haines City Directories, were reviewed at Haines & Company in Fullerton, California for past names and businesses that were listed for the Property and adjoining properties. The findings are presented in the following table:

The review of historical street directories shows that the Property was occupied by residential units from at least 1971. In 1981, the historical street directories list one of the addresses of the Property (4827 Sepulveda Blvd.) as occupied by a commercial office building. The surrounding properties were listed as primarily residences with some commercial tenants. The review of historical street directories did not indicate any obvious evidence of past industrial, manufacturing, liquid storage or environmental degradation at the Property or adjoining properties activities that may have impacted the environmental integrity of the Property.

3.3.4 Chain of Title

A 50-year chain-of-title was not requested for this study. Historical use of the Property was researched using other standard historical sources.

3.3.5 Additional Environmental Record Sources

Although requested, no previously prepared environmental reports such as Phase I or II Environmental Site Assessments, lead-based paint surveys, lead-in-water surveys, asbestos surveys or geotechnical reports were provided for LAC’s review.


3.3.6 Historical Use Information on Adjoining Properties

By review of the standard historical sources referenced above, the historical uses of the adjoining properties are summarized below:

North: Areas immediately adjacent to the north of the Property were historically recorded as residential development from at least 1938.

South: Areas immediately adjacent to the south of the Property were historically recorded as residential development from at least 1952. Prior to 1952, the area was vacant land.

East: Areas immediately adjacent to the east of the Property were historically recorded as residential development from at least 1947. Prior to 1947, the area was vacant land.

West: Areas immediately adjacent to the west of the Property were historically recorded as residential development from at least 1947. Prior to 1947, the area was vacant land.


4.0 SITE RECONNAISSANCE

The Property was inspected by Darrin Domingo, REA II, CHMM, on October 30, 2006. The weather at the time of the site visit was clear. Mr. Jim Scott, Building Maintenance manager, provided site access. LAC was given access to only three of the single-family residential buildings and approximately 12.5% of the total current residential units of the apartment buildings on the Property (per agreement with the Client).

4.1 General Site Characteristics 4.1.1 Solid Waste Disposal

Solid waste on the Property is collected in waste bins situated within the perimeter of the Property. The solid waste is collected once a week by Waste Management. The dumpsters were noted to contain miscellaneous cardboard at the time of the Property reconnaissance and no indication of potentially hazardous material disposal was noted during LAC’s reconnaissance.

4.1.2 Surface Water Drainage

Storm drains are located in various locations throughout the parking lots, along curbs and in landscaped areas, which discharge to the municipal stormwater management system.

4.1.3 Wells and Cisterns

No aboveground evidence of wells or cisterns was observed during the site reconnaissance.

4.1.4 Wastewater

No indications of industrial wastewater disposal or treatment facilities were observed during the on-site reconnaissance.

4.1.5 Additional Site Observations

No additional relevant general site characteristics were observed.

4.2 Potential Environmental Conditions 4.2.1 Hazardous Materials and Petroleum Products Used or Stored at the Site

No evidence of the use of hazardous materials or wastes was observed on the Property.

4.2.1.1 Unlabeled Containers and Drums

No unlabeled containers or drums were observed during the site reconnaissance.

4.2.1.2 Disposal Locations of Regulated/ Hazardous Waste

No obvious indications of hazardous waste generation, storage or disposal were observed on the Property or were indicated during interviews.

4.2.2 Evidence of Releases

No obvious indications of hazardous material or petroleum product releases, such as stained areas or stressed vegetation, was observed during the site reconnaissance or reported during interviews.


4.2.3 Polychlorinated Biphenyls (PCBs)

No electrical equipment expected to contain PCBs was observed on the Property during LAC’s reconnaissance.

4.2.4 Landfills

No evidence of on-site landfilling was observed or reported during the site reconnaissance.

4.2.5 Pits, Ponds, Lagoons, Sumps, and Catch Basins

No evidence of on-site pits, ponds or lagoons was observed or reported during the site reconnaissance. No evidence of sumps or catch basins, other than used for stormwater removal, was observed or reported during the site reconnaissance.

4.2.6 On-Site ASTs and USTs

No evidence of aboveground or underground storage tanks was observed during the site reconnaissance or reported during interviews.

4.2.7 Radiological Hazards

No radiological substances or equipment was observed or reported stored on the Property.

4.2.8 Drinking Water

The Property is connected to the city water supply provided by LADWP. According to a LADWP representative, the drinking water supplied to the Property is within state and federal standards, including lead and copper.

4.2.9 Additional Hazard Observations

No additional hazards were observed on the Property. In particular, no evidence of mold was noted.

4.2.10 Asbestos-Containing Materials (ACM)

In accordance with the Scope of Services, LAC has conducted a limited, visual evaluation of interior, accessible areas for the presence of suspect asbestos containing materials (ACM) at the Property. The objective of this visual survey was to note the presence and condition of suspect ACM observed. Based on the date of construction (1970s) there is a potential that ACM was used in construction materials. In addition, the Occupational Safety and Health Administration (OSHA) regulation 29 CFR 1926.1101, requires certain construction materials to be presumed to contain asbestos, for purposes of this regulation. All thermal system insulation (TSI), surfacing material, and asphalt/vinyl flooring that are present in a building constructed prior to 1981 and have not been appropriately tested are presumed asbestos containing material (PACM)

The survey consisted of noting observable materials (materials which were readily accessible and visible during the course of the site reconnaissance) that are commonly known to potentially contain asbestos. This activity was not designed to discover all sources of suspect ACM, PACM, or asbestos at the site; or to comply with any regulations and/or laws relative to planned disturbance of building materials such as renovation or demolition, or any other regulatory purpose.


Rather, it is intended to give the lender an indication if significant (significant due to quantity, accessibility, or condition) potential sources of ACM or PACM are present at the Site. Additional sampling, inspection, and evaluation will be warranted for any other use.

No building plans or specifications, which may be useful in determining areas likely to have used ACM, were made available for review.

Based on the results of the limited asbestos survey, trace (<1%) ACM has been confirmed at the Property in the form of spray applied ceiling texture. It should be noted that the visual asbestos screening survey conducted under the scope of this investigation does not constitute a full asbestos inspection, in which all areas of the buildings would have been thoroughly surveyed and sampled. The possibility exists for ACM to be present in areas of the buildings not accessed or sampled by LAC personnel. Prior to the disturbance of any suspect ACM in this facility, a comprehensive asbestos survey, designed to determine if the suspect ACM is a regulated material, is recommended. If such materials are identified and need to be disturbed, repaired or removed, a licensed abatement contractor should be consulted. Suspect ACM can be managed under the auspices of an Operations and Maintenance (O&M) plan.

4.2.11 Radon

The US EPA has prepared a map to assist National, State, and local organizations to target their resources and to implement radon-resistant building codes. The map divides the country into three Radon Zones, Zone 1 being those areas with the average predicted indoor radon concentration in residential dwellings exceeding the EPA Action limit of 4.0 picoCuries per Liter (pCi/L). It is important to note that the EPA has found homes with elevated levels of radon in all three zones, and the EPA recommends site specific testing in order to determine radon levels at a specific location. However, the map does give a valuable indication of the propensity of radon gas accumulation in structures. Review of the EPA Map of Radon Zones places the Property in Zone 2. Zone 2 is defined as areas that have a moderate potential for radon gas with levels between >4.0 picocuries per liter (pCi/L) but <2.0 pCi/L. The EPA guideline for radon is 4.0 pCi/L. In accordance with the scope of work, a limited radon screening was not performed at the Property. Notwithstanding, long-term sampling and testing are the only definitive means of radon detection.


4.2.12 Lead-Based Paint

At the request of the Client, limited qualitative lead screening was performed on selected painted surfaces at the Property.

The purpose of this screening was to gather qualitative information that may indicate the presence of lead on selected painted surfaces. Quantitative lead analysis should be performed by a qualified firm in order to confirm the results indicated herein.

This screening is not designed to meet the requirements of the Residential Lead-Based Paint Hazard Reduction Act of 1992 (Title X), or any other applicable regulatory requirements; rather, it is intended to give the Lender an indication of the likelihood that lead-based paint is present. The Property falls under the definition of Target Housing, and is regulated under Title X. Regardless of the findings of this limited screening, the seller or renter of the Property is required to make available a federally approved lead hazard information pamphlet and must disclose known lead-based paint and/or lead-based paint hazards to purchasers and renters of the Property pursuant to the requirements of 24 CFR 35.92 and 40 CFR 745.113.

Selected painted surfaces were screened for the presence of lead by applying a colorimetric lead-sensitive chemical (Lead Check) to the painted surface. If the color of the applicator turns pink, the screen is positive, and the presence of lead is indicated. The following table presents the painted surfaces that were screened for the presence of lead.

6.2 Opinion No off-site, on-site or historical recognized environmental conditions were identified that were considered likely to impact the Property. Non-ASTM issues can be adequately addressed through implementation of the recommendations contained herein.

6.3 Conclusions LAC has performed a Phase I ESA in conformance with the scope and limitations of ASTM Practice E 1527-00 of 4827 Sepulveda Boulevard, Sherman Oaks, California, the Property. Any exceptions to or deletions from this practice are described in Section 1.4 of this report. This assessment has revealed no evidence of recognized environmental conditions in connection with the Property; however, the following pertinent information warrants mention:

• Suspect asbestos-containing materials were observed during LAC’s assessment and one sample of damaged material was collected and submitted for analysis. Laboratory analyses reported that this sample did not asbestos concentrations above the method detection limit of 1% by weight. Nonetheless, based on the date of construction of the Property buildings, ACMs may be present at the Property.

6.4 Recommendations Based on the findings of this ESA, LAC recommends the following:

• Prior to the disturbance of any suspect ACM in this facility, a comprehensive asbestos survey, designed to determine if the suspect ACM is a regulated material, is recommended. If such materials are identified and need to be disturbed, repaired or removed, a licensed abatement contractor should be consulted. Suspect ACM can be managed under the auspices of an Operations and Maintenance (O&M) plan.

6.5 Deviations This Phase I ESA substantially complies with the scope of services and ASTM 1527-00, as amended, except for exceptions and/or limiting conditions as discussed in Section 1.4.

Manufactured Gas Plants: EDR Proprietary Manufactured Gas PlantsThe EDR Proprietary Manufactured Gas Plant Database includes records of coal gas plants (manufactured gas plants)compiled by EDR’s researchers. Manufactured gas sites were used in the United States from the 1800’s to 1950’sto produce a gas that could be distributed and used as fuel. These plants used whale oil, rosin, coal, or a mixtureof coal, oil, and water that also produced a significant amount of waste. Many of the byproducts of the gas production,such as coal tar (oily waste containing volatile and non-volatile chemicals), sludges, oils and other compoundsare potentially hazardous to human health and the environment. The byproduct from this process was frequentlydisposed of directly at the plant site and can remain or spread slowly, serving as a continuous source of soiland groundwater contamination.

Mr. Domingo has more than 10 years experience conducting Phase I and II Environmental Site Assessments of commercial, industrial and multi-family residential properties throughout the United States for a wide range of clients. He also has extensive experience in property condition assessments (PCA), environmental data management and database design, Geographic Information Systems (GIS), cost engineering, subsurface investigations of soil and groundwater contamination, and environmental and geotechnical engineering projects including civil and remediation design.

In addition, he has examined the impact of local zoning regulations, building codes, and any special hazards that may affect the income stability of the property.

Mr. Domingo has experience in application development and an in-depth understanding of the following database systems: MS Access and SQL Server, as they relate to database design, implementation and management of environmental projects. Mr. Domingo has experience in form design, report design, advanced query design, data access pages, as well as programming with a variety of languages such as Structured Query Language (SQL), Visual Basic 6.0 and Microsoft (MS) Office Suite utilizing Visual Basic for Applications (VBA). Mr. Copman has 19 years of experience in the environmental assessment field. He has a strong background in providing environmental due diligence for real estate, as well as the performance of Phase I, II, and III ESAs, asbestos and lead-based paint studies, storage tank closure, wetlands, compliance and environmental impact statements.

Previously, while with another national consulting firm, Mr. Copman was the primary environmental technical contact for clients based in the Mid-Atlantic and Southeast Regions of the United States, and managed various environmental assessment projects throughout the country for approximately four years. In addition, Mr. Copman served as the technical lead for two national based clients during this time, providing interpretive guidance for the company and a liaison to the Client. Further, he conducted training sessions to clients covering potential environmental issues. Mr. Copman has performed Phase I Environmental Site Assessments; asbestos, radon, and lead-based paint screenings; and Environmental Transaction Screens throughout the United States. He has assisted in managing large site portfolios, and provided report review and managerial support. Mr. Copman has formerly given internal training on Phase I ESAs and Transaction Screens to new employees. While working for a United States Government Contracting Firm, Mr. Copman performed Preliminary Assessments and Site Investigations in the eastern United States as part of the United States EPA’s Region II Field Investigation Team. These sites were all investigated as candidates for inclusion to the US EPA CERCLIS/Superfund Program. Mr. Copman’s original responsibilities included the performance of Site Assessments and Wetlands Delineations for two New Jersey-based Consulting Engineers. Mr. Howell has 12 years of experience in the environmental assessment field. He has a strong background in providing environmental due diligence for real estate going through securitization, as well as the performance of Phase I - III ESAs, asbestos studies, and lead-based paint surveys.

Previously, Mr. Howell was vice president of a national environmental firm, where he managed environmental site assessments, characterizations, asbestos abatement and monitoring, remediations and underground storage tank removals. Mr. Howell also conducted aquifer analyses and computer modeling of soil and groundwater systems as well as provided asbestos building audits and removal specifications.

Mr. Howell was also principal of his own firm, located in Southern California, where he was responsible for the overall technical and business management of the firm. He also managed projects in environmental site assessment, characterization, asbestos abatement and monitoring, remediation and underground storage tank removal. Mr. Howell also analyzed airborne particulates in clean rooms and investigated worker complaints of respiratory distress.

For a national geoscience company Mr. Howell served as a senior enviromental scientist and managed environmental Phase I and II environmental site assessments for residential, commercial, industrial and vacant properties, including large portfolio property site assessments for substantial fiduciary clients. He also performed asbestos-related services, including investigations, abatement and ongoing monitoring.

As a managing partner of another environmental services firm, Mr. Howell handled business management, client interface and technical projects. As an environmental scientist with another firm Mr. Howell conducted surface and subsurface geologic and hydrogeologic investigations, as well as underground storage tank removal and site closures. He also handled disposal and remediation of hazardous materials and managed projects involving toxic and chemically affected soil and groundwater.

As a hydrogeologist for the Bolsa Chica Conservancy in Huntington Beach, California Mr. Howell performed hydrogeological evaluations of numerous sites and conducted surface and subsurface geologic and hydrogeologic investigations.
