ORDINANCE NO. 604 .-~ BOOKII / PAGt.aa.~ AN ORDINANCE VACATING AN ALLEY IN I. N. JAQUESS SUBDIVISION OF THE HYDRAULIC RESERVE OF THE CITY OF MT. CARMEL WHEREAS, there is now located int~e City of Mt. Carmel an alley approximately 12 feet in width lying adjacent to and South of Lots 16 and 17 of I. N. Jaquess Subdivision, and Lots 18, 19, 20, 21 and 22 of Chipman Subdivision, and North of Lots 10, 11, 12, 13, 14 and 150f I. N. Jaquess SubdJvision, all in the Hydraulic Reserve in the City of Mt. Carmel, Illinois, according to recorded placs of Chipman Subdivision recorded in Plat Book I, Page 110 (Slide 2-254), and I. N. Carmel; and WHEREAS, it is in the public interest that the City no longer be responsible for or pay the costs of maintenance of said alley mentioned above and hereinafter described. . . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MT. CARMEL, ILLINOIS, AS FOLLOWS: Section 1. That the alley lying a~jacent to and South of Lots 16 and 17 of I. N. Jaquess Subdivision and Lots 18, 19, 20, 21 and 22 of Chipman Subdivision and North of Lots la, 11, 12, 13, 14 and 15 of I. N. Jaquess Subdivision 611 in the'Hydraulic Re serve in the City of Mt. Carmel, Ll Linoi s, (Slide 2-202 and 2-254, Wabash County, Illinois) is hereky abandoned and vacated by the City of Mt. Carmel and the same shall be hencefor.th declared to be no longer a public alley or thoroughfare of the Ci~y. Sec t Ion .... _? Section 3. That the City of Mt. Car.mel retains the right to maintain, operate, repair or replace, by itself or by any licensee or holder of any franchise from the City, any poles, wires, pipes, conduits, sewer mains, water mains or any other facility or equipment for the maintenance or operation of any utility now located in said segment, or any portion of the alley, vacated by this Ordinance. Section 4. A certified copy of th~s Ordinance shall be filed for record in the Office of the Recorder of Wabash County, Illinois. Section 5.
