The following are the important activities of Department of ConsumerAffairs during the month of October 2018:

1. Pulses Buffer Stock:

• As on 31.10.2018,the available stock in the pulses buffer is 6.44 lakhMT after disposal of 14.06 lakh MT from 20.50 lakh tonnesprocured/imported.

• FiveWeekly Review Meetings on Disposal of pulseswere held duringthe month of October, 2018 leading to disposal of around 1.43LMTin October. The concerned agencies were encouraged to engagewith States/UTsto take them on board for their requirement of pulsesfrom central buffer.

2. Onion Prices:

• The situation of Onion Prices and its availability was reviewed andfollowing decisions were taken:

• Increase in supply of Onion to Delhi from the buffer stock( 13500MT)under PSF2-3 times;

• Mother Dairy was advised to roll back the prices of Onions by 2rupees across all variants.

3. NCCF:

• The non- Government Directors on Board of NCCF challenged theorder of supersessionof Board of Directors of NCCF in the High Court ofDelhi. Ld. Single Judge stayed the implementation of order. The casewas listed on 30-10-2018 and is now listed for hearing on 20th

November 2018.4. Super Bazar:

• After obtaining favourable orders from Hon'ble Supreme Court, AxisBank was asked to return Rs.35crore of Super Bazar transferredillegally by then Official Liquidator to the account of Writers andPublishers Ltd. Also, DAC & FW was requested to take disciplinaryaction against the Official Liquidator who is a former employee ofDAC & FW.

5. Consumer Protection Rules:

• A conference was held on 27th October, 2018at Vigyan Bhawan, NewDelhi, in association with National Consumer Disputes RedressalCommission (NCDRC)to deliberate on issuesrelating to the functioningof the Consumer fora. Representative from State Governments/UTsand Presidents, State Consumer Disputes Redressal Commissions(SCDRC) participated in the conference. The pendency of cases,filling up of vacancies of President and Members, utilization of buildinggrant and implementation of CONFONETScheme were discussed.State Governments were asked to work in close cooperation withConsumer Fora in addressing their bottlenecks.

6. NCDRC Judgements:

• During the month of October, 2018, the NCDRCdelivered inter-alia thefollowing noteworthy judgments:

I. FirstAppeal No. 522 of 2017 : Vivek Kishorechandra Mehta &another VersusPuranikBuildersPrivate Limited Mehta Realtors.

Briefly, the case is between the Home buyer and the Builder.When the builder failed to build the promised house, refund of Rs.40,000/- was sought which was paid to the home buyer.

Having received the payment, the home buyer filed a petition inthe State Commission, Delhi seeking intervention for payment ofinterest by the builder, which was not given. State Commissiondeclined to entertain the case saying that after payment wasaccepted, the case is over. Relationship between them asconsumer and service provider ceases to exist.

The case came up in appeal to NCDRC,which opined that thedecision of the State Commission was not made on solid legalfooting. It was just prudent to accept the payment of moneydeposited without protest in the first instance. A protest for nothaving been paid interest could have seen the homebuyer loseeven this amount. Therefore, it was just prudent to accept themoney paid and then claim the interest. The appeal wasallowed and a lump sum compensation equivalent to @6%interest on Rs.40, 00,000,amounting Rs.2, 40,000/- was orderedto be paid to the petitioner.

ii. RevisionPetition No. 4461 of 2012: Neelam Chopra VersusLifeInsurance Corporation.

Briefly,the case is relating to payment of life insurance money tothe insured. LlC refused to pay Rs.5.00 lakh to the insured sayingthat the insured did not disclose his diabetes while filing theinsurance form. NCDRC decided that suppression of lifestyledisease like diabetes does not disentitle the claimant. The lifestyle diseasesdo not bring about sure death. Hence, the claim ofthe insurance amount of Rs. 5.00 lakh was allowed withoutinterest.

7. Bureau of Indian Standards (BIS) :

• Each of the Regional offices of BIScelebrated the World Standard Day2018 by having curtain raiser seminars on the specific facets of thetheme "International standards and the fourth Industrial Revolution" asa pre-cursor for the finale event to be held at New Delhi on Nov 15-2018.

• The 2nd World Conference on Access to Medical Products-Achieving the SDGs2030 was organized during 9-11 October2018,New Delhi.

• An Indian delegation consisting of officers from this Department,DIPPand BISattended meetings on quality infrastructure as a partof the Indo-German Joint working group held in Germany from 15to 19 Oct 2018. During this visit, meetings with StandardizationCouncil Industry 4.0, German Institute for Standardization (DIN) andGerman federal ministry for economic affairs and energy tookplace.

• BISofficers participated in several meetings of ISO held in variouscountries on petroleum and related products, Block chaintechnology, AI, loT,CSR- Operationalization of Indian Standards.

8. Minimum Government, Maximum Governance:

Price Monitoring Cell (PMC) of the Department of Consumer Affairs monitors theretail and wholesale prices of 22 essential commodities on daily basis from 106centres across the country. These prices are reported by State Civil Supplies Departmentson daily basis mainly through online portal. These prices are disseminated through theDepartment website immediately. Because of the online price reporting, the time takento report and dissemination is less. As per instructions/guidelines even other routineoffice work is being shifted on line to reduce delays and for more efficient results.
