Kind reference is invited to this office memorandum No. A-27/17/6 th /CPC/4/2008-E.III dated 30.11.2009, introducing the Modified Assured Career Progression Scheme (MACPS) in ESI Corporation. Certain doubts have been raised by the regions seeking clarifications on the same. The point wise clarifications are given under:- SI.No. Point of Doubt Clarification 1. In the case of grant of first financial upgradation Under MACPS for LDC's whether grade pay of 2000 is to be granted or grade pay of 2400 is to be Granted. Grade pay of Rs. 2000/· is to be granted. This has already been clearly clarified by DOPT Point NO. 28 B of the Annexure-I of the DOPT O.M dated 19-05-2009. 2. In the case of grant of financial upgradation under MACPS for UDC's whether pay is to be fixed in the pay band of 5200-20200 with Grade Pay of 2800 Or in the Pay Band of 9300-20200 with Grade Pay of 2800 or 4200 Psy is to be fixed in the pay band of 5200-20200 with grade pay of 2800/-.This has already been clearly clarified by DOPT Point NO. 28 B of the Annexure-l of the DOPT O.M dated 19-05-2009. 3. If an employee completes 24 years of regular service before 31-08-2008 i.e. before implementation of MACPS, his grade pay has been fixed to 4200/- whereas, as per MACPS his grade pay would be 2800/-. In such eventuality whether to consider his case of financial upgradation under old scheme from the due date or MACPSfrom 01-09-2008. As per the point No.9 of the DOPT O.M. under reference- .the "scheme would be operational w.eJ .. 01-09-2008. In. other words, financiai upgradations as per the provisions of the earlier ACP Scheme would be granted till 31-08-2008." 4. If an existing Group "D" employee in the grade pay of Rs.1800/- who has already earned promotion/financial upgradation under ACP in the pre-revised scale of 3050-4590 and due for 3 rd financial upgradation under MACPS, which grade pay is to be granted. As per the O.M. No. 35043/3/2008 dated 16-11- 2009, issued by D.O.P.T. "promotions earned or upgradations granted under ACP scheme of August, 1999 in the past to the four pay scales of 2550-3200, 2610-3540, 2610-4000 and 2650- 4000, which now carry the grade pay of Rs. 1,800/- shall be ignored for the purpose of MACPS". In view of the same, promotions and financial upgradations earned in all the posts which presently carry the grade pay of 1,800/- is to be ignored and 1. in respect of the officials who are presently placed in the grade pay of Rs.1800/- having more than 10 but less than 20 years of regular service i are to be granted first financial upgradation in the grade pay ofl,900/-, and 2. Officials with more than 20 but less than 30 years of regular service are to be granted second financial upgradation in the grade pay of2.000/- and 3. Officials with more than 30 years of regular service are to be granted third financial upgradation in the grade pay of 2,400/-. Contd .....2

Sub: Introduction of MODIFIED ASSURED CAREER PROGRESSION SCHEME (MACPS) inESI Corporation- Clarification regarding.

Kind reference is invited to this office memorandum No. A-27/17/6th /CPC/4/2008-E.III dated30.11.2009, introducing the Modified Assured Career Progression Scheme (MACPS) in ESI Corporation.Certain doubts have been raised by the regions seeking clarifications on the same. The point wiseclarifications are given under:-

SI.No. Point of Doubt Clarification

1. In the case of grant of first financialupgradation Under MACPS for LDC'swhether grade pay of 2000 is to begranted or grade pay of 2400 is to beGranted.

Grade pay of Rs. 2000/· is to be granted. Thishas already been clearly clarified by DOPT PointNO. 28 B of the Annexure-I of the DOPT O.Mdated 19-05-2009.

2. In the case of grant of financialupgradation under MACPS for UDC'swhether pay is to be fixed in the pay bandof 5200-20200 with Grade Pay of 2800Or in the Pay Band of 9300-20200 withGrade Pay of 2800 or 4200

Psy is to be fixed in the pay band of 5200-20200with grade pay of 2800/-.This has already beenclearly clarified by DOPT Point NO. 28 B of theAnnexure-l of the DOPT O.M dated 19-05-2009.

3. If an employee completes 24 years ofregular service before 31-08-2008 i.e.before implementation of MACPS, hisgrade pay has been fixed to 4200/-whereas, as per MACPS his grade paywould be 2800/-. In such eventualitywhether to consider his case of financialupgradation under old scheme from thedue date or MACPSfrom 01-09-2008.

r.J. The promotion from Assistant to 1.1. is

done at the level of the Hqrs. Office, thecadre of 1.1. being a centralized cadre.Whether screening for grant of financialupgradation to Assistants in the grade of4,600/- is to be done at the Regional levelor at the level of the Hqrs. office.

Even ad-hoc promotions from the post ofAssistant to 1.1. are effected at the regional level,under reporting to Hqrs. office. On the sameanalogy, financial upgradation for Assistants tobe granted in the grade pay of 4,600/- is to bedone at the regional level under reporting toEstt-l of Hqrs. office (the cadre controllingbranch)

6. If the financial upgradation under earlierACP scheme was deferred due todisciplinary proceedings will it haveconsequential effect on the grant of MACP

Yes.

7. Whether financial upgradation grantedunder the earlier ACP Scheme from 1-9-2008 will become null and void and suchcases are to be considered for grant offinancial upgradation under MACP.

Yes,the financial upgradation granted earlier underACP (after 1-9-2008)becomes null and void andtheir names are to be considered for grant offinancial upgradation under MACP as per theterms and conditions of the MACP.For examplefinancial upgradation granted to an UDC in thegrade pay of 4,200/-on completion of 24 years ofregular service on or after 1-9-2008 under ACPscheme will become null and void and the saidUDC should be granted financial upgradationunder MACP in the grade pay of 2,800/- from 1-9-2008 (from the date of introduction of MACPScheme, since he has already completed 20 yearsof regular service).

8. Whether the criteria of educationalqualification is essential in the case ofGroup "D" employees now drawing gradepay of Rs.1,800 / - for grant of MACP.

No.The erstwhile Group "DUemployees who do nothave the requisite educational qualification, buthave undergone the "Skill upgradation trainingand who are placed in the grade pay of 1,800should be granted MACP as per detailselaborated at point No. 4 above.

9. Whether officiating Assistants who havecompleted 10 years since their regularpromotion in the cadre of UDC, is to begranted financial upgradation underMACP or not and if yes, then in the gradepay of2,800/- or 4,600/-

They should be considered for grant of financialupgradation in the grade pay of 2,800/- underMACPby the screening committee. However, thebenefit of financial upgradation should beallowed only on their reversion to the lower post.(Point NO. 26 of the Annexure-l of the DOPT O.Mdated 19-05-2009).

10. Whether an Assistant whose initialappointment was LDC and who hascompleted 24 years of regular service,but who has completed 10 years ofregular service in the cadre of Assistant isentitled for third financial upgradationunder MACP scheme even though he hasnot completed 30 years of regularservice.

Yes.(Point NO. 28 (B) of the Annexure-l of the DOPTO.M dated 19-05-2009). An Assistant whoseinitial appointment was LDC and who hascompleted 10 years of regular service in thecadre of Assistant is entitled for third financialupgradation under MACPscheme even though hehas not completed 30 years of regular service.

11. An Official who has refused regularpromotion to the post of 1.1. on more thanone occasion has accepted the ad-hocpromotion. Whether the official isentitled for financial upgradation underthe MACP.

No.(Point NO. 25 of the Annexure-1 of the DOPT O.Mdated 19-05-2009).

In the case of an employee who opted forInter Regional Transfer and joined thenew Region as LDC, whether the servicerendered by him in the parent region canbe counted or it is to be counted from thedate he has joined on IRT in the newregion.

If an employee opts for IRT after earningone/two promotions/financial upgradations inthe parent region then he will be entitled forsecond and third financial upgradations oncompletion of 20/30 years of regular service, inthe new region. In case he has not earned anypromotion/financial upgradation in the parentregion then he will be entitled for first secondand third financial upgradation on completion of10/20/30 years of regular service from the dateof his joining in the new region.( Point NO. 25 ofthe Annexure-1 of the DOPT O.M dated 19-05-2009).

This settles all references received on the above points/issues from the regions/hospitals.
