The Monroe County Board of Supervisors met pursuant to adjournment on January 6, 2012, with Dennis J. Ryan, Michael R. Beary and John Hughes present.

Minutes of December 28; 2012, read and approved.

Motion by Beary and seconded by Hughes to approve $900.00 of the recommended $2,000.00 salary increase made by the Monroe County Compensation Board for all the County's elected officials (Attorney, Sheriff, Board of Supervisors, Auditor, Recorder and Treasurer). Salary increase is for the new fiscal year beginning July 1, 2012, through June 30, 2013.

All voted "AYE". - Motion Carried.

Discussion held concerning salary increases for fiscal year 2012/2013 for non'-bargaining County employees.

Motion by Beary and seconded by Hughes to approve a $2,000.00 increase in salary for County Engineer John Goode effective July 1, 2012, through June 30, 2013.

All,voted "AYE". - Motion Carried.

Motion by Beary and seconded by Hughes to approve a $900.00 increase in salary for Office Manager (Engineer) Juanita Murphy effective July 1, 2012, through June 30, 2013.


Motion by Beary and seconded by Hughes to approve a $1,500.00 increase in salary for Engineer Technician Justin Kamerick effective July 1, 2012, through June 30, 2013.and to approve a $2,500.00 increase in salary for Engineer Technician Jess Hutchinson effective July 1, 2012, through June 30, 2013.

Motion by Beary and seconded by Hughes to approve a $900.00 increase in salary for Monroe County Central Point Coordinator (CPC)/General Relief Director Katie Fisher effective July 1, 2012, through June 30, 2013.


Motion bf Beary and seconded by Hughes to approve a $720.00 increase in salary for Courthouse custodian Ray Vitko,effective July 1, 2012, through' June 30, 2013.


Motion by Beary and seconded by Hughes to approve a $400.00 increase in salary for recycling - :employee Steve Parks effective July 1, 2012, through June 30, 2013.


Motion by Hughes and seconded by Beary to increase the maximum:wage forparttime help to $12.25 per hour effective July 1, 2012, through June 30, 2013.


Motion by Beary and seconded by Ryan to approve Employment contract for Lake Miami Park Executive Director Christopher J. Hughes effective January 3, 2012 to January 3, 2013, with salary increase of $1,000.00 to go into effect July 1, 2012, to coincide with all other County employees salary increases/adjustments.

Ryan voted MAYE". - Beary voted "AYE'.'. - Hughes abstained from voting. Motion Carried.

Motion by Hughes and seconded by Beary to authorize Chairperson to sign Election Precincts Agreement between Monroe County, Iowa, and the City of Albia, Iowa. Precincts must consist of contigubus territory and a portion of the city of Albia, Iowa, is not contiguous with rest of the city and precinct. Chapter 49.6 of the Code of Iowa grants cities and counties power to combine township and city territory. Said agreement is on file in the County Auditor's office.

No action was taken on Board's agenda item number five - Review and Accept Application for text amendment dated December 6, 2011, from the Monroe County Planning and Zoning Commission.

Motion by Beary and seconded by Hughes to enter into a formal agreement with Michael Lauer to assist Monroe County Planning and Zoning develop the Monroe County Plan-land use, transportation and fiscal goals, policies and strategies for $25,000.00 with one payment of $12,500.00 in this fiscal year and one payment of $12,500.00 in fiscal year 2012/13.


Motion by Hughes and seconded by Beary to adopt the following resolution:

RESOLUTION FOR INTERFUND OPERATING TRANSFER

WHEREAS, it is desired to transfer monies from the Rural Services Fund to the Secondary Road Fund, and transfer monies from the General Basic Fund to the Secondary Road Fund;

WHEREAS, said operating transfers are in accordance with Section 331.432, Code of Iowa;

NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Monroe County, Iowa, as follows:

Section 1. The sum of $221,421.00 is ordered to be transferred from the Rural Services Fund to the Secondary Road Fund, effective January 6, 2012. The sum of $16,007.00 is ordered to be transferred from the General Basic Fund to the Secondary Road Fund.

Section 2. The Auditor is directed to correct her books accordingly and to notify the Treasurer of the Operating transfer, accompanying the notification with a copy of this resolution and the record of its adoption.


Motion by Hughes and seconded by Beary to approve the purchase of benches for the Courthouse lobby on_:the first floor in the amount of $2,400.

Motion by Hughes and seconded by Beary to approve resolution to authorize participa-tion in the Southeast Iowa Contracting Consortium 28E Agreement to contract for services to meet Monroe County residents' needs in the area of mental health, mental retardation and developmental disabilities.


Motion by Beary and seconded by Hughes to set the 1st day of February, 2012, at 9:00 a.m. to tour county roads.


Motion by Beary and seconded by Hughes to approve utility permit application made by Windstream Communications in Section 26 of Guilford Township.


Motion by Beary and seconded by Hughes to approve handwritten warrant number 9871 to to Iowa Bridge and Culvert in the amount of $42,695.24.out of Secondary Road Fund.


Motion by Beary and seconded by Hughes to authorize Chairman to sign quote with Pictometry International Corp. to renew and extend the terms and conditions of our License Agreement dated October 21, 2008, for an additional three (3) year period, at an annual cost of $11,813.33. Also the Board agreed to purchase two additional directions county wide with an increased cost per year of $2,160 for three years. Total due in Fiscal year 2012/2013 is $14,174.34. Amount due in the next two fiscal years (2013/14 & 2014/15) is $13,973.33.


The Board discussed with County Assessor Karen Fontinel the ChangeFinder project that Pictometry offers for a cost of $12,010.50 based on the County's 16,014 parcels. The Board andoAssessor declined the purchase of this project at this time.

ADLM representative Donnie Herteen present to discuss with the Board an amendment to Monroe County Board of Health Rules and Regulations. There was a citation in Appanoose County that a Judge through out because an old code section was not updated. A public hearing has been held and there were no comments made. Notices were also posted in the newspaper. The former code of Iowa Section number was 137.21. The new Section number is 137.117 Penalties - criminal and civil.

Motion by Hughes and seconded by Beary approve the amendment to Monroe County Board of Health Rules and Regulations as requested. Copy is on file in the Board of Supervisors office in the Monroe County Courhtouse.

Motion by Hughes and seconded by Beary to approve quarterly reports ending December 31, 2011, for Auditor, Recorder, Sheriff and Veterans Affairs.


Motion by Beary and seconded by Hughes to approve the amendment (No. 2) to the general obligation note between Monroe County and Peoples State Bank for Honey Creek Resort. Said amendment is lowering interest rate to 3.50% (from 4.50%). All other terms and conditions of the general obligation note to remain the same. A new repayment schedule was also filed. Quarterly payments will be $12,828.66 effective with next payment on April 15, 2012.


Motion by Beary and seconded by Hughes to accept the Treasurer's monthly investment report for December, 2011.


Motion by Hughes and seconded by Beary to accept the Treasurer's semi-annual report for period ending December 31, 2011.


Chairman opened the public hearing at 10:00 a.m. for amending the County's Budget for the current fiscal year 201 .1/2012. Persons present were Albia Newspaper representative Bethany Caskey, Dan Johnson, Chris Crall, Juanita Murphy and Denny Amoss.

There were no oral or written objections filed.

Minutes of February 7, 2012, read and approved.

Motion by Beary and seconded by Hughes to approve the Treasurer's monthly investment report for January, 2012.


Sheriff Dan Johnson discussed Sleuth program upgrade. Monroe County currently licenses both RMS and JMS (Jail). The Albia Police Department licenses only RMS. Sheriff Johnson had quote which contained costs to combine the data from the Albia Police Depart-ment and County Sheriff's Department into one system. The City's cost would be $5,570 and the County's cost would be $17,320 (JMS-Jail cost of $11,750). Sheriff Johnson also had a quote for a Sleuth v10 CAD system upgrade. This quote was for $12,478.13 and contingent upon the City of Albia's Police Department agreeing to pay equally for this upgrade. Sheriff Johnson stated that the County would not purchase this upgrade unless the City of Albia agreed to share the cost.equally.

Motion by Hughes and seconded by Beary to authorize Sheriff to accept the Quote from Sleuth for the version 10 upgrade for $17,320 (County's portion) and contingent upon the City of Albia's agreeing to pay equally for the Sleuth v10 CAD system upgrade'to accept that quote as well'($6,239 ,.06 County's share).


Motion by Beary and seconded by Hughes to set the 6th day of March, 2012, at 10:00 a.m for public hearing to consider adopting the Monroe County Budget for fiscal year 2012/2013. Notices to be published in both papers (2-16-12 & 2-21-12).

The Supervisors and County Engineer John Goode were present to conduct interviews with three (3) county employees who have applied for the Monroe County Secondary Road Department Foreman position. Dennis Amoss, the current Road Foreman, will be retiring April 30, 2012. The position has been posted on employee bulletin boards in accordance to Monroe County's policy on job postings, with consideration being given to County employees who have applied for the position.

At the request of the applicants, and in accordance with Iowa Code Section 21.5(1)i, it was moved by Supervisor Hughes and seconded by Supervisor Ryan to go into closed session at 9:47 a.m.

Motion by Beary and seconded by Hughes to approve claim to Iowa Bridge and Culvert out of Secondary Road Fund in the amount of $6,387.95 Warrant Number 10290 for bridge work over South Avery Creek approximately seven (7) miles SE of Albia.


Discussion held concerning upgrade. of Boom mower for secondary road department. Secondary Road Employees Denny Amoss and Ed Heriford present. Also present Engineer John Goode and two sales representatives. Heriford stated that the mower is tired and its time for it to go. Engineer Goode stated that we need to fix it or park it. Supervisor Beary inquired if there was money in the Secondary Road budget. Goode stated that he didn't have it in the budget right now. It's pretty tight right now. Salesman offered a trade in offer of $16,000 and with two options for the one year old demo mower (brush guard over the top and stabilizer'on the front) a purchase price of $114,000. The demo model still has a full warranty on it. Supervisor Ryan asked for a week so County could arrange financing. Board will place item on next week's agenda.

Appointment of Monroe County Secondary Road Department foreman to fill vacancy of Dennis Amoss due to his retirement on April 30, 2012, discussed. Board had three inter-views of excellent candidates last Friday.

Motion by Beary and seconded by Hughes to approve the appointment of Ed Heriford as Monroe County's Secondary Road Department Foreman at a starting salary of $44,500 and after a probationary period of six (6) months an additional $1,000.

The Monroe County Board of Supervisors met pursuant to adjournment on March 6, 2012, with Dennis J. Ryan and John Hughes present. Michael R. Beary absent.


Sara Bixby of South Central Iowa Solid Waste Agency discussed the need for the Board of Supervisors to pass authorization for SCISWA to issue revenue bonds for its next round of cell financing.

Motion by Hughes and seconded by Ryan to approve resolution consenting to the issuance of notes by the Board of the South Central Iowa Solid Waste Agency (SCISWA) for the purpose of constructing improvements under the terms of the intergovernmental agreement creating the South Central Iowa Solid Waste Agency (SCISWA), approving and authorizing modification of the intergovernmental agreement creating the South Central Iowa Solid Waste Agency, and related matters. Complete agreement on file in Board of Supervisors office.


Discussion held concerning the need for County Credit card policy as recommended by the County's audit firm, Hunt and Associates. Currently two departments are authorized for County credit card usage (Engineer's and Sheriff's offices).

Motion by Hughes and seconded by Ryan to adopt the following policy:

Monroe County, Iowa Credit Card Policy

It shall be the policy of the Monroe County Board of Supervisors that whenever possible, County purchases be made using direct billing or reimbursement. There may be times, however, when it is necessary to make a purchase using a credit or account card.

This policy applies to all departments that currently use or could potentially use credit cards such as MasterCard or Visa, or account cards such as Menards or Wal-Mart, or various gas cards for future County purchases. All types will be referred to as "cards" for the remainder of the policy.

Each Elected Official/Department Head shall be responsible for cards acquired by his/her department. The maximum credit limit for each department shall not exceed $5,000, with a per purchase limit of $1,000. The $1000 limit per purchase can be waived if purchase is previously approved by a member of the Board of Supervisors. Said cards are to carry no annual fees. Cash advances on cards are prohibited.

The Elected Official/Department Head shall authorize all card usage within his/her department.

Card usage is restricted to the following uses:

1.) Motel/Hotel expenses and guarantee of reservation and other travel expenses. 2.) County vehicle expenses 3.) Airline reservations 4.) Car rental 5.) Registration fees 6.) Expenses incurred in the execution of a court order or warrant 7.) Departmental expenses as approved by Elected Official/Department Head 8.) Other expenses with prior approval of the Board of Supervisors

Any employee charging through the card system is responsible for arranging the sales tax exempt status of Monroe County in the State of Iowa.

All card statements must be immediately submitted for payment to avoid finance charges. All card statements shall be accompanied by detailed itemized receipts. Charges not accompanied with a receipt will be the responsibility of the employee. Employees using county cards authorize Monroe County to withhold any amount deemed to be the responsibility of the employee from their wages if necessary. In exceptional circumstances, the Board may allow a claim without proper receipt. Written documentation explaining the exceptional circumstances shall be maintained as part of the County's record of the claim. Late finance charges or annual fees will be the personal responsibility of the Elected Official/ Department Head.

County cards shall not be used for the employee's personal purchases or any family member's expenses.

Any misuse of a county credit card may result in disciplinary action, including termination.

Employees who have county cards in their possession shall be responsible for protecting the cards from unauthorized use. Lost or stolen cards shall be immediately reported to the

Elected Official/Department Head so that the card may be cancelled. The Elected Official/ Department Head shall also notify the Auditor's Office.

When changing departments or ending employment with the County, purchasing cards must be turned in to the department head, elected official or the Auditor's Office. If requested by the department head or elected official for any reason, the card must be surrendered. Use of the purchasing card or its accounty number for any purpose after it is turned in is prohibited.

This policy shall be presented to each employee for review before a card is used by said employee. The employee's signature will evidence that the employee has read and agrees to comply with all of its provisions. The signed copy will be kept in the employee's personnel file maintained in the Auditor's Office.

Motion by Hughes and seconded by Ryan to set the 27th day of March, 2012, for sealed bid sale of County Equipment. Bids to be received by 10:00 a.m. and opened at 10:30 a.m. Notices to be put in both official newspapers.


Motion by Hughes and seconded by Ryan to adopt following resolution finalizing "C" level road in Sections 9, 10, 15 and 16 of Guilford Township per public hearing from October 18, 2011:

RESOLUTION TO VACATE A COUNTY ROAD MONROE COUNTY

WHEREAS: A request has been made by Bee & C Farms, L.L.C., an Iowa Limited Liability Corporation, to vacate a county road as described below:

WHEREAS: This being the date'and time set for the hearing on the proposed vacation and closure of a portion of a county road described as follows:

All of the road commencing at the N corner of Section 16, T72N, RI8W, thence east 2673 feet to a point 33 feet east of the NE Corner of said Section 16. All of the road being in Guilford Township:. A total length of 0.51imiles.

WHEREAS: on the 29th day of September, 2011 notice of said hearing was sent by certified mail to the affected property owners, all utility companies whose facilities are on the road right-of-way and the Iowa Department of Transportation; and

WHEREAS: on the 6th day of October and the 11th day of October a Notice of Public Hearing for the proposed road vacation was published in the Albia Union Republican and Monroe County News, newspapers of general circulation in the County where said road is located; and

Chairman opened the public hearing to consider the Proposed Monroe County Budget for Fiscal Year beginning July 1, 2012, and ending June 30, 2013, at 10:00 a.m. The proposed budget was published February 16th and 21st in the official newspapers of the county. Those present were: Bethany Caskey, Joe Welsh, Dan Johnson, C.J. Hughes, Kathy Welsh, Katie Fisher, Diane Durian, Pam Freshwater, Tracy Casady, Peggy VandenBerg, Ray Vitko, Ed Heriford, Denny Amoss and John Goode.

At 10:00 a.m. the Chairman opened the public hearing to take public comment on the Final Report made by the Monroe County Zoning and Planning Commission concerning and application for rezoning filed by Alvin J. and Marilyn S. Kurtz, 6944 201st Street, Albia, Iowa; Property address 2499 645th Avenue, Albia, Iowa. Persons present were: Bethany Caskey, John Goode, Ed Heriford, Juanita Murphy, Chris Crall, Alvin and Marilyn Kurtz.

No oral or written objections were filed. Discussion held concerning a restrictive covenant for the duration that the parcel is zoned commercial the home and business shall be owned and operated by the same individual(s) or their lineal decendants.

BE IT understood that due to operational difficulties during the 2011/2012 holiday season the normal agreement for payment of lighting to Chariton Valley Electric needs to be addressed.

Since the Victorian Stroll normally pays for lighting after the 1st of January and the amount is double the amount they usually pay it is understood the Monroe County will pay approximately half of the bill to Chariton Valley Electric in the amount of $358.14 with Victorian Stroll paying $60.59 on the March billing. It is also understood that Victorian Stroll will pay any remaining bill to Chariton Valley Electric after the March billing.

This memorandum is to be renegotiated before the next holiday season.

RESOLUTION FOR INTERFUND OPERATING TRANSFERS

WHEREAS, it is desired to transfer monies from the Rural Services Fund to the Secondary Road Fund and transfers monies from the General Basic Fund to the Secondary Road Fund.

WHEREAS, said operating transfers are in accordance with Section 331.432, Code of Iowa,


Section 1. The sum of 221,421.00 is ordered to be transferred from the Rural Services Fund to the Secondary Road Fund effective April 10, 2012. The sum of $16,007.00 is ordered to be transferred from the General Basic Fund to the Secondary Road Fund effective April 10, 2012.

Section 2. The Auditor is directed to correct her books accordingly and to notify the. Treasurer of the operating transfer, accompanying the notification with a copy of this resolution and the record of its adoption.


Motion by Beary and seconded by Hughes to approve purchase of fifty (50) hours of prepaid maintenance hours for IT services from Solutions, Inc. of Spencer, Iowa, in the amount of $5,175.00.


Motion by Hughes and seconded by Beary to approve resolution providing for planning support with Chariton Valley Planning and Development Council of Governments and agree to a contribution of $3,500 at this time for annual fees.


Discussion held concerning the recycling program in Monroe County. Currently recycling is held in Albia on the first and third Saturdays from 8:00 a.m. until 12:00. In Lovilia it is held on the second Saturday of the month from 8:00 a.m. until 10:00 a.m. In Melrose it is held on the fourth Saturday of the month from 9:00 a.m. until 11:00 a.m. Currently a county employee is unable to work temporarily. This position requires a Commercial Drivers License (CDL) and is a part time position. Board discussed running an advertisement for a part-time temporary position. .

Engineer John Gooded opened the four sealed bids for farm to market rock letting at 10:00 a.m. Bids were received from Douds Stone, Inc., Bruening Rock Products, Inc., Martin Marietta Materials Inc. and L & W Quarries, Inc.

Motion by Beary and seconded by Hughes to accept low bid on all items one through twenty as recommended by Engineer Goode. Individual bids are on file in the Board of Supervisors office for public review.

TEMPORARY ROAD CLOSURE OF 170TH STREET FROM 140TH STREET NORTH TO 117TH LANE

RESOLUTION

WHEREAS: Iowa Code Section 306.41 provides for the temporary closing of sections of roadway when necessary because of construction and maintenance, and

WHEREAS: the Monroe County Engineer has been authorized by a previous resolution of the Monroe County Board of Supervisors to execute the above requirements of Iowa Code Section 306.41 regarding temporary road closures; and

WHEREAS: Cargill is in the process of completing track and crossing maintenance to multiple rail crossings at the crossing of their rail line and T-55 (720th Ave) approximately 1 mile south of Iowa Highway 137, and

WHEREAS: Cargill Inc. has requested a portion of Route T-55 (720th Ave) between Highway 137 and Route H-21 (140th Ave) be closed for up to less than forty eight (48) hours to allow their maintenance to be completed.

NOW, THEREFORE BE IT RESOLVED by the Monroe County Board of Supervisors the Route 170th Street from 140th Street, north to 117th Lane be closed starting 8:00 a.m. Wednesday, April 18, 2012, to last less than forty eight (48) hours.


Motion by Hughes and seconded by Beary to approve claim to Iowa Bridge and Culvert, Inc. in the amount of $12,238.49 out of the Secondary Road Fund. Warrant number is #11104.


Motion by Beary and seconded by Ryan to approve pending passing pre-employment physicals the appointment of 3 part time seasonal emmployees at $10.00 per hour of approximately twenty hours a week (Cody Swan, Cody Bakalar and Sandy Keegel).

The Monroe County Board of Supervisors met pursuant to adjournment on May 1, 2012, with Dennis J. Ryan, Michael R. Beary and John Hughes present.


Motion by Beary and seconded by Hughes to approve sheriff's quarterly report ending March 31, 2012.


Motion by Beary and seconded by Hughes to approve utility permit application to Rathbun Regional Water in Section 34 of Troy Township and to Rathbun Regional Water in Section 35 of Union Township.


Motion by Hughes and seconded by Beary to approve contract with Coal Construction for Project ER-0068(68)--58-68 but wait to sign contract until all necessary paperwork is complete. Project is eighty (80) percent federal funds with twenty (20) percent farm to market funds.


Park Director C. J. Hughes, Conservation Board member Mike Runyan, Engineer John Goode and Treasurer Peggy VandenBerg present. Hughes stated that Lake Miami area sustained hail damage during storm on April 14, 2012. Every building needs a new roof. The house needs new siding and roof. Vehicles that were damaged are separate. Hughes inquired about how to pay the contractor and whether or not it had to go through the County conservation budget. Auditor Jeannie Bettis stated for a proper accounting trail that the insurance proceeds should be receipted into the Treasurer's office and expenditures would come out of the Conservation budget. A budget amendment will have to be done for the conservation department to account for the unexpected expenses.

Recycling program discussed. Supervisor Ryan stated that he was at Melrose last Saturday and only two people brought items to recycle in two and one-half hours. He stated that it is not cost effective. Lovilia keeps busy on their Saturday. Ryan stated that he would like to talk to the City Councils and Mayors to get their input on the situation. The consensus of the Board is to have written up and post and then advertize for part-time temporary supervisor recycling and for part-time regular help for recycling.

Chapter 225C.7(3) of the Code of Iowa requires, as a condition of eligibility for receiving Mental Health and Developmental Disabilities Community Services Fund dollars, that counties not currently affiliated with a community mental health center expend a portion of those funds to contract with a community mental health center.

Motion by Beary and seconded by Hughes to approve Community Health Centers of Southern Iowa, 302 NE 14th Street, Leon, Iowa, as Monroe County's community mental health center for fiscal year 2013.

Motion by Beary and seconded by Hughes to appoint Engineer John Goode as Monroe County's Title VI Coordinator and approve the following Title VI Policy Statement:

The County of Monroe assures that no person shall, on the grounds of race, color, national origin, or sex as provided by Title VI of the Civil Rights Act of 1964, and the Civil Rights Restoration Act of 1987 (P.L. 100.259), be excluded from or participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity. The County of Monroe further assures every effort will be made to ensure nondiscrimination in all of its committees, programs and activities, regardless of the funding source.

The County of Monroe will include Title VI language in all written agreements and bid notices and will monitor compliance.

The Coordinator of the County of Monroe will be responsible for initiating and monitdring Title VI activities, and all other responsibilities as required.

Sheriff Dan Johnson present to discuss trade of four sheriff's department weapons. Johnson stated that it is basically an upgrade and a straight across the board offer. Motion by Beary and seconded by Hughes to set the 12th day of June, 2012, at 10:00 a.m. to take bids on hay ground located in Cedar Township, Section 18 (formerly old wash plant). The parcel has twenty five acres more or less of grass hay. Bids should be clearly marked as "Sealed Bid Hay" and reflect cash rent for 2012 crop season and received in the Auditor's office by 10:00 a.m. on June 12th. RESOLUTION FOR TEMPORARILY ESTABLISHING SPEED LIMIT

WHEREAS: The Board of Supervisors is empowered under authority of Sections 321.55 and 321.285 Subsection 5 of the Code of Iowa to determine upon the basis of an engineering and traffic investigation, that the speed limit of any secondary road is greater than is reasonable and proper under the conditions existing and may determine and declare a reasonable and proper speed and

WHEREAS: Such investigation has been requested and completed by the Monroe County Engineer and recommends the following speed limits.

NOW, THEREFORE, BE IT RESOLVED by the Monroe County Board of Supervisors that the speed limit be established and appropriate signs erected at the locations described as follows:

T-61 (Monroe/Wapello Road) from the E corner of Section 12 of Mantua Township (12-72-16) Northerly mile, REDUCE SPEED TO 35 MPH UNTIL FURTHER NOTICE.

At 10:00 a.m. the Chairman opened the public hearing to take public comment and make a final determination on the recommendation made by the Monroe County Planning and Zoning Commission on the application for rezoning filed by Kelly V. and Angela L. Freeman to rezone 11.92 acres from "A-1" Prime Agriculture to "C" Commercial Service District in Section 19 of Troy Township.

Persons present were Jim Duea, Laura Kurimski, Kelly Vaughn Freeman, Angela L. Freeman, Jaime Thiravong, Chris Grail, Bethany Caskey, Dien Judge and Alan Ammons.

Chairman of the Planning and Zoning Commission Dien Judge spoke on their behalf. The Planning and Zoning Commission held a public hearing on May 16, 2012, and had a good long discussion concerning the application for rezoning by the Freemans. It passed on a four to one vote by the five members in attendance of the hearing. The Planning and Zoning Commission is a seven member board.

Kelly V. Freeman commented that he and his wife are concerned citizens and their focus is to be a good steward to the land and a good neighbor and would answer any questions. Laura Kurimski stated that she lives directly West of the proposed property and has contactec an attorney and is concerned about spot zoning and possible negative impact on property value. Kurimski also stated that she is opposed to this rezoning. Jim Duea also expressed his dislike of the rezoning to commercial and is concerned about the noise factor, road upkeep and lighting of the area. Freemans are proposing to establish a retail gun and manufacturing shop with the possibility of an indoor gun range. Kelly Freeman stated that he is heavily regulated by the federal and state governments and their primary concern is safety. It will not be a large gun range with only two people at a time being able to utilize it. Judge stated that the Planning and Zoning Commission has had comments about folks not able to have a small business in the county. If the request to rezone meets the Planning and Zoning Commission's criteria that we need to approve it. Supervisor Beary stated that zoning does give a lot of protection and that he has to support the Planning and Zoning Board's decision.



Motion by Beary and seconded by Hughes to accept the recommendation of the Monroe County Planning and Zoning Commission that the application for rezoning filed by Kelly V. and Angela L. Freeman of a parcel of ground approximately 11.92 acres in size described as Parcel A of Lot 3 in the SEi SEi of Section 19, Township 72 North, Range 17 West of the 5th P.M., Monroe County, Iowa, be rezoned to Commercial Service District with mixed use requirement allowed for the landowner and lineal descendants requirement required.

RESOLUTION FOR INTERFUND OPERATING TRANSFER

WHEREAS, it is desired to transfer monies from the Rural Services Fund to the Secondary Road Fund.

WHEREAS, said operating transfers are in accordance with Section 331.432, Code of Iowa,


Section 1. The sum of $110,710.50 is ordered to be transferred from the Rural Services Fund to the Secondary Road Fund effective June 26, 2012.

Section 2. The Auditor is directed to correct her books accordingly and to notify the Treasurer of the operating transfer, accompanying the notification with a copy of this resolution and the record of its adoption.

APPROPRIATIONS. RESOLUTION

WHEREAS, it is desired to make appropriations for each of the different officers and departments for the fiscal year beginning July 1, 2012, in accordance with Section 331.434, subsection 6, Code of Iowa.

NOW, THEREFORE, be it resolved by the Board of Supervisors of Monroe County, Iowa, as follows:

Section 1. The amounts itemized by fund and by department or office on the below schedule are appropriated from the resources of each fund so itemized, to the department or office listed in the first column on the same line of the below schedule.

Section 2. Subject to the provisions of other county procedures and regulations, and applicable state law, the appropriations authorized under Section 1 shall constitute obligations from the itemized fund effective July 1, 2012.

Section 3. In accordance with Section 331.437, Code of Iowa, no department or officer shall expend or contract to expend any money or incur any liability, or enter into any contract which by its terms involves the expenditure of money for any purpose in excess of the amounts appropriated pursuant to this resolution.

Section 4. If at any time during the 2012/2013 budget year the auditor shall ascertail that the available resources of a fund for that year will be less than said fund's total appropriations, she shall immediately so inform the Board and recommend appropriate corrective action.

Section 5. The auditor shall establish separate accounts for the appropriations authorized in Section 1, each of which account shall indicate the amount of the appropria-tion, the amounts charged thereto, and the unencumbered balance. The auditor shall report the status of such accounts to the applicable departments and officers (monthly) during the 2012/2013 budget year.

Section 6. All appropriations authorized pursuant to this resolution lapse at the close of business June 30, 2013.

Dan Tometich with Albia Industrial Development Corporation was present to discuss with the Board AIDC's commitment to Monroe County's Economic and Industrial Development. Tometich said it is Albia Industrial Development Corporation's goal to continue its involvement and be actively engaged in bringing new businesses and industry to Monroe County as it has since 1984.


RESOLUTION DESIGNATING AND AUTHORIZING FINANCIAL SUPPORT AND LEADERSHIP OF ALBIA INDUSTRIAL DEVELOPMENT CORPORATION AS MONROE COUNTY'S SOURCE FOR INDUSTRIAL AND

ECONOMIC DEVELOPMENT

BE IT RESOLVED, by the Board of Supervisors of Monroe County, Iowa that:

1. Monroe County and Albia Industrial Development Corporation have in past years recognized the importance of actively being engaged in industrial and economic development for the welfare of the citizens and businesses in Monroe County and, since developing this partnership in 1984, have created well over 1,000 high paying jobs at 23 new plants-that have invested over $1.1 Billion in new plant and equipment.

2. Without continued emphasis on growing our industrial base, Monroe County's economy is not sufficiently diversified to provide a stable economic base if in large part it once again becomes dependent on agriculture and agribusiness.

3. While the current economic problems in agriculture, agribusiness industries, and in other industries are serious in other areas of the state, Monroe County's industries have fared much better but are still at risk to suffer the same fate if we do not continue to work to create and retain jobs for our residents.

4. It is therefore in the best interest of the citizens of Mornoe County, Iowa to take steps reasonably calculated to lead to diversified industrial and economic development in the county of Monroe, Iowa.

5. Monroe County does not have sufficient resources to hire a Director of Economic Develop-ment as a county employee and lacks sufficient resources to effectively operate an economic development program on its own.

6. Other cities and counties in the state of Iowa have found it necessary to engage in industrial and economic development efforts.

7. Therefore, Monroe County, Iowa finds that it is in the best interests of its citizens ti cooperate with the cities in Monroe County, Iowa and the Albia Industrial Development Corporation, a non-profit corporation, as well as other organizations which may arise in order to promote diversified industrial and economic development in Monroe County, Iowa.

THEREFORE BE IT RESOLVED that Monroe County, Iowa has and will continue to support in effor to enhance industrial and economic development by its financial contibution to Albia Industrial Development Corporation to be approved by the Board of Supervisors of Monroe County, Iowa.

CPC Katie Fisher present to update the board on the State's Redesign of the Mental Health System in Iowa. Fisher stated there really have been no further developments since her last meeting with the board. She expressed her desire to merge with group of counties to the West of Monroe County. She feels they are more compatible in size and needs than other surrounding counties and feels they would be able to work more effeciently together.

Motion by Hughes and seconded by Beary to authorize CPC Katie Fisher to draft a letter of intent to the Iowa Department of Human Services to indicate Monroe County's preference to merge with the counties to the West of Monroe County, currently Lucas, Wayne, Decatur and Ringold Counties.

Motion by Beary and seconded by Hughes to send Letter of Intent to Iowa Department of Human Services for Monroe County to form a South Central region by the use of an Iowa Code Chapter 28E Agreement with Decatur, Lucas, Ringgold and Wayne Counties in Iowa for the purpose of implementing the regionalization and redesign of the Adult Mental Health and Disability Service System and to adopt the following resolution:

A RESOLUTION OF THE BOARD OF SUPERVISORS OF MONROE COUNTY APPROVING PARTICIPATION IN PLANNING

WHEREAS, the Iowa Legislature has passed and the Iowa Governor has signed SF2015 An Act relating to Redesign of Publicly Funded Mental Health and Disability Services; and

WHEREAS, SF2015 expresses the intent of the legislature that Mental Health and Disability Services shall be provided by counties operating as Regions; and

WHEREAS, the MONROE County Board of Supervisors finds it in the public's best interest to make informed decisions on entering into a Region based on sound planning; and

WHEREAS, Counties in Central Iowa have begun planning for the Development and Delivery of Mental Health and Disability Services through a Regional Structure;

BE IT RESOLVED that MONROE County commits to participate in the planning and develop-ment of this MH/DS Region in Central Iowa including the counties who have agreed to participate.

BE IT FURTHER RESOLVED that MONROE County hereby authorizes the County CPC to attend and participate in all planning meetings throughout the planning process.

BE IT FURTHER RESOLVED that MONROE County understands that this is for planning planning purposes and the decision to join a region would be made when a final 28E Agreement has been received.

Engineer John Goode discussed with the Supervisors the possibility of road vacation in Section 13 of Wayne Township. The record landowners are George P. Sinnott and Mary C. Delaney. It is B-level road on the North side of Section 13. There is one-quarter mile that goes South which use to be a driveway back to a house no longer there. The East-West road would remain a B-level road. The landowners would have to agree on a mutal easement. The Board of Supervisors were in agreement to authorize the Engineer to proceed with the vacation process.

Discussion held with Courthouse custodian Ray Vitko concerning authorization to advertize for part-time help for the Courthouse on an on call basis when needed.

Motion by Hughes and seconded by Beary to approve advertizing for part-time help for the Courthouse custodian on an on call basis.

The Monroe County Board of Supervisors met pursuant to adjournment on July 31, 2012, with Dennis J. Ryan, Michael R. Beary and John Hughes present.


Motion by Beary and seconded by Hughes to table the hiring of employee for the Secondary Road Department until a later date.


Chief Deputy Ken Hollingsworth present to discuss the County jail inspection which was done on June 4, 2012, by the Iowa Department of Corrections as required by Iowa Code Section 356, to ensure compliance with Chapter 201-20 of the Iowa Administrative Code.

Motion by Beary and seconded by Hughes to accept the Jail Inspection Report dated June 20, 2012, from Department of Corrections Chief Jail Inspector, Delbert Longley.


Motion by Hughes and seconded by Beary to approve the abatement of taxes on two parcels for a disabled veteran per Iowa Code 425.15. The parcel 230-110-015-000-000 has a total $150.00 to be abated. The parcel 230-110-015-001-000 has a total of $2.00 to be abated. (Disabled Veteran's Homestead tax credit)

The Monroe County Board of Supervisors met pursuant to adjournment on August 7, 2012, with Dennis J. Ryan, Michael R. Beary and John Hughes present.


Treasurer Peggy VandenBerg gave annual review of her investment policy. VandenBerg stated that nothing had changed. There are three important issues concerning public funds which are safety, liquidity and return. The County keeps all funds in the local banks.

Motion by Hughes and seconded by Beary to authorize continuation of the treasurer's investment policy as stated.


Motion by Beary and seconded by Hughes to accept the Treasurer's investment report for July, 2012.


Motion by Hughes and seconded by Beary to approve Title VI Agreement with Iowa Depart-ment of Transportation and authorize Engineer John Goode to sign on behalf of Monroe County.


Motion by Hughes and seconded by Beary to approve hire of T. J. Meredith as assistant mechanic for the Secondary Road Department effective August 8, 2012.


Motion by Beary and seconded by Hughes to approve the consolidated tax rates for 2011 Assessment year payable 2012/2013 as certified to the County Auditor's office by the Iowa Department of Management. Tax rate sheets are available in the Auditor's office.


Motion by Hughes and seconded by Beary to approve utility permit application to Rathbun Regional Water Association in Section 21 of Mantua Township.


Chairman opened the public hearing at 10:00 a.m. to consider request to vacate a county road in Section 16 of Unithn Township. Persons present were Bethany Caskey, Deb Ballalatak, Peggy VandenBerg, Ed Heriford and John Goode. There were no oral or written objections filed concerning said vacation.

RESOLUTION TO VACATE A COUNTY ROAD Monroe County

WHEREAS: A request has been made by Brian Lindberg to vacate a county road as described below:

WHEREAS: This being the date and time set for the hearing on the proposed vacation and closure of a portion of a county road described as follows:

All of the road (131st Lane) commencing at the South right-of-way line of 130th Street, approximately 400 feet North of the S 1/4 corner of Section 16, T73N, R18W, thence Southeasterly 1,330 feet to the South line of said Section 15. All of said road being in Union Township. A total length of 0.25 miles.

WHEREAS: On the 20th day of July, 2012, notice of said hearing was sent by certified mail, return receipt requested to the affected property owners, all utility companies whose facilities are on the road right-of-way and the Iowa Department of Transportation; and

WHEREAS: On the 24th day of Jyly, 2012, and the 26th day of July, 2012, a notice of public hearing for the proposed road vacation was published in the Albia Union Republican and Monroe County News, newspapers of general circulation in the County where said road is located; and

WHEREAS: A hearing was held by the Monroe County Board of Supervisors on the 7th day of August, 2012; and

WHEREAS: The Baord of Supervisors have determined that provisions of Chapter 306 of the Iowa Code have been met; and

WHEREAS: No objections have been received either in writing or by persons present.

WHEREAS: It has been determined to be in the best interest of the County and affected property owner that the County not purchase the vacated road, but instead transfer said road to the adjoining property owner by resolution; and

WHEREAS: The adjoining property owners are as follows:

RESOLUTION PROVIDING FOR PLANNING SUPPORT WITH CHARITON VALLEY PLANNING AND DEVELOPMENT COUNCIL OF GOVERNMENTS

WHEREAS, Chapters 28E and 473A of the State Code of Iowa, as amended, authorized the governing bodies of governmental units to corporate in the operation of a regional planning commission; and

WHEREAS, Chapter 28H of the State Code of Iowa establishes Chariton Valley Planning and Development Council of Governments serving Appanoose, Lucas, Monroe and Wayne Counties as your council of governments. In 2007 the Iowa Legislature amended the Iowa Code 28H with this approval,

WHEREAS, the governing body of Monroe County, Iowa, is a part of the Chariton Valley Planning and Development Council of Governments and has agreed to a contribution of $3,500 at this time for annual fees.

BE IT FURTHER RESOLVED, that Monroe County has designated Dennis J. Ryan as its offical representative to be a contact for the area.

Supervisor Ryan reviewed the follow-up report from Ed Morrison, Loss Control Represent-ative from IMWCA, on the loss control site visit held on August 28, 2012. Morrisson recommended the County take the following actions: Resume regularly scheduled safety committee meetings. To assist the committee in re-defining its purpose, create a list of clearly-defined objectives for the upcoming year and develop plans to reach those objectives. Establish an incident review process that requires the safety committee to send written recommendations for improvements to departments and requires the department to provide a written response. Establish an organization-wide safety self audit provess for the departments. Supervisor Ryan stated that he has scheduled a Safety Committee meeting for September 18, 2012 and at that time the County will fill out the County's response to Mr. Morrison's form.

RESOLUTION

WHEREAS: Iowa Code Section 306.41 provides for the temporary closing of sections of roadway when necessary because of construction and maintenance, and

WHEREAS: the Monroe County Engineer has been authorized by a previous Resolution of the Monroe County Board of Supervisors to execute the above requirements of Iowa Code Section 306.41 regarding temporary road closures, and

WHEREAS: K & L Landscape and Construction is in the process of completing a slide repair in the East right of way limits of T7H (623rd Ave.) approximately 200 feet south of U. S. Highway 34, and

WHEREAS: K & L Landscape and Construction has requested a portion of Route T7H (623rd Ave.) between U. S. Highway 34 and 206th P1. be closed for up to 20 days to allow the slide repair to be completed.

NOW, THEREFORE, BE IT RESOLVED by the Monroe County Board of Supervisors that Route T7H (623rd Ave) from U. S. Highway 34 South to 206th P1., be closed starting 7:00 a.m. on Monday, October 1, 2012, to last 20 days.


Motion by Hughes and seconded by Beary to approve and authorize Supervisor Ryan to sign recycling grant ($18,750) with the Iowa Department of Natural Resources.


Discussion held concerning the part time recycling position which requires the applicant have a CDL license. One applicant does not have a CDL license but stated that her spouse would volunteer to drive the county's vehicle.

Discussion held concerning the fencing at the Wash plant site. Supervisor Hughes stated some of the fencing is rotting. Engineer John Goode stated that his department could supply the equipment and labor if the Supervisors would supply the materials.

Motion by Beary and seconded by Hughes to authorize the Engineer to use the County's equipment. and Secondary Road Department employees and the Supervisors will pay for the materials for the fence at the Wash plant site out of their budget.


Courthouse custodian Ray Vitko present to discuss lights for the courthouse tower. Chariton Valley Electric Coop has agreed to sell the lights at costs to the County. The quote is for $2,433.00. Vitko stated that he has the funds in his courthouse budget.

Motion by Beary and seconded by Hughes to authorize the custodian to accept the quote from Chariton Valley Electric Coop for the new lights for the courthouse in the amount of $2,433.00.

Discussion held concerning the Monroe County Community Services Building's roof with Custodian Ray Vitko and Engineer Goode. Vitko stated that we can patch the roof but it is only a temporary fix but feels we need to fix it right with a new roof. The central air unit is on the roof and would have to be removed. Board stated that the County needs to advertize for quotes with three different options in mind: spray foam; rubber; pitch metal roof.

Temporary Road Closure of 645th Avenue From 240th Street South 1000 feet

WHEREAS: Iowa Code Section 306.41 provides for the temporary closing of sections of roadway when necessary because of construction and maintenance; and

WHEREAS: the Monroe County Engineer has been authorized by a previous resolution of the Monroe County Board of Supervisors to execute the above requirements of Iowa Code Section 306.41 regarding temporary road closures; and

WHEREAS: Monroe County intends to repair a portion of 645th Avenue at the underpass of the Appanoose Community Railroad

WHEREAS: Monroe County requests a 1000 foot section of 645th Avenue to be closed for the repair, for the duration of the project, expected to be about 3-4 days.

NOW, THEREFORE, BE IT RESOLVED by the Monroe County Board of Supervisors that 645th Avenue from just South of 240th Street, South 1000 feet be closed Starting October 8, 2012, subject to scheduling and weather.

Motion by Beary and seconded by Hughes to accept the bid of Conley Spray Foam Insulation with the additional 1/2 inch of foam to make it two inches of spray foam insulation ($3700) which makes the full package $23,098 less $6,500 rebate from Alliant for a total of $16,598.

Motion by Beary and seconded by Hughes to accept the Treasurers monthly investment report for November, 2012.


The Board of Supervisors canvassed the Special Election results held on December 4, 2012, in Monroe County for Indian Hills Community College. No absentee ballots were cast and a total of twenty-two (22) persons cast votes at the Courthouse precinct on Election day. Claims for election expenses and poll workers were approved at the December 5th regular session day.


RESOLUTION FOR ESTABLISHING SPEED LIMIT

WHEREAS: The Board of Supervisors is empowered under authority of Sections 321.55 and 321.285 Subsection 5 of the Code of Iowa to determine upon the basis of an engineering and traffic investigation that the speed limit of any secondary road is greater than is reasonable and proper under the conditions existing and may determine and declare a reasonable and proper speed limit, and

WHEREAS: Such investigation has been requested and completed by the Monroe County Engineer and recommends the following speed limits.

NOW, THEREFORE, BE IT RESOLVED by the Monroe County Board of Supervisors that the speed limit be established and appropriate signs erected at the locations described as follows:

646th Avenue (Old Highway 5 South) from the Appanoose County Line (S 1/4 Corner of Section 33, Monroe Township) North about 4.5 miles to the Intersection with New Highway 5 (near the center of Section 9 in Monroe Township).

REDUCE SPEED TO 45 MPH UNTIL FURTHER NOTICE

A RESOLUTION OF THE MONROE COUNTY, IOWA BOARD OF SUPERVISORS APPROVING THE APPLICATION OF HF CHLOR ALKALI LLC, FOR PARTICIPATION IN

THE HIGH QUALITY JOB CREATION ACT AS SET OUT IN CHAPTER 15, CODE OF IOWA, AS AMENDED

WHEREAS, the gneeral assembly of the State of Iowa has declared that the use of direct economic development incentives by state and local governments are necessary in order to continue to attract economic investment; and

WHEREAS, the general assembly has made a finding that the public and private sectors should undertake cooperative efforts in order to encourage economic investment thereby enhancing the general economic climate in the State of Iowa; and

WHEREAS, the general assembly has set forth certain general principles to govern the relationship between government and business and the Monroe County Board of Supervisors hereby adopts such governing principles; and

WHEREAS, the Board of Supervisors has been advised that HF Chlor Alkali, LLC desires to explore acquisition of funding under the High Quality Job Creation Act as set forth in Chapter 15, Code of Iowa; and

WHEREAS, in order to be eligible to receive benefits under the High Quality Job Creation Act, a business shall comply with certain criteria as set forth in Chapter 15, Code of Iowa; and

WHEREAS, the Board of Supervisors has been fully informed of the reasons the business seeks to take advantage of the High Quality Job Creation Act and believes that HF Chlor Alkali, LLC can meet the requirements of Chapter 15 to receive funding, and

WHEREAS, the Board of Supervisors hereby authorizes the sponsorship of the application for Business Financial Assistance to the Iowa Economic Development Authority for HF Chlor Alkali, LLC, for purposes of receiving the benefits of Chapter 15, Code of Iowa; and

WHEREAS, HF Chlor Alkali, LLC has agreed to advertise for all positions of employment in the local Monroe County newspapers and hire Monroe County Residents when they have the qualifications required for the positions available; and

WHEREAS, the Board of Supervisors contemplates providing HF Chlor Alkali, LLC with a partial, seven (7) year ad valorem tax exemption under Section 15.332, Code of Iowa on all real property improvements directly related to HF Chlor Alkali, LLC's project under the High Quality Job Creation Act, which is estimated to have a total value over the seven (7) year period of $1,389,130 as follows:

BE IT THEREFORE RESOLVED by the Monroe County Board of Supervisors, as follows:

CONSTRUCTION EVALUATION RESOLUTION

WHEREAS, Iowa Code section 459.304(3) sets out the procedure if a board of supervisors wishes to adopt a "construction evaluation resolution" relating to the construction of a confinement feeding operation structure; and

WHEREAS, only counties that have adopted a construction evaluation resolution can submit to the Department of Natural Resources (DNR) an adopted recommendation to approve or disapprove a construction permit application regarding a proposed confinement feeding operation structure; and

WHEREAS, only counties that have adopted a construction evaluation resolution and submitted an adopted recommendation may contest the DNR's decision regarding a specific application; and

WHEREAS, by adopting a construction evaluation resolution the board of supervisors agrees to evaluate every construction permit application for a proposed confinement feeding operation structure received by the board of supervisors between February 1, 2013, and January 31, 2014, and submit an adopted recommendation regarding that application to the DNR; and

WHEREAS, the board of supervisors must conduct an evaluation of every construction permit application using the master matrix created in Iowa Code section 459.305, but the board's recommendation to the DNR may be based on the final score on the master matrix or may be based on reasons other than the final score on the master matrix;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF MONROE COUNTY that the Board of Supervisors hereby adopts this construction evaluation resolution pursuant to Iowa Code section 459.304(3).


Motion by Hughes and seconded by Beary to approve urban renewal report for fiscal year 2011/2012. New legislation effective July 1, 2012, requires the Board of Supervisors address the revenue generated by an urban renewal area. Monroe County's urban renewal area is inactive and has not generated any revenue.
