Tender Notice

On the behalf of the Head, ICAR-IISWC,RC Vasad, Limited Tender Bids are hereby invited in two bid system (Technical & Financial bid) in sealed cover envelop for “Hiring Manpower for Office & Research Assistance purely on contract basis” at this Centre.

Detailed information/Instructions containing terms and condition governing the above contract as well as tender document are enclosed herewith. Details of Tender Deposits:- Earnest Money Deposit: ₹ 35,000/- (Thirty five thousand only) in the form of Account Payee Demand

Daft, FDR, Banker’s cheque or Bank Guarantee from any of the commercial bank in favour of Head, ICAR-IISWC, Vasad, Anand to be attached with Technical Bid.

Security Deposit: ₹ 90,000/- (Ninety thousand only) which is required to be deposited at the time of

Annexure-I

Scope of work & duties to be performed

1. Name of work:- Hiring Manpower for Office & Research Assistance purely on contract basis. 2. Brief description of work :- The ICAR-IISWC,Research Centre-Vasad; main office is located in village Vasad; opp Railway Station Vasad and Farm Office on N.H. 8 near vallage Rajupura. The manpower for office assistance to be hired shall be deployed at the following locations:-

invitation and their proceeding. Preparing forwarding letter to CAO and Director. All store works routing day by day. Should work as per instructions by AAO or Head.

For Establishment Works (1 Person) Dispatched letters to HQ and outsiders. Maintain Dispatch register (Main , Local, Inverted) Leave application for EL, Medical, CL, CH and RH put up to sanctioning authority with leave application for sanctioning the leaves and prepared leave orders. Maintained personal files and service books of all staff Members and other establishment related files. Did periodical increment certificate and doing necessary entry in every Service book Credit EL/ Commuted leave in every service books. All establishment works routing day by day. Should work as per instructions by AAO or Head.

Knowledge of Computer works including Micro office Like word, Excel, etc. Knowledge of writing & typing in English & Hindi related & other office works.

Working place will be Main office – Vasad on all working days of office but in case of unaccomplished work, extra hours may be required occasionally. Working as per the instruction and supervision of the AAO.

Skilled Manpower for Laboratory assistance (Technical) – 01 Preparation of Standard solutions for various analyses as directed by OIC laboratory. Preparation of different chemical reagents for various analyses of Soil, Runoff, Plants and Water samples. Performing estimation analysis including preparation of samples of analysis, chemical titration and operation of different equipment’s. Preparation of digested plant samples. Preparation of digested soil and runoff samples. Preparation of soil extracts for nutrient analysis for soil samples for Organic Carbon, Nitrogen, phosphorus, potassium, calcium, magnesium, sulphur. Preparation data entry in system and data processing

Gradate in Chemistry/Environmental Sciences/Agriculture or allied Sciences. Knowledge of computer Data entry works.

Working place will be main office campus, Farm and adjoining are/ villages. Duty timing 09.00 AM to 5.00 PM (Half an hour lunch break) for all working days. If necessary for holidays and beyond working hours no extra charges paid. Working as per the instruction and supervision of the Scientist (Soil & OIC Laboratory)

Vehicle Driver – 01

Driving office vehicles on demand (Qualis, Swaraj Mazda mini bus), Regular maintenance of Vehicles in checking, cleaning & servicing etc. Keeping Vehicle record (log book) as per the requirement of office under the supervision of Vehicle in-charge.

LTV/HTV driving license along with two to five years experiences. 8 to 10th Standard pass. Knowledge of writing for logbook.

Working place will be Research Centre / Farm, Vasad and villages of outreach-research projects, any place in nearby cities Anand / Vadodara / Ahmadabad including railway station and airport, outstation tours with journeys of any distance and any period involving night stay. Service will be required during office hours on all

working days of office but in case of unaccomplished work, extra hours may be required occasionally. Working as per the instruction and supervision of the Vehicle in-charge.

Unskilled Manpower - 04 Office Messenger / attending Scientists and technical staff / laboratory / Guest house services / Gardening Office paper movement, table cleaning nd other officer services, field work related to data collection, field operations, as per instructions. Guest house services including maintenance of rooms and beds, kitchen, may need cooking as per need, etc. Maintenance of Main office and Farm office Garden as per instructions.

Working place will be main office Campus or sometime farm. Duty timing 09.00 AM to 5.30 PM (Half an hour lunch break) for all working days. If necessary for holidays and beyond working hours no extra charges paid. Working as per the instruction and supervision of the Scientist & I/C – Main office Campus.

Annexure-II Terms & Conditions

Name of work:- Hiring Manpower for Office & Research Assistance purely on contract basis.

The contract shall be governed with the following terms & conditions :-

1. EMD shall be attached with the Technical Bid as per tender notice. Non-submission of EMD with Technical shall liable the firm as unresponsive and rejection of complete tender bid.

2. The EMD of the unsuccessful bidder shall be returned to them as soon as contract is finalized on receipt of written request. The EMD of successful bidder shall be returned on submission of performance security deposit.

3. If Successful bidder does not accept the offer, after issue of Letter of Award by Institute within 15 days, the offer made shall be deemed to be withdrawn without any notice and Earnest Money will be forfeited.

4. The Selected agency should furnish performance security as per tender notice.

5. No interest on EMD and Performance Security deposited by the bidders shall be paid by the Institute to the tenderer.

6. The award of work shall be communicated by Speed Post/Registered Post on the address mentioned by the firm in its tender document. So Centre shall not be responsible for non-receipt of work order if the address is wrong or non-accessible to the Postal Department.

7. In the Financial Bid, the tenderer shall indicate only the service charges (fixed amount in rupees) per person in different category per month basis for providing manpower for desired category under this contract. No request for alteration in the service charges once quoted will be entertained within the contract period. The total cost of contract would be all mandatory costs as indicated in Annexure-IV-A and the service charge to be quoted by the firm for providing the services.

8. If in the Financial Bid ‘Nil’ service charges are quoted by the firm, the bid shall be treated as unresponsive and bid shall be rejected.

9. The criteria for selection of bidder shall be the lowest total service charge rates.

10. In case of tie between two or more firms, the criteria for selection shall be the highest turn over during the last 03 three years put together. In case more than one bid having the same total turn-over, then the selection criteria shall be the maximum experience in the field of contract and finally even if tie falls again preference will be given to the firm whose experience is maximum in government.

11. The Service Provider shall in no case pay its employees less than the minimum mandatory rates per day/per month in accordance with the minimum wages fixed by Central or State Govt., whichever is higher (Liable to change every six month i.e. 1st April & 1st October every year) and Payment for all National Holidays for all dates payments must be provided to manpower by the firm itself.

12. The mandatory payments i.e. minimum wages, EPF, ESI/WC POLICY, GST etc. as given in Annexure-IV-A shall be made by the Institute on prevailing rates prescribed by the government. The interest of the service provides shall be only the service charge on per month basis.

13. The Service Provider shall abide by all the laws of land including labour laws (EPF, ESI/WC POLICY etc.), Income Tax, GST, or any other statutory taxes levied by Govt.), welfare measure of its employees and all other obligation that is being instructed in such cases and are not essentially

enumerated and defined herein, though any such burden shall be the exclusive responsibility of the service provider and it shall not involve IISWC,RC Vasad in anyway whatsoever. Compliance of these provision shall be ensured at the times to making monthly payments. The agency may submit copies of receipt/challans of these statutory payments alongwith monthly bill by affixing its seal in all copies.

14. In case service provider fails to make any statutory or contractual payment, then the Head IISWC, RC Vasad shall have the right to realize this amount from the Security deposit/monthly payable amount to the Contractor.

15. The contractor/agency shall make payment of monthly remuneration/wages to its deployed personnels before 7th of every month by cheque/or proof of RTGS payment in presence of Head or DDO/AAO of the office. After making the payment, the Contractor shall raise the monthly bill on the Head IISWC, RC Vasad for payment of the settled amount. They will submit to the Head, IISWC,RC Vasad a copy of the payment vouchers duly signed by the workers for each month alongwith copy of challans & ECR for deposition of EPF and ESI/WC POLICY contribution of each deployed personnel as well as copy of challan through which GST/service tax etc. deposited by the Contractor/Agency.

16. The personnel so provided by the agency under this contract will not be the employees of the CENTRE and there will be no employer-employee relationship between the CENTRE and the persons so engaged by the contractor in the aforesaid services. They shall be employees of the contractor for all purposes.

17. The contractor will discharge all his legal obligations in respect of the workers/ supervisors to be employed/deployed by him for the execution of the work in respect of their wages and service conditions and shall also comply with all the rules and regulations, provisions of law in force that may be applicable to them from time to time. The contractor shall indemnify and keep indemnified the CENTRE from any claims, loss or damages that may be caused to it on account of any failure to comply with the obligations under various laws. The decision of Head, IISWC, RC Vasad shall be final and binding on the contractor.

18. Income Tax in respect of individuals (if applicable) will be deducted from the payment due for the work done as per rule.

19. TDS in respect of contractor will be deducted as per rules applicable from time to time. So while quoting service charge the contractor may keep it in mind. Though it will not be a criteria of financial evaluation.

20. The tendering agency shall be liable for depositing all taxes, levies, cess etc. on account of service rendered by it to the CENTRE to the concerned authorities from time to time as per extant rules and regulations on the matter.

21. The service charge to be quoted by the firm should be inclusive of all other expenses required for day to day service viz. transportation, communication facility, reliever charges, firm’s commission, TA, Bonus(if any) etc. So while quoting the service charge this aspect should be kept in mind.

22. Service charges (in rupee term, not in %), to be quoted by the Bidder, shall remain firm/unchanged during the entire contract and no request, on whatsoever ground, shall be considered for any increase in the service charge during contract period including extended period, if any.

23. The selected agency shall provide efficient personnel for office assistance services at ICAR-IISWC,RC Vasad strictly as per the charter of duty and terms and conditions mentioned in the tender document or assigned by the competent authority during contract.

24. The agency shall employ good and reliable personnel and of clean record to carry out the job contract. In case any of the personnel so engaged by the agency is not found suitable by the IISWC,RC Vasad the Head, IISWC, RC Vasad shall have the right to ask for its replacement without giving any

reason thereof and the agency shall on receipt of a oral or written communication in this regard will have to replace such persons immediately.

25. It is essential that person deployed should have identity cards of the contracting agency.

26. The agency shall also provide Communication Facilities, Transportation, etc. at their cost for smooth functioning of the works.

27. The Contractor shall not sub-let or further assign the contract.

28. The Agency shall provide name and mobile number of its authorized representative for communication for contract related complaints.

29. The selected contractor/ agency for award of contract shall have to execute an agreement (as per specimen attached in Annexure-V) with ICAR on a non-judicial stamp paper of Rs.100/-.

30. All the concerned Agencies are advised to have a complete inspection/site visit of the Research Centre before offering rates and they are all welcome for a survey of the area during 10.00 a.m. to 5.00 p.m. in any working day before submission of tender form.

31. A Pre-Bid meeting on 05 March 2018 at 3:00 pm in the centre at given address to discuss and clarify any doubt with respect to tender and its terms and conditions.

32. The deployed personnel shall be strictly punctual on his job.

33. The tenderer shall invariably ensure the time bound confidential movement related to manpower

34. The deployed personnel should be able to use fire extinguishers etc in case of fire emergency.

35. The agency shall employ reliable persons with good health in the age group of 21 to 55 years.

36. The selected agency shall provide necessary personnel at the IISWC, RC, Vasad as per labour laws prevalent in Anand/Gujarat.

37. The manpower deployed shall follow strict attendance and alternative arrangements are to be made by the agency whenever any of manpower goes on leave under intimation to AAO of the Centre. In case, no person was made available as alternative then centre will have authority to deduct wages as well contractor’s service charges on pro-rata basis.

38. The manpower provided shall maintain secrecy and discipline in the premises of IISWC, RC Vasad. The attire of the manpower should be formal and decent and not in violation of office decorum. Any deviation will be viewed seriously and liable to penalty as deemed fit by the centre.

39. The manpower deployed shall be capable of reading and writing Hindi/Gujarati and English.

40. The Contractor shall keep a complaint register with his representative, and it shall be open to verification by the authorized officer of IISWC, RC Vasad for the purpose. All complaints should be immediately attended to by the Agency.

41. The contractor or his workers shall not misuse the premises allotted to them for any purpose other than for which the contract is awarded.

42. The Service Provider shall replace immediately any of its personnel who is found unacceptable to IISWC, RC Vasad because of conflict of interest, incompetence, improper conduct etc. upon receiving a notice from IISWC, RC Vasad.

43. No association/trade union activities will be allowed by the manpower supplied by the agency.

44. Any change in deployed manpower shall be intimated to Head/AAO.

45. The agreement is terminable with one month notice from centre. If the service provider wants to rescind the contract voluntarily or otherwise, he is required to give a notice of atleast three months failing which the amount of security deposit including any other dues/loss will be recovered from him for making alternate arrangement till the new contract is assigned to the other party.

46. In case of termination of this contract on its expiry or otherwise, the personnel deployed by the service provider shall not be entitled to and have no claim for any absorption in the regular/otherwise capacity in centre.

47. The personnel engaged by the agency shall be available on times as mentioned, which agency has to prepare in consultation with Head/AAO. Adequate supervision will be provided by the AAO as nominated by the IISWC, RC Vasad to ensure correct performance of the said persons engaged in accordance with prevailing assignment/instruction agreed between the two parties in order to exercise effective control and supervision over the staff deployed by the agency.

48. Risk Clause: IISWC, RC Vasad reserves the right to discontinue the service at any time, if the services are found unsatisfactory by giving a show-cause to be replied within a week and also has the right to award the contract to any other agency at the risk and cost of current agency and excess expenditure incurred on account of this can be recovered from Security Deposit or pending bills or by raising a separate claim.

49. The service provider shall be solely responsible for the redressal of grievances/resolution of dispute related to personnel deployed and centre shall in no way be responsible for settlement of such issues whatsoever.

50. The service provider will furnish the full particulars of the personnel deployed including details like name, father’s name, age, photograph, permanent address, Aadhar number, telephone numbers etc. to the centre and will also ensure the verification of the antecedents of such personnel from their ex-employer/police.

51. The personnel provided shall be under the direct control and supervision of the contractor/ agency. However, they shall comply with the oral and written instructions given on day to day basis, by the officer(s) authorized by the Head, IISWC, RC Vasad from time to time. They will be bound by office timings, duty, placement, locations etc., as decided by the IISWC, RC Vasad.

52. Any loss, theft or damage to the life and/or property of the employees of the IISWC,RC Vasad and/or property of the IISWC, RC Vasad shall be compensated by the contractor/agency if the cause of such loss, theft or damage is on account of default, negligence and/or lapse of the personnel deployed by the contractor/agency.

53. In case of breach of any terms and conditions attached to this contract, the security deposit of the contracting agency will be liable to be forfeited by the CENTRE besides annulment of the contract.

54. The terms and conditions as stipulated in the tender document and enclosed herewith shall be automatically part of the agreement which shall be executed between IISWC, RC Vasad and the successful bidder/contracting agency.

55. The Centre reserve the rights to increase or decrease the number of manpower deployed for any task under the ambit of tender. As per need at the centre as well as considering finance availability, office will inform the contractor and accordingly the manpower is to be deployed.

56. If any information/documents as desired in the tender document is not provided/attached with the tender document, the tender bid shall be treated as unresponsive and will be rejected.

57. Settlement of disputes: in the event of any dispute or difference(s) between the IISWC,RC Vasad and the successful tenderer arising out of or relating to this contract will be resolved through joint discussion of the Authorities representative of the concern contractor. However, if the disputes are not resolved by the joint discussion, then the matter will be refer for Ad-jurisdiction to a sole Arbitrator appointed by the Head of the Centre.

58. The Decision of the sole arbitrator shall be final and binding to all the parties. The arbitration proceedings shall be governed by Indian Arbitration and conciliation Act, 1996 as amended from time to time. The cost of Arbitration shall be borne by the Respective parties in equal proportions. During the pendency of arbitration proceeding and currency of contract, neither parties shall be entitle to

suspect the work/service to which the dispute relates to, on account of the arbitration and payment to the agency shall continue to be made in terms to the contract. Arbitration proceedings will be held at IISWC, RC Vasad. All disputes shall be subject to jurisdiction of courts at Anand/Gujarat.

59. Successful bidder should deposit the performance security of ₹ 90,000/- (Rupee Ninety thousand only) after receiving a communication from the centre. In the event of non-deposition of the same, the Earnest Money of the successful bidder will be forfeited.

60. The Head of the Centre reserves all right to accept or reject one of all tender bid. LIQUIDATED DAMAGES CLAUSES : - 1. In case of non-satisfactory / unauthorized absent / not attending work noticed by the Competent

Authority, IISWC,RC Vasad an amount equivalent to two days of contract amount subject to a minimum of Rs. 2500/- per day will be levied as liquidated damages apart from penalty. Whenever and wherever it is found that the work is not up to the mark in specified point /area it will be brought to the notice of the supervisory staff of the firm by IISWC, RC Vasad and if no action is taken within two hour liquidated damages clause will be invoked.

2. The Firm will not charge placement charges and /or on any other account from the manpower for

office assistance deployed at the IISWC, RC Vasad. The contract is liable to be terminated, security deposit forfeited and the Contractor/Firm will be blacklisted if, at a later stage, reports are received that the Contractor/Contracting Firm has charged the manpower on any account.

3. Any misconduct/misbehavior on the part of the manpower deployed by the agency will not be

tolerated and such persons will have to be replaced immediately. 4. If the number of persons found less than the minimum required under the contact a penalty of

Rs.2000/- per person per day will be deducted from the bill. Not with-standing anything above, the Head, IISWC, RC Vasad reserves the right to reject any or all

tenders in whole or in part without assigning any reasons therefore. The decision of Head, IISWC RC Vasad shall be final and binding on the contractor/agency in respect of any clause covered under the Contract.

4. GST The firm may charge GST in its monthly bill as per prevailing rates of GST on the consolidated amount i.e. total Sl.No.1 to 3 & 5 and deposit the same in concerned government office and submit a copy of its receipt/challan alongwith next month’s bill.

5. Service charge The firm may charge service charges in its monthly bill as per the rates quoted by the firm in its financial bid.

Manpower for Office & Research Assistance purely on contract basis” at ICAR-IISWC, RC Vasad to the firm on the terms and conditions hereinafter contained. NOW IT IS HEREBY AGREED by and between the parties hereto as follows :- 1. This agreement shall come into force w.e.f. …………..(date)…………… and will remain in force for a period for one year or the period of contract if extended on mutual consent but can be terminated by IISWC,RC Vasad by giving one calendar months notice in writing of its intentions to terminate the agreement. 2. The firm will provide full particulars of every worker deployed by it for providing the services purposes and get their character and antecedents verified from the police authorities. 4. All personnel posted at premises shall at all times and for all purposes be deemed to be employees of the firm and the IISWC, RC Vasad shall have no liability on this account in any manner. 5. That the Firm shall ensure that all persons deployed at IISWC, RC Vasad premises are of good character, well behaved and otherwise competent and qualified to perform the work for which they are deployed. 6. The IISWC, RC Vasad shall have the right to ask for the removal from its premises any personnel considered by them to be incompetent, disorderly or any other reason and such person shall not again be deployed without the consent of the IISWC, RC Vasad . 7. The manpower deployed by the agency should work as per the working days and timings of the IISWC, RC Vasad and the working hours for which contract is awarded. No extra wages will be paid for attending office on weekends, holidays and late-sitting. 8. Wages to be paid to the contractual manpower will be as per Minimum Wages prescribed by Govt. of Indian/Govt.of Gujarat, whichever is higher. Current wages etc. shall be as per Annexure-IV-A of the tender document. 9. Monthly consolidated charges for job/ work contract for providing ....................services at IISWC, RC Vasad is as per terms and conditions specified and scope of work as per Annexure-…………in the tender document including all the taxes viz. GST and other taxes as applicable will be paid to the firm by the centre. The firm will raise a bill of this amount as per terms & conditions of the tender document and the payment released by the centre in the form of crossed cheque payment/online payment/RTGS whatever is feasible to the firm subject to satisfactory performance / delivery of contracted job / work/

services. Copies of documents such as deposit challan alongwith list of persons showing deposit of ESIC / WC POlicy, EPF, GST with the concerned agencies are also to be deposited with the bill. 10. The deduction of income tax from the bills of the agency will be made at source as per rates applicable from time to time. 11. In case of dispute between the parties, the matter shall be referred to the sole arbitrator appointed by the Secretary, ICAR. The decision of the sole arbitrator shall be final and binding in any respect of any dispute between the parties. Arbitration proceeding shall be governed by the Arbitration & Conciliation Act, 1996 as amended from time to time. 12. That the firm shall provide identity card to each of the workers engaged for office assistance at IISWC, RC Vasad premises. 13. That the firm shall ensure the successful implementation of the terms and conditions of the agreement by proper control and supervision of the work. 14. That in case the firm fails to perform any of the terms and conditions of this agreement or commits any breach of the contract, IISWC, RC Vasad shall cancel the contract. 15. That the firm agrees to discharge all their legal obligations in respect of their workers in respect of their wages and services conditions and shall also comply with all the rules and regulations and provisions of law in force that may be applicable to them from time to time, viz. obligations under Contract labour (Regulation & Abolition) Act. 1970, Employees Compensation Act, 1923, EPF, ESI & MP Act, 1952 etc. Firm agrees to indemnify and keep indemnified the IISWC, RC Vasad on account of any failure to comply with the obligations under various laws or damage to IISWC,RC Vasad due to acts/omissions of Firm. 16. It is also agreed that under no circumstances, the employees/ workmen of the firm shall be treated, regarded or considered or deemed to be the employees of the IISWC, RC Vasad and the firm alone shall be responsible for their remuneration, wages and other benefits etc. Firm shall indemnify and keep indemnified the IISWC, RC Vasad against any claim that it may have to meet towards the employees/ workmen of the firm. Firm's employees/workmen shall have no claim to absorption/ regularization. 17. The contract is subject to the conditions that the firm shall comply with all the laws and bye-laws of Central Govt./ State Govt. as applicable relating to this contract. 18. In case of any loss or damage to the property of the centre which is attributable to the firm, the full damages will be recovered from the firm as decided by centre. 19. The firm shall not transfer its right or sub- contract to anyone else. 20. The firm or its workers shall not misuse the premises allotted to them for any purpose other than for which contract is awarded. 21. The firm shall devote its full attention in service to ensure highest quality in all aspects and discharge its obligations under the contract with trust, diligence and honesty. 22. Compensation to the workers in case of any accident, loss of life during discharge of their duties shall be borne by the firm and not by centre in any manner. 23. There may be frequent surprise checking by an Officer. Shortcomings, if any, pointed out by him shall be rectified by the contractor within 24 hours of its bringing to his notice. 24. The firm shall provide a Coordinator for immediate interaction with the organization.

25. The terms and conditions as stipulated in the tender documents and enclosed herewith, shall be part of the agreement. 27. The Service charges quoted by the Bidder, shall remain firm/unchanged during the entire contract and no request, on whatsoever ground, shall be considered for any increase in the service charges.
