0915 – 1045Reformation in Europe: workplace reforms born from the new economic reality – what are the trends and lessons learned? In the search for a panacea to Europe’s crisis-induced workplace maladies, some countries have opted for major transformations, while others have settled for superficial alterations or passivity.
What effect will these reforms have on the development of employment and discrimination law and the types of cases and strategies through which employers and employees will assert their rights?
This session will explore various legislative initiatives including:• EU minimum wages• The Danish flexicurity model as a possible European model – is it all
it’s cracked up to be?• Austerity measures throughout the public services sectors – good or
bad for the long term sustainability of the EU and civil servants?• Will reduced security of tenure lead to more discrimination cases?• Implementing executive bonus caps in banking and financial sectors
– is it workable?• The use of atypical employment contracts in the post-recessionary
era, such as fixed-term, probationary and zero-hours contracts: exploitation, or a rising trend that benefits employers and employees?

BREAKOUT ONEEmployee health and wellness programmes and policies – are they essential or just nice to have? Lifestyle worker-related diseases such as malnutrition and underdevelopment, heart disease, diabetes, and high blood pressure in emerging countries are increasingly placing a heavy financial burden on employers. With ageing workers set to suffer from more of these diseases, the problem will only get worse:• What are (and should) employers be doing to address this?• What accommodations should employers implement for affected
employees? • How to interpret the Advocate General of the EU’s recent
comments that morbid obesity could be a form of disability? – Are obesity policies required?– Are employers facing new risks? If so, how these risks should be
mitigated?• How to develop workplace policies and best practices on health,
nutrition and wellness programmes for employees.

in traditional European and US strongholds?• How are automotive workplaces in Europe and the US innovating to
stay competitive?• How are trade unions reacting?• Is the strategic role of employee relations in automotive
manufacturers diminishing or increasing and what are the best practices?

BREAKOUT THREEA regional look at religious discrimination in the workplace: is it getting better or worse and what can be done to stop it?Recent court rulings in Europe and elsewhere indicate different jurisdictions are moving in divergent directions in regulating religion in the workplace.
This session will explore the global trends and practices with respect to:• Wearing hijabs, crosses and other religious symbols at work – what
are the laws and the controversies associated with displays of faith in the workplace?
• US Equal Employment Opportunity Commission (EEOC) guides addressing workplace religious dress and grooming.
• Rastafarianism at work – can dreadlocks get you fired?• Accommodating prayer at work.• Food in the workplace – is it necessary to ensure that the food in

BREAKOUT ONENew labour and employment laws in southern and eastern European countries: is there a trend to harmonisation within the European Union?• How to harmonise the European social model that combines
economic growth with high living standards and good working conditions in eastern and southern Europe
• Are reforms in collective bargaining and employment protection, combined with rising unemployment and weakened trade unions, pushing southern European countries towards a combination of flexibility and insecurity that typically characterised central eastern European countries?
• The pros and cons of increased migration from eastern and southern European countries into the labour markets of central and northern Europe: how does this migration impact employment, wages and the overall market security of those destination-countries?
• How to reform the workforces in southern and eastern European countries facing fiscal austerity measures, inequality and high unemployment in order to ensure long term market security

BREAKOUT TWOCollective redundancy: selection models in Europe in the non-discrimination eraYears ago, many European states imposed requirements on employers to account for family status, age and other ‘social factors’ when selecting employees for redundancies in a collective lay-off. More recently, these same countries have imposed stringent laws against gender and age discrimination. These rules do not harmonise well with one another. What is the future of redundancy selection mandates in Europe? What lessons might be learned from other jurisdictions?

BREAKOUT THREERestrictive covenants and unlawful competition in employment lawIn difficult economic times, the competition for the best talent and the fight for dwindling market-share brings with it heightened risks of employee poaching and increased appetites to enforce protective mechanisms such as non-compete agreements.
This session will explore trends, developments and strategies for dealing with poaching of individual employees or teams, enforcing non-competes against executives or key personnel, as well as agreements between competitor companies (such as Google, Intel and Apple) not to hire their respective employees and the anti-trust challenges that arise from this. It will also address the issue of whether non-compete clauses are still enforceable in a globalised workforce, and how these restrictions are managed in the context of social media?

Conferences 2015International Bar Association
International Bar Associationthe global voice of the legal profession
The International Bar Association (IBA), established in 1947, is the world’s leading organisation of international legal practitioners, bar associations and law societies. The IBA influences the development of international law reform and shapes the future of the legal profession throughout the world. It has a membership of over 55,000 individual lawyers and 206 bar associations and law societies spanning all continents. It has considerable expertise in providing assistance to the global legal community as well as being a source of distinguished legal commentators for international news outlets.
Grouped into two divisions – the Legal Practice Division and the Public and Professional Interest Division – the IBA covers all practice areas and professional interests, providing members with access to leading experts and up-to-date information. Through the various committees of the divisions, the IBA enables an interchange of information and views among its members as to laws, practices and professional responsibilities relating to the practice of business law around the globe. Additionally, the IBA’s high-quality publications and world-class conferences provide unrivalled professional development and network-building opportunities for international legal practitioners and professional associates.
Employment and Industrial Relations Committee overview The aims of the committee are to develop and exchange knowledge of employment and industrial relations law and practice. Members support each other through the provision of innovative ideas and practical assistance on day to day issues. In addition, through its journal and through presentations, the committee ensures the dissemination of up-to-date law and practice in this highly important business area.
Discrimination and Equality Law Committee overview The committee is concerned with discrimination and gender equality issues which arise in the profession and under the general law. The committee members are made up of private practitioners, academics and in-house counsel who assist in the promotion of discrimination and gender equality issues. Many of these professionals are members of leading law firms or corporations and have often had professional and practical experience of discrimination and equal opportunity issues.
European Regional Forum overview The European Regional Forum has been developing and strengthening the existence of the IBA within the whole of Europe by promoting the goals of the IBA to members, non-members and others, disseminating professional know-how, and assisting the committees and other constituencies of the IBA to increase their presence in the different sub-regions of Europe, including parts of North Africa and the Middle East.
The goals of the forum include addressing current and long-term needs of professional organisations and individual members within the geographical reach of the Forum, as well as increasing membership and participation in the IBA and integrating them within the organisation. The Forum will also facilitate cross-border activity between lawyers and bars in different European countries. The Forum has a particular focus on cross-disciplinary activities.
