Sanborn Auto, Inc. is a partnership between own- ers Doug Harms and Ramo Ohrt, and has been in operation since approximately 1999. Harms and Ohrt took over the yard from Ramo Ohrt’s father, Mearl Ohrt, in December of 1999. Mearl Ohrt had rented the land from John Vander Haag, Sr., and that arrangement continued until Doug Harms and his wife, Brenda, purchased the yard from Vander Haag in 2002. Sanborn Auto, Inc. lies on 5.5 acres 1mile west and 1/2 mile south of Sanborn. Averaging 350 to 400 cars annually, they try to stay current with newer late model vehicles. They use the Hollander Management System for inventory and locating parts and ship any where in the United States. Sanborn Auto, Inc. also does install work on most vehicles and offer a 90 day guarantee. Says owner Doug Harms, “We are growing every day with out the high overhead cost. We put a lot of pride and time into our yard. We currently have a 60 x 107 building for parts storage, a repair shop and the business office, and hope to erect another building for parts storage in the future, as the market keeps growing.” Harms continues, “We’re self employed and work hard to make sure we get the parts out as soon as possible. There’s not a 7 – 10 day wait like with some yards.” Says Harms, “We decided to join IAR because all of the yards around here are members. Being an IAR member has already helped us through this article. Iowa Automotive RecyclersTeleconference Meeting

February 27, 2008 10:00 AM.

President Mike Swift called the meeting toorder at 10:12 a.m. Members present were: TomSnyder, Brent Nugent, Mike Swift, Kelly Lynch-Salseg, Mike Waterbury, Tim Smith, Eric Piper,David Hesmer, Joel McCaw, Tracy Hurst, JodiKunde, Dave Wood, Clyde Lems and Jeff Smid.

IAR MEMBERSHIPS: Kelly read the list ofdirect memberships for renewal to be voted on andthey were: B & B Salvage, Delp Auto & Truck,Hawkeye Auto Salvage, Pat’s Auto Salvage andSwift Auto Parts. David made a motion to acceptthese direct members. Jodi seconded the motion;motion carried. Kelly then stated that she had oneassociate member to be renewed and that was Al-Jon. David made a motion to accept that renewalwith a second from Tom; motion carried. Kelly hada new direct member to vote on. Sanborn Autofrom Sanborn, Iowa whose owner is Doug Harms.Joel made a motion to accept Sanborn Auto as anew member. Tracy seconded the motion; motioncarried.

Kelly stated that 100% of the associate mem-bers have renewed now but there are still somedirect members who have not renewed yet. Four ofthose have verbally stated they plan to renew but

haven’t sent their dues yet; they are: Don’s Auto,Smitty’s, Dumont and Hogeland.

LEGISLATIVE UPDATE: Clyde asked ifany of the board members have heard from theirsenators/representatives who received their HSB247 letters. There had not been much response,although Mike S. said Jim Lykam, member of theHouse Transportation Subcommittee, emailed thathe would be willing to have a meeting and discussfinding some “common ground.” After some dis-cussion, it was decided that Mike would respond toJim that we appreciated his offer and would possi-bly have a meeting at a later date. That would giveus some time to define what a “salvage yard”should be required to do, etc. before meeting withJim.

Clyde plans to have a meeting soon with theLegislative Committee and set another meetingshortly after that to include Judy Wilson who is theExecutive Director of the Iowa Used Car Dealers.The purpose of the meeting with Judy would beabout defining the requirements for obtaining arecyclers license and how to present those to JimLykam. Clyde requested that each board memberemail him 5 ideas of what a recycler’s licenseshould require. He hopes to have something pre-pared to present to the board at the meeting atGMARE.

Clyde stated that our lobbyist, David Scott, iscontracted through 2008.

There was some discussion about the mandato-ry used dealers license class. Kelly is planning toput an article in the newsletter about the importantpoints taken from that class if she can get permis-sion to reprint from IIADA.

GMARE: Mike S. said that Minnesota wouldlike to meet with some of the Iowa members anddiscuss possibly joining forces. A few of theMinnesota members plan to attend the upcomingGMARE conference in Des Moines.

SCHOLARSHIP: Jodi stated she has not

received any scholarship applications to date andthat the deadline is this Saturday at midnight. Shedid, however, have someone request she email anapplication. Jodi and Tracy agreed that everyonehas had plenty of advance notice and time to get anapplication completed and turned in so that anextension is not necessary.

Brent made a motion to adjourn; Jeff secondedthe motion. The meeting was adjourned at 11:09a.m.

Iowa Automotive RecyclersBoard Meeting

Holiday Inn – Des Moines, IAMarch 28, 2008 3:00 PM

The meeting was called to order by PresidentMike Swift at 3:15 p.m. at the Holiday Inn.Members present were: Mike Swift, MikeWaterbury, Jodi Kunde, Tracy Hurst, Joel McCaw,Scott Frank, David Hesmer, Dave Wood, Eric Piper,Tim Smith, Brent Nugent, Tom Snyder, ClydeLems, Kelly Salseg, Frank Reginaris, John VanderHaag and Jeff Smid.

MINUTES: The minutes were distributed andread silently by the board members. Brent made amotion to approve the minutes with a second fromScott; motion carried.

SUE SCHAUL’S PROPOSAL: Tom intro-duced Sue and handed out her Certified IowaAutomotive Recycler proposal to set up a programthroughout Iowa with the Iowa AutomotiveRecycling association. Tom read through the pro-gram then opened up discussion and questions forSue. It’s a 3-step program to certify member yards’compliance with all environmental regulatory per-mits and waste management requirements applica-ble in Iowa and under state and federal jurisdiction.This proposal is different from the original plan tohave Sue available to individual yards for certifica-tion. A motion was made by Brent to accept Sue’sproposal as long as the IAR can afford the cost of

implementation. David seconded it; motion car-ried. David then made a motion after some discus-sion to approve the financing of the proposal with asecond from Jeff; motion carried.

FINANCIAL REPORT: Joel distributed thefinancial report to board members. David made amotion to approve the financial report with a sec-ond from Jodi; the motion carried. Joel stated thatDavid Silverburg from Smith-Barney recommend-ed moving the scholarship fund into an ETF(Exchanged Traded Fund) which is a bond fundonly that is making 6.5-7% at this time. Jeff madea motion to follow David’s recommendation andmove the scholarship money into an ETF fund.Scott seconded the motion; motion carried. Joelsaid he and Kelly had completed the paperworkneeded to obtain a credit card for each of them (onecard number). It will be a credit card, not a debitcard. Joel is going to check to see if there is anycash back on the credit card and also if there is anannual fee.

SCHOLARSHIP COMMITTEE: Jodireported that her committee received 5 applicationsfor a scholarship. One was from an associate mem-ber which is not accepted. The other four werefrom: Jessica Snyder (Snyders), Erin Snyder(Snyders), Chase Moore (Spilmans) and StephanieTill (Nugents). It was stated that they could use upto $5,000 for the scholarships. The ScholarshipCommittee will meet then make its recommenda-tion to the board.

FALL OUTING: The date for the 2008 FallOuting was discussed. It was set for October 4th at

Vander Haag’s in Spencer, IA. John will check intoaccommodations. This will be the 50th anniversaryof the IAR.

LEGISLATIVE COMMITTEE: Clyde iscontinuing to gather information as to what a recy-cler should and needs to be so these guidelines canbe put in writing and taken to the legislature forpolitical action. This includes mandates wanted,criteria set out, fees, licensing requirements, zon-ing, etc. Clyde hopes to meet with the IowaIndependent Auto Dealers to see how they got theiragenda through the legislature.

Jodi distributed 2 PAC reports; one for yearending 12/31/07 and one for the first two months of2008. The first two months of 2008 showed only anaddition of a small amount of interest.

IAR MEMBERSHIP: Kelly had 2 directmembers’ renewals to vote on: Don’s Auto and

Hogeland Auto, and 1 indirect member to vote on:Frontier Auto and Truck Parts. David made amotion to accept these 3 memberships as stated byKelly. There was a second from Jodi; motion car-ried. Also, A & L Auto Parts has submitted itsapplication and a check for the fee. After some dis-cussion, it was decided to hold on to the applicationand check at this time and vote on A & L’s member-ship at a later date.

Kelly said there was an 18% gain in indirectmemberships this year. Direct memberships lostone but gained two new ones. She is still waitingfor a couple of checks from direct members whohave verbally committed to joining.

Kelly has collected $3,775 in advertising feesfor the Who’s Who booklets recently mailed tomembers. There is still $900 due in advertisingfees which brings the total to $4,675. The cost to

make the booklets was $1,476 so the net profit was$3,208.

Kelly told the board that she received a callfrom Paul Davis of Kansas (A+ Auto) inquiringabout a reciprocal membership between the 2states. The board decided to table this topic.

Kelly handed out Bob Hoffman’s QRP propos-al. Mike S. said that he has signed on for this so ifanyone has any questions, please contact him.

NEXT MEETING: The next board meetingwill be at the Okoboji Grille in Pleasant Hill onFriday, June 6, 2008 at 1:00 p.m.

OTHER: The representatives from theAutomotive Recyclers of Minnesota, Rick Lemkeand Dan Brekke, have extended an invitation to theIowa members to attend the Upper MidwestAssociation meeting in April.

Iowa Automotive RecyclersTeleconference Board Meeting

April 3, 2008 10:00 AM

The meeting was called to order by PresidentMike Swift at 10:12 a.m. Members present were:Mike Swift, Kelly Salseg, Brent Nugent, DavidHesmer, Joel McCaw, Mike Waterbury, TracyHurst, Scott Frank, Dave Wood, Clyde Lems, TimSmith, Jodi Kunde and Jeff Smid.

Mike stated that he thought GMARE went verywell, was a great meeting and that Dana did anexcellent job organizing it. Approximately $8000was raised at the auction.

Mike asked about A & L becoming a memberof IAR since Chad attended the GMARE meeting.After some discussion, Brent made a motion toaccept A & L as a member for the current year andJodi seconded the motion. The motion carried. Itwas brought to the attention of the board that thecriteria for becoming a member is pretty vague andthat we need to work on setting clearer guidelines.

Mike W. will be contacting A & L and talking toChad about membership expectations, complianceissues, etc.

Mike then asked the board about their feelingsconcerning expanding the GMARE to includeMinnesota, Wisconsin and Illinois. The generaldiscussion was very positive about enlarging thegroup. It was decided that Kelly would set up aconference call in the next couple of weeks with acouple from each state in on that conference call totalk about becoming one group.

Jodi, on behalf of the scholarship committee,said the Scholarship Committee is recommendingthat all 4 applicants receive $1000 each. She madea motion to approve scholarship payments of $1000to: Stephanie Till (Nugents), Chase Moore(Spilmans), Erin Snyder (Snyders) and JessicaSnyder (Snyders). The motion was seconded byBrent; motion carried.

The issue of the unaudited PAC reports wasbrought to the attention of the board. Normally itfalls into the responsibility of the past presidentwhich is Jami Schnoebelen. Since Jami has missedmore than 3 board meetings, she has become aninactive member without voting rights according tothe IAR by-laws. Kelly is going to send a letter toJami to notify her of this. Scott volunteered to lookinto the unaudited PAC reports.

David made a motion to adjourn which was sec-onded by Jodi. The meeting was adjourned at11:01 a.m.

I’m writing today on the issue of the publicbuying from the salvage pools as well as the pub-

lic scrapping junk cars and trucks with out recy-clers or dealers licenses. Every day I get more and

more frustrated with this issue.Not knowing where else toturn, I have also sent lettersand numerous emails to thepeople in charge of transporta-tion and the environment in thestate of Iowa.

First off, if you look at thecar-parts area of the paper inthe Des Moines Register alone,they have over eight ads fromindividuals buying scrap-junkcars. Of those eight, only onehas a recyclers license in thestate of Iowa. We have lawsabout this but nothing seems toget done to enforce them.

Individuals also scrap anddismantle cars and trucks intheir front yards or places ofbusiness that are not zonedcorrectly to do this kind ofwork. We as automotive recy-clers, that are in business tosell and scrap out cars andtrucks, have to keep track of allkinds of items that are wasteproducts off of the vehicles.Mercury switches, Freon, oil,transmission fluids, brake flu-ids, tires, antifreeze, batteries.The list goes on and on. Asrecyclers we are supposed tokeep track of these items -what we do with them, how wedispose of them, etc. What

does the individual do with these products? I sus-pect nothing. About the only thing they do take offthe cars when scrapping them is the radiators, accondensers, batteries, catalytic converters, and alu-minum wheels, because these items will bringmore in pounds than in tonnage weight that goeswith the cars.

I would just like to get the playing field leveledout. These people are coming out of the woodwork. The prices of scrap are at an all time highand I think that the problem is going to get worse.The scrap yards that have shredders are very hun-gry for this product and the competition for this isat an all time high. The unlicensed individuals thatdo this can make an average of $1000.00 to$5000.00 per day depending how many junk carsand trucks they can buy out of the paper or theadvertising that goes on Craig’s List.

I am sure these unlicensed individuals don’tkeep track of how many cars they buy, who theybuy them from and what they do with all of thewaste that they generate. Also, I would say thatwhen they sell the cars they don’t transfer the titlesin to their names - more money that the state miss-es out on.

I have had the DOT come in to our businesslooking for certain cars and trucks that the VINnumber came back to us. We keep a record ofevery car that we buy, from whom we buy it, etc.We also turn in about 300 titles per month to thecounty for junking certificates.

In the last few weeks I learned that in the scrapbusiness, scrap yards and shredders can’t purchasewhite goods, which are appliances, unless they area licensed demanufacturer. Maybe this is theanswer for the automotive recyclers of Iowa. I dealwith several scrap processors in the state that don’tpurchase cars or trucks off the street from individ-uals. They tell them to take the cars to an auto sal-vage yard, because then the product they want tobuy has been processed with the salvage yard, tak-ing care of the waste products and the title work.

I could go on and on about this issue but I thinkthat now is the time to get something done. I don’t

think that it is fair that individuals can do the samething that I do without any kind of rules or regula-tions. I would like the laws that we have in placenow to be enforced and I would like to stop thesepeople from dismantling cars in their front yards,driveways, streets, etc. I would also like to changehow the state defines an automotive recycler. Iwould like to have a meeting with legislators andthe DOT to discuss these issues and maybe get ridof some of my frustrations.

I have made some head way. The following isthe content of an email I received from MajorKerry A. Kirkpatrick with the Motor VehicleEnforcement / Investigative Unit /IowaDepartment of Transportation, in response to manyinquiries on my part.

Thanks for letting me share my thoughts andknow that I and the IAR board will continue to tryand get more positive changes made in this area.

“I have been advised to publish an article inthe paper (educational campaign) before westart a concentrated enforcement effort. Thearticle will be for individuals getting rid of theirjunkers, a warning for unlicensed recyclers andinformation for licensed recyclers on what isneeded to purchase junk vehicles. That articlewent to our media and marketing folks in Amestoday. Once it is published in approximately400 newspapers/shoppers and etc., we can startour enforcement. I have met with several uni-formed MVE officers and they are looking forviolations as well. We’re working on it.”

The 15th annualGreater MidwestAutomotive RecyclersExposition took place thispast March 27 – 29 in DesMoines, Iowa. The expowas very well attendedwith representatives fromIowa, Nebraska, Kansasand Minnesota. The expofeatured a great tradeshow, several informativeindustry seminars andtrainings, hilarious enter-tainment, a lively and funauction and banquet, andlots of good fellowshipamongst the quad state recyclers attending.

The event kicked off Thursday evening with aWelcome Reception in the lobby of the HolidayInn & Suites in Des Moines. Friday’s schedulebegan bright and early at 8 a.m. with a continentalbreakfast, with a bus loading for Yard Tours at 8:30a.m. Yard Tours included Wrench-N-Go, Sam’s

Riverside, Swift Auto Parts, MetroSalvage Pool where lunch wasserved, and ending at Trails’ EndAuto & Truck Salvage whereexhibitor demonstrations took place.Friday evening was the opening ofthe Trade Show and reception withexhibitors.

Saturday’s slate of activitiesincluded forklift safety and airbagtrainings, and several great presenta-tions including: ShannonNordstrom/Nordstrom’s Automotive“Ebay Sales Do’s & Don’ts”; SueSchauls/Environmental Specialist“Are your Environmental PracticesCertifiable, or Just Plain Crazy?”;

and Jeff Schroeder/Car-Part.com “Recycled PartTrends & E-commerce”. Saturday evening includ-ed a social hour, banquet and lively and entertain-ing live auction. As some of you may know and we reported inthe last issue of this newsletter, Dale Swift, ownerof Swift Auto Parts in Des Moines and long timeIAR member, has been waging a battle againstesophageal cancer and a small lesion on his liver.Dale is currently undergoing chemotherapy atMercy Hospital and is doing well.

In support of Dale and the many others fightingthis disease, Dale’s daughters, Wendi Roush &Susan Fidler, established the Dale Swift CancerSlush Fund. This fund has been set up as a “pettycash” fund at Mercy Hospital. The money is givenout in $20 increments to individuals fighting can-cer in order to assist them with simple necessities.

At the GMARE closing banquet this pastMarch, Mike Swift, IAR Board President andDale’s son, spoke eloquently and movinglyabout his father and the Cancer Slush Fund.An impromptu collection was taken up to sup-port the fund, and $1343.00 was raised.

We would like to thank all of those thatdonated generously to this cause that evening,and share with you a ‘thank-you note’ that wassent to the Dale Swift Cancer Slush Fund. Thisgentleman is 56 years old and has metastaticlung cancer. He has very limited financialmeans, and travel logistics / expense wasbecoming limiting for him. The Dale SwiftCancer Slush Fund provided him with gasmoney with which he was able to travel andcomplete treatment. This is what he wrote:

“Thanks to all of the staff. You all havebeen so kind and caring in every aspect. Youhave uplifted my soul. Don’t know how I’mgetting through all this without your supportand prayer. What is your e-mod? In fact, what is an e-mod? Your experience modifier or e-mod is anumber that shows how your organization’s work-er’s compensation claims experience compares tothe experience of other businesses similar in sizeand types of jobs.

The average for similar businesses is exactly1.0. If your e-mod is less than 1.0, then yourclaims experience is better than average. If it ismore than 1.0, then your experi-ence is worse than the averageand probably worse than manyof your competitors – so youmay have some catch-up workto do.

Your e-mod number is amultiplier used in calculatingyour work comp premium. Ane-mod less than 1.0 directlyreduces the premium you pay.The lower your e-mod, thegreater the reduction.

The better you manage your business when itcomes to preventable injuries, the lower your workcomp premium. Most businesses that are success-ful at preventing injuries have these practices incommon. They:

• Are responsive to safety throughout theirorganizations. This shapes a safety culture.It influences employee work behaviors.And typically, safety is coordinated by oneor two safety point persons.

• Hire with safety in mind. It all starts withthe person hired.

• Put into writing the kind of safety focusedorganization that they are and communi-

cate the focus to employees on a regularbasis.

• Regularly train employees to work safely.They spot check their employees work andwork habits.

But even the best intentions still result in awork place injury. Minimizing the injury costs canpresent difficult situations for managers and own-ers. A big one is deciding whether to and how to

bring an injured employee backto work at a lighter-duty job.

Although creating a lightduty job is hard, bringing anemployee back to work afterthey have been released for lightduty by their doctor can have asizable impact on reducing theamount of the claim. Manyemployers experienced at man-aging their e-mods have madelight duty, early return-to-work

the norm. They understand its value. They workclosely with the treating doctors to obtain medicalreleases. Some go to great lengths to accommo-date an employee’s physical condition or otherneeds. By bringing an employee back to work assoon as possible, they do not get out of a work rou-tine and they are ready to go back to their regularjob duties more quickly.

There are many reasons individuals own andoperate their own businesses. Certainly one ofthem is to make money and profit. So minimizingwork comp claims, having a lower e-mod, andfocusing on the majors helps to drive money andprofit to the business bottom line. Managing youre-mod becomes a win-win!

The 2007 Iowa General Assembly passedSenate File 358, effective July 1, 2007, requiringcertification that all used motor vehicle dealerlicense applicants have met certain educationalrequirements prior to licensing. The provisions ofthe law apply to all used motor vehicle dealers,except the following:

• Motor vehicle rental companies having anational franchise

• National motor vehicle auction companies• Wholesale dealer-only auction companies• Used car dealerships owned by a fran-

chised motor vehicle dealer• Banks, credit unions and savings and loan

associationThe legislation requires that all license appli-

cants attend an 8 hour pre-licensing course prior tosubmitting their initial dealer license application.Applicants seeking renewal of their current dealerlicense will be required to take a 5 hour continuingeducation course. Both courses will focus on state

and federal regu-lations pertainingto retail motorvehicle sales.

All motorvehicle dealerlicenses expire onDecember 31,2008. Dealerswho wish toretain theirlicense must takethe 5 hour contin-uing educationcourse beforetheir license expi-ration. Failure todo so will require

the dealer to file new license applications and paythe required fees.

At least one individual associated with the usedmotor vehicle dealer as an owner, principal, corpo-rate officer, director or member or partner of a lim-ited liability company or limited liability partner-ship must complete the required education course.

The legislation authorizes the IowaIndependent Automobile Dealers Association todevelop curricula in consultation with the IowaDepartment of Transportation, the Iowa AttorneyGeneral, the Iowa Association of CommunityCollege Trustees, and the Iowa Department ofEducation. The education program courses will beprovided by community colleges or by the IowaIndependent Automobile Dealers Association inconjunction with a community college. Fees willbe established by the Department of Education forthe class and instructional materials.

The certificate of course completion, or a copy,must be posted conspicuously in the principaloffice of the dealership. Failure to display the cer-tificate may be grounds for license revocation.

How to Survive a Dealer AuditIowa law allows “Peace officers to inspect

vehicles, component parts or records in the posses-sion of a vehicle Rebuilder, Vehicle Salvager, UsedParts Dealer, or any person licensed under Chapter322 (dealer) or found in any public garage, enclo-sure, or property in which vehicles are kept forsale, storage, hire, or repair, and for that purposemay enter any such public garage, enclosure, orproperty.” These records must be open for inspec-tion during normal business hours.

Motor vehicle enforcement investigators willattempt to identify themselves to the highest rank-ing official of the dealership and show them prop-er identification credentials. (If someone purportsto be an investigator with the DOT and does nothave credentials, please call Major KerryKirkpatrick 515-237-3260). At this time they willadvise why they are at your facility. An audit canrun anywhere from 30 minutes to several hours,depending on the amount of vehicles/titles to bechecked. Below are listed the items that the DOTwill check for.

General Requirements• Telephone answered in the advertised deal-

ership name and adequate office area, sep-arate from other facilities.

• Dealer License Prominently Displayed(Dealer, Extension, Recycler, Leasing)

What is a Material Safety Data Sheet(MSDS)?

A Material Safety Data Sheet (MSDS) is a doc-ument that contains information on the potentialhazards (health, fire, reactivity and environmental)and how to work safely with the chemical product.It is an essential starting point for the developmentof a complete health and safety program. It alsocontains information on the use, storage, handlingand emergency procedures related to the hazards ofthe material. The MSDS contains much moreinformation about the material then the label.MSDSs are prepared by the supplier or manufac-turer of the material. It is intended to tell what thehazards of the product are, how to use the productsafely, what to expect if the recommendations arenot followed, what to do if accidents occur, how torecognize symptoms of overexposure, and what todo if such incidents occur.

Does my Business Need an MSDS?State and Federal Employee Right-To-Know

regulations require that companies make MaterialSafety Data Sheets (MSDS) available to workersthat may be exposed to chemicals in the work place.These Occupational Safety and Health Act (OSHA)regulations require that employers maintain safetyinformation about hazardous chemicals used orpresent in the workplace. Such knowledge beginswith an MSDS. Provided by the manufacturers,importers or distributors and existing in written orelectronic form, an MSDS informs users about anypossible hazards inherent with a chemical.

The Iowa Occupational Safety and Health Act(IOSHA) applies OSHA standards (29 CFRPARTS 1910 and 1926) as adopted by IowaWorkforce Development, Division of Labor. Thisagency investigates safety and health complaints inconstruction and general industry, fatalities/catas-trophes and performs general scheduled inspec-tions in Iowa including a review of an employer’sMSDS program.

How do I Obtain an MSDS?Chemical manufacturers and importers are

required to obtain or develop an MSDS for eachhazardous chemical they produce or import.Distributors are responsible for ensuring that theircustomers are provided a copy of the MSDS.Employers must have an MSDS for each hazardouschemical that they use. Employers may rely on theinformation received from their suppliers.

There is no specified format for the MSDSunder the rule, although there are specific informa-tion requirements. OSHA has developed a non-mandatory format, OSHA Form 174, which maybe used by the chemical manufacturers andimporters to comply with the rule. The MSDSmust be in English. Purchasers of hazardouschemicals are entitled to receive from the supplieran MSDS which includes all of the informationrequired under the rule. If an MSDS is notreceived automatically, one should be requested.

What is the Purpose of an MSDS?The role of an MSDS under the rule is to pro-

vide detailed information on each hazardous chem-ical, including its potential hazardous effects, itsphysical and chemical characteristics, and recom-mendations for appropriate protective measures.This information should be useful to the employerresponsible for designing protective programs, aswell as the workers. Most employers using haz-ardous chemicals will primarily be concerned withMSDS information regarding hazardous effectsand recommended protective measures.

What information is on the MSDS?There are seven (7) sections of information on

an MSDS. These categories include: Sec. 1:Hazardous Ingredients/Identity Information; Sec.2: Physical/Chemical Characteristics; Sec. 3: Fireand Explosion Hazard Data; Sec. 4: ReactivityData; Sec. 5: Health Hazard Data; Sec. 6: Controlmeasures; Sec. 7: Precautions for safe handlingand Use/Regulatory Information.

What is a Compliant MSDS Program?MSDS must be readily accessible to employees

when they are in their work areas during their workshifts. This may be accomplished in many differ-ent ways. Many employers keep the MSDSs in aloose-leaf binder in a central location at the facili-ty. In workplaces with large numbers of chemi-cals, MSDS information is kept electronically andaccessed through computer terminals. AL long asemployees can get the information when they needit, any approach may be used.

The employees must have access to an MSDSthemselves – simply having a system where theinformation can be read to them over the phone isonly permitted under the mobile worksite provi-sion when employees must travel between work-places during the shift. In this situation, they haveaccess to an MSDS prior to leaving the primaryworksite, and when they return, so the telephonesystem is simply an emergency arrangement.

A written MSDS program is an excellent toolto help maintain a compliant MSDS program andmay include:

• Designation of person responsible forobtaining and maintaining the MSDSs

• How such sheets are to be maintained in theworkplace (e.g., notebooks in the work areaor electronically with access) and howemployees can obtain access to them whenthey are in their work area during the workshift

• Procedures to follow when the MSDS isnot received at the time of the first ship-ment

• A list of all products in the facility (aninventory) that require an MSDS to bemaintained.

For employers using hazardous chemicals, themost important aspect of the written program interms of an MSDS is to ensure that someone isresponsible for obtaining and maintaining theMaterial Safety Data Sheets for every hazardouschemical in the workplace.

The dilemma that many companies face is how

to keep this information up-to-date and readilyavailable to workers. Failing to have MSDS infor-mation up-to-date and available to workers canresult in substantial non-compliance violations andfines.

In order to ensure chemical safety in the work-place, information must be available about theidentities and hazards of the chemical. OSHA’sHazard Communication Standard (HCS) requiresthe development and dissemination of such infor-mation:

• Chemical manufacturers and importers arerequired to evaluate the hazards of thechemicals they produce or import, and

• Prepare labels and material safety datasheets (MSDSs) to convey the hazard infor-mation to their downstream customers

• All employers with hazardous chemicals intheir workplaces must have labels andMSDSs for their exposed workers, andtrain them to handle the chemicals appro-priately.

The Automotive Recyclers AssociationEducational Foundation (ARAEF) has added twonew innovative training programs to its online uni-versity. The ARA University (ARAU) will nowgive the auto recycler the ability to plug in to e-training offered by the Coordinating Committeefor Automotive Repair (CCAR) and ARA ProductServices, LLC. These exciting new additions to theARAU curriculum will provide the recycler withdirect access to industry-recognized hazmat andairbag training. Both programs are designed tohelp the auto recycler stay in compliance with fed-eral regulations. This collaboration with theARAU, CCAR and ARA Product Services, LLCbrings a new level of compliance e-training to theauto recycler.

ARAU has partnered with CCAR to bring theauto recycler two specialized training courses,S/P2 and HazmatU, that are focused on safety andpollution prevention and hazmat materials. S/P2 is

an e-learning program developed by CCAR toaddress key safety and pollution prevention sub-jects. The training is based on U.S. EnvironmentalProtection Agency (EPA) and U.S. Department ofLabor, Occupational Safety and HealthAdministration (OSHA) standards, which requirethat personnel be trained on safety and environ-mental issues at the beginning of their employ-ment, and at least annually thereafter. Also avail-able, the HazmatU was created by CCAR in coop-eration with the North American Automotive haz-mat Action Committee (NAAHAC), a group ofregulatory compliance specialists representing themajor automotive manufacturers in NorthAmerica, and ShipMate, Inc., a hazmat specialtytraining company with an extensive background ofserving automotive companies. DOT regulationsrequire any employee who works in the shipping orreceiving of hazardous materials to receive trainingwithin 90 days and recurring training at least every

Increased demand for steel in countries such asChina and India has pushed the price of scrapmetal up to more than twice what it was in 2004.As of March 19, 2008, the price of a ton of scrapsteel stood at $351.67, up from less than $300 a tona year ago. Because of the rising prices, scrapyardsacross the country are seeing a significant increasein business. “It’s been getting busier and for us itfeels like business has doubled,” says Russ Taylor,the manager of Pacific Steel & Recycling, whichserves south-central Idaho and northern Nevada.

Taylor notes that operations at his company’s TwinFalls, Idaho, location are up 150 percent from lastyear. He says the increase came on top of a 120percent increase the year before. Taylor says thatone of the most popular items being recycling isold farm equipment, which contains a lot of steel.Most farm tractors made between 1940 and 1970contain more than a ton of steel, according toTractorData.com.

Last week a key official with the U.S.Department of Justice (DOJ) indicated that thelong-awaited regulationsimplementing key parts of theAnti Car Theft Act of 1992would be published by the endof June. The AutomotiveRecyclers Association (ARA)has been aware of the generalprovisions of the act and inanticipation of potentiallyadverse regulations, ARA hasbeen active in formulating asolution for the industry tosupply federally requiredreporting to meet the DOJguidelines.

In early March, ARA sent aletter to major data providersoutlining a program aimed atreducing the regulatory bur-dens associated with the forth-coming regulations. The letterdetailed a program, theNational Salvage VehicleReporting Program, organizedpursuant to an agreementbetween ARA and the NationalInsurance Crime Bureau(NICB).

It is important that yardmanagement system and dataproviders for the automotiverecycling industry such asPinnacle, Car-Part, Fast Parts,Actual Systems, HollanderSolera, Hot Lines, Locator,CCC, Mitchell, ITS and othersparticipate in this voluntaryprogram. Without prompt

action, auto recyclers could potentially be exposedto burdensome DOJ requirements that might be

Rising metal prices have resulted in a boomingU.S. scrap market, with prices rising 20 percentover the last month, says Trenton Iron and Metalowner Joseph Lonchar. Scrapyards must competewith one another for business because the highprices have created a seller’s market. Manyplumbers and auto shops now bring used partsdirectly to the scrapyard rather than giving them toscrap peddlers. Lonchar advertises to attract scrapsellers and offers bonus prices for scrap onWednesdays to compete with the three scrapyardsin the immediate Trenton area, as well as relatedbusinesses such as auto salvage firms. “Thepipeline is starting to dry up,” Lonchar says. “Thefact is there’s only so much scrap metal out there.”

The rising prices for recyclables also is good forlocal governments. Hamilton township generatesabout $30,000 annually from selling scrap droppedat its recycling center, says the city’s RichBalgowan. He says the city’s recycling center col-lected 44 tons of scrap in the first three months ofthis year, up from 37 tons in 2007’s first quarter.Rising metal prices also are attracting thieves. InTrenton, N.J., the theft of copper is so prevalentthat the police had to create a special task force thatpatrols abandoned properties and stakes out scrap-yards.

In general, the DOJ regulations will require allrecycling or salvage yards to file a monthly reportwith the operator of the system recognized by theDOJ in order to identify lost, stolen or otherwisefraudulently titled vehicles. The required reportmust contain an inventory of all junked automo-biles or salvage automobiles obtained by the facil-ity during the prior month.

ARA is actively engaged with the non-com-mercial identity, NICB, to provide this vehicleidentification number (VIN) information to meetthe federal DOJ reporting requirements and allowsubmission of recycler data in a simple formatthrough the existing industry management systemsand information suppliers of their choice.

ARA has been informed by NICB counsel thatNICB and DOJ have reached an agreement where-by any submission made through this process pro-moted by ARA will be accepted by DOJ as meet-ing the reporting requirements. ARA encouragesour members and the industry in general to providedata through the ARA enabled protocol to meet therequirements of the federal law.

A recent study by Carfax has backed up a sim-ular study done last year on flood damaged vehi-cles, that has proven that the amount of salvagevehicles are continuing to rise and so should con-sumers suspicions on the purchasing of used vehi-cles. We are still reeling from the effects ofKatrina and the 500,000 flooded vehicles that werea product of that disaster. With the increase in sal-vage we see more rebuilt vehicles that are unsafe todrive, or that are purchased for illegal purposessuch as VIN cloning or title washing. We are alsoseeing a large number of illegally exported vehi-cles turning up in other countries for terrorist andsmuggling purposes.

ARA and the recycling industry have beenworking hard to fight back against these fraudulentbuyers and illegal exporters. Connecticut, cur-rently has a bill pending (HB 5742) that wouldorder buyers at the salvage auctions to declare theautomobile for export if that is the reason for pur-chase. This declaration would also be sent to lawenforcement who would track the vehicle andensure it has a legitimate purpose.

ARA will continue to make sure that the autorecyclers have a level playing field and that salvageprices are not increased because of the sale tofraudulent buyers and illegal exporters.

CENTREVILLE, Va.—(BUSINESS WIRE)—Anyone shopping for a used car right now needs tobe on high alert for rebuilt wrecks being sold intheir area. A new study by Carfax shows that mil-lions of cars severely damaged in major accidentshave been rebuilt and are up for sale. Over the lastfive years, the number of salvaged cars revealed byCarfax Vehicle History Reports has increasednationwide by more than fifty percent. Cars pur-chased with Carfax Vehicle History Reports that do

not contain DMV-reported incidents like salvagemay be eligible to be bought back by Carfax.

“This problem is more widespread than wepreviously thought,” said Larry Gamache, commu-nications director at Carfax. “Based on our data,the number one concern consumers should haveright now, even above flood damage, is unknow-ingly buying a used car that was badly damaged inan accident. Buying a salvaged car may not be abad investment, but you must make sure you’reaware of any prior damage and, more importantly,see that the proper repairs were made. Checkingthe information gathered in our database is the firststep consumers should take to protect themselvesfrom unwanted problems.”

Experts estimate that more than 5 million carsannually are deemed salvage after severe acci-dents. More than half of these cars are resold,many by sellers who intentionally hide their dam-aged past from unknowing consumers.

Alliance Steel Services of Minneapolis hasgrown from a small scrap metal dealer to a power-house thanks to CEO Michael Zweigbaum’s agen-da to buy up local scrapyards and set up a regionalnetwork of recycled metal providers. His businessplan included the deployment of a system forweighing, tagging, and shooting digital photos ofevery batch of metal that came into Alliance’s yard.The system begins operation the second a truckcarrying scrap metal enters the yard and unloads itscontents onto a scale. A worker studies the materi-al and uses a touchscreen to choose the metalgrade. Software registers the weight on the scaleand then a camera transmits a picture of the metal,revealing any contaminants. This data is filed in adatabase from which Alliance’s owners can accesstrade receivables, shipping and billing documents,and inventory. The company’s annual revenueshave increased more than fivefold to $100 millionsince Zweigbaum bought Alliance three years ago,and he says the precision of the new system hasenabled Alliance to sell more nonferrous scrapmetals, which buyers now purchase directly fromcompany yards. Alliance is also making heftyinvestments in a software dashboard that shows thefrequency and efficiency of Alliance’s inventoryshipment and a Web site that gives customers lim-ited database access.

Instead of stealing the entire car, a growingnumber of car thieves are stealing catalytic con-verters, a part of the exhaust system that is valuablebecause it contains platinum, palladium, and rhodi-um. Platinum recently reached a record high priceof more than $2,300 an ounce compared withabout $1,000 an ounce for gold. Thieves can selleach converter for a few hundred dollars andremoving it from the car often goes undetectedbecause it doesn’t set off an alarm. SUVs and vanshave been targeted by thieves because the largerconverters contain more platinum, and it is easierfor thieves to crawl underneath the vehicles andsaw the part off. “These are definitely occurringmore than they have in recent memory, and whythat is is definitely tied to the price of preciousmetals within converters,” says the NationalInsurance Crime Bureau’s Frank Scafidi. Therehave been many large-scale thefts, with thievesstealing converters from 25 cars in an Ohio parkinglot and 19 from vehicles being held at a Minnesotapolice department’s impound lot. Several states areconsidering bills that would make it more difficultfor people to resell catalytic converters on the openmarket.
