,Mrs.Mary Froehley. of 86 High Street appeared at meeting relative to bill she
received from Lauren Brown, loca1,plumber, wherein ~he claims. she was billed forwork done by Mr.Broq,n on the village sewer on High Street~ This part .of her billamounted to $ 13.50. Motion made bY Mrs.Clow, seconded by Mr.Fraw1eyth~t the billof.$ 13.50 be paid by .. the vill{l.ge,and Mrs.Froehley wa.s told to have Mr.Brovm bill.th\,! village direc.tly. Unanimously Carried.
Mr.Louis Dippola" owner of property. on Hardpan Road was at meeting and askedthe board for water. He was informed that at-the present time there is no way for theVillage to get to his property and M8¥or Drago suggested to Mr.Cippola that he tryand arrange llith Mr.Frank Catalano to enlarge his present 3/4" line to 2" on theprivatii' right of way known as Mesi Drive. When this has been done then the villagewould poss.ibly be in position to extend the 2" line onto Hardpan Road.
Letter was read from the· Town of Brant Board asking,that the present FireProtection Contract between the Village of Angola and the Town of .Brant, be extendedto December 31.1953 for the aIllQllmt of Five Hundred Dollars. The Village Clerkwas instructed to notify them that the Village will'be, willing to ~tend thiscontract to December 31,1953 as soon as a new contract is presented to them.

Pursuant to the authority conferred by Article VI-A of the VillageLaw of the State of New York, and for each of the purposes specified therein,the Board of Trustees of the Village of Angola, Ccunty of Erie, do enact asfollows: r;

SECTION III - SHORT TITLE
. This ordinanoe shall be known and may be cited as "The Village ofAngola, N.Y., Zoning Ordinance." .
SECTION IV - DEFINITIONS
Fo:(Ji.h\l;;purposes of this ordinance certain terms are herewith defined.Vlhen not inc9~#~$tent with the context, words used,in the present tense includethe future, "\'{~,ds,in the singular number include the plural .and words in thepluraL.numbe~!'·{nctudethe singular. The word "person" includes a firm, partnershi.p" or:.,ciorporation as well as an individual. The word "used" shall beinterp;\~ted to include the term "desighed or iritended to be used". The term"shall" i$ always mandatory.
'Accessory Use: A use customarily incidental and subordinate to themain use or building and located on the same lot therewith. In no case shallsuch accessory use dominate, in area, extent or purpose, the principal lawfuluse or building.
Accessory Building: A subordinate building located on the same lotwith the main building, occupied by or devoted to an accessory use. Where anaccessory bUilding is attached to the main building in a substantial manner,as by a wall or roof, such accessory building shall be considered part of themain bUilding.
Alley: A permanent service way providing a secondary means of accessto abutting. properties.
Alterations. As applied to a building or structure, means a changeor rearrangement in the struotural parts or in the exit facilities; or an 'enlargement, whether by extending on a side or by increasing in height; or themoving from one location or position to another.

Automobile or Trailer Sales Area: An open area. other than astreet or pUblio place. used for the display. barttir. pur'ohas'el. sale or rentalof new or used motor vehicles or trailers. and where no repair work is doneexoept minor incidental repair of vehicles to be displayed. sold or rented onthe premises.
Basement, A story partly underground but having less than half ofits clear height 'below finished grade.
Boarding or Rooming House: A dwelling other than a hotel or lodginghouse. where 5 or more persons are housed or lodged for hire with or withoutmeals.
Building: Any structure having a roof supported by columns or bywalls and intended·for the shelter, housing or enolosure of persons, animalsor chattel.
Building Height: The vertical distance measured from the averageelevation of the proposed finished grade at the front of the building to thehighest point of the roof for flat roofs; to the deck line of mansard roofs;and to the mean height between eaves and ridge for gable. hip and gambrel roofs.
Camping Gr?und: A parcel of land used or intended to be used, letor rented for oocupancy by campers. or for occupancy by or of trailers. tentsor movable or temporary dwellings. rooms or sleeping quarters of any kind.
Cellar, A story having more than one-half of its clear heightbelow the average level of the adjoining ground.
Club. Private: A non-profit social organization whose premises arerestrioted to its members and their guests.
Court: An open unoocupied space bounded on three or more sides bythe exterior walls of a building or exterior walls and lot lines.
Court. Inner, A court enclosed on all sides by exterior walls of ~
building or by exterior walls and lot lines on which walls are allowable.
Court. Outer: A court enclosed on not more than three sides byexterior walls and lot lines on which walls are allowable. with ,one side orend open to a streot. driveway, alley or yard.

Dwelling; Gl!oup: A group of' 2 or more dwelling structures locatedon the same lot.
Family: One or more persons living together in one dwelling unitand maintaining a comnlon household, inoluding domestio servants and gratuitousguests, together With boarders, roomers or lodgers not inexoess of thenumber allowed by this ordinance as an aooessory use.
Farm: Any paroel of land oontaining at least 10 aores whioh isused for gain in the raising of' agricultural products, live stook, poultry anddairy produots. It inoludes necessary farm struotures Within the presoribedlimits, and the storage of' equipment used. It exoludes oommercial feed lots,dog kennels, livery or boarding stables, riding academies and the raising offur-bearing animals.
Filling Station: Auy area of land, inoluding struotures thereon,that is used or designed to be used for the suppl~ of gasoline or oil or otherfuel for the propUlsion of motor vehioles and whioh may inolude faoilitiesused or designed to be used for g,'easing, washing, or otherwise cleaning orservioing such motor vehioles, but not collision servioe or painting.
Flammable Liquids: Liquids having a flash point below 200 degreesFahrenheit, closed cup tester. Class I flan@able liquids (e.g. gasoline,ether, liquid petroleum gas) are those having a flash point below 25 degreesFahrenheit. Class II flammable liquids are those having a flash point below70 degrees Fahrenheit but not below 25 degrees Fahrenheit.
Garage, Private: A garage used for storage purposes only and haviqga oapacity of not more than 3 automobiles or not more than one automobile perfamily housed in the buildine; to whioh su oh garage is aooessory, whi oheveris greater. Spaoe therein may be used for not more than one oommeroialvehiole, which shall be used by an oooupant of suoh building, and spaoe maybe rented for not more than 2 vehioles of others than oooupants of the bUildingto whioh suoh garage is aooessory.
Garage, Public: Any garage other than a private garage, availableto the public, operated for gain, and which is used for storage, repair, rental,servioing or equipping of automobiles or other motor vehicles.

Parking Area, Private: An unroofed offstreet area used for the/ same uses as a private garage.
Parking Area, Public: An unroofed offstreet area used for thetemporary storage of self-propelled vehicles and available for pUblio usewhether free, for oompensation or as an acoommodation for clients or oustorners~
Plat: A map, plan or layout of a oity, town, section or subdivisionindicating the ~cation and boundaries of individual properties.
RoomiJ1g House: (See "Boarding or Rooming House".)
Stable. Private: An aocessory building in whioh horses are keptfor private use and not for hire, remuneration. or sale.
S~able~ Public, A building in which any horses are kept forremuneration, hire or sale.
Sign: Any advertisement, announcement, direction or oommunicationprcduced in whole or in part by the construction, erection, affixing orplacing of a structure on any land or on any other structure, or produced bypainting on or posting or placing any printed, lettered, pictured,' figured orcolored material on any building, structure or surface; provided, however, thatsigns placed or erected by the Village or other governmental unit for thepurpose of showing street names or traffic directions or regulations or forother municipal or governmental purposes shall not be included'herein nor shallthis include signs which are part of the architectural design of the building.
Story: That portion of a building between the surface of any floorand the surface of the floor next above; also any portion of a building usedfor human occupanoy between the topmost floor and the roof. For purposes ofheight measurement, in determining the permissible number of stories~ a base;.ment shall be counted but'a cellar shall not be counted.
Stor;, Half: A story under a g~ble, hip or gambrel roof, the wallplates of whicil on at least 2 opposite exterior walls are not more than 2 feetabove the floor of. such story.
Street: A public or private thoroughfare which affords the prinoipalmeans of aocess to abutting property.
Structure: Anything constructed or erectee, which requires permanentlooation on the ground or attachment to something having such location.
Structural Alterations: Any change i.n the supporting members of abuilding or structure, such as bearing walls, columns, beams or girders,
Yard, Front: An open spaoe extending the full width of the lot betweena main building and the front lot line, unoocupied and unobstructed by buildingsor struotures from the ground upward, the depth of whioh shall be the leastdistance between the front lot line and the front of such main building.

Yard, Rear, An open space extending the full width of a lot betweenthe rearmost main building and the rear lct line, unoccupied and unobstructedby buildings or structures from the ground upward except as.hereinafterspecified, the depth of which shall be the least distance between the rear lotline and the rear of suoh main building.
Yard, Side, An"open space extending from the front yard to the rearyard between a main building and the side lot line, unoccupied and unobstructedby buildings or structures from the ground upward. The required width of sideyard shall be measured horizontally from the nearest point of th~ side lotline to the nearest part of the main bUilding.
SECTION V ... ESTABLISHMENT OF DISTRICTS
For the purpose of promoting the public health, safety, morals andgeneral welfare of the community, the Village of Angola is hereby dividedinto the following types of districts,
"Rl" District (One-family Residenoe District)"RZ" District (Two- or mpre family Residence District)
"B rl District (Business District)"I" District (Industrial District)

Said districts are bounded and defined as shcwn on a map entitled"Zoning Map _... Village of Angola" which accompanies and whioh, with allexplanator~ matter thereon, is hereby made a part of this ordinance. TheZoning Map shall .show the effective date of this ordinance and of each sUbsequentamendment to said map, and shall be duly certified by the Village Clerk.
~~ere uncertainty exists with respect to the boundaries of any of theaforesaid districts as shown on the zoning map, the following rules shall apply:
(1) Where district boundaries are so indicated that they approximatelyfollow property lines or extensions thereof, such lines or extensions shall beconstrued to be said boundaries.
(2) Vlllere district boundaries are indicated as approximately following the center lines or right-of-way lines of streets or highways, such cen'carlines or right-of-way lines shall be construed to be such boundaries.
(3) Where district boundaries are so indicated that they areapproximately parallel to the center lir\es or right··of-way lines of streetsor highways, such district boundaries shall be construed as being parallelthereto and at suoh distance therefrom as indicated on the zoning map. If nodistanoe is given, such dimension shall be determined by the use of the scaleon said zoning map.
SECTION VI ... APPLICATION OF REGULi\.TXONS
Except as hereinafter provided:
(1) No building or land shall hereafter be used or occupied and nobuilding or part thereof shall be erected, moved or altered exoept in conformitywith the regulations herein speoified for the district in which it is located.

(2) No building shall hereafter be ereoted or altered
a. To a greater height;b. To aooommodate or house a greater
number of families;o. To have narrower or smaller rear
yards, front yards, side yards, inneror outer oourts; or
d. To have lesser floor area, in theoase of dwellings,
than is specified herein for the distriot in which suoh bUilding is looated.
(3) No part of a yard or other open,space required about anybUilding for the purpose of oomplying with the provisions of this ordinanoeshall be included as a part of a yard or other open spaoe similarly requiredfor another building.
(4) No lot, yard, oourt, parking area or other spaoe shall be soreduoed in area, dimension or oapacity as to make said area, dimension oroapacity less than the minimum required under this ordinanoe. If already lessthan the minimum required under this ordinanoe, said area, dimension orcapaoity shall not be further reduced.
SECTION VII - DISTRICT REGULATIONS
The requirements and limitations hereinafter set forth in a tableentitled "Table of Distriot Regulations", whioh aooompanies and which, withall e~planatory matter thereon, is hereby made a part of this ordinance, shallapply in the respeotive districts as indicated.
SECTION VIII - SUPPLE~ffiNTARY REGULATIONS
The provisions of the "Table Of Distri ot Regulations" shall be subject to additional requirements, limitations and exoeptions in aooordanoe withthe following supplementary regulations. Unless otherwise specified, suohsupplementary regulations shall apply in all districts.
A. Use
1. Aocessory Use Limitations.
,{~) The permitted aocessory uses in any distriot shall nctinolude any use first specified in a less restricted district. In the interpretation of this provision, an "I" district shall be considered the leastrestricted and an "Rl" dis'crict the most res+'ri,cted.. -
- (h) In any "Rl" or "R2" distriot the permitted uses shall notinolude: the establishment of any new aooess driveway or walk to premises situatedin any "B" or "I" district; storage of flammable liquids known as Class I or ClassII in quantities exoeeding 280 gallons: or any home ocoupation for which a busine,ss

She reports that part of the new Beverly Drive is inthe Town of Evans and that the Town has agreed to Il.ccept the portion, if the Vi1.1.agealso agrees to accept the street in the village. However the Board did not like the150 feet llClrth to a dead end on Miller Drive, and suggested to Mrs.Irish that shededica.te 150 feet west on Beverly·lJrivenot as yet improved, but the Board would arrange
. to imprQve this stretoh at their own expense. The Board feels that Miller Drive andBeverly Drive ae S;iown on this map with the exception of the l50 feet mentionedie verydeslrious property and will be a definite asset to the village.
Mr.Claremce Deeker of Miller Drive appeared at meeting and presented a appliCation,for' building permit to erect a building on Miller Drive. He claims that a buildlbng.permit application was given to some employee of the village who rettlrned same to him,un.-approved. A delegation. representing four property owners residi.ng on Erie Roadsouth of Lake Street appeared at mee.ttng and asked for water 'to theirresidences. They agreed to defray all expense in connection with thiswork and asked the village to make the tap from the 10" main on Lake streetand carry same' to south side of this street. They then will carry the linethellfseliles the approximate' 900 feet to their respective residences on ErieRoad. They were informed by the Village that the cost of making this 1" tapfrom the mai.n to the curb box w0\<11d be cost plus 101. and they were lasked .• toa part payment of' $ 60.00 in connection with this work. Individual meter$;will be installed at each· property, but the cost of preparIng theseJpropertiesfor metering also would be at the expenses of the property owne~ ,

Mr.Leonard Lerczak appeared at this meeti.ng and said that the plat as to lotsizes has been approved by Building Inspector Hob.ertson and also that tile ErieGounty Health De'partment has accepted the plat for sanitation.
An examinati.on of the blue print of this plat showed all roads proposed andfuture extensions with exception of portion of Lerczak Drive already acoepted, ##.lJ:Ii#Ylj#l/Jifwill be private roads.
