On Augusl23,2019, I filed a complaint with this Commission against councilmember

Thomas. At preliminary hearing on September 17,2019, this Commission found my

complaint to be supported by just cause. Pursuant to Section 12A-32(b)(2) of the

Code of Ethics, Mr. Thomas engaged the firm of Carter Arnett, selected by the City

Attorney, to represent him in the proceeding from and after the preliminary hearing

carter Arnett's fees and expenses in representing Mr. Thomas totaled $5729.12. As of

Jan.24,2020, Mr. Thomas had made no effort to reimburse the City for this sum. On

date, the City Attorney's Office imposed a payment plan, but it only covers $2590.00

suBrEcr Notice of Repayment for Legal Fees Pertaining to Ethics Complaints

The purpose of this memorandum is to inform you of your obligation to repay the City ofDallas arising from legalfees incurred on your behalf. On January 10,2020, Chris Caso,lnterim City Attorney, contacted me regarding the independent outside attorney that wasretained to represent you in defending the allegations of violations of Section 12A-5(a)and (b) of the Code of Ethics referred to the Ethics Advisory Commission ("EAC") by theEAC's preliminary panel. Section 12A- 32(bX2Xc) of the Dallas City Code provides that ifthe EAC finds that a person commifted a violation of the Code of Ethics, the person shallreimburse the City for the reasonable fees and expenses of the independent outsidecounsel. Carter Arneft, the outside counsel who represented you before the EAC,submifted invoices for the work performed totaling $2,590,00. Because the EAC foundthat you violated Section 12A-5(b), you must reimburse the City for this amount.

You may opt to repay the City in full by check or money order payable to the City of Dallas,delivered to my office, provided we receive the payment by February 21,2020. After thatdate, I will institute the following repayment plan consistent with that required by the CityCouncil Rules of Procedure for collecting compensation adjustments (Ch. 4, $13(c)). Thatprocedure calls for the Chief Financial Officer to collect debts from Council Members viapayroll deductions of substantially equal payments from paychecks paid during thecalendar year in which the debt was incurred.
