Attached is Bill No. 154-32 (COR), entitled, "AN ACT TO ADD A NEW § 7160(1'') OF CHAPTER 7, TITLE 16, GUAM CODE ANNOTATED, RELATIVE TO EXEMPTING FROM VEHICLE REGISTRATION FEE REQUIREMENTS CERTAIN MOTORIZED UTILITY VEIllCLES OPERATED BY GUAM MAYORS IN ACCORDANCE WITH, AND IN FURTHERANCE OF THEIR STATUTORILY PRESCRIBED DUTY TO OVERSEE, COORDINATE AND OTHERWISE UNDERTAKE THE BEAUTIFICATION AND MAINTEN4NCE OF THEIR VILLAGES," which lapsed into law as Public Law 32-102.
It is agreed with 1 Liiles/alum that on occasion it is necessary and in the public interest that village Mayors be able to operate certain motorized utility vehicles upon public roadways, including the routed roads. In doing so, however, the safety of the Mayors and of the traveling public must be made a priority.
Therefore. after consultation with the Federal Highway Administration, it is strongly recommended
that IUhes/a/ura consider amending P.L. 32-102 or the Vehicle Code of Guam to provide that slow
moving vehicles such as motorized utility vehicles which travel at a speed of less than 30 m.p.h.
display a slow-moving vehicle emblem such as shown below when traveling along the public
roadways, including the routed roads. The display of the slow-moving vehicle emblem is a legal
requirement in most states, as it serves to protect the public and save lives.
As depicted here. the slow-moving vehicle emblem is a tluorescent red-orange
triangle surrounded by a rellective dark-red border. The emblem is displayed in
a position visible from the rear for a distance of at least 600 feet when
illuminated by the low-beam headlights of a following automobile.

AN ACT TO ADD NEW § 7160(0 OF CHAPTER 7, TITLE 16 GUAM CODE ANNOTATED, RELATIVE TO EXEMPTING FROM VEIDCLE REGISTRATION FEE REQUIREMENTS CERTAIN MOTORIZED UTILITY VEffiCLES OPERATED BY GUAM MAYORS IN ACCORDANCE WITH, AND IN FURTHERANCE OF, THEIR STATUTORILY PRESCRIBED DUTY TO OVERSEE, COORDINATE AND OTHERWISE UNDERTAKE THE BEAUTIFICATION AND MAINTENANCE OF THEIR VILLAGES.
1 BE IT ENACTED BY THE PEOPLE OF GUAM:
2 Section 1. Legislative ~'indings and Intent. I Liheslaturall Gudhan finds
3 that pursuant to §§ 40112 and 40113 of Division 4, Chapter 40, Title 5, Guam

1 Code Annotated, Guam Mayors are responsible for general mInor repair and
2 maintenance work, including, but not limited to, cleaning, painting, plumbing,
3 planting, collecting and transporting trash and debris, and other similar tasks
4 incident to the general upkeep, beautification and maintenance of their respective
5 villages.
6 I Liheslaturan Gudhan further finds that in perfonning these duties the
7 Mayors and/or their respective staff regularly operate certain motorized utility
8 vehicles, such as multifunctional utilityllogistics and equipment vehicles (mules),
9 gator recreational utility vehicles (gators), and riding mowers.
10 I Liheslaturan Guahan fulther fInds that while the Mayors' operation of
11 these vehicles is primarily limited to the shoulders of public roadways, I
12 Liheslatura recognizes that said operation involves moving onto the travelled
13 portion of public roadways on certain occasions, such as where passage on the
14 shoulder of a road is impossible or othelWise unsafe. Therefore, I Liheslaturan
15 Guahan deems it in the public interest that the village Mayors be able to operate
16 these vehicles upon public roadways under certain circumstances, and, toward this
17 end, that said vehicles, when operated as prescribed by this Act, be exempted from
18 the requirements of Guam's vehicle registration law.
19 Section 2. A new paragraph (f) is added to §7160 of Chapter 7, Title 16,
20 Guam Code Annotated, to exempt from vehicle registration fee requirements
21 certain motorized utility vehicles operated by village Mayors under certain
22 conditions, to read:
23 "(t) A "motorized utility vehicle" may operate in accordance with,
24 and in furtherance of, legitimate Mayoral duties. Mayors, Vice-Mayors,
25 and/or their respective staff may operate motorized utility vehicles, such as
26 mules, gators, golf carts, and riding lTIOWerS on non-routed public roadways,
27 so long as said vehicles are permanently marked with the Mayor's official

1 logo of that municipality, where (1) passage on the shoulder of a roadway is
2 impossible or otherwise unsafe, and (2) the operator of said vehicle is
3 engaged in the perfonnance of Mayoral duties as prescribed by Title 5 GCA
4 §40 101 et seq" and is otherwise acting in accordance with Guam law;
5 provided, that the motorized utility vehicle may operate on routed roadways
6 for the purpose of crossing to get from one non-routed roadway to another.
7 For the purposes of this Subsection, a "motorized utility vehicle" is any
8 Inotorized vehicle primarily manufactured for off-roadway use, which is
9 sixty-three inches (63") or less in width, has an unladen dry weight of one
10 thousand eight hundred fifty pounds (1,850 lbs) or less, travels on less than
11 six (6) wheels, and can travel up to maximum speeds of 20 miles per hour.
12 The registration fee of subject utility vehicles, that are the property of the
13 Mayoral offices, shall be waived."
14 Section 3. Effective Date. This provisions contained herein shall take
15 effect upon enactment of this Act.
