AN ACT TO AMEND § 79601 OF ARTICLE 6, CHAPTER 79, TITLE 21, GUAM CODE ANNOTATED;AND TO ADD A NEW ITEM (v) TO §1515(i)(2)(B) OF ARTICLE 5, CHAPTER 1, TITLE 5, GUAM CODE ANNOTATED, RELATIVE TO THE DEMOLITION OF THE MANUEL F.L. GUERRERO ADMINISTRATION BUILDING IN HAGÅTÑA AS A HOTEL OCCUPANCY TAX (HOT) BOND PROJECT.

BE IT ENACTED BY THE PEOPLE OF GUAM: 1

Section 1. Legislative Findings and Intent. I Liheslaturan Guåhan finds that 2

the Guam Capitol District consists of the grounds and structures comprising the old 3

Guam Congress Building (the old legislative building), Plaza de España, the Manuel 4

F.L. Guerrero Administration Building and, upon the termination or expiration of any 5

leases attached to the property, the Post Office in Hagåtña. Properties included in the 6

Guam Capitol are hereby placed under the control and supervision of I Liheslaturan 7

Guåhan. Moreover, Skinner Plaza was transferred to the Government of Guam 8

pursuant to P.L. 31-23. 9

I Liheslaturan Guåhan further finds that the Manuel F.L. Guerrero 1

Administration Building was constructed in the 1950s; and while the facility has 2

served its purpose, it is now over sixty (60) years old and has serious structural, 3

mechanical, electrical, and environmental issues that create significant safety hazards 4

and render the building unfit for further occupancy, such that all the government of 5

Guam agencies that were utilizing the building have relocated to other office facilities. 6

The cost of rehabilitation to bring the building to current Uniform Building Code 7

standards does not warrant the significant investment of public funds necessary to 8

extend the useful life of the facility. 9

Section 2. § 79601 of Article 6, Chapter 79, Title 21, Guam Code Annotated, 10

is amended to read: 11

Ҥ 79601. Creation of Guam Capitol District. 12

The Guam Capitol District is hereby established, consisting of the grounds and 13

structures comprising the old Guam Congress Building (the old legislative building), 14

Skinner Plaza, Plaza de España, the Manuel F.L. Guerrero Administration Building 15

and, upon the termination or expiration of any leases attached to the property, thePost 16

Office in Hagåtña. Properties included in the Guam Capitol are hereby placed under 17

the control and supervision of I Liheslaturan Guåahan. This Section shall not be 18

interpreted as preventing the development and beautification of Skinner Plaza, as 19

detailed in the Budget Act for Fiscal Year 1998. Government agencies and 20

departments utilizing facilities in the Guam Capitol District shall continue to do so 1

unless subsequently and otherwise indicated by I Liheslaturan Guåhan. The 2

Department of Parks and Recreation, the Department of Public Works and other 3

government agencies that may provide maintenance, security and other services on 4

property within the Guam Capitol District shall continue to do so unless subsequently 5

and otherwise indicated by the Guam Legislature. The provisions of other Sections of 6

this Act do not apply to the Guam Capitol District. Notwithstanding any other 7

provision of law, The Speaker of I Liheslaturan Guåhan may be authorized by 8

Legislative Resolution passed by two thirds (2/3) vote of the Members to negotiate, 9

approve, and execute lease agreements for the premises of the Agana Post Office to 10

the United States Postal Service in one (1) year increments, terminable by I 11

Liheslatura upon no more than one hundred twenty (120) days notice. Leases of 12

property within the Capitol District shall be procured pursuant to procurement laws 13

applicable to I Liheslatura, and shall be approved as to form by Legislative Counsel.” 14

Section 3. A new Item (v) is hereby added to §1515(i)(2)(B) of Article 5, 15

Chapter 1, Title 5, Guam Code Annotated (HOT Bond Law), to read: 16

“(B) for various projects related to Historic Hagåtña to include the 17

following: 18

(i) for the restoration of the walls of the Plaza de España; 19

(ii) for the restoration and rehabilitation of the Plaza de España 20

Azotea; 21

(iii) for the restoration of the Plaza de España Chocolate House; 1

and 2

(iv) for the development of a paver-surface crosswalk and 3

landings on both sides of Marine Corps Drive to provide a 4

proper connection between Skinner Plaza and the Chamorro 5

Village; and 6

(v) for the demolition of the Manuel F.L. Guerrero 8

Administration Building.” 9
