In reference to the site inspection of above cited project on 16th April, 2016, point wise discussion with you and other project executing authorities and subsequent information submitted so far, following are the comments and observations for necessary action at your end. Accordingly, information and 'action taken report' on the following points may be submitted to this office urgently:­

1. Benefit cost ratio alonq with internal rate of return for the project may be intimated. 2. Submit production figures in respect of LPG during the year 2015-2016 and 2016-2017

till date. Inform the schedule for establishment of Ambient Air Quality monitoring stations in consultation with the PSPCB.

Progress about physical and financial progress about the funds utilized in social welfare and eco development activities from time to time

4.

Uploading of six monthly progress report and monitoring reports on the web site of the Company may be ensured.

5.

Submit the schedule for changing Horton spheres into mounded spheres.6. 7. Submit a certificate from the qualified doctor that no occupational disease has

been found so far during medical check up of the workers till end of June, 2016. 8. Submit monitorinq results in respect of VOC & HC for last two years.

PART-II STATUS OF COMPLIANCE

& PART-III

DETAILED MONITORING REPORT

Mis Bharat Petroleum Corporation Limited have set up two nos. of additional tJ mounded bullets of 1445 MT capacity each at Lalru, District-Patiala, Punjab. Plant is located within the existing bottling plant area and no additional land is acquired. The total cost of the project is RS.35.78 Crores.

2.0 The Project is only limited to storage and dispatch of LPG, hence no process water requirement is envisaged. There will be no source of generation of effluent from operation of the proposed storage facility. There will be no increase in road or rail traffic or cylinder filling and dispatch beyond present capacity. The company will change the horton spheres to mounded spheres in a phased manner. No solid or hazardous waste generation is envisaged.

3. Two mounded storage vessels have been completed. Besides them, there are 6 sphere storage vessels. Capacity of mounded vessel is 2890 MT each. The production figures of the LPG Plant during 2013-2014 and 2014-2015 are given below:­

The project proponent has been asked to inform the production figures for the year 2015-2106. The compliance of different conditions is given below:­

S ecific Conditions: The project authorities shall strictly comply Being complied with the provisions made in Manufacture, Storage and Import of Hazardous Chemicals Rules 1989, as amended in 2000 and the Public Liability Insurance Act for handling of hazardous chemicals etc. Necessary approvals from Chief Controller of Explosives must be obtained before commission of project. Requisite On-site and Off-site Disaster Management Plans will be prepared and im lemented.

It is observed that the provIsions made in Manufacture, Storage and Import of Hazardous Chemicals Rules, 1989, as amended in 2000 are being implemented. Following points are worth mentioning:­

.:. MSDS sheets have been displayed for the guidance of the workers in all working areas.

•:. Proper PPP's ie safety helmets, safety shoes, safety trainings are imparted to workers once in a year to cover all the staff members including contract labourers, drivers, security guards and permanent employees.

•:. Mock drill exercise is conducted 2 times in a month in the factory and 2 times in a year with District Administration .

•:. On site and off site Emergency Plans have been prepared and revised in June, 2015.

(ii) Regular Ambient Air Quality Monitoring shall be carried out for VOC and HC besides other parameters in ambient air around the Plant. The location and results of existing monitoring stations shall be reviewed in consultation with the concerned State Pollution Control Board based on the occurrence of maximum ground level concentration and downwind direction of wind. Additional Stations shall be set up, if required. It will be ensured that at least one monitoring station is set up in up-wind & in down-wind direction along with those in other directions. HC detectors shall be installed at sensitive locations.

Ambient Air Quality monitoring stations have not been established so far. It is informed that the budget for RS.2.5 lacs has been received for ~stablishment of two ambient air quality monitoring stations. The stations will be established before March,2017. The ambient air quality is being monitored by an outside approved lab namely International Testing Center, Panchkula. Last monitoring was done in June, 2015 indicating all the results within permissible limits of the PSPCB.

(iii) The proponent shall upload the status of Partially complied compliance of the stipulated EC conditions, including monitored data on their website and shall update the same periodically. It shall simultaneously be sent to the Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB. The criteria pollutant namely; SPM, RSPM, S02, NOx (Ambient levels as well as stack emissions) and VOC shall be monitored and displayed at the convenient location near the main gate of the Company in the public domain.

The status of compliance of the stipulated EC conditions, including monitored data is being uploaded on the website of the project proponent periodically. The PA has been asked to start the same on immediate basis. It is also advised that the results may be sent simultaneously to the Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB. The details of DG sets available in the factory are given below:­

The stack emission from all the DG sets have been monitored by International Testing Center, Panchkula in December, 2015 & January, 2016. All the results are within permissible limits of the PSPCB.

(iv) The storage facility shall comprise of two nos. of additional mounded bullets of 1445 MT capacity each LPG storage vessels and there shall be no change in the Bulk Storage Capacity and other facilities.

(v) As agreed, the company shall change the Being complied horton spheres to mounded spheres in a phased manner. A detailed time bound action plan in this regards shall be submitted to the Ministry's Regional Office within 3 months from date of issue of this letter.

Only two Horton spheres have been changed into Mounded spheres. Further conversion of Horton spheres into mounded spheres is under consideration.

There are 78 workers in the factory. They are medically checked up from time to time in Max Hospital, MohalL Last medical check up was done in June, 2015. No worker has been found affected by any occupational disease.

(viii) Greenbelt shall be developed to mitigate the effect of fugitive emissions all around the plant in a minimum 30% plant area in consultation with DFO as per CPCB guidelines.

Being complied

It is informed that 20 acres of land has been covered by planting 5700 trees and shrubs with an expenditure of RS.3.50 lacs covering species namely Neem, Babool and Safeda. Recurring and maintenance expenditure on plantation is about RS.10.00 lacs per annum.

(ix) Regularly monitoring of VOC and HC in the Being complied Work Zone Area in the Plant shall be carried and data be submitted to Ministry's Regional Office at Chandigarh, CPCB and Punjab Pollution Control Board. Quarterly monitoring of fugitive emissions will be carried out as per the Guidelines of CPCB.

Explosive meters to check the concentration of gas and Leak Detection System have been installed to monitor vac and HC in the Work Zone area in the Plant. The PA has been asked to carry out quarterly monitoring of fugitive emission as per guidelines of CPCB.

(x) The company shall obtain permission for drawl Yet to comply of ground water from the Central Ground Water Authority/Central Ground Water Board.

There are two bore wells for drawal of ground water @ 10 KL per hour. Permission from CGWA is yet to be obtained.

(xi) The Company shall harvest surface as well as rainwater from the rooftops of the buildings proposed in the project and storm water drains to recharge the ground water and use the same water for the various activities of the project to conserve fresh water.

Two rainwater harvesting pits have been constructed to collect rainwater from roof tops and surface run off. The rainwater harvesting pits are cleaned twice in a year i.e before monsoon and after monsoon.

Provision shall be made for the housing of Complied construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, Safe drinking water, medical health care, creche etc. The housing may be in the form of temporary structures to be removed after the completion of the project.

(xii)

B General conditions' (i) The project authorities must strictly adhere to

the stipulations made by the concerned State Pollution Control Board (SPCB), the State Government and any other statutory body.

The Consent to Operate under Air & Water Acts have been extended by the PSPCB upto 31.03.2017 and the Authorization under HW(IVI, H & T) Rules, 2008 has been accorded by the PSPCB with an validity upto 31.03.2020. License from Chief Controller of Explosive has also been obtained which is valid upto 2017. The insurance policy under the Public Liability Insurance Act, 1991 is valid upto 31.03.2017. The PA has been asked to get all the approvals renewed from time to time.

(ii) No further expansion or modifications in the plant shall be carried out without prior approval of the Ministry of Environment and Forests.

No expansion is planned

It is clarified by the project authorities that there is no plan for any expansion of the project in near future.

(iii) The overall noise levels in and around the plant Partially complied area shall be limited within the prescribed standards by providing noise control measures including acoustic hoods, silencers, enclosures etc. on all sources of noise generation. The ambient noise levels should conform to the standards prescribed under EPA Rules, 1989 viz. 75 dBA (day time) and 70 dBA (night time).

Noise level monitoring is being done by International Testing Center, Panchkula which is an outside approved lab. It is informed by the PA that the noise levels are within permissible limits. The PA has been asked to submit monitoring results from time to time.

(iv) The project authorities will provide adequate funds both recurring and non-recurring to implement the conditions stipulated by the Ministry of Envirunm&lil i:lluJ Fure~l~ i:l~ well i:l~

the State Government along with the implementation schedule for all the conditions stipulated herein. The funds so provided should not be diverted for any other purposes.

The PA has been asked to submit the expenditure figures in respect of Environment Management Plans to this office for the year 2015-2016 and 2016­2017(upto May, 2016).

(v) The stipulated conditions will be monitored by the concerned Regional Office of this Ministry /Central Pollution Control Board/State Pollution Control Board. A six monthly compliance report and the monitored data should be submitted to them regularly. It will also be displayed on the Website of the Company.

Partially complied

The project has been monitored on 16.04.2016 and regular submission of six monthly progress report is being ensured. The PA has been asked to submit six monthly progress report in 1st week of December and 1st week of June every year in soft and hard copies both as the report will be displayed on Web site of the Ministry of Environment & Forests in pursuance of the provisions of new EIA Notification no. 1533(E) dated 14th September, 2006 as amended from time to time.

(vi) The project proponent shall also submit six monthly reports on the status of compliance of the stipulated EC conditions including results of monitored data (both on hard copies as well as bye-mail) to the respective Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB.

(vii) A copy of clearance letter shall be sent by the proponent to concerned Panchayat, Zila Parishad/Municipal Corporation, Urban Local Body and the Local NGO, if any, from whom suggestions/representations if any, were received while processing the proposal. (viii) The Project Proponent should inform the public that the project has been accorded environmental clearance by the Ministry and copies of the clearance letter are available with the State Pollution Control Board and may also be seen at Website of the Ministry of Environment and Forests at http://www. Envfor.nic.in . This should be advertised within seven days from the date of issue of the clearance letter at least in two local newspapers that are widely circulated in the region of which one shall be in the vernacular language of the locality concerned and a copy of the same should be forwarded to the concerned Regional office of this Ministry.

The project authorities have informed that the environment clearance has been advertised in the newspapers. However, the copies of newspaper cuttings are yet to be submitted by the project authorities to this office.

(ix) The environmental statement for each financial year ending 31 st March in Form-Vas is mandated to be submitted by the project proponent to the concerned State Pollution Control Board as prescribed under the Environment (Protection) Rules, 1986 as amended subsequently, shall also be put on the website of the Company alongwith the status of compliance of EC conditions and shall also be sent to the respective regional Office of the MoEF be-mail.

The PA has informed that the Environment Statement for the year 2014-20 15 has been submitted to the office of PSPCB. The PA has been asked to submit the Environment Statement to PSPCB in time.

(x) The date of Financial Closure and final approval of the project by the concerned authorities and the date of commencing the land development work as well as the commissioning of the project will be informed to the Ministr and its Re ional Office.

The date of financial closure is 31 st March every year.

(xi) Proper House keeping and adequate occupational health programme shall be taken up. Regular Occupational Health Surveillance Programme for the relevant diseases shall be carried out and the records shall be maintained properly for at least 10 years. Sufficient preventive measures shall be adopted to avoid direct exposure to emission and other H drocarbons etc.

It was upto the project proponent to file the case to National Environment Appellate Authority if they are not satisfied with the EC of the Ministry. But the project proponent has not filed any case so far with the National Environment Appellate Authority as per records available in this office.

(9) The above conditions will be enforced, inter- Being complied alia under the provisions of the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986, the Public Liability Insurance Act, 1991, Hazardous Waste (Management, Handling and Transboundary Movement) Rules, 2008 and Manufacture, Storage and Import of Hazardous Chemicals Rules, 1989/2000 along with their amendments and rules.

The Consent to Operate under Air & Water Acts have been extended by the PSPCB upto 31.03.2017 and the Authorization under HW(M, H & T) Rules, 2008 has been acc'orded by the PSPCB with an validity upto 31.03.2020. License from Chief Controller of Explosive has also been obtained which is valid upto 2017. The insurance policy under the Public Liability Insurance Act, 1991 is valid upto 31.03.2017. The PA has been asked to get all the approvals renewed from time to time.

It is also informed that the ETP of 50 KLD capacity has been established for treating water from washing of LPG cylinders. The ETP is having collection tank, reaction tank and AC and Sand Filters. Treated water is used in green belt. One more ETP of 50 KLD capacity will be installed in due course of time.

Other conditions: Social welfare and Eco Development Activities:

The project authorities have informed that they are conducting various social activities under CSR activities as per details given below:­

1. Conducting safety awareness programme regularly in nearby villages of the plant for enhancing safe use of LPG at homes.

2. Planted various types of saplings and plants in different areas of Plant to increase the eco-development.

3. Releasing new connections in rural areas to save environment.

Funds to the tune of RS.8.5 lacs have been spent on CSR activities by the project proponent during the year 2015-2016.
