We are currently in a longevity revolution. Ourthoughts about aging have had to change over the past 20years as seniors have started staying more active and thusliving longer. Yet living longer sometimes means that as weage, we may find ourselves alone, sitting in our homes star-ing out the window wishing someone, anyone would comeand visit. In some cases, our eyesight is no longer goodenough for us to drive. It is at times like this that one mayfind his or her thoughts going to 'What would it be like to livein a retirement community?' With questions such as . . .'Could I make friends?' . . . 'Would my life be easier and sim-pler in a retirement community?' The answer is yes and yes!That's why the number of adults-only complexes is on therise. They range from small apartment style living to largecustom homes with many upgrades including customizablefloor plans in a security-gated community. Many of themhave their own clubhouses that can be reserved for largerfamily parties, swimming pools with water aerobics classes,walking/biking paths that weave in and around the communi-ty; providing not only exercise but a great way to meet yourneighbors. Some are even built on golf courses. Makingyour home in one of these developments can surely reduce ifnot eliminate one's time spent staring out the window wishingfor a visitor.

When shopping for a retirement community that willbest fit your needs, here are three things to consider. 1)Location - does the climate work for you and any health

needs you have. Is it close enough to shopping, church,freeways, etc? 2) Services & Amenities - there is a largerange of differences from one community to the next in thearea. If your cooking skills are not as good as they oncewere, you may want to find one that offers three meals a dayserved in their dining room. Some of the other services youmay want to consider are housekeeping needs, transportationto and from doctor appointments & shopping trips, snowremoval, lawn care, high-speed internet and cable TV. Dothey have activities and social events that you like? A few ofthe communities have weekly humanitarian and other serviceprojects which not only keep you active but help fulfill one'sneed to give. 3) Safety Features - this list is not as long asthe amenities but may be more important. Here are just afew to keep in mind. Emergency call systems, fire sprinklers,are doors and/or gates secured at night, is there a manager

available 24/7? Does that man-ager live on site?

In short, visit severalretirement communities beforechoosing one. Talk to some ofthe residents and the staff. Ahappy community will come froma combination of both friendlystaff and satisfied residents.

For many, the cost of liv-ing is often the determining fac-tor as to what retirement com-munity you choose. It is impor-tant to realize that you do nothave to give up your entire lifesavings to enjoy the benefits ofthis type of lifestyle. Shoparound until you find the one thatworks for you.

Chicken and waffles is a Soul Food dish combining waf-fles, a breakfast food, with (usually) fried chicken; the waf-fle is then typically covered with butter and/or maplesyrup. This unusual combination of foods is beloved bymany people who are influenced by traditions of Soul Foodpassed down from generation to generation.

Always looking for new menu items at Winger’s, we heardabout Chicken & Waffles from a friend of ours who hadexperienced it at a famous Los Angeles Soul Food restau-rant, Roscoe’s Chicken & Waffles. His rave reviewsencouraged us to research the combination and test it our-selves. We have put our own spin on it using our experi-ence with chicken dishes and re-creating a waffle recipefrom one of our employee’s grandmother. Now we can’tget enough. Our Waffle recipe (Nellie’s Waffles) is a secretformula that we believe makes the combo addictive!!! Wehope you enjoy them as much as we do; and know thatthey are made with love.

Wanting to try the Chicken & Waffles for myself, I couldn’twait for the release of the new menu. My wife on the otherhand was skeptic but willing to give it an honest try. Weordered The Big Stack (Two chicken breasts servedSouthern Style, with Applewood smoked bacon, atop twoNellie’s waffles). We loved it; the chicken and bacon werecooked to perfection, the whole combination worked won-derfully!

Wingers has always done chicken well.(USA Today recent-ly named Winger’s the top place in America for wings)Before we were finished eating we were already talkingabout which of the 4 Chicken & Waffle meals we wantedto try on our next visit.

Their menu is still loaded with all your favorite meals:Chicken & Ribs, Fajitas, Chicken Pot Pie, 4 Burgers 3Sandwiches and a sticky Finger Wrap, just to name a few.

PhilWINGERS – A GOOD TIME WITH CHICKEN!The other day, my wife and I and some friends met atWingers on State Street in Orem for an evening of conver-sation and friendly food.

Winger’s rocks Spring with a new name and menu. Theyhave added Roadhouse Grill to their name, so of coursethere has to be a steak on the menu.

Piedmont Top Sirloin steak is a minimum of 1 inch thick,has less fat and calories than standard beef not raised onthe Piedmont beef ranches in Montana. This is servedwith mashed red potatoes sprinkled with cheese andhouse veggies.

What jumped out to me on the new menu is the Chicken &Waffles. A little history on Chicken & Waffles I think wouldbe helpful (From Wingers):

We all trickled into the diner at different times, and so therestaurant’s tradition of fresh, warm popcorn as the starterwas perfect for the occasion. We could munch and talk andcatch up on recent events in our lives without any rush asthe group gathered.

The popcorn is one of my favorite things about Wingers, butI really go there for the chicken – the Amazing sticky fingersto be exact. They are delicious and they are always the sameand never fail to meet expectations. Wingers has a variety ofgreat choices, including ribs, fajitas, burgers, sandwiches,and salads. And if you have a desire for any of those, theywill definitely fill your longing. But, I always come back tothe chicken. Once my mouth finds something it really likes, ithas a hard time salivating past it to something different.

But for those who don’t want the same thing every time,there are a lot of options, even if you stick with chicken,including ½ barbecue chicken, chicken wings, and a comboplatter with ribs. There’s blackened chicken tacos, blackenedchicken alfredo, cilantro lime chicken, and if you really wantbasic comfort food – chicken pot pie. And if you’re craving asalad, there’s salad with sticky fingers, crispy chicken salad,and bbq chicken salad. Sandwiches include a sticky fingerwrap, cashew chicken salad, and grilled chicken topped withcrispy bacon. Wow! And then there’s the non-chicken itemson the menu…

Our group stayed with a variety of chicken choices and weate and talked and laughed and smacked our lips and lickedour fingers for a couple of hours. It was good the waitressput us in a large booth at the back of the diner so we didn’tbother the rest of the diners! A couple of the gals tried a newdish – the sizzling chicken platter – which included grilledchicken, melted cheese, and mushrooms in a sizzling skillet.It was so good, I kept stealing tastes, and vowed to orderthat one next time around.

For dessert, we all shared the Cookie Zookie, which is afreshly baked chocolate chip cookie served fresh out of theoven(so it takes a several minutes to prepare) and toppedwith vanilla ice cream, hot fudge, pecans and whipped top-ping.

Wingers! It’s a good time, with good chicken and a host ofother choices sure to please the whole group, and thatincludes families with kids who can never agree on whatthey want. Trickle on in the next time you get to hankeringgood food you can count on.

Los Hermanos, tryit again – for the

first time!If you haven’t been to Los Hermanos for awhile, themexican restaurant that has been a fixture in UtahCounty for years, it’s time to try them again – for thefirst time.

The restaurant in downtown Provo recently moved fromthe corner of Center Street and University Ave. to abuilding almost a block east (still on Center Street). Mywife and I and some friends ventured in for the first timein the new location and were pleasantly surprised andimpressed with the whole experience.

The new location is well designed and retains the vintageLos Hermanos feel, but I liked it even better than the old

location (there’s always somethinggreat about a newly remodeled space).And the good experience didn’t endwith the physical location. The staffwas friendly and engaged. Our hand-some waiter was attentive, funny andinterested in us as his guests. Heanswered our questions about the menuwith familiarity and knowledge andkept our chips and salsa, as well as ourdrinks full without our having to waitand wonder.

The food was served to us quickly, very hot, and atleast to my memory was far superior to our previousexperience. Each entrée had its own presentation, andwas unique in feel. Sometimes mexican dishes can seemlike they were all stirred in the same pot – but theseseemed as though they had been prepared individually,with special attention paid to each ingredient.

The guys ordered the smothered chile rel-leno and the gals ordered the LosHermanos Sampler. Both were exquisite.The whole Anaheim chile was just a tadwarmer than mild and had just the rightkick. The egg batter breading was tasty,and there was not too much of it. Ithought the chile could have had a bitmore monterey jack cheese inside, but

then I’m a cheeselover. I was pleasant-ly surprised by howgood the dish wascovered in shreddedbeef! I am usually aflavor separatist, butthis combination wasgreat, and the flavorof the beef comple-mented the chilesuperbly. The sides

of Spanish rice and refried beans were just right. I usu-ally don’t finish the sides, but this night I did.

The sampler platter included measured portions of riceand beans, along with a small street market taco (beef orchicken) in a corn tortilla, a cheese and bean burritoserved enchilada style and a crispy corn taqueno (alsobeef or chicken). Each flavor, again, was separate anddelicious. And the combination was plenty filling at avery comfortable price.

For dessert we tried a cherry empanada, recommendedby our waiter, and it did not fail to please. The soft,warm, and flaky dough, filled with a pie cherry fillingtasted fresh and wasn’t too heavy as the end to a perfectmexican meal.

For a great new experience with a familiar friend, headto Los Hermanos on East Center Street in Provo. You’llbe glad you did and I guarantee you will want to returnagain and again.

the trust. In a normal situation, the Trustor will reserve or retaincertain rights and privileges. The Trustor normally will retain theright to amend or revoke the Trust. This will have important taxconsequences.

The Trustee is an individual, company, or bank, that willact on behalf of the Trust. If you want to relate it to a business, theTrustee is the manager or president of the trust. Again, in a normalsituation, the Trustor will also act as the Trustee during his life-time.

The Beneficiary is the person that has the right to receivethe income, use or benefit from the property that is in the trust.Also, in a normal situation, the Trustor is a beneficiary of theirown trust during his lifetime.

If an individual creates a trust, there are a number ofitems in the trust that will change at the death of the Trustor. If theTrustor is a sole Trustor, on death, the trust becomes irrevocable,or that it cannot be changed. The trust is now written in stone.The next item is that the Trustee will have to be changed. As I design an estate plan, I look at a number of factorsto determine the proper documents to prepare: different propertiesor assets owned, the family structure, the business interests, lifeinsurance as well as the estate planning goals of the individual orcouple, ages of the children, death of a child prior to a parent, andgrandchild or their descendants.

Many people are confused by the concept of trusts. Theyare actually very simple if we break them down to what a trustreally involves. The basic factor of a trust is that there are three (3)classes of individuals involved: Trustor/Settlor/Grantor, Trustee,and the Beneficiary. The trust is an agreement between the threeclasses of individuals.

The Trustor/Settlor/Grantor is the individual that will cre-ate the Trust. By create, I do not mean to say that they are requiredto type or draft the trust. They will sign the trust or agreement andcontribute the property that will comprise the assets or corpus of

you would put in a successor trusteefor the time that the original trusteeis unable to serve. A trust can onlyact through the trustee of the trust.

The beneficiaries wouldchange to the children, grandchil-dren, descendants or others that theTrustor designated in the Trust.These new beneficiaries now havethe right to the income, use or benefitof the trust assets, subject to theterms of the trust.

With this background,there are a number of reasons why I usually recommend a trustover just a simple or complex will. When the estate plan is beingdiscussed we review the circumstances of the individuals and lookat all of the factors that may affect the determination of the besttools such as a will or trust to accomplish their objectives. Someof the important factors that influence that determination are indi-vidual tax issues minor beneficiaries, second marriage and probateissues to determine if the individual would be better served by awill or a trust and will.

Some of the advantages of a trust is that it can deal withtax planning better than a simple will. When an individual passesaway, under the current estate tax law, the individual can pass$2,000,000 to children, heirs and beneficiaries, tax free, this doesnot count transfers to spouses. If the estate is greater than$2,000,000 there are strategies and techniques to transfer on thedeath of the spouses up to $4,000,000 tax free.

The trust handles the transfer of assets to minors, (indi-viduals under the age of 18) or incapacitated and handicappedbeneficiaries better than a will. If a person is a minor, incapacitatedor handicapped, they usually are not able to receive property untilthey reach the age of majority, or they have the capacity to receivethe property. The trust provides you the opportunity to tailor thedistribution of your assets to the needs or limitations of your heirsand beneficiaries.

Trusts often handle the challenges of the plan for distri-bution follow second marriages better than a will. You are able toallow the surviving spouse use of assets, but the final distributionwill be to the identified beneficiaries of the Trustor and not simplyto the beneficiaries of the surviving spouse.

As our we age, the chances that you will be in a situationthat you will need assistance with health care decisions, financialdecisions and assisted living arrangements increases. The use of atrust will allow for the successor trustee that you choose to step inand continue to run you estate without the need of court approval.(I should point out that there are a number of other documents thatyou will need in order to accomplish this completely and that occa-sionally, there is still need for court involvement.)

One of the last advantages of using a trust in conjunction

with a will is the fact that you are notrequired to probate the property heldby a trust following your death.There are limited circumstanceswhere the trust would be probated,but they are few and far between.

In most cases, a trust usedin combination with your will is abetter choice for you estate planningthan a simple will. The use of thetrust will allow for smoother adminis-tration of the estate, less courtinvolvement, and usually less cost tothe estate. One word of caution, just

because you have created the trust, does not mean the end to theestate plan. You now have to transfer all assets to the trust and re-designate beneficiaries to life insurance policies, annuities, 401(k)and IRA=s. This is a very technical part of the process and shouldbe reviewed with your attorney prior to making the transfers.

As you think over the many factors that may or may nothelp you to determine what is best for you, remember that there isnot one deciding factor, but that it is a combination of factors.This is a big step and should be thoroughly reviewed with a pro-fessional.
