Notice

The Chief Promoter of Fabtech Multi State Co-operative Cr d't Society Limited, 1661, Dnyaneshwar Complex, 1661, Dnyaneshwar Complex, 1st Floor Shop No. 8.9.10 (CTS o. 3149/C/2), Miraj Road, At & Post - Sangola, District­Solapur, Maharas tra - 413307, has submitted a proposal for registration of a multi ­State cooperative society under the provisions of Multi-State Cooperative Societies (MSCS) Act, 2002. On scrutiny, the following deficiencies have been observed in he proposal: ­

a) In form No.1, the reasons gi en by the ociety for its r gistration under MSCS Act, 2002 does not s em to be on merit and it can be registered and function under the State Act to achieve the objectives of the society.

b) In Form No.1, the Chief Promoter has given the signing authority to mar than one person.

c) In the membership lists of Maharashtra and Karnataka, full addresses of members have not been given as required under Form No.1 of the Act. Further, in the membership list of Maharashtra, it is observed that many memb IS

profession has been given as Job' which is_not supported by documentary evidence. Further, it is observed that in some places the membership list has been signed by few persons.

d) Membership list for Maharashtra has not been attested by the Chief Promoter.

e) Project report is not satisfa ory. The source of funds for the project has not been mentioned In terms of figures and further, the profit appropriation as required uls 63 of the Act has not been provided. Furt er, the soci ty in the project report has stated that they already enrolled 8410 members and collected an amount of Rs. 1 crore from them as share capital and wher as, the membership list enclosed along with the proposal i eluded only 120 members.

f) The bank certificate stating the balance in favour of the society is very old dat·· November 2015 and whereas, the upda ed bank certificate is required to be enclosed along with the proposal. Further, it is observed from the bank certificate issued by the bank dated 30.11.2015 stating the credit balance in favour of the society as on 19.09.2014.

h) Bye-law No. 3(a)(vi) to (x), (xii) (xv) &. (xvi) are not framed properly.

i) The proposed soci ty is a credit society and whereas, provision has b n made in bye-law No. 4(ii) that multi-State coop rative society, cooperative societies, Central/State Government, NCDC and other institutions have been proposed as members.

j) In bye-law No.6, the proviso as required u/s 25(4) of the MSCS Act, 2002 has not been provided.

k) Bye-law No.7 is not framed properly.

1) In bye-law No. 12, no provision has been made for readmission of members.

m) Bye-law No. 21(i) is vague as shares can be transferred to members only.

n) Bye-law No. 26 is not consistent with provision of section 67 of the Act.

0) Bye-law No. 31(e) is riot framed properly and not consistent with Election Rule 1(f) of Election Schedule annexed with the MSCS Rule 2002.

p) Bye-law No. 35 relating to constitution of Board of Directors is not framed properly in consonance with the provision of section 45 of the Act.

q) Bye-law No.46(ii) is in contravention to the provision of the Act. Meetings of the Board shall be held within the area of operation of the society and not as proposed by any other'places as decided by the board.

r) Bye-law No. 48 is not consistent with the provision of section 51 of the Act.

s) Bye-law No. 55(d) is not framed properly.

t) Resolutions have not been enclosed with the applica ·on.

u) Information of interim board/ list of promoters has not been given by the society.

v) Certificates stipulated u/ s 7(b,c,d) of MSCS Act, 2002 ha e not been enclosed with the application.

4. This issues with the approval of Central Registrar of Cooperative Societies.
