February 24, 2015 Mr. James Brennan West Irondequoit Central School District 321 List Avenue Rochester, NY 14617 Re: Promise Project – DiFiore Construction Value Engineering Items Dear Mr. Brennan: Following the bid opening, the project team was able to meet with the apparent low bidders to review the bid results. The purpose of the meeting is to review the bidders’ values and to identify if there are any issues or scoping items that are of concern. Another item that is requested during this de-scoping meeting is to identify any Value Engineering (VE) items or scope items that may be altered to save the district money from the bid value that was provided. As a result of the Site Work Contract de-scoping process and meetings, the project team and Site Work Contractor, DiFiore Construction, have identified a few Value Engineering Items for the district’s review. These VE items are described in the attached DiFiore Construction letter dated February 13, 2015. The project team has had a chance to review and thoroughly vet the VE items proposed and recommends the following VE items to be accepted by the district: VE #1

- Total Credit of $18,000 to allow a portion of the infill material on the existing turf field to be recycled as the middle layer of the Field Turf Revolution system. The bottom layer of sand and top layer of rubber will be new material. Field Turf has provided the method by which the existing recycled material will be analyzed, removed, cleaned and re-installed, along with the previous projects by which the method was completed. This Field Turf patented process will carry the full warranty as specified in the contract documents.

VE #2 - Total Credit of $33,000 to allow the installation of Beynon BSS-200WB Red Running Track

Surface, in lieu of the specified BSS-300WB Track Surface. The total value of the Value Engineer Items that the project team is recommending to accept is $51,000. If the district agrees to accept the items noted above, the project team will begin the change order process that will be signed in conjunction with the Site Work Contract.

70,100,andthenthepan.Thistestingwilldetermineifitisnecessarytoaddmorerubber

orsandtothemixbeforeredistributingtheinfillintothenewfieldtoensureitmatchesour

patentedrecipeforour3layerinfillsystem.

2.Cleaning/RemovalofExistingInfill

BeforeweremovetheinfillweuseourSMGDeepGroomertocleanthesurface.Thefirst

stepisadeepsweepingandbrushingoftheinfillmaterialsthatremovesalldirt,gum,dust,

skin,blood,andessentiallyanythingelsethatcollectsonyourfield.Partofthesweeping

andbrushingprocessisadeepvacuumingoftheinfillmaterialsthatseparatestheinfill

fromthedirt,dust,etc.Thecleanedinfillisthenredistributedbackintothefield.Wealso

useourpowerfulmagnettoremoveanymetallicitemsfromtheinfillduringthisprocess.

Thecleaningprocessalsodecompactstheinfillmaterials,makingiteasiertoremovethem

forrecycling.

Theturfisthencutinapproximately45”sections.Thenthecutsectionofturfstripsare

fedthroughconveyorthatextractstheinfillfromtheturf.Theemptyturfcarpetis

returnedtotheground,andtheremovedinfillisconveyedintoasupersack.

Thefinalstepisrollingtheemptyturfcarpetandremovingitfromthefield.

3.Re­Installation

Newsandisusedforthebottomlayerofour3layersystem.Additionally,thetopcoating

ofBrubberisnewalso.Therecycledmaterialfromthepreviousfieldisonlyusedto

constructourmiddlemixedlayerofour3layersystem.

Itisimportanttonotethattherecyclingofinfilldoesnoteffectthewarranty,specification,

drainage,g­maxetc.AttachedisalistofFieldTurfprojectsthatwehaverecycledinfillon.

Hi Dave,

In response to Norms comments,

1. The top layer of B rubber, which will be new material is 1/8”. The middle layer, which will

be composed mostly of the recycled material is 1.5”. The bottom layer, which will be composed

of new sand is 1/8”. The total infill depth will be 1.75” for our 2.5” pile height turf.

2. We have no issue taking 10 infill samples in the ASTM GMAX locations and having them

analyzed. We have no issue sharing the results of that analysis with the engineer.

Bids were opened and publicly read. The bid was successful, due in large part to the design team’s detailed drawings and the project team’s recruitment of bidders. By-Laws SUBJECT: DUTIES OF CIVIL RIGHTS COMPLIANCE OFFICERS

The Board will designate at least two Civil Rights Compliance Officers to assure there is at least one male and one female. Compliance Officers are responsible for overseeing all complaints involving federal and state laws protecting civil rights as well as Board of Education policies that address discrimination and/or harassment. The Chief Civil Rights Compliance Officer (also known as the Title IX/ADA/Section 504 Coordinator) will oversee and coordinate the District response to all cases of discrimination and/or harassment that arise. He/she may address cases on his/her own or assign them to Alternate Officers. In addition, complainants may select which Compliance Officer they wish to work with. Compliance Officer responsibilities also include identifying and addressing any patterns or systemic problems that arise during the review of such complaints or at any time and submitting their findings and recommendations to the Superintendent. Title IX, Section 504, and ADA require the designation of compliance officers, but it makes sense to use the same people for all discrimination/harassment issues (Titles VI, VII, IX, Section 504, ADA, DASA and others. This is a new policy that would parallel other “Duties of” policies we already in the 1000s. Before this review, Compliance Officers’ duties were sometimes listed in policies, sometimes not, and their titles were inconsistent (e.g., Title IX Coordinator, etc.). Compliance Officers are expected not only to oversee complaints regarding discrimination and/or harassment, but also to identify and address patterns or systemic problems that may exist.

Notice of Non-discrimination The West Irondequoit Central School District does not discriminate on the basis of an individual’s actual or perceived race, color, weight, national origin, ethnic group, religion, disability, age, sex, sexual orientation or gender identity, political affiliation, familial status, military status, veteran status, domestic violence victim status, arrest or conviction record (except as permitted by law), genetic information or any other basis prohibited by New York State and/or federal non-discrimination laws in its programs and activities. In addition, it provides equal access to the Boy Scouts and other designated patriotic youth groups. Civil Rights Compliance Officer The Board will annually appoint a Civil Rights Compliance Officer whose duties will include coordinating efforts to comply with and carry out District responsibilities with respect to all provisions of its non-discrimination policies and procedures. The Board will also appoint at least one alternate Compliance Officer to assure one male and one female officer is available to respond to complaints or reports of discrimination or harassment. Public Notification Prior to the beginning of each school year, the District will issue an appropriate public announcement which advises students, parents, employees and the general public that all employment and educational opportunities the District operates will be offered consistent with the terms of this non-discrimination policy. In addition, the District will include its Notice of Non-discrimination in other bulletins, announcements, publications, catalogs, application forms, or other recruitment materials that are made available to participants, students, applicants, or employees. Complaint Procedures The Superintendent will establish and maintain procedures for reporting, investigating, and resolving all complaints, grievances, allegations, reports or other issues relating to discrimination and/or harassment.

This is a new policy that will contain WI’s Non-Discrimination Notice as well as the terms requiring its publication and the procedures designed to enforce it. By adopting this policy, the Board adopts the Notice.

The Board of Education is committed to sustaining a productive, supportive, healthy and harmonious environment throughout its programs and venues and to promptly address and resolve complaints and issues brought to its attention. Toward those ends, the Superintendent will establish and maintain procedures for reporting, investigating, and resolving complaints, grievances, allegations, or other questions for which it has responsibility and over which the District has authority. This set of procedures will address issues that do not involve discrimination and/or harassment. Cases involving discrimination and/or harassment will be addressed through separate procedures. (See Policy 1430 and Regulation 1430R.) The procedures authorized through this policy will provide for prompt, thorough, equitable, and objective investigation and resolution of issues. They will also establish levels of appeal for dissatisfied parties up to and including appeal to the Board of Education. This is a new policy. Many policies provide opportunity for students or staff to submit grievances or complaints and to receive a formal response. For complaints that involve discrimination or harassment, the more extensive and elaborate procedure of 1430R should be used. This policy authorizes its associated regulation, which addresses issues that do not involve discrimination or harassment. It does not directly involve Compliance Officers, and it includes one less stage of appeal.

SUBJECT: DISCRIMINATION, HARASSMENT AND THE DIGNITY FOR ALL

STUDENTS ACT General The Board of Education prohibits harassment of anyone by anyone, as well as unlawful discrimination, on District grounds or at District-sponsored functions. Harassment involves hostile words or actions, including but not limited to bullying, taunting, and intimidation, that have the purpose or effect of interfering with an individual’s rights to learn, teach or otherwise function in the District or which may reasonably cause an individual to fear for his/her safety or well-being. This policy includes, but is not limited to, discrimination and harassment based on a person's actual or perceived race, color, weight, national origin, ethnic group, religion, religious practice, disability, sexual orientation, gender or sex. The Board also prohibits acts of discrimination or harassment, including cyberbullying, that occur off school grounds or outside of school sponsored events and which can reasonably be expected to materially and substantially disrupt the educational atmosphere. Such acts may be subject to District intervention and response, and may result in disciplinary consequences. As part of this policy, the Board adopts all provisions of and definitions in the Dignity for All Students Act of 2010 (DASA). The purpose of that act, and of this policy, is to “to foster civility in public schools and to prevent and prohibit conduct which is inconsistent with a school's educational mission.” While all harassment and unlawful discrimination is prohibited under this policy, District resources and training will focus on the protection of students, pursuant to the Act. 1. Raise the awareness and sensitivity of school employees to potential discrimination or harassment, and

2. Enable employees to prevent and respond to discrimination or harassment.

The District will also develop and maintain non-discriminatory instructional and counseling methods. The Superintendent will establish guidelines to be followed in the development and training of staff in these methods.

Dignity Act Coordinator (DAC)

In each building, the District will maintain at least one Board-appointed Dignity Act Coordinator (DAC) who is trained in dealing with human-relations situations with respect to the areas of race, color, weight, national origin, ethnic group, religion, religious practice, disability, sexual orientation, gender, and sex. The DACs will oversee programs designed to raise the sensitivity of students and staff to these human relations situations in their respective locations and will play an active role in prevention, intervention, and follow up to incidents of harassment or discrimination.

Reporting of and Response to Suspected Harassment

The Superintendent will establish procedures by which reports or complaints of harassment or discrimination are received and responded to expeditiously by District officials who are responsible for addressing them. Because of the emotionally-charged tensions that generally accompany situations of harassment or discrimination, the procedures will be applied with sensitivity toward all individuals involved and, to the extent possible, with care to avoid unintended negative consequences.

Staff members who become aware of an incident of harassment, bullying, or discrimination against a student must submit an oral report to the principal or DAC within one school day, and a written report within two school days of the time they learned of the possible offence.

Procedures will include provisions for receiving and investigating reports of harassment or discrimination and of determining appropriate corrective action, and will include opportunities for parties who are dissatisfied with the outcome of an investigation to appeal.

STUDENTS ACT

The District will maintain a minimum of two Compliance Officers, one male and one female. Compliance Officers will play a central role in provisions for investigating reports of harassment or discrimination as specified in procedures established by the Superintendent. In addition, Compliance Officers will be responsible for reviewing cases to determine whether any District policies, procedures, training, or programs should be adjusted in order to better prevent harassment and discrimination, and to advance a culture of respect for individuals and for the District’s educational environment. Officers will submit any concerns and recommendations that emerge from their reviews to the Superintendent.

The District Notice of Non-discrimination, including names and contact information of Compliance Officers responsible for assuring non-discrimination in the District, is available in all main offices or through THIS LINK.

Incidents of harassment or discrimination that occur within a building will be addressed at the Building Level. Incidents involving more than one building should be submitted directly to the Superintendent’s Level.

Prohibition of Retaliatory Behavior (Whistleblower Protection)

No person who, acting reasonably and in good faith, reports suspected discrimination or harassment or participates in a related investigation will be subject to any retaliation on the part of the District or its employees. A person who, acting reasonably and in good faith, reports suspected discrimination or harassment or participates in a related investigation will not be subject to any retaliation on the part of District or its employees. Knowingly Making False Accusations

Employees and/or students who knowingly make false accusations of discrimination or harassment may also face disciplinary consequences.

Reporting to the Commissioner

Pursuant to the Dignity for All Students Act, the District will report incidents of discrimination and of harassment of students to the Commissioner through the channels and in the manner that the Commissioner requires.

SUBJECT: SEXUAL HARASSMENT: PERSONNEL OF STAFF The Board of Education affirms its commitment to non-discrimination and recognizes its responsibility to provide for all West Irondequoit personnel an environment that is free of sexual harassment and intimidation. Sexual harassment, including sexual violence, is a violation of law and stands in direct opposition to Board of Education policy. Therefore, the Board prohibits and condemns all forms of sexual harassment by employees, school volunteers, students, and non-employees such as contractors and vendors which occur on school grounds and at all school-sponsored events, programs and activities including those that take place at locations off school premises or those that take place in another state.

Definitions

Generally, sexual harassment is defined as unwelcome sexual advances, including requests for sexual favors or other verbal or physical conduct or communication of a sexual nature. In addition, sexual harassment occurs when such conduct and/or communication has the purpose or effect of substantially or unreasonably interfering with an individual’s work performance or creating an intimidating, hostile or offensive work environment. Sexual harassment also occurs when submission to sexual advances is, either explicitly or implicitly, made a condition of an individual’s employment or is used as a basis for employment decisions affecting an individual.

Sexual violence is defined by New York Penal Law as physical sexual acts perpetrated against a person's will or where a person is incapable of giving consent. Sexual violence includes but is not limited to acts such as:

Pursuant to Policy 3413 and Regulation 3413R, provisions will include the right for parties who are dissatisfied with the outcome of an investigation and the accompanying remedy to appeal to a higher level. launch appeals up to and including appeal to the Board of Education. All parties involved in a complaint will receive written notification of the outcome and of any corrective action the District intends to take to remedy the situation.

Any staff member or volunteer who believes he/she has experienced sexual harassment in the school environment or any other person who becomes aware of or suspects an occurrence of sexual harassment should immediately inform his/her principal or supervisor and/or a Compliance Officer. Outcomes

If an investigation determines that an employee, student, or other person has violated the terms of this policy and/or accompanying regulations, corrective action will be taken as warranted. Should the offending individual be a student, appropriate disciplinary measures will be applied, up to and including suspension, in accordance with District policy and regulation, the Code of Conduct, and applicable laws and/or regulations. Prohibition of Retaliatory Behavior

The Board prohibits any retaliatory behavior directed against complainants, victims, witnesses, and/or any other individuals who participated in the investigation of a complaint of sexual harassment. Compliance Officers and administrators will conduct follow-up inquiries to ensure that sexual harassment has not resumed and that all those involved in the investigation of the sexual harassment complaint have not suffered retaliation. The complaint procedures will include affirmative steps to prevent and respond to any retaliatory behavior.

Finding That Harassment Did Not Occur

At any level/stage of investigation of alleged harassment, if a determination is made that harassment did not occur, the Compliance Officer or investigating administrator will so notify the complainant and the alleged offender of this determination. Such a finding does not preclude the complainant or the offender from filing an appeal pursuant to District policy or regulation and/or pursuing other legal avenues of recourse.

Compliance Officers

Compliance Officers shall be informed of any report and investigation of a sexual harassment complaint that occur. They will provide oversight, guidance and, where appropriate, direct involvement. In addition, they will seek to identify any patterns and/or systemic problems regarding sexual harassment in the District and will offer corrective recommendations to the Superintendent.

Privacy Rights

As part of the investigation, the District has the right to search all school property and equipment including District-owned computers. Rooms, desks, cabinets, lockers, computers, etc. are provided by the District for the use of staff and students, but the users do not have exclusive use of these locations or equipment and should not expect that materials stored therein will be private.

Awareness

In accordance with the provisions of General Municipal Law and the collective bargaining agreements, all District personnel shall have the opportunity to present their complaints or grievances free from interference, coercion, restraint, discrimination or reprisal. The District shall provide at least two procedural stages and an appellate stage for the settlement of any grievance.

Complaints or grievances not covered under employee contracts shall be handled and resolved, whenever possible, as close to their origin as possible. The Superintendent is responsible for implementing regulations for the redress of complaints or grievances through proper administrative channels. Complaints and Grievances Coordinator

Additionally, the Board shall ensure compliance with Title IX of the Educational Amendments of 1972, Section 504 of the Rehabilitation Act of 1973 and the Americans With Disabilities Act (ADA). The Superintendent shall designate a District employee as the Title IX/Section 504/ADA Coordinator and regulations and procedures shall be implemented to resolve complaints of discrimination based on sex or disability.

Prior to the beginning of each school year, the District shall issue an appropriate public announcement which advises students, parents/guardians, employees and the general public of the District's established grievance procedures for resolving complaints of discrimination based on sex or disability. Included in such announcement will be the name, address and telephone number of the Title IX/Section 504/ADA Coordinator.

Like 6121, this policy is revised to align it with the standard discrimination/harassment procedure (1430R). While the policy still contains a number of details, many have been removed since they appear in (and apply to) the complaint procedure, 1430R. (This policy parallels 6121: Sexual Harassment: Personnel.)

The Board of Education affirms its commitment to non-discrimination and recognizes its responsibility to provide for all West Irondequoit students an environment that is free of sexual harassment and intimidation. Sexual harassment, including sexual violence, is a violation of law and stands in direct opposition to West Irondequoit District policy. Therefore, the Board prohibits and condemns all forms of sexual harassment by employees, school volunteers, students, and non-employees such as contractors and vendors which occur on school grounds and at all school-sponsored events, programs and activities including those that take place at locations off school premises or those that take place in another state.

Definitions

Generally, sexual harassment is defined as unwelcome sexual advances, including requests for sexual favors or other verbal or physical conduct or communication of a sexual nature. In addition, sexual harassment occurs when such conduct and/or communication has the purpose or effect of substantially or unreasonably interfering with a student's academic performance or participation in an educational or extracurricular activity; or of creating an intimidating, hostile or offensive learning environment; or of effectively barring the student from access to an educational opportunity or benefit. Sexual harassment also occurs when submission to sexual advances is, either explicitly or implicitly, made a condition of a student’s academic status.

Sexual violence is defined by New York Penal Law as physical sexual acts perpetrated against a person's will or where a person is incapable of giving consent. Sexual violence includes but is not limited to acts such as:

a) Rape

b) Sexual assault

c) Sexual battery

The Board of Education will designate, at a minimum, two (2) Compliance Officers, one (1) of each gender. Students who believe they have experienced sexual harassment may select which Compliance Officer they wish to work with.

Complaint Procedures

The Superintendent will establish and maintain procedures for reporting, investigating, and remedying allegations of discrimination and/or harassment, including sexual harassment. A copy of the procedures (1430R) may be obtained in any District main office or through THIS LINK.

The procedures for reporting and responding to cases of possible sexual harassment of students will be the same as those established for any case of harassment and/or discrimination under Board policy 3413 Discrimination, Harassment, and the Dignity for All Students Act¸ and its accompanying regulation, 3413R. Pursuant to Policy 3413 and Regulation 3413R, provisions will include the right for parties who are dissatisfied with the outcome of an investigation and the accompanying remedy to appeal to a higher level. The procedures will comply will all aspects of guidelines provided by the United States Department of Education Office of Civil Rights. They will include stages of appeal and specific time frames for investigating and responding to complaints and for the submission of appeals. Complainants and alleged offenders will have equal rights to present evidence and to launch appeals up to and including appeal to the Board of Education. All parties involved in a complaint will receive written notification of the outcome and of any corrective action the District intends to take to remedy the situation.

Any student who believes he/she has experienced sexual harassment in the school environment or any other person who becomes aware of or suspects an occurrence of sexual harassment should immediately inform his/her principal, a Compliance Officer, or any trusted staff member (teacher, counselor, administrator, or any other staff member). Staff members who receive such reports will immediately transmit them to the principal and a Compliance Officer. Even in the absence of a complaint, if the District has knowledge of or has reason to suspect any occurrence of sexual harassment, it will investigate such conduct promptly and thoroughly.

Each student attending West Irondequoit programs shall have equal access to educational opportunities and will not be excluded or prevented from participating in or having admittance to the educational courses, programs or activities, school services, and extracurricular events on the basis of race, color, ethnicity, creed, religion, national origin, political affiliation, sex, sexual orientation, age, weight, marital status, military status, veteran status, disability, or use of a recognized guide dog, hearing dog or service dog.

SUBJECT: CAREER AND TECHNICAL (OCCUPATIONAL) EDUCATION Though not part of the BOCES packet, we should also fold this policy into the group tied into the standard complaint procedure (1430R). This is West Irondequoit’s “CTE” program and falls under the same auditing jurisdiction as BOCES.

The Board of Education recognizes the need for occupational education and reaffirms its policy of strengthening the local high school occupational program through utilization of any available federal and state funds for that purpose and of supporting the BOCES program. Equal Opportunity
