Who can be a Qualifi1JinD Relative QRIl1 ?

• For the purposes of the extreme hardship assessment, the OR must be the applicant's USC spouse or USC parent.

• "Parent" includes step-parent, out of wedlock parent. or adoptive parent, if the specific requirements of INA 101 (b )(1) are met

• The OR does NOT have to be the immigrant visa petitioner.

• Under certain circumstances, the OR can be the applicant's deceased USC spouse or parent.

• The applicant may have more than one QR (e.g. USC spouse, USC father, and USC mother) but only needs to show extreme hardship to one.

• Although the applicant might identify a specific OR on his/her application, the adjudicator should look for and consider any evidence that might support an EH determination involving a different individual who could also be a OR.
