1. BACKGROUND

The Government of Tripura after considering all issues related to operation andmanagement of the Pensioners’ Awaas - “Ashray" has decided to constitute aSociety for the purpose for the Pensioners" Awaas -- “Ashray".

2. AIMS AND OBJECTS

Pensioners” Awaas — “Ashra\/' shall be managed and maintained in all respects by a"-registered Society. 1

The objects and purposes for which the Society is established are:

respects by the Governing Body. l_-lowevenit may form sub-committee(s), fromamongst its official members or their representatives and non-official members, forthe day to day management, control, supervision and works of ‘Ashray'.

immediately after formation/registration of the Society, operation and managementof the Pensioners‘ Awaas - “Ashray" shall be taken over by the Society, along with allthe properties! assets thereof, from the Department of Social Welfare & SocialEducation, Government of Tripura.

No assets, land or building(s) of the Pensioners’ Awaas - “Ashray"' shall be used forany other purpose than as envisaged in the Memorandum of Association and Rulesof the Society. S

The society shall maintain all relevant documents, files, registers, including details ofboarders, minutes record register etc., as may be needed for the purposes ofoperation and maintenance of “Ashray".

There shall be a Bank Account, preferably in Nationalized Bank, in the name ofSociety, to be operated jointly by any two of the following Member Secretary of theGoverning Body, Joint Director. SW&SE(member of the Governing Body), andOfficer in -charge of ‘Ashray’. All receipts in the name of Pensioners‘ Aawaas shallbe deposited into that Account. Monthly report on physical and financial status of themanagement of the Pensioners‘ Awaas — “Ashray" shall be sent to the Social Welfare8‘ Social Education Department by the Joint Director, SW&SE.

The Society mayengage outside agencies for up-keeping, sweeping, house-keepingand other services in the Pensioners’ Awaas — “Ashray" after observing all codalformalities. The Society shall provide services to the occupants — boarders onpayment of charges, as per rates, as may be notified from time to time.

For proper management and smooth functioning of the Pensioners’ Awaas —‘Asnray”. Society may e "gs persons through outsourcing or on contract basis.mth the approval cf the Governing Body.

The Society may establish a Recreation Club from amongst the boarders.

The Governing Body may form Sub-Committee! Sub-Committees from amongst thepensioners. Govt. officials and persons possessing expertise, ability and experiencefor other activities —- e-g. it-leaith C-are/recreation/Library etc. .

The Governing Body may make provision of a room for First rlid as well as healthcheck up of the boarders of the Awaas. It shall take necessary steps for procuringarnbuiance. rnedicines etc. for the Awaas.

The relative of the boarders can stay at the Awaas for a temporary period underunavoidable circumstances, subject to availability of accommodation. The temporaryperiod will be limited to 7(seven) days at the most. The boarders will, however, haveto bear the expenditures as may be fixed by the Governing Body for the temporaryboard & lodge of their relative in the Awaas “Ashray".

Visitors can meet the boarders of the Awaas “Ashray" during the time that may befixed for the purpose.

9 1 Deposit of advance~iri“the event of an application made by aPensioner/ Family Pensioner for admissionto the Pensioners‘ Awaas "Ashray" being accepted, the applicant selected for beingtaken in as a boarder shall have to deposit an advance of Rs..30,000.00 (RupeesThirty thousand) only, for the time being. The amount so deposited shall berefunded to the boarders as and when they leave the Awaas subject to adjustment oftheir dues, if any, and maintenance charges (20%). g

in the event of death of a boarder while residing in the Awaas “Ashray", if any dues isoutstanding, payable to the Awaas, the dues will be adjusted against the depositedadvance of Rs.3U,UElG.O0 (Rupees Thirty thousand) only made by him I her to theSociety and the balance will be refunded to the nominee of the boarder. Unclaimedfund shall remain with “Ashray". '

Service ChargesEvery boarder shallhave to pay an amount of Rs.2,000.00 (Rupees two thousand)only per month, for the time being, as service charges.

Charges for food ' -Every "boarder shall have to pay a sum of Rs.5,000.00 (Rupees five thousand) onlyoer month. for the time being, as charges for food, as estimated at the present rate.

3. Headquarter of the Society :

The registered office-of the Society for Management of Pensioners‘ Awaas “Ashray”shall be at Kunjaban, PO- Kunjaban, Agartala, West Tripura, Pin-799006.

4. Members of the Society

' The number of members of the Society would be as per Societies Registration Act,‘L560 & Rules. The members of the Society shall be assented by Government ofTripura. The membership of the Society will be from the following:

(i) Representatives of the State Government or any other Government authority as Ex-officio members. '

(ti) Representatives of Government Pensioners of Tripura, which includes persons fromthe following categories Scheduled Castes, Scheduled Tribes, Physically challengedand at least one women member. x

(iii) Persons possessing special expertise, ability or experience relevant to thefurtherance of the objective of the Society. Representation may be by name anddesignation, as may be deemed appropriate.

5. Termination of Ex-officio membershipWhere a person becomes a member of the Society by virtue of office or appointmentwhich he/she holds. hi:sr’her membership of the Society shall stand terminated when

Validation of ActsThe Society shall function notwithstanding vacancy any of its bodies and no actdirection of proceedings of the Society shall be invalid merely by reason of suchvacancy or any defects in the appointment of any of its members.

(ii) To undertake any other activities those are consistent with the aims andobjectives of the Society. ~

(iii) To make, alter and revise the Rules and Regulations of the Society consistentwith the provisions of the Societies Registration Act, 1860.

(c) All properties of the Society shall vest in the Governing Body.

13. Powers ofthe Chairman of the Governing Body

(a) The Chairman shall preside over all meetings of the Governing Body.fl-

(b) She/he, if necessary, shall direct any other member to conduct proceedings of any__ S meeting of the Governing Body, in her/his absence.

14. Meeting of the Governing Body

ta) The Governing Body shall meet as and when considered necessary for thes transaction of business of the Socieh; provided that the interval between two

meetings generally shall not exceed three months.

The Sub-Committee (s) may exercise powers and execute functions, for thepurpose of management of affairs of the pensioners Awaas, as may be entrusted to itby the Governing Body, including to run the day to day affairs of the Society andactivity incidental or ancillary there to and to execute the decisions which may betaken by the Governing Body for the affairs of the Society.

Budgeting, Planning, Programming, implementation, supervision and monitoring ofthe activities of the Society.

Exercise all executive and financial powers of the Society, subject to such directions,as may be issued by the Government of Tripura and Governing Body from time totime. ' ,

In particular and without prejudice to the generality of the foregoing provisions, theSub-Committee(s) may‘:

ii) Consider annual and supplementary budget placed before it and recommendwith such modification as may be deemed necessary, for submission to theGoverning Body;

Engage staff as per strength sanctionedby the Governing Body, observing- codal formalities. '

The members of the Sub- Committee(s), except govt. officials, may be paidconveyance charge @ Rs.i50l- (Rupees One hundred fifty) only for each sitting.

Proceedings ofthe meetingA book of proceedings of the Sub-committee shall be maintained and all business ofthe Sub-committee shall as far as possible be recorded in the said book.

All disputed questions regarding the business of the Society shall be referred to theGoverning Body for settlement.

Minutes of each meeting vvill be circulated to all members of the Society preferablywithin seven days of holding the meeting.

Secretaryhe Director of the Nodal Department shall be the Member Secretary of the Society formanagement of Pensioners’ Avvaas “Ashray".

The Member Secretary shall see that affairs of the Society are run efficiently and inaccordance with the provisions of the Memorandum of Association, Rules andRegulations and bye laws of the Society. To run efficiently the Pensioners‘ Avvaas“.-’1“~tshray", the Member Secretary may delegate his/her power if any, to thesubordinate officer not below the rank of Joint Director subject to approval of theGoverning Body of the Society.

The Society may sue or be sued in its name and may be represented by theMember-Secretary ofthe Governing Body to all intents and purposes.

Funds of the Society.-

The funds cf the Society snail consist of the following:

Revenue generated from Pensioners’ Avi/aas”“Ashray".§'

Grants received from the Government of Tripura.

Ail funds received by vvay of grants, gifts. donations and in any other manner fromany source i Boarders.

Loan from financial institutions I banks for the purpose of achieving the objectives ofthe Society.

Budget tThe annual budget showing the estimated receipt and expenditure shall be approvecby the Governing Body. V

Maintenance of funds

All money credited to the fund of the Society shall be deposited in an account of thebank operated at Agartala (preferably nearby to the society) as approved by theGoverning Body.

Funds will be drawn from the account of the Society only through cheques.

Accounts of the Society will be operated jointly by any two of the following, Member-Secretary of the Governing Body, Joint Director, SW&SE, who is a member of theGoverning Body, and Officer -in -- Charge of ‘Ashrayi.

Audit of accounts

The Society shall cause regular accounts to be kept of its moneys. The accountsshall be maintained in such form as may be applicable, as per instructions of theAccountant General.

The accounts of the Society shall be audited annually by a Chartered Accountantsiirrn appointed by the Governing Body and from the office of the Accountant General,Tripura! Director of Audit, Government of Tripura,

At the close of each guartera consolidated account showing the total receipts andpayments during the quarter under detailed head of accounts should be preparedand submitted to the Governing Body. _

Immediately after audit and preferably within April, the Society shall hold its AnnualGeneral Meeting with agenda point etc. for arranging budget , passing of accounts,approval of new plan, amendments etc.

The Annual Report of the working of the Society and all work undertaken during theyear, together with balance sheet and audited accounts shall be prepared for

A draft of the Annual Report along with the audited accounts of theSociety and the Auditors Report thereon, shall be placed before~therGoverningcBody"in its Annual Meeting. One set of Annual Report shall be submitted to the office of theRegistrar of Societies, Govt. of Tripura along with other required documents.

Authentication

All orders and decisions of the Society shall be authenticated and conveyed underthe signature of the Member-Secretary or any other member of the Governing Body,as authorized by the Governing Body.

Amendments AThe Rules & Regulations of the Society may be amended by the Governing Body asper provisions ofthe Societies Registration Act, 1860.

Suit I Proceeding by or against the SocietyThe Society may sue or be sued in the name of the Society in a court of competentjurisdiction at Agartala.

Every decree or order against the Society in any suit /proceeding shall be executableonly against the property of the Society.

Dissolution

If the members, not less than 3/5*“ members of the Governing Body, determine thatthe Society shall be dissolved, it shall then have to be dissolved with the approval ofthe State Government. Upon dissolution and satisfactory discharge of liabilities, ifthere remains any residual property of the Society, it will be disposed off suitably withthe approval of the State Government.

MiscellaneousEvery member of the Society shall be bound to abide by the rules and decisions ofthe Governing Body. Any act considered being detrimental to the Society will lead tocanceliation of hisiher membership of the Society as may be decided by theGoverning Body.
