Department of Community Planning Date: July 21, 2021 Subject: HY001-21 Gillam Way: A request by the State of Alaska Department of
Transportation and Public Facilities to replat four (4) parcels, with two (2) of the parcels being reduced in size and (2) of the parcels being affected with new public right-of-way easements, to provide for Gillam Way reconstruction.
Location: The property is located within United States Survey No. 849 and within Sections 10 and 15, T.1S., R.1W., F.M., specifically on the east side of Gillam Way between 22nd Avenue to 14th Avenue within the City of Fairbanks, Alaska.
I. REQUEST SUMMARY
Per ADOT&PF’s application for local government approval, this project is described as:
• Project Description: This project proposes to reconstruct Gillam Way, from 22nd
Avenue to 14th Avenue.o Repaving;o Constructing ADA-compliant sidewalks throughout the project limits;o Providing shoulders for shared-use bicycle facilities on both sides of Gillam
Way;o Installing traffic-calming features, including intersection bulb-outs and
traffic circles;o Improving the storm drain system; ando Updating signing and lane striping.

• Purpose: The project proposes to reconstruct the corridor to meet currentstandards, improve pedestrian access, comply with the Americans with DisabilitiesAct (ADA) access requirements, and introduce traffic-calming measures tomaintain acceptable speeds in the corridor.
A more thorough description of the project may be found in the FNSB Transportation Planner’s staff report (Attachment 1), which was presented to the FNSB Planning Commission at its June 26, 2018 meeting.
Sheet 1 from the preliminary plat is shown below (Figure 1). The entire sheet set of the preliminary plat is part of this staff report packet.

II. GENERAL INFORMATION

Current Zoning The roadway is bordered by several land-use zoning types, including Multiple-Family Residential/Professional Office (MFO), General Commercial (GC), Outdoor Recreation (OR), Light Industrial (LI), Multi-Family (MF), and one lot of Light Commercial with Special Limitations (LC/SL). (Attachment 2)

III. PROPERTY HISTORY
As required by AS 35.30.010, the Local Planning Authority Approval for the Gillam Way Restoration project, Alaska Project No. 0655012/Z637840000, was completed by one action of the Fairbanks North Star Borough. It was approved on June 26, 2018, by the FNSB Planning Commission. Therefore, no further action was required for the local planning review process of this project.
IV. FLOOD ZONE
The request is located in Flood Zone X: Protected by Levee (100%) (Figure 2)

V. WETLANDSIt appears the project contains no wetlands, as depicted by the Fish and Wildlife mapping of the National Wetlands Inventory (Figure 3).

VI. PUBLIC NOTICEThe Community Planning Department notified 18 parcels and mailed 10 “Dear Property Owner” notices prior to July 7, 2021.
VII. FNSB IN-HOUSE REVIEWTransportation Planning: Gillam Way requested and received Local Planning Authority Approval on June 26, 2018. The project was constructed the following year in the summer of 2019. There was minimal right-of-way acquisition, and no variances were anticipated based on the ROW acquisition. Community Planning—Transportation has no further comments. (D Galligan, Transportation Planner IV.)

Zoning: Current Planning has no objections. Both Lots 5 and 6 of Block 25 Rickert Subdivision remain above the minimum lot size for the MFO zoning district in Title 18.56.030. There is not an established use on either lot. Title 18.104.080(B) requires property owners to receive a zoning permit before any excavation, construction, relocation, or installation is started for a new use. (S Bingham, Planner II.)
Flood: DOT HY001-21 is located in Flood Zone X: Protected by Levee (100%) and is not required to meet FNSBC 15.04 Floodplain Management Regulations. (N. Durham, Floodplain Administrator.)
Rural Services: No comment was provided. (F Sheesley, Rural Services Engineer.)
Land Management: Land Management property remains unaffected, so we have no objections to this platting action as proposed. (Daniel Welch, Land Officer.)
Assessing: No comment from Assessing. (Brenda Holladay, Title Examiner.)
VIII. AGENCY AND UTILITY REVIEW
ADOT&PF staff issued the statement that utility coordination is standard on all of their projects. AS 19.25 provides them the authority to authorize utilities in its highway rights of way, and 17 AAC 15 allows them to permit utilities in its highway rights of way. All affected utilities on this project (GVEA, ACS, GCI, FNG, and GHU) were relocated elsewhere in the ROW, or new ROW or easements was obtaining on their behalf. ADOT&PF staff stated that local Utility Coordination is complete.
IX. SUBDIVISION ANALYSIS
Current ADOT staff realized that FNSB platting authority approval had never been granted for this project. Although all property acquisition has occurred, all public utility easements have been obtained, and construction has been completed, it is important that the Platting Board consider this request for approval and that the right-of-way acquisition requirements of FNSBC 17.28 be met. As required by AS 35.30.010, the Local Planning Authority Approval for the Gillam Way Restoration project, Alaska Project No. 0655012/Z637840000, was granted approval by the FNSB Planning Commission on July 26, 2018.
This right-of-way (ROW) project involves the acquisition of two fee parcels and two easement parcels. For the purpose of this staff report, the acquired portions will be referred to as ROW parcels, and the remaining portions will be referred to as remainder parcels.

The ROW easement parcels at the intersection of Gillam Way and 19th Avenue combined are approximately 6,386 square feet (SF). Parcels E16 and E17, are outlined in red below. (Figure 4)

The ROW parcels at the intersection of Gillam Way and 20th Avenue combined are approximately 7,198 square feet (SF). Parcels 8 & 9, are outlined in red below. (Figure 5)

Acquisition of the ROW parcels prior to Platting Board approval and recording of the right-of-way acquisition plat is in accordance with FNSBC 17.28.030 (E), “The state, its agencies, instrumentalities, and political subdivisions may acquire or obtain conveyances, including dedication of lots or tracts of a right-of-way acquisition plat, before submittal of a right-of-way acquisition plat for approval by the borough. A right-of-way acquisition conveyance may be recorded before approval and recording of the right-of-way acquisition plat.”
The four ROW parcels have been assigned Parcel Numbers Designation by ADOT, Parcel No. E16 and E17, and Parcel No. 8 and 9. No parcels required a Title 18 variance to minimum lot size, and no parcels are requiring a Title 17 variance. Moreover, the project does not change the function of the roadway or connecting roadways.
ADOT&PF has fulfilled the submission requirements required by FNSBC 17.28.020, which states,

“A government right-of-way acquisition plat submitted under this chapter shall contain the following information:
A. The location (including section, township and range), name, projectnumber and plat number, if applicable, of the acquisition project;
B. The proposed timetable for acquisition and construction;C. The dimensions and area of the acquired parcel or of the parcels to be
acquired and of each remainder parcel;D. The names of the property owners identified by parcel.”
X. COMPREHENSIVE PLAN
This project is located within the Urban Area. As noted by the FNSB Transportation Planner in his 2018 staff report for the Planning Commission,
“This project is consistent with the goals and policies of the Fairbanks North Star Borough Comprehensive Plan in that it ensures the transportation needs are adequately and safely met.
This project is supported in the following sections of the FNSB Comprehensive Plan. The most pertinent portion of the Plan is Transportation and Infrastructure Goal 1: “To have a safe, efficient, multi-modal transportation system that anticipates community growth.”
1. Strategy 1, Action C: “Ensure that road designs improve safety andminimize adverse impacts…Integrate pedestrian-friendly sidewalks andbike trails.”
2. Strategy 1, Action D: “Retain the integrity of neighborhoods as the roadnetwork expands.”
3. Strategy 3: “Make the Borough more pedestrian-friendly in urban andsuburban areas and safety in rural and remote areas.”
4. Strategy 4, Action B: “Encourage use of non-motorized transportationsystems.”
XI. SUBDIVISION RECOMMENDATION
Staff recommends preliminary approval of the right-of-way acquisition plat for the Gillam Way Restoration project, Alaska Project No. 0655012/Z637840000, with the following conditions:

1. The monumentation requirements of FNSBC 17.28.030 shall be adhered to anddepicted on the final plat.
2. As provided in FNSBC 17.28.040(C), the final plat shall be submitted within 60months of the Platting Board’s approval.
XII. FINDINGS OF FACT
Staff further recommends the adoption of the staff report and the following findings:
1. This project is a proposal by the Alaska Department of Transportation & Public Facilities in cooperation with the Alaska Division of the Federal Highway Administration.
2. Acquisition of the two fee parcels and two easement parcels are in accordance with FNSBC 17.28.030 (E).
3. The applicant has satisfied the submission requirements of FNSBC 17.28.020.4. The FNSB Planning Commission recommended approval of this project.5. As required by AS 35.30.010, the Local Planning Authority Approval for the Gillam
Way Restoration project, Alaska Project No. 0655012/Z637840000, was granted approval by the FNSB Planning Commission on July 26, 2018.
6. The FNSB Transportation Planner supports this project.
Recommended Subdivision Motion:
I move to approve the right-of-way acquisition plat for the Gillam Way Restoration project, Alaska Project No. 0655012/ Z637840000, w ith the two conditions, adopting the six findings of fact and the staff report in support of approval.
