Suspended for poor performance or race bias? In a Maryland hospital a worker, Mrs.
Larson, a black woman born in Haiti, has been employed since 2004. She was changed to the
day shift in 2006 where she began a relationship with a co-worker. That relationship began to
give her problems and it began to affect her work performance. She began to make lab

mistakes for which she was written up for 2 times and suspended for 3 days. She also had to
retrain for 2 weeks.
Mrs. Larson¶s performance did not improve. She was called in to a meeting where the
attendees that except her were white and U.S. born. She did not want to participate and she left
the meeting in tears. She resigned the next day. She filed a law suit against the hospital for race
and national-origin discrimination. The court ruled in the hospitals favor because of Mrs.
Larson¶s performance problems. She did try to appeal but because other employees who were
white, were disciplined the same way for similar performance, the court still ruled in the
hospital¶s favor.
Pepsi settles dispute over criminal background checks for $3.13 million. A claim was
filed with EEOC by applicants at Pepsi. Applicants said that they were not being hired by Pepsi
because of their background checks. The offenses were minor which had no bearing on the
type of work they were applying for.
The EEOC investigated that 300 black applicants were not selected by Pepsi to be hired
because they were convicted of minor offences. Pepsi decided to settle for $3.13 million. They
will also offer employment to those who are qualified to work. Pepsi has also agreed to give the
EEOC regular reports on its hiring practices and the training for managers.

some of the following reasons to call in sick:

Some employers are a little more flexible with employees to use their sick time. They let
employees use their sick time to take care of personal business. Emergencies do happen and
employers understand that employees need to take time off. The employees best bet is to be
honest with their managers when having to call in sick.
