humankind by permanently prohibiting the basing of weapons in space

by the United States, and to require the President to take action to

adopt and implement a world treaty banning space-based weapons.

Be it enacted by the Senate and House of Representa-1

tives of the United States of America in Congress assembled,2

SECTION 1. SHORT TITLE.3

This Act may be cited as the ‘‘Space Preservation Act4

of 2001’’.5

SEC. 2. REAFFIRMATION OF POLICY ON THE PRESERVA-1

TION OF PEACE IN SPACE.2

Congress reaffirms the policy expressed in section3

102(a) of the National Aeronautics and Space Act of 19584

(42 U.S.C. 2451(a)), stating that it ‘‘is the policy of the5

United States that activities in space should be devoted6

to peaceful purposes for the benefit of all mankind.’’.7

SEC. 3. PERMANENT BAN ON BASING OF WEAPONS IN8

SPACE.9

The President shall—10

(1) implement a permanent ban on space-based11

weapons of the United States and remove from12

space any existing space-based weapons of the13

United States; and14

(2) immediately order the permanent termi-15

nation of research and development, testing, manu-16

facturing, production, and deployment of all space-17

based weapons of the United States and their com-18

ponents.19

SEC. 4. WORLD AGREEMENT BANNING SPACE-BASED WEAP-20

ONS.21

The President shall direct the United States rep-22

resentatives to the United Nations and other international23

organizations to immediately work toward negotiating,24

adopting, and implementing a world agreement banning25

space-based weapons.26

SEC. 5. REPORT.1

The President shall submit to Congress not later than2

90 days after the date of the enactment of this Act, and3

every 90 days thereafter, a report on—4

(1) the implementation of the permanent ban5

on space-based weapons required by section 3; and6

(2) progress toward negotiating, adopting, and7

implementing the agreement described in section 4.8

SEC. 6. NON SPACE-BASED WEAPONS ACTIVITIES.9

Nothing in this Act may be construed as prohibiting10

the use of funds for—11

(1) space exploration;12

(2) space research and development;13

(3) testing, manufacturing, or production that14

is not related to space-based weapons or systems; or15

(4) civil, commercial, or defense activities (in-16

cluding communications, navigation, surveillance, re-17

connaissance, early warning, or remote sensing) that18

are not related to space-based weapons or systems.19

SEC. 7. DEFINITIONS.20

In this Act:21

(1) The term ‘‘space’’ means all space extend-22

ing upward from an altitude greater than 60 kilo-23

meters above the surface of the earth and any celes-24

tial body in such space.25

(2)(A) The terms ‘‘weapon’’ and ‘‘weapons sys-1

tem’’ mean a device capable of any of the following:2

(i) Damaging or destroying an object3

(whether in outer space, in the atmosphere, or4

on earth) by—5

(I) firing one or more projectiles to6

collide with that object;7

(II) detonating one or more explosive8

devices in close proximity to that object;9

(III) directing a source of energy (in-10

cluding molecular or atomic energy, sub-11

atomic particle beams, electromagnetic ra-12

diation, plasma, or extremely low frequency13

(ELF) or ultra low frequency (ULF) en-14

ergy radiation) against that object; or15

(IV) any other unacknowledged or as16

yet undeveloped means.17

(ii) Inflicting death or injury on, or dam-18

aging or destroying, a person (or the biological19

life, bodily health, mental health, or physical20

and economic well-being of a person)—21

(I) through the use of any of the22

means described in clause (i) or subpara-23

graph (B);24

(II) through the use of land-based,1

sea-based, or space-based systems using2

radiation, electromagnetic, psychotronic,3

sonic, laser, or other energies directed at4

individual persons or targeted populations5

for the purpose of information war, mood6

management, or mind control of such per-7

sons or populations; or8

(III) by expelling chemical or biologi-9

cal agents in the vicinity of a person.10

(B) Such terms include exotic weapons systems11

such as—12

(i) electronic, psychotronic, or information13

weapons;14

(ii) chemtrails;15

(iii) high altitude ultra low frequency16

weapons systems;17

(iv) plasma, electromagnetic, sonic, or ul-18

trasonic weapons;19

(v) laser weapons systems;20

(vi) strategic, theater, tactical, or extra-21

terrestrial weapons; and22

(vii) chemical, biological, environmental,23

climate, or tectonic weapons.24

(C) The term ‘‘exotic weapons systems’’ in-1

cludes weapons designed to damage space or natural2

ecosystems (such as the ionosphere and upper at-3

mosphere) or climate, weather, and tectonic systems4

with the purpose of inducing damage or destruction5

upon a target population or region on earth or in6

space.7
