    Annexure-I

    GENERAL INSTRUCTIONS FOR TENDERERS

    All tenderers must carefully observe the following instructions:-

    1. Offers / tenders not strictly in accordance with these instructions shall be liable torejection.

    2. Tenders must be completed in all respects.

    3. Telegraphic / Fax offers will not be accepted.4. Tenders should be submitted by Registered post or by hand. All pages should be

    duly signed & stamped by authorized representative of the firm as a token ofacceptance of terms/ conditions & scope of work of NIT.

    5. Offers / tenders should positively reach before last date prescribed for theirreceipt. Those received late will not be considered irrespective of whether thesame was sent by registered post or otherwise.

    6. Only those firms are eligible to quote who have purchased tender set fromRGTPP or have downloaded the same from HPGCL website and are depositingthe tender cost along with Part-I offer.

    7. All corrections made in the tender should be attested with full signatures.

    8. Tenders / offers received without earnest money shall be straight way rejected.9. The offers / tenders should be typed or written in ink. Any thing written in pencil

    in the offer / tender shall be ignored. All cancellations, overwriting and insertionsshall be duly attested by the tenderer.

    10. In case, the date of submission / opening of tenders happen to be a holiday or aholiday is subsequently declared on that day, the tenders will be received /opened on the next working day following the holiday at the same time & place.

    11. Since the contractor will be handling sophisticated equipments, he must haveproper skilled staff that has already worked on similar jobs.

    12. The firm should either be registered with the Labour Commissioner, Haryana orshould get himself registered immediately after the award of the work. The

    payment can be withheld for the want of the registration certificate.

    13. STUDY OF TENDER DOCUMENTS.Before quoting, the tenderer shall carefully study all the clauses and specificationsof the tender documents. If tenderer has any doubt for the meaning of any portionof the tender specifications or find discrepancies or the tender documents issuedare incomplete or need clarification in technical aspects, scope of work etc., heshall at once contact the authority inviting the tender for clarification beforesubmission of the tender. No arguments on this account whatsoever shall beentertained after the last date & time of submission of tenders.

    14. INSPECTION OF SITE OF WORK

    Before submission of tender, the tenderer is advised to inspect the site of work, theenvironment & get himself acquainted with the actual work & other prevalentconditions, facilities available. No claim will be entertained later, on the ground oflack of knowledge.

    15. EARNEST MONEY.a) The tenderer shall be required to deposit earnest money of Rs.25,500/- only in one

    of the following forms: -i) Demand draft drawn on the State Bank of Patiala payable at Hisar in favour of

    Sr. A.O. RGTPP, Khedar, Hisarii) Cash at counter of RGTPP, Khedar, Hisar in the form of BA-16.iii) Earnest money in the name of any Officer other than mentioned above & in any

    other form will not be accepted.b) The earnest money of successful tenderer will be treated by the HPGCL as part of

    the security deposit for faithful execution of the contract.c) The Bank charges, if any, will be to the account of tenderer.d) No claim shall be entertained against the HPGCL in respect of interest on earnest

    money deposit.e) The failure on the part of tenderer to honour his commitment given in the tender will

    constitute a default and in that event, his earnest money will stand forfeited byHPGCL.

    f) EMD shall also be forfeited in case the tenderer withdraws his tender at any stageduring the currency of his validity period.

    g) The earnest money should be submitted in a separate envelope along with Part-I,which should bear the words Earnest money amount Rs._ _ _ enclosed. The

    envelope should be properly sealed & signed by the tenderer. Tender Enquiry No.& due date should also be mentioned on the Envelope.

    16. SUBMISSION OF TENDERa) Tenders should be submitted in two parts, addressed to Executive Engineer / BMD-

    I, RGTPP, Khedar, Hisar-125122. Part-I shall comprise of technical bid containingthe scope of work, General / Technical terms & conditions & deviations, if any,along with the earnest money (Annexure-II, Annexure-III, Annexure-IV and

    Annexure-V of tender document). Part-II shall comprise of price bid only(Annexure-II). Both Part-I & Part-II are required to be submitted in separate sealedcovers, each super-scribed with Tender Enquiry No. quoted for. Both thesecovers be enclosed in another envelope duly sealed & super-scribed with TenderEnquiry No. and the fact that Earnest money amount of Rs. _ ___ is enclosedwith Part-I tender. Part-I shall be opened on due date & time and Part-II shall beopened on subsequent date which shall be intimated to those tenderers whosePart-I is accepted.

    b) The tenders will be received in the office of Executive Engineer / BMD-I, RGTPP,Khedar, Hisar up to 1300 hours on the date of submission and will be opened onthe same date at 1530 hours in the presence of the tenderer or his / their

    representatives who may like to be present.

    17. RATES / PRICE QUOTIING METHODi) The tenderer shall quote the prices in English Language and international

    numerals. If any mistake is found between the words & figures, the lower valuementioned either in words or in figures shall be considered.

    ii) The rates quoted by the firm should be firm and inclusive of all levies, duties or anyother tax levied by State / Central Govt. during the period of the contract if notspecified.

    iii) All the taxes considered while submitting the offer must be defined. The applicablerate of service tax shall be indicated. If there is any variation i.e. increase /decrease in these taxes, during the contract period, the same will be to theaccount of HPGCL.

    18. ACCEPTANCE /DEVIATIONThe Tenderers should record acceptance of all instructions and terms &conditions. Any deviation in the terms & conditions of tender document shouldspecially be brought out in tender under the head Schedule of deviations-Annexure-V, with reference to sections and clause numbers in the tenderspecification, failing which, it shall be presumed that all the terms & conditions aslaid down in tender documents are acceptable to the contractors.

    19. RATE QUOTING SHEET (PRICE-BID)The tenderer will quote his rates STRICTLY AS PER THE RATE QUOTINGSHEET AT ANNEXUREII (Part-A & B).

    20. At any time before dead line for submission of tender, HPGCL may modify thetender document by issuing an addendum and extend the date of receipt andopening of tender.

    21. The authority inviting tenders reserves the right to accept or reject any or alltenders, without assigning any reasons and will not be responsible to pay for anyexpenses or losses that may be incurred by the tenderers in preparation of thetenders.

    22. Tenderer shall certify in the part-I tender that their firm is not black listed by anystate/ central Govt. Organisation during the last 5 years & they would be liable for

    the consequences of wrong declartion.

    23. VALIDITYThe validity of tenders should atleast be for a period of 90 days from the date ofopening of Part-II of tender i.e. Price Bid.

    24. The contract shall be awarded to the tenderer whose total overall rates (Fixedrates for Part-A & Unit rates for Part-B combined) are lowest.

    Annexure-II

    SCOPE OF WORK FOR PART-AAMC FOR GENERAL / ROUTINE / PREVENTIVE MAINTENANCE OF BOILER & ITS

    AUX. FOR 2X600 MW UNIT-I&II at RGTPP, Khedar, Hisar.

    The jobs detailed below shall be carried out by the firm round the clock as perrequirement to ensure smooth & trouble free operation.

    A (i). Boiler & AuxiliariesI OIL GUNS

    1. Removal, cleaning by steam / diesel oil & refitting of HFO/LDO guns as perrequirement of system.

    2. Repair / rectification of the HFO / LDO guns assembly including replacement ofHFO / LDO Guns clamp, oil & steam flexible hose pipe connections etc.

    3. Replacement of hose pipes of scanner and igniter guide pipe, oil guns coolingsystem and igniter cooling system, if required.

    4. Cleaning of HFO / LDO Guns Chamber, flow meter and other equipment

    5. While cleaning the guns if, any oil is splashed that has to be immediately gotwiped off.

    II HFO / LDO PUMPS

    1. Cleaning / Replacement of HFO / LDO filter of Pressuring Pump House &Unloading Pump House, strainers in steam and HFO / LDO line in Unit-I&II.

    2. Checking of oil level of HFO / LDO Pumps in Pressuring Pump House &Unloading Pump House in Unit-I&II and top up the same.

    3. Cleaning of oil trays of HFO pumps / LDO pumps HFO Pressuring Pump House& Unloading Pump House in Unit-I&II.

    III Burners Tilt Mechanism

    1. Up Keeping of burners tilt mechanism, clearing of any jamming includingcleaning.

    IV Soot Blowing System

    1 Up keeping of soot blowing system, oiling /greasing of drive mechanism including

    LRSB's and cleaning of components

    2. Providing assistance during soot blowing, manual withdrawal during stuck up ofsoot blower in advance position.

    V ID Fan, FD Fan, PA Fan, Seal Air Fan, Scanner Air Fan & Seal Air Blower

    1. Top up of Oil in lube oil tanks, bearing housing etc.

    2. Preventive mtc. of Fans & blowers, checking of lube oil pumps, cleaning of filters(oil coolers/ oil chambers if required ).

    3. Attending minor oil leakages from lub oil systems & fans.

    4. Checking of vibration as and when required.

    5. Attending any jamming problem of damper / gate.

    6. Checking & tightening of clamps of expansion bellows of ID/FD/PA fans.

    7. Cleaning of filters of scanner air fans.

    VI ESP1. To check and attend any abnormal sound from gearbox of rapping mechanism.

    2. To regularly clean oil and dust from the gear boxes of rapping mechanism.

    3. Opening & closing of man holes of ESP for checking of fields.4. Checking of collecting & emitting rapping system.

    5. Repairing of worn/ damaged manhole and making leak proof by changing glandrope etc.

    6. Routine / preventive mtc. of rapping gear box and other equipment of ESP alongwith checking and top up of oil as per requirement.

    7. Cleaning of shaft insulators.

    8. Manual opening & closing of ESP inlet & outlet gates if required.VII Rotary Air Pre-Heater

    1. Servicing /removal of choking problem of suction and discharge pipe lines of lube

    oil system including cleaning of lube oil coolers & filters of RAH.2. To attend minor air/ gas leakage from RAH and connecting ducts by applying

    silicate/ M. seal.

    3. Toping up of oil in Support & Guide Bearing & gear boxes installed on RAH andassociated preventive mtc. work.

    4. Preventive mtc. of RAH soot blowing.5. Priming of lub oil pumps as & when required.

    VIII CBD SYSTEM, SCAPH SYSTEM & BY PASS DAMPER.1. Thorough cleaning of all above equipments, piping & structure etc. of all

    plant including minor repair if required and upkeep of area surroundingthe same.

    2. Attending of leakages of air, oil & water.IX DG SETS ( EMERGENCY DG SETS)1. Topping up oil in DG sets & water (coolant) in radiator.2. Carrying out the routine maintenance including filter cleaning etc.3. Assisting the service carried out by the OEM Engineer.4. General fault attending including tightening of loose nut/ bolt or

    gasket changes etc.X COMMON ACTIVITIES1. Attending of oil / steam / water leakage in pump house and all steam

    including oil guns, tracing lines including minor modification/repair of pipeline including gas cutting, grinding & welding up to 2 inch pipeline.

    2. Replacement of gland packing / gasket of various oil/steam / air valves andpipe line.3. Replacement of hose pipes of water/ lube oil/Air System.

    4. Attending oil/water leakage from various joints / flanges /unions in the lubeoil system and bearing cooling water system including replacement ofdamaged flanges, unions, valves etc. of all boiler auxiliaries excluding coalmills and feeders.

    5. Topping up of oil in pumps, fans, actuators and gear boxes.

    6. Attending leakages of manholes / peepholes by providing asbestos ropesand tightening of bolts including its opening & closing in boiler area &ducting.

    7. Refixing of any dislocated skin casing / cladding in the area is under thescope of work.

    8. Attending the minor leakage of HFO / LDO / Steam / Air & Water from theoil line flanges / valves at any location at boiler, pressurizing pump house,unloading pumps, oil transfer pumps, drain pumps, day oil tank area andstorage tank area.

    9. Any day to day routine / preventive maintenance work including minorwelding of broken cleats, supports and brackets etc. as per the instructionsof Engineer-in-Charge.

    10. Checking and minor repair of CC pumps viz. leakage / choking of coolingsystem etc.

    Note:-

    1, Above works related to routine / preventive maintenance are of indicativenature and may be carried out periodically. Out of the above jobs, someactivities will be required to be undertaken as per site requirement on dailyneed basis.

    2. Any of the work relating to above scope not indicated but required to becarried out as per site requirement is deemed to be included andcontractor shall accomplish the same at no extra cost.

    Annexure-IIITECHNICAL TERMS & CONDITIONS

    1. Consumables for cutting & cleaning and all small items required for handling& maintenance jobs will be arranged / provided by the firm. In casecontractor fails to bring sufficient consumables to site without which HPGCLwork is suffering, HPGCL shall be procuring the same from the market and

    recover the cost from the contractor's bill @1.5 times the purchase price ofthe item. All the welding electrodes to be used will be provided by HPGCLfree of cost.

    2. Contractor has to make his own arrangement for welding set and weldingleads, wire brush, welding torch, gloves, bulbs, wires and holders fortemporary lighting etc. at work place.

    3. All tools and tackles like spanners, chain pulley block, hydraulic jack,ortablegrinding machine, hoisting arrangement, hand operated bending machineand drilling machine, personal protective equipments for the safety ofworkers, safety belt, minor scaffolding material etc. shall have to bearranged by the contractor. However available T&P like EOT Cranes andspecial fixtures installed at site, will be available to the contractor free ofcharge and contractor will be responsible for upkeep of the electric hoist.Any minor repair required for electric panels, pendent Switch andreplacement of wire rope if required shall be in scope of the firm. However, ifEOT hoist is not available due to any reason, the contractor shall make hisown arrangement for completion of the work.

    4. The entire work shall be completed by the contractor within the time given byEngineer-in-Charge and to achieve this, contractor has to work round theclock. However, in case of any delay in the supply of spare parts in time orany job involving machining etc., the time extension shall be given

    accordingly by the HPGCL.5. All spares, bolts, nuts, grease, lubricants and gaskets, seals, O rings ,electricity supply for welding set / lighting, water and air etc. if required forany job will be issued free of charge by HPGCL.

    6. The description of works has been given in the scope of work in Part-A & Bof Annexure-II of the tender document. However, in case of any new job,the rate shall be decided by HPGCL on the representation of the contractor.It will be obligatory on the part of the contractor to carry out left over jobsrelating to the system.

    7. The work shall be started immediately after getting written/verbal instructionsfrom the authorized representative of the Engineer-in-Charge.

    8. Any temporary Platform/ minor scaffolding etc. required to execute any workshall be in the scope of contractor.

    9. The electricity for carrying out the welding / cutting / other site works & forsite office at nearest point will be provided free of cost. The contractor will beresponsible to use the same judiciously.

    10. The transportation of material from site to workshop & vice versa will be inthe scope of contractor. The contractor will assist the loading / unloading ofspares, if the same are to be got repaired from any private workshop.

    11. The transportation of spares & other material from O&M store to site store orplace of work & transportation of scrap to store yard will be in the scope of

    contractor.12. After attending the job, the area will have to be got cleaned / cleared and

    scrap etc. to be removed from site. In case Engineer-in-Charge feels that thearea has not been cleaned / cleared properly, HPGCL has the right to getthe above work done from other agency at the risk and cost of thecontractor.

    13. If required, the space for office and store can be provided if available byHPGCL. The site office should be well painted and constructed in such away that it should give a good look.

    14. The removal of insulation, G. I. sheet / AL Sheet up to one meter square orso to carry out any job & re-fixing the same after completing the job will be inthe scope of contractor.

    15. In case spares are not available at site or in store and same are required tobe removed from other equipments i.e. boiler & its auxiliaries etc., thecontractor is bound to do same without any extra cost.

    16. The dismantled spares, new spares, kept at site for emergency use shouldbe properly stacked, kept cleaned and covered properly in safe custody.

    17. If the grating of platform / stairs, railings, etc. get damaged while carrying out

    the repair work, same shall be rectified / repaired by the contractor.18. Contractor will arrange all measuring instruments like micrometers, vernier

    calipers, scales, dial gauge, hydraulic testing pumps for coolers etc.

    19. Additional manpower will be required to be mobilized during overhauling ofany unit and the contractor will ensure adequacy of manpower so thatoverhauling works are completed in time.

    20. The contractor shall make an arrangement so that his authorizedrepresentative is available round the clock at specified location to takemaintenance job on all days including Sundays / Holidays. The Supervisor /Foreman deputed by the contractor should be technically sound and shouldhave full know-how of the boiler & its auxiliaries.

    Annexure-IV

    GENERAL TERMS & CONDITIONS

    1. PRICESThe rates shall be firm inclusive of taxes & statutory duties (except servicetax at the applicable rate) during the period of contract.

    2. PERIOD OF CONTRACTThe period of contract shall be for one year from the date ofcommencement of work. A notice of seven days shall be given for startingthe job, but the contractor should be able to mobilize his resources within24 hours, if necessity arises. The period of contract may be extended up tothree months at the same rates & termsand conditions at the discretionof HPGCL.

    3. PENALTY / DEDUCTIONS

    a) i) If the quality of work is not upto the satisfaction of Engineer-in-Charge orthere is delay in attending of jobs of Part-A, a penalty @ 2% of the

    monthly lumpsum charges shall be levied on the contractor for eachdefault.a. ii) If the contractor does not provide sufficient labour i.e. a Gang of minimum

    three Tech. + three Helper round the clock for each unit , two technician +two helpers in general duty and two Supervisor/ foreman for supervisionduriing day/ night per unit for technical maintenance jobs and for carrying outactivities under Part-A of Scope of Work then a penalty of Rs. 500/- perperson per shift shall be levied.

    b. For the works covered under Part-B, a penalty @2% per hour (if completiontime is in hours) or @ 2% per day (if completion period is in days) shall belevied, subject to max.10% of total rate of that particular item. The completion

    time as per work order will be indicated in the indent.c. If any unit is put under shut down for overhauling, then the period ofoverhauling i.e. date of box up of boiler to date of light up of boiler will betreated as total time for completion of any or all items of works. If the timetaken for the completion of any or all items of works exceeds theshutdown period of the unit, penalty @2% per day per unit shall be leviedon the total charges to be paid to the contractor for the activitiesscheduled to be carried out during shutdown period.

    d. In case, HPGCL is unable to supply the spares in time to the contractorafter opening of any equipment and the contractor is unable to completethe job in absence of these spares, then the contractor will be allowed the

    extension in scheduled time for completion of that delayed activity forthe period for which contractor has not been provided the spares. Thisextension will be granted with the approval of SE / Incharge, RGTPP,HPGCL, Khedar, Hisar. In case any spares of the equipment underoutage are to be repaired & machined in the HPGCL / Private workshop andthe job getsdelayed, the extension in completion time will also be consideredaccordingly with the approval of SE / Incharge, RGTPP, HPGCL, Khedar,Hisar. However, nothing extra will be paid for idling time etc.

    4. FORCE MAJEURE

    Contractor shall not be liable for any delay for reasons arising out ofcompliance with regulations, orders or instructions of Central / State Govt.,

    acts of the God, acts of civil and Military authorities, fires, floods, strikes,lockout, freight embargoes, war-risk, riots, civil commotion, epidemicsand accidental. If the contractor wants to extend the completion periodunder this clause, he will request for such extension of the completionperiod alongwith all necessary evidence, before the expiry of the scheduledate of completion. In no case, the completion period shall be extendedunder this clause, in case the request is received after the due date ofcompletion. Extension in the completion period may be granted only for theperiod for which the completion of the work is proved by the contractorto have been delayed for circumstances mentioned in the clause.

    5. NEGLIGENCE

    If the contractor neglects to execute the work with due diligence andexpedition or refuses to do the work, then HPGCL may serve 15 daysnotice, in writing to the contractor to make good the failure within the

    stipulated time otherwise HPGCL shall be at liberty to take the workwholly or partially at the risk and cost of the contractor at a reasonableprice. It shall be lawful for the HPGCL to retain any balance which mayotherwise be due to the contractor on any account, if dues of thecontract are not sufficient to cover the amount thus recoverable from thecontractor and to recover the whole of the balance of the amount from thecontractor by action at law or otherwise. The remedy under this clause willbe in addition to and without prejudice to rights available to the HPGCL under

    other clauses of the terms and conditions.6. SUBLETTING NOT ALLOWED

    Contractor shall neither sublet the contract nor suspend the work at anytime during the period of contract without any lawful excuse and withoutthe earlier permission of the project authorities.

    7. SECURITY DEPOSIT AND EMD

    10% of the monthly running bill will be retained as security deposit fromeach running / monthly bill of the contractor. However, the earnest moneydeposited by the contractor shall be adjusted into the security deposit.

    Security Deposit & EMD shall be returned to the contractor after the faithful execution and satisfactory completion of contract includingguarantee / warranty period and completion of all pending documentaryformalities. No claim for interest on security amount shall be acceptable. Ifthe contractor fails or neglects to observe or perform any of his obligationsunder the contract, it shall be lawful for the HPGCL to forfeit either inwhole or in part at its absolute discretion, the security deposit furnishedby the contractor. The forfeiture of security deposit shall be withoutprejudice to the right of the HPGCL to recover any further amount of anyliquidated or other damages, under payments or over payments made to thecontractor under this contract or any other contract.

    8. PERIOD OF LIABILITY

    The contractor shall give guarantee for the work done for a period of 45 daysor 500 running hours whichever is earlier from the date of successfulcommissioning of equipment repaired. During the liability period, if anydefect is observed in the equipment, which is attributed to poorworkmanship or poor quality of material used by the contractor, the sameshall be attended by the contractor at his own cost.

    9. DOCUMENTATION / BILLING

    All measurements shall be in metric system. All the works completed willbe measured by the representative of the Engineer-in-Charge. The

    contractor will submit the bill in triplicate on approved Performa to theEngineer-in-Charge. The bill for works covered under catego ry A i.e.works for General / Routine / preventive maintenance will be raised intwo parts, half for each Unit-I&II respectively. For works covered undercategory "B" i.e. the works for which unit rates are applicable, the bill willbe raised separately for Unit-I&II as per the actual works carried out foreach unit.

    10. ENGAGEMENT OF ADEQUATE LABOUR

    The contractor would station adequate working persons of the categorylike FM/ supervisor / high pressure welder, technician / fitter, welder cum

    gas cutter, riggers skilled / unskilled, electrician etc. and would deploy themin such a way that the maintenance work is carried out effectively andwithout any delay round the clock. However, contractor shall make hisarrangement to deploy minimum one fitter / technician, one welder cumgas cutter, one rigger and three helpersround the clock per unit as job isof continuous nature. No extra payment on this account will be made. Thework shall have to be started immediately as per the instructions ofEngineer-in-Charge or his representative. The contractor should be able tomobilize the working force as per the quantum of work and should becapable of executing maintenance work simultaneously at all the frontsdepending upon the site requirements. If more persons are required for

    completion of work in the time schedule as per emergency defined byEngineer-in-Charge, the same shall be arranged by the contractor withoutany extra payment to complete the work. It is also made clear that thedeployment of the workers of contractors will be subject to approval of

    Engineer- in-Charge of the works.The contractor would be responsible for the following:-

    a. All the labour / workmen deployed during the execution of the contract shallbe adequately got insured by the contractor at his own cost.

    b. Any mishappening / accident to any workmen at site of work &compensation payable to workmen on this account, all liabilities arisingout of any provision of Labour Act / Workman's Compensation Act shall bethe responsibility of the contractor. Any expenditure incurred by HPGCL

    arising out of the negligence of the contractor would be recovered fromhis bills / pending dues.

    c. The good conduct of all the workmen at work site.

    d. The loss / damage caused to the property of HPGCL or any other agencyof the contractor or any of his workman / employee.

    e. The contractor may employ such employees, as he may think fit to ensurethe execution of the work to the entire satisfaction of Engineer-in-Charge.The employees would not be deemed to be in the employment of HPGCLfor any purpose whatsoever. The contractor shall abide by the rules, lawsand regulations that may be enforced from time to time regarding theemployment conditions of service of his employees.

    f. Under no circumstances whatsoever, HPGCL would be held responsibleto the labour of the contractor. HPGCL shall have the right to pass on theresponsibility on the contractor for any expense incurred by HPGCL as aresult of certain dues on the part of employees of the contractor. HPGCLshall be entitled to recover / claim dues / compensation from thecontractor in that event.

    g. The labour / employees engaged by the contractor shall not be below theage of 18 years and above 60 years.

    h. Further, the contractor would furnish an undertaking on non judicial stamppaper of appropriate value by each and every worker employed by him,

    that the worker will not claim any lien as a worker of HPGCL for theservices, he is rendering to the contractor.i. The contractor shall also indemnify HPGCL against any liability towards

    its labour for non-compliance of laws etc.

    11. TERMS OF PAYMENT

    Subject to any deduction which the HPGCL may be authorized to makeunder this contract, the payment shall be made as follows

    90% payment shall be made against the running bill or monthly billsfor the work done & balance 10% shall be kept as security which shall bereleased after the satisfactory completion of the contract including theperiod of guarantee / warranty. No interest shall be paid by HPGCL on

    the security amount.In case any unit i.e. Unit-I or Unit-II remains under shutdown for more

    than 30 days due to capital / annual overhauling or due to any other reason,or not commissioned, the payment under lumpsum fixed charges will not bemade. An advance notice of 3 days in this regard will be given to thecontractor. However, for the days during the months in which the unitwas running, payment will be made on prorata basis.

    12. CONTRACTOR TO REMOVE UNSUITABLE LABOUR

    On instruction of the Engineer-in-Charge, the contractor would immediatelyremove any person employed on the work, who misbehaves or causes any

    nuisance or otherwise in the opinion of the Engineer-in-Charge is not fit tobe deployed on the work, such person shall not be re-employed or allowedon the work without the prior written permission of the Engineer-in-Charge.

    13. MODE OF PAYMENT

    The payment shall be made through account payee cheque in favour ofcontracting firm by the Sr. Accounts Officer, RGTPP, HPGCL, Khedar,Hisar. No Bank charges etc. of any kind shall be paid by HPGCL.

    14. INCOME AND OTHER TAXES DEDUCTIONS

    The income tax plus surcharges and any other statutory levies required tobe deducted by the HPGCL will be deducted at source at the rateapplicable from time to time.

    15. SERVICE TAX

    No service tax will be paid extra until and unless it is liable on theservices provided by the contractor and specifically demanded for thesame in his offer. However, non-claiming of servicetax from the HPGCL bythe contractor cannot help the contractor in escaping from his liability to theGovt. against the taxable service. In case, the service tax is to be paid bythe HPGCL, the contractor will have to submit the proof of submission of

    service tax claimed from HPGCL to the relevant authority.16. TAXES AND DUTIES

    No taxes or duties will be paid extra until and unless the same has beendemanded by the firm in its offer specifically. In case the same is to bepaid by the HPGCL, an undertaking is to be submitted by the firm in thisregard stating that the taxes or duties as claimed from the HPGCL havebeen deposited with the relevant authority

    17. EPF REGISTRATION

    The contractor / firm should be registered with the Regional EmployeesProvident Fund Commissioner, Govt. of India and should possess valid

    EPF Registration number. Contractorshall ensure the deposit of monthlyEPF contribution of his workers engaged on said works with EPFDepartment in the accounts of the workers. Documentary evidence inrespect of the amount deposited for the previous month must besubmitted before submitting the bill for the following month by thecontractor. Annual EPF inspection from the respective inspector isalsorequired to be submitted by the contractor before closing of the contract.

    18. INSURANCE

    Immediately before the commencement of the work, a group insurance policyof appropriate value valid for the term of the contract in respect of all the

    workers deployed on work under Workman Compensation Act 1923 shall beobtained by the contractor to cover up the risk of injury / death /fatal / non-fatalaccident. The documentary proof of the same shall have to be furnished withthe first running bill. The contractor shall be fully and wholly responsible forany mishappening, injury, fatal / non-fatal accident sustained by him / hisemployees / workers at site during performance of the work under the contractand HPGCL shall not entertain any claim of this account. However, if HPGCLis forced to pay any compensation to any workman employed / engaged by thecontractor, the amount so paid shall be recovered from the contractor from hispending dues against this contract or any other contract with the HPGCL.

    19. LABOUR LAWS

    I. The contractor must get himself registered with the Labour Department,Haryana under Section-7 of Labour Contract Act 1970.

    II. He should also obtain a valid Labour License as applicable under Section12 of Act for the work awarded to him immediately after the allotment ofwork and a copy of the same must be submitted alongwith the contractAgreement.

    III. The contractor shall abide by all labour-laws required to be followed under

    Factories Act, 1948, Industrial Dispute Act 1947, Workmen Compensation

    Act 1923, Employees State Insurance Act 1948, EPF Act 1952, Payment ofWages Act 1936 & Minimum Wages Act 1948 and other rules & regulationsframed by Central / Haryana Govt. from time to time in this regard.

    IV. The contractor shall maintain necessary records viz. Register of wages,Muster roll / Attendance register, Employment card / Gate Pass, OvertimeRegister and other necessary records etc. as required under aforesaidActs and the same shall be made available to the Engineer-in-Charge /Project Authorities / Govt. of Haryana for checking / inspection as andwhen required.

    V. The contractor shall indemnify the HPGCL against all the obligations ofthe Labour Rules and Regulations under any Statutory Act asmentioned above.

    VI. The contractor shall submit an undertaking stating that all risks &responsibilities towards labour will be owned by him.

    VII. The contractor will engage labour after getting the character antecedentsverified from the Police department.

    VIII. The workmen engaged by the contractor shall not be treated as

    employees of HPGCL. The HPGCL shall have no relation with workersengaged by the contractor. An affidavit from the labour / workmen shall besubmitted by the contractor that they will not claim themselves asemployees of HPGCL.

    IX. The contractor shall deduct labour welfare fund @Rs. 5/- from eachworker with employers share @ Rs. 10/- per worker (i.e. total Rs. 15/- foreach worker or any other further amendment by the competent authority)deposit the same with the Welfare Commissioner, Haryana, Chandigarh

    and present its documentary proof alongwith the bill.20. SAFETY RULES

    I. Contractor shall have to comply with all the provisions of safety rules. TheEngineer-in-Charge or The Chief Safety Officer shall impose penalty ofRs.100/-per day per head if the workers of contractor are found to beworking carelessly or in violation of use of proper protective equipmentsi.e. safety helmets, shoes, safety belts, goggles, ear plugs etc. andagainst violation of any other clause. A penalty of Rs. 500/- per violation(minimum) shall be levied in case of repeated violation. Further, if theviolation made by the contractor / labour which may cause any serious

    accident or direct loss to the corporation or threatens to cause severeconsequences, the higher penalty may be imposed including suspension /termination of the contract.

    11. Following undertaking is also required to be submitted by thecontractor:-

    "I / We have gone through all the terms & conditions on safetyregulations and undertake to strictly enforce the same during the executionof this contract including mobilization period, if any. In case of violation ofthese terms & conditions, the HPGCL is free to take action as deemed fit.

    III. In case of any fatal / non fatal accident or any other violation of Factory Act1948. Pb Hr Factory Rules 1952 or under other Industrial or Labour Act are

    made by / with the workers of the contractor and if prosecution is launchedby Chief Inspector of Factories, Chandigarh against occupier / FactoryManager or any other authority of HPGCL, the contractor shall be liableto deposit the amount of fine / penalty decided by the Court, on the sameday. In case of default, the amount will be recovered from theoutstanding dues / liabilities of the contractor against this contract or anyother contract at RGTPP besides other action as the HPGCL may deem fitlike black listing of the firm etc.

    IV. The liability of the injured person shall be borne by the contractor,irrespective of the location at which the accident has occurred.

    21. LOSS OF PLANT / HPGCL PROPERTY DURING EXECUTION OF THE

    WORK

    The contractor shall ensure that no damage or loss is done to HPGCL / Plantproperty or any other agency in the jurisdiction of work site. In case, it isfound that there is any loss to the plant equipment, HPGCL property orhuman being due to negligence of the labour / worker of the contractor, thesame shall be made good to HPGCL by the contractor at his own cost.

    22. BREACH OF CONTRACT

    If the contractor fails to adhere to the time schedule or if his services arefound to be unsatisfactory, the HPGCL will be entitled at its option either:-

    a) To recover damages as per penalty clause mentioned as above, if the said

    delay is not covered under the Force Majeure reasons.b) To get the work done from any other agency after serving a notice of three

    days to the contractor at his risk and cost and without prejudice to the otherprovisions of the work order.

    OR

    c) To cancel the contract by giving 15 days notice & forfeit the security.

    23. CONTRACT AGREEMENT

    The contractor shall execute a contract agreement on specific Performa onNon judicial Stamp Paper of appropriate value within 7 days of date of issueof LOI / W.O. Cost of the stamp paper will be borne by the contractor. Theperson who has signed the tender papers should have got authority to signon behalf of the contractor. If it is discovered at any time that the personso signing has no authority to do so, the HPGCL without prejudice to any

    other right or remedy available to it, may cancel the contract and get thework done from any other agency at risk and cost of the contractor. Thecontractor shall mean the contractor's legal representatives, successorsand assigns.

    24. ARBITRATION

    In all cases of disputes or disagreements between the parties arising outfor the settlement of the differences, the matter shall be finally settled by

    the Arbitrator appointed by the Chief Engineer, RGTPP, HPGCL & thedispute will be dealt in accordance with provision of the Arbitration &Conciliation Act, 1996.

    25. JURISDICTION

    All legal proceedings in connection with contract shall be subject to theterritorial jurisdiction of local court at Hisar (Haryana).

    26. ELECTRICITY / AIR / WATER

    Electricity/ Air / Water will be provided free of cost at one point per unit asper requirement of job. HPGCL may provide suitable space for site store /temporary workshop free of charges to the contractor. The electricity for

    site store / office will be provided by HPGCL free of cost. The contractorwill use electricity / air / water judiciously.

    28. ACCOMMODATION

    The contractor will be responsible for the accommodation of his employees /workers deployed for execution of work. However, if the accommodation isavailable with HPGCL the same may be allotted on chargeable basis as perHPGCL rules.

    27. TRANSPORTATION OF MATERIAL

    a) The contractor shall make his own arrangement for transportation of thematerial from O&M stores to site of work, from site of work to O&Mworkshop, if required and return of scrap back to stores. The contractor shallalso assist in loading / unloading of material being sent for repairs orreceived after repair to / from outside of RGTPP.

    b) The contractor shall make his own arrangement for removal of old as wellas unused material from the site to the place as specified by the Engineer-in-Charge after completion of work.

    28. PRESERVATION & STORAGE OF MATERIAL

    All the material issued to the contractor by the HPGCL or brought by thecontractor for its bonafide use shall be stored and preserved against anyloss, damage, shrinkages or deterioration in any form. Any damage / loss

    suffered on this account shall be considered as loss due to willfulnegligence on part of the contractor and shall be liable to compensateHPGCL for these losses suffered at penal rates to be determined by theHPGCL. The rates charged for the purpose of recovery shall be final andbinding on the contractor.

    29. SUPERVISION OF WORK

    a) The Engineer-in-Charge shall have the general supervision of the work.The work shall have to be started by the contractor as per the instruction ofEngineer-in-Charge or his authorized representative at any time on workingday, on holiday or after office hours, and shall be confirmed by post dated

    indent. The indent will indicate the date / time of start of work, details ofwork and scheduled time of completion of work as per contract. The timeallowed for a work maintained in the indent will be addition of time of all the jobs / activities as per contract. The Engineer-in-Charge may reduce thetotal cumulative time of various activities, keeping in view of emergency tobring back the equipment in time. The total time allowed by the Engineer-in-Charge will be final & binding on the contractor. He has the authority to stopthe work whenever such stoppage is necessary to ensure the properexecution of the contract. He shall also have authority to reject all works orpart thereof and give necessary direction to carry out work again to hissatisfaction. No claim whatsoever on this account will be entertained. The

    work shall be subjected to the inspection by Engineer-in-Charge all the time.b) The decision of Engineer-in-Charge shall be final with regards to all matters

    relating to his contract.

    c) The decision of Engineer-in-Charge for determining the category of thework with reference to the items not mentioned in scope of work shall befinal.

    d) The execution of work may entail working at all the sites and weather

    conditions and no extra claim will be considered on this account. The

    contractor may have to carry out jobs and work round the clock, as per therequirement to be decided by Engineer-in-Charge. No extra claim / over timewill be paid on this account.

    e) In case the contractor fails to do the extra / substituted work, Engineer-in-Charge will have the option to get the work done through any other agency atthe risk & cost of the contractor.

    f) In case of any dispute, the contractor may represent in writing to theEngineer-in-Charge.

    30. TELEPHONE

    The successful contractor shall provide the phone facility to his supervisorto facilitateHPGCL for easy communication with the contactor. The phoneNumber shall be intimated by the contractor immediately after the award ofthe contract.

    31. AUTHORIZED REPERSENTATIVE

    The firm will intimate (in writing) the name of authorizedrepresentative at site to whom necessary instructions regarding the workscan be imparted and who will make correspondence regarding contractrelated issues. The signatures of the aforesaid authorized representativeshall be got attested from First Class Magistrate or Notary Public.

    32. OWNERSHIP DEED

    The firm will give ownership deed / partnership deed / proprietorship deed(as applicable) duly attested by Notary Public for record and reference ofhis office.

    33. Any other work relating to preventive maintenance of the equipments notmentioned in Part-A of scope of work but otherwise felt necessary will alsobe in the scope of contractor. No extra payment on this account will bemade.

    34. The frequency of works covered under Part-B can vary depending upon sitecondition. But the total value of the work order shall remain fixed for theperiod mentioned in the order.
