The Building ActThe Building Act 2004 regulates all building work, establishes a licensing regime for building practitioners, and sets performance standards to ensure that:• people who use buildings can do so safely without endangering their health• buildings have attributes that contribute to the health, physical independence, and well-being of
the people who use them• people who use a building can escape from the building if it is on fire or during an emergency• buildings are designed, constructed, and able to be used in ways that promote sustainable
development.
The Act requires anyone proposing to do building work to obtain a Building Consent (BC) from a Building Consent Authority before starting work. A Project Information Memorandum (PIM) is voluntary under the Act but the council strongly recommends that those seeking to build also follow the PIM process to smooth the way to a successful Building Consent application.

What is a Building Consent?A.Building.Consent.is.the.formal.approval.issued.by.a.Building.Consent.Authority.(BCA).that.certain.works.meet.the.requirements.of.the.New.Zealand.Building.Act,.Building.Regulations.and.Building.Code.You.can.not.undertake.any.building.work.that.requires.a.BC.without.this.approval..Most.building.work.requires.a.BC.but.some.minor.work.is.exempt.under.the.Act.
Some building work will not require building consentExempt.building.work.is.generally.low.risk.building.work.that.will.not.affect.the.structural.integrity.or.safety.components.of.the.building..The.building.owners.are.responsible.for.determining.whether.or.not.their.proposed.building.work.is.exempt.from.the.requirement.of.obtaining.a.building.consent..Each.situation.will.depend.upon.its.own.circumstances..Hence,.it.is.important.to.get.good.advice.before.deciding.if.the.building.work.is.covered.by.the.exemptions.in.Schedule.1.of.the.Building.Act.2004..Guidance.can.be.found.on.the.MBIE.website.Projects.that.normally.do.not.require.a.building.consent.are.listed.as:•. General.repair.and.maintenance•. Small.detached.buildings.–.less.than.10.square.metres.in.floor.area•. Tents,.marquees.and.similar.structures.–.up.to.100m²•. Repair.or.replacement.of.outbuilding.e.g..damaged•. Some.interior.alterations.–.e.g..non.load.bearing.wall.removalsThis.is.not.a.comprehensive.list.and.there.are.some.boundaries.with.these.items...There.is.very.good.guidance.on.this.subject.available.from.the.MBIE.Building.Pages.
Owner-Builder ExemptionsThe.exemption.provides.owner-builders.or.Do-It-Yourself.builders.(DIY).a.regime.where.they.can.undertake.restricted.building.work.on.their.own.homes,.or.use.a.friend.or.family.member.to.either.assist,.or.undertake.the.works.on.their.behalf.If.an.owner.builder.claims.an.exemption.under.the.LBP.scheme,.the.statutory.declaration.must.be.held.on.the.Land.Information.Register.so.that.future.owners.are.made.aware.that.the.design.or.construction.of.the.dwelling.has.been.undertaken.by.an.owner.builder.This.satisfies.Council’s.obligations.in.respect.of.maintaining.records.under.the.Building.Act.If.an.owner-builder.holds.a.license.for.the.restricted.building.work.(RBW),.they.will.not.be.considered.for.an.exemption..The.owner-builder.exemption.is.specifically.tailored.to.apply.to.a.DIY;.or.for.an.exemption.for.RBW.where.the.owner-builder.proposes.to.carry.out.works.that.they.are.not.licensed.to.carry.out.The.owner-builder.exemption.will.not.cover.works.such.as.electrical,.gas.or.plumbing.and.drainage.works.unless.the.owner-builder.holds.appropriate.licenses.for.this.work..Further.guidance.from.MBIE.is.available.

Restricted Buiding Work and LBPRBW.(Restricted.Building.Work).applies.to.most.residential.building.work.(e.g..new.dwellings.and.apartments.including.renovations,.additions.and.alterations)..It.does.not.affect.ancillary.buildings.associated.with.residential.buildings.(e.g..garages,.carports,.swimming.pools,.etc)..Nor.does.it.affect.mixed-use.apartments.(e.g..those.that.include.an.element.of.commercial.construction.such.as.a.shop.or.office)..Restricted.building.work.includes.any.work.critical.to.the.integrity.of.the.building,.being.the:•. Primary.structure:.foundations,.sub.floors,.floors.walls.columns,.beams,.bracing.and.roof•. External.moisture.management.systems:.damp.proofing,.roof.and.wall.cladding.and.water.proofing,.
and•. Design.of.fire.safety.systemsif.you.are.lodging.an.application.for.building.consent.and.the.application.involves.RBW,.a.memorandum.also.known.as.a.Certificate.of.Design.Work.(CoW),.must.accompany.the.application..A.CoW.can.only.be.issued.by.an.LBP.(Licensed.Building.Practitioner)..If.we.do.not.receive.a.CoW.with.the.application,.we.cannot.accept.it.The.CoW.should.clearly.articulate.the.restricted.building.work.that.is.being.undertaken;.this.will.ensure.that.all.work.is.correctly.identified.through.the.inspection.process.Owner.builders.are.able.to.carry.out.Restricted.Building.Work.on.their.OWN.home..You.are.an.“owner.builder”.if.you:•. Live.in.or.are.going.to.live.in.the.home.(includes.a.bach.or.holiday.home)•. Carry.out.the.Restricted.Building.Work.to.your.own.home.yourself,.or.wit.the.help.of.your.unpaid.friends.
and.family.members,.and,•. Have.not,.under.the.owner-builder.exemption,.carried.Restricted.Building.Work.to.any.other.home.

What is a PIM (Property Information Memorandum) – Why do you need it?.A.PIM.is.a.memorandum.issued.by.the.territorial.authority.(council).under.section.34.of.the.Act.and.sets.out.information.relevant.to.your.building.work..The.information.provided.is.required.to.include.all.such.information.known.to.council.which.may.be.relevant.to.the.project.or.site..This.includes.potential.for:•. erosion•. avulsion.(removal.of.land.by.water.action)•. falling.debris•. subsidence•. slippage•. alluvium.(the.deposit.of.silt.from.flooding)•. the.presence.of.hazardous.contaminants.which.are.likely.to.be.relevant.to.the.design,.construction.or.
alteration.of.your.proposed.building.Details.of.stormwater.and.wastewater.systems.(e.g..a.TP58.Design).which.may.relate.to.your.project.or.site.will.also.be.included.(where.applicable).A.project.information.memorandum.also.identifies.any.additional.approvals.required.such.as:.•. Resource.Management.Act•. New.Zealand.Historic.Places.Trust.(heritage.buildings./.sites)•. New.Zealand.Fire.Service.CommissionThe.memorandum.also.includes.confirmation,.subject.to.other.provisions.of.the.Act,.that.you.may.carry.out.the.building.work.subject.to:•. the.requirements.of.the.BC,.and•. You.may.contact.the.PIM.Officer,.or.your.own.planning.adviser,.to.determine.whether.your.proposal.complies.with.the.District.Plan..If.it.does.not.a.Resource.Consent.is.required..You.are.strongly.advised.to.obtain.this.before.seeking.Building.Consent.to.avoid.possible.expensive.changes.to.your.proposal..Under.changes.to.the.Building.Act.made.in.February.2010,.it.is.up.to.the.applicant.to.decide.whether.or.not.to.apply.for.a.PIM..However.if.you.decide.not.to.seek.a.PIM,.there.is.the.potential.for.delays.to.the.issue.of.a.Building.Consent.if.unexpected.requirements.not.previously.identified.through.the.PIM.process.should.arise..An.application.for.a.PIM.must.be.made.on.the.PIM/BC.application.form.which.is.available.from.our.council.offices.or.our.website..This.form.is.required.to.be.completed.in.full,.signed.and.dated.before.being.submitted.

Processing the ApplicationWe.will.evaluate.the.various.aspects.of.your.building.consent.application.to.ensure.it.meets.the.requirements.of.the.Building.Act.and.the.Building.Code..Your.application.may.be.assessed.by.a.number.of.officers.with.specific.skills.and.knowledge..These.may.include.building,.plumbing.and.drainage,.structural,.resource.management.and.others..There.is.a.requirement.for.some.applications.to.be.sent.to.the.Design.Review.Unit.of.the.NZ.Fire.Service.(Fire.Engineering.Unit)..There.will.be.additional.fees.to.pay.if.your.application.needs.to.be.sent.to.here..During.these.assessments.there.may.be.some.questions.or.clarifications.required.by.officers.to.satisfy.them.that.the.project.will.comply.with.the.various.requirements..If.so.the.officer.will.send.a.request.for.information.(RFI)..This.contact.may.be.through.phone.call.or.email.but.will.be.also.confirmed.with.a.letter..The.application.will.at.this.point.be.suspended,.this.means.that.the.‘time.clock’.stops.and.will.not.restart.until.all.the.information.requested.is.received.and.accepted..The.letter.will.also.inform.of.a.time.frame.with.which.to.reply.or.send.in.the.information.required..The.purpose.of.this.time.frame.is.to.ensure.prompt.supply.of.required.information..If.the.information.cannot.or.will.not.be.supplied.in.the.time.stated.please.inform.us.so.we.can.extend.this.to.suit.your.requirements..Note,.if.nothing.has.been.received.within.the.time.frame,.your.application.may.be.refused.and.returned..The.RFI.will.sent.to.the.person.stated.on.the.application.form.as.“First.Point.of.Contact”.The.Building.Act.requires.us.to.process.your.application.within.20.working.days.from.the.time.we.accept.it..However,.if.your.application.is.suspended.because.of.lack.of.supporting.information,.the.period.of.suspension.is.not.counted.as.part.of.these.20.days..Therefore.it.is.important.that.you.fully.and.accurately.complete.the.application.form.and.attach.all.information.at.the.outset.to.avoid.the.possibility.of.delays.during.the.process..
Checking Resource Consent requirementsWe.check.your.proposed.project.to.see.if.it.requires.other.permissions,.e.g..Resource.Management.Act.or.District.Plan.requirements..A.land.use.consent.is.required.where.all.or.part.of.the.proposed.building.activity.does.not.fully.comply.with.the.relevant.rules.in.the.District.Plan..A.subdivision.consent.is.required.to.legally.divide.land.or.buildings.for.separate.ownership,.such.as.new.lots.or.sections..In.either.of.these.cases,.if.you.have.not.already.applied.for.and.been.granted.a.resource.consent,.we.will.advise.that.you.do.so..A.building.consent.may.be.issued.but.the.required.Resource.consent.must.be.obtained.before.the.building.work.can.start..The District Plan rules are available on the Council website (www.fndc.govt.nz) or from Council service centres. We.also.check.for.compliance.with.the.Council’s.bylaws.and.other.legislation.for.things.such.as.vehicle.access/crossings,.water.supplies,.public.drainage.and,.in.the.case.of.commercial.premises,.matters.such.as.health,.trade.waste,.building.warrant.of.fitness.and.safety.systems..As.with.other.processing,.this.has.to.take.place.within.the.20.day.timeframe.and.may.also.generate.some.questions.requiring.further.information.which.may.suspend.the.“time.clock”.

06 Additional feesOther.fees.might.be.required.for.vehicle.crossing.permits,.connections.to.services.or.RAPID.(Rural.Address.Property.Identification).number.for.example..These.fees.also.need.to.paid.at.time.of.application.lodgement..It.would.help.greatly.if.these.payments.were.made.separately.–.for.each.application.–.rather.than.one.payment.for.all.items.
Reasons for delays or refusal of your ApplicationThere.are.a.number.of.reasons.why.your.application.may.be.delayed.or.refused:•. an.incomplete.application.form•. missing.information•. the.need.to.supply.code.compliant.or.amended.information.for.your.applicationWe.can’t.guarantee.that.there.will.be.no.delays,.but.the.chance.of.this.occurring.is.significantly.lessened.if.you.thoroughly.check.your.application.before.it.is.submitted.–.use.the.checklist.on.the.application.form..If.there.are.any.areas.that.you.are.unsure.about,.we.recommend.that.you.seek.input.from.a.professional.
Approving the ApplicationThe.application.and.detailed.plans.will.be.checked.for.compliance.to.planning.rules.as.well.as.to.the.New.Zealand.Building.Code..There.may.be.some.items.that.require.further.clarification.during.this.time.and.officers.will.contact.you.either.by.phone.or.email.as.well.as.by.letter..The.requests.for.further.information.have.been.given.a.“time.for.reply”.so.please.either.supply.the.information.requested.or.contact.the.building.team.to.keep.them.informed.of.progress.or.the.application.may.be.refused..Usually.these.requests.are.dealt.with.in.a.timely.manner..Whilst.we.are.waiting.for.the.requested.information.the.statutory.time.frame.is.“suspended”,.or.stopped,.until.all.information.has.been.supplied.Once.processing.has.been.completed.and.the.consent.will.be.issued..Staff.will.contact.you.as.to.how.you.want.the.application.to.be.delivered.or.you.can.arrange.to.pick.this.up.a.service.centre.if.more.convenient..Please.read.the.issued.consent,.conditions.and.other.information,.such.as.the.inspections.required,.as.it.will.provide.guidance.as.to.what.needs.to.be.followed.during.construction.for.successful.Code.Compliance.

09 What happens next?.Once.your.building.consent.is.issued.and.you.have.obtained.any.other.approvals.required,.such.as.a.resource.consent,.then.you.may.start.work.on.your.building.project..It is very important that you (and your contractors) read the building consent documentation and are clear about the requirements. It contains a list of inspections that need to be made by Council officers during the building process, and a list of producer statements required from specialists (typically engineering services). The specialists must provide documentation of the inspections they undertake in support of their producer statement. For.applications.that.contain.restricted.building.work,.you.must.advise.us.in.writing.before.work.starts.who.the.licensed.building.practitioner.that.is.completing.or.supervising.the.work,.if.not.provided.you.cannot.start.work..The.Licensed.Building.Practitioner.must.be.licensed.to.carry.out.the.work.or.supervise.the.type.of.work.proposed.and.you.also.need.to.specify.their.registration.number..We.recommend.the.information.is.supplied.with.your.building.consent.application..More.information.about.licensed.building.practitioners.is.available.at.business.govt.nz/lbp..Your.building.consent.will.include.an.information.letter,.which.contains.useful.information.about.matters.you.need.to.comply.with.during.your.building.project..Work must start on your project within 12 months after the date the consent was issued..If.we.haven’t.heard.from.you.before.then.we.will.send.you.a.letter.reminding.you.that.work.must.be.started.and.asking.if.you.intend.to.proceed.with.the.work..You.may.decide.that.you.will.not.do.the.work,.in.which.case.the.consent.will.lapse,.or.you.may.apply.for.an.extension.of.time.to.start.the.work..An.extension.of.time.to.start.work.may.be.granted.in.some.circumstances.after.an.officer.has.reviewed.the.building.consent.file..If.we.do.not.hear.from.you.within.the.stated.time,.or.we.refuse.you.an.extension.of.time,.the.consent.will.lapse..This.means.a.new.consent.would.have.to.be.applied.for.and.issued.before.any.work.could.be.carried.out..If.lapsed,.refunds.for.the.inspections.and.other.fees.paid.for.at.lodgement.will.be.made.to.the.person.specified.on.the.application.form.under.“Billing”.

Inspections.At.various.stages.during.construction.you.will.need.to.arrange.for.building.officers.to.inspect.work.that.has.been.carried.out.to.check.that.your.building.work.complies.with.the.conditions.of.the.approved.plans.and.building.consent..The.inspection.requirements.will.be.listed.in.your.building.consent..You can book your inspection anytime by calling 0800 920 029. You.should.plan.ahead.work.and.book.in.advance.to.ensure.that.you.can.get.an.inspection.when.you.need.it.to.avoid.delays.on.site..Inspections.cannot.be.guaranteed.for.last-minute.bookings.we.advise.that.inspections.should.be.booked.48hrs.in.advance..You.will.be.given.a.timed.appointment.rather.than.a.“generic”.morning.or.afternoon.response.and.building.officers.will.keep.you.informed.if.running.early.or.late.on.the.day..
You will need to supply the following information when booking an inspection:• Address for inspection• Type of inspection required• BC number (this is the unique number given to each building consent)• Name of person who will be on site• Contact number for this person
Re-inspections.may.be.required.if.the.officer.is.not.satisfied.that.the.work.meets.the.requirements.of.the.Building.Code.and.approved.plans..These.may.incur.additional.charges.if.inspections.exceed.those.estimated.when.you.received.your.Building.Consent..If.you.or.your.builder.is.not.ready.for.an.inspection.let.us.know.as.early.as.possible.to.avoid.a.failed.inspection.–.and,.therefore,.re-inspection.costs.-.and.to.possibly.let.another.project.have.an.inspection.for.that.time..In.addition.to.the.inspections.by.Council.officers,.inspections.may.be.required.by.specialists,.including.structural,.geotechnical.and.fire.engineers..This.would.have.been.agreed.at.the.consent.processing.stage..You.will.need.to.liaise.directly.with.your.specialist.about.the.inspections.he/she.will.need.to.make..Your.specialist.may.not.be.able.to.give.you.the.required.producer.statement.if.you.have.failed.to.arrange.for.inspections.at.the.appropriate.times..If.inspections.have.been.missed,.contact.us.to.discuss.possible.alternative.evidence.you.can.provide.to.show.that.the.work.is.code.compliant..A.subsequent.inspection.may.not.be.able.to.be.done.until.it.has.been.verified.that.the.work.already.in.place.complies.with.the.approved.plans.

11 Types of inspections.The.following.are.some.of.the.types.of.inspections.that.may.be.required:
Foundations – slab or wall concrete strip foundations. Before.any.concrete.has.been.laid,.looking.for.correct.depths,.re-enforcing.and.siting.of.building.to.boundaries... (if.not.already.checked).may.need.Surveyors.report.for.some.sites
Footings – pile or posts. Before.any.placement.of.piles.looking.for.depth,.width.and.siting.of.pile
Framing. Framing.should.be.“bare”.so.all.fixings.etc.can.be.seen.and.verified.to.fixing.plans.–.including.roofing.details
Brick Veneer. Bricks.to.be.at.half.height.so.that.items.like.brick.ties,.cavity.clearances.–.ensuring.excess.mortar.is.removed.. from.the.inside.of.the.bricks
Pre Line. Outside.cladding.is.complete.and.water.tight,.moisture.content.of.timber,.insulation.complete,.pipes.and.. wiring.installed.(initial.installation)
Post Line. Internal.linings.installed.and.bracing.elements.in.place.–.no.stopping,.skirting.or.scotia.etc.to.be.fitted
Drainage. Drainage.checked.either.stormwater.or.foul.water.lines.and.connections.with.no.backfilling.of.lines/trenches
The.work.must.be.carried.out.in.accordance.with.your.approved.building.consent..If.you.wish.to.change.some.aspect.of.the.project.it.might.mean.that.you.will.have.to.obtain.an.amendment.to.the.building.consent.before.the.work.is.carried.out..The.process.for.obtaining.an.amendment.is.the.same.as.obtaining.the.original.consent..This.process.can.slow.or.even.stop.a.building.project.until.the.required.changes.have.been.approved..Some.changes.to.the.plans.can.be.agreed.onsite.with.the.inspector.but.may.require.new.plans.–.or.“as.builts”.–.to.be.provided..It.is.very.important.that.at.the.time.of.the.inspection.the.building.consent.documents.accurately.reflect.what.has.actually.been.built..A.list.of.inspections.required.will.be.listed.with.the.approved.plans.and.issued.consent..At.each.inspection.the.officer.will.advise.what.the.next.required.inspection.is.and.of.any.other.requirements..Building.is.a.flexible.process.and.sometimes.more.than.one.inspection.may.be.required.to.cover.an.item.off,.other.times.two.items.can.be.covered.in.one.visit..If.two.items.are.inspected.in.one.visit.only.one.inspection.may.be.charged..If.the.work.has.not.been.done.in.accordance.with.the.approved.plans.the.inspector.may.issue.a.notice.to.fix.or.a.site.instruction.stating.what.is.required.to.be.done.

Project completion and Code Compliance Certificates.When.your.building.work.is.complete.you.will.need.to.formally.apply.for.a.Code.Compliance.Certificate.(CCC).on.the.form.enclosed.with.your.building.consent..A.CCC.means.that.the.building.work.complies.with.the.Building.Code.and.with.the.building.consent..You may also need to arrange a time for a final inspection, if one has not already been carried out. When.you.apply.for.a.CCC.you.will.need.to.give.names.and.contact.details.for.all.the.people.involved.in.your.project.e.g..builders,.plumbers,.engineers,.etc..If.the.project,.involved.construction.work.that.is.restricted.building.work.the.licensed.building.practitioner.must.supply.a.‘Memorandum.from.licensed.building.practitioner:.Record.of.building.work’.on.completion.of.the.restricted.building.work.to.both.the.owner.and.the.Council..This.form.can.be.downloaded.from.the.Ministry.of.Business,.Innovation.and.Employment,.Building.and.Housing.Group.website.business.govt.nz/lbp.You.may.also.be.required.to.supply.supporting.documentation.such.as.energy.work.certificates.from.your.electrician.or.a.PS4.(engineer’s.producer.statement).before.a.code.compliance.certificate.can.be.issued..Your.building.consent.lists.the.documentation.required.before.a.CCC.can.be.issued.and.additional.documentation.may.also.be.requested.during.inspections..We.may.be.unable.to.issue.the.CCC.if.any.of.the.required.inspections.have.been.missed.or.the.required.producer.statements.cannot.be.provided..Without.a.CCC.you.may.experience.difficulties.insuring.your.property.or.selling.it.in.the.future..A.review.of.the.fees.paid.for.inspections.will.be.made.when.the.CCC.has.been.approved.for.issue..Additional.inspection.fees.will.be.charged.if.re-inspections.have.been.required.or.money.can.be.refunded.if.there.has.been.some.fees.not.used/required.–.e.g..there.were.less.inspections.required.than.originally.charged..These.will.be.either.charged.or.refunded.to.the.person.identified.in.the.Billing.section.of.the.application.from..The CCC will not be issued if there are any unpaid fees, including unpaid Development Contributions required. If.an.application.for.a.CCC.has.not.been.received.before.two.years.after.the.building.consent.was.granted,.the.Council.is.obliged.to.decide.whether.or.not.to.issue.the.certificate.or.not..This.will.usually.mean.that.a.review.of.the.project.thus.far.and.an.inspection.may.be.conducted.to.inform.the.decision..We.will.keep.you.informed.of.this.time.frame.and.of.the.options.you.may.wish.to.take,.mainly,.extend.this.time.frame.or.apply.for.a.CCC.If.you.apply.for.an.extension.of.time.to.complete.your.building.project.an.officer.may.grant.an.extension.after.reviewing.the.file..In.some.circumstances.we.may.refuse.to.issue.a.CCC,.e.g..if.an.extension.of.time.to.complete.is.not.granted.or.if.the.work.is.not.complete.or.does.not.comply.or.if.you.fail.to.supply.the.required.documentation..For.most.commercial.building.projects.a.compliance.schedule.will.be.issued.with.the.CCC.where.the.building.has.specified.systems.that.have.been.added,.removed.or.altered.(including.residential.properties.that.are.serviced.by.a.cable.car)..Where.the.compliance.schedule.is.new,.a.Compliance.Schedule.Statement.will.also.be.issued..You must display the Compliance Schedule Statement in the building. The.Building.Act.requires.us.to.process.your.application.for.code.compliance.certificate.within.20.working.days..The.‘clock’.starts.when.we.receive.your.application..As.with.building.consent.applications,.the.‘clock’.will.stop.if.your.application.is.suspended.awaiting.additional.inspections,.documentation.or.fees.and.will.restart.when.the.issue.has.been.resolved..

Certificates for Public Use.A.Certificate.for.Public.Use.(CPU).is.used.to.certify.that.premises.or.parts.of.premises.affected.by.building.work.are.safe.to.be.used.by.members.of.the.public..A.Certificate.for.Public.Use.can.only.be.issued.where.consent.has.been.granted.for.building.work.but.no.CCC.has.been.issued.yet..A.CPU.does.not.relieve.the.owner.of.a.building.from.the.obligations.to.apply.for.a.CCC.after.all.the.building.work.has.been.carried.out.or.to.ensure.that.the.building.is.safe.all.users.at.all.times..A.CPU.may.be.issued.for.a.limited.period.of.time..Certificates for Public Use are not required for private homes.
