(5)(4) The judicial expense fund for the Parish Court for theParish of Ascension shall pay an amount equal to the differencebetween the total salary of the judge as specified in Paragraphs (1)

through (4) of this Subsection and the salary of a district court judgeof the judicial district in which the parish court is located.

C. The governing authority of Ascension Parish shallannually appropriate from the parish general fund and theAscension Parish Judicial Expense Fund amounts sufficient tofully fund the operations of the parish court, which shall includethe salaries and benefits of the parish judge and the parishcourt's employees.

* * *§2563.17. Judicial expense fund Fees; Judicial Expense Fund;

Probation Fund; establishedA. In all criminal cases over which the court has jurisdiction,

there shall be taxed as costs against every defendant who is convictedafter trial or after a plea of guilty or who forfeits his bond, a sumdetermined by the judge of the parish court, which sum shall notexceed fifteen dollars, which shall be in addition to all other fines,costs or forfeitures lawfully imposed and which shall be transmittedto the clerk of court for further disposition in accordance herewith ona monthly basis to the chief financial officer of Ascension Parish,hereinafter referred to as "chief financial officer", for depositinto the Judicial Expense Fund. Any bench warrant fees collectedby the court from a defendant shall also be transmitted to the clerk ofcourt for further disposition in accordance herewith chief financialofficer for deposit into the Judicial Expense Fund.

B. The clerk of court chief financial officer shall place all sumscollected or received under Subsection A of this Section in a separateaccount to be designated as the Judicial Expense Fund for the ParishCourt for the Parish of Ascension. The judge of the parish courtgoverning authority of Ascension Parish shall have control overthe fund and all disbursements made therefrom. He, shall cause to beconducted annually an audit of the fund and the books and accountsrelating thereto, and shall file the same with the office of thelegislative auditor where it shall be available for public inspection.

C. The judicial expense fund is established and may be used forany purpose or purposes connected with, incidental to, or related tothe proper administration or function of the said court or the officesof the judge, and is in addition to any and all other funds, salaries,expenses, or other monies that are now or hereafter provided,authorized, or established by law for any of the aforesaid purposes.However, no salary shall be paid from the judicial expense fund tothe judge, except the judge appointed temporarily under theprovisions of R.S. 13:2563.9 and as provided in R.S. 13:2563.5(B)(5)R.S. 13:2563.5(B)(4) and (C).

A. There is hereby established as a special fund in the statetreasury the Louisiana Medical Assistance Trust Fund, hereinafterreferred to as the "fund", which shall consist of monies generated bythe provider fees on healthcare services collected and authorized fordeposit into the fund as provided by law and any other monies whichmay be provided by law. the fees on providers of health care servicescollected under the authority of R.S. 46:2625. The monies in the fundshall be available for appropriation by the legislature to the Medicaidprogram solely as provided for in Subsection C of this Section. Themonies in the fund shall be invested by the state treasurer in the samemanner as monies in the state general fund. All interest earned fromthe investment of monies in the fund shall be deposited in and remainto the credit of the fund and allocated to each separate account on apro-rata basis. All unexpended and unencumbered monies remainingin the separate accounts of the fund at the close of each fiscal yearshall remain in the separate accounts of the fund.

B. (1) Within the fund there shall be segregated sub-accounts,one for each health care provider group that pays fees pursuant toR.S. 46:2625. Monies collected from each health care provider groupshall accrue to the sub-account of that health care provider group.The state treasurer shall establish a separate account within the fundfor each healthcare provider group in which provider fees arecollected and deposited into the fund in accordance with law. Anymonies deposited into the fund from other sources, and the interestearned on those monies, shall be deposited into a separate accountwithin the fund, hereafter referred to as the "general account".

(2) Monies shall be allocated, with accompanying federalmatching money, to each of the health care provider groups inproportion to the amount of fees collected in each sub-account, basedupon fees established by the Department of Health and Hospitalspursuant to R.S. 46:2625. Such allocation shall be calculated usingcollections data from the most recent four quarters for which data isavailable prior to the state fiscal year for which the allocation will bemade. The state treasurer shall deposit monies collected from eachprovider group's provider fees into the account created for thatprovider group based upon actual collections of the provider fees.

(3) The monies, including interest earnings, in each separateaccount shall be appropriated by the legislature to the Medicaidprogram solely as provided in Subsection C of this Section.

C.(1) Notwithstanding any other provisions of this Chapter, thelegislature shall be authorized to appropriate as state funds to thedepartment for use in any fiscal year, all revenues dedicated anddeposited into each segregated sub-account. Such appropriationsshall be made for the sole purpose to obtain federal financialparticipation in the provision of support to health care providergroups listed in R.S. 46:2625. Any appropriation from the segregatedsub-accounts for any purpose other than medical assistance payments

to health care provider groups listed in R.S. 46:2625 shall be void.The legislature is authorized to appropriate monies from the separateaccounts only if the appropriation is eligible for federal financialparticipation under Title XIX of the Social Security Act, or itssuccessor, except monies deposited into the general account may beappropriated for any Medicaid program expenditure.

(2) Appropriations from monies generated by health careprovider group fees, including federal financial participation on thosefees shall be expended as follows: for the fiscal year commencingJuly 1, 2013, and fiscal years thereafter, all of such appropriations ineach sub-account shall be used for the purpose of Medicaidreimbursement payments to the health care provider groupsgenerating those fees listed in R.S. 46:2625. The Department ofHealth and Hospitals, or its successor, shall expend monies depositedinto each account only for the reimbursement of services to theprovider group that paid the fee into the account in any fiscal year,except the general account may be expended for any Medicaidprogram expenditure. Any expenditure from the separate accounts forany purpose other than medical assistance payments for the providerspaying the fee shall be void.

D. The monies in the fund shall not be used to displace, replace,or supplant appropriations from the state general fund for theMedicaid program below the amount of state general fundappropriations to the agency for the 2012-2013 Fiscal Year.

E. The state treasurer shall report the status of the fund and itssub- accounts at least quarterly to the secretary of the Department ofHealth and Hospitals and the Joint Legislative Committee on theBudget.

(1) The state treasurer shall report the status and utilization ofthe fund and the separate accounts quarterly to the secretary of theDepartment of Health and Hospitals, or its successor, and the JointLegislative Committee on the Budget.

(2) The Department of Health and Hospitals, or its successor,shall report on the expenditure of funds out of each separate accountthat comprises the fund quarterly to the Joint Legislative Committeeon the Budget.

(c) Not later than January 31, 2018, the state Department ofEducation shall report in writing to the State Board ofElementary and Secondary Education, the House Committee onEducation, and the Senate Committee on Education the numberof diplomas granted, by school district, pursuant to thisParagraph.

(d) The State Board of Elementary and Secondary Educationshall promulgate rules in accordance with the AdministrativeProcedure Act for the implementation of this Paragraph. Thestate Department of Education shall disseminate a copy of therequirements of this Paragraph and procedures and guidelinesfor submitting petitions to each city, parish, and other localpublic school system not later than ninety days after the effectivedate of this Paragraph. Such procedures and guidelines shallinclude but shall not be limited to the following:

(i) The eligibility criteria for submitting a petition.(ii) The petition process, including but not limited to the

deadline for submitting a petition and all other applicabledeadlines.

§2554. Certification and appointment* * *

C.(1) In the event a vacancy cannot be filled by reinstatement orby re-employment as above provided, the board next shall certify thenames of the persons upon the promotional list, in the order in whichthey appear thereon, for the class in which the vacancy is to be filled.

(a) The appointing authority shall select and appoint to the firstvacancy to be filled the one person certified to it who has the greatestseniority in the departmental service. Any remaining positions to befilled in the same class shall be filled by appointing to each suchsuccessive vacancy the one of the remaining persons certifiedtherefor who has the next highest seniority in the departmentalservice. If any one or more persons so certified should refuse theappointment, the appointing authority shall then select and appointone of the persons certified by the board with the next highestseniority in the department service. This procedure shall be followeduntil the position has been filled by appointment of the one personwho has the greatest seniority in the departmental service who iswilling to accept the appointment, or until each person whose nameappears upon the list has in this order been certified and offered theappointment for the vacancy.

(b) Any person certified to the appointing authority who,because of work-related illness, injury, or incapacity, is unable toimmediately begin a working test, shall be appointed in accordancewith Subparagraph (a) of this Paragraph. However, the working testshall be immediately interrupted and shall not commence until theemployee has fully recovered and returns to full duty. If theemployee fails to recover and return to full duty within six months ofthe date of his appointment, the board shall declare him ineligible tocontinue therein, and the appointment shall be made to one of theremaining persons certified therefor who has the next highestseniority in the departmental service. Any such person appointed inaccordance with R.S. 33:2496(2) to substitute for the injuredemployee during the period of interrupted working test shall havesuch time counted toward his twelve-month working test period.

(2) Notwithstanding any other provision of law to the contrary,in the city of DeRidder a vacant position in the police departmentshall be filled in the following manner:

(a) If a vacancy cannot be filled by reinstatement, or byreemployment as provided in Subsections A and B of this Section,the board shall next certify the names of the persons on thepromotional list, in the order in which they appear thereon, for theclass in which the vacancy is to be filled.

(b) The appointing authority shall select and appoint to the firstvacancy to be filled the one person certified to him who has thegreatest promotional seniority in the next lower rank. Any remainingpositions to be filled in the same class shall be filled by appointingto each such successive vacancy the one of the remaining persons

(d) If two or more persons possess an equal amount ofpromotional seniority, those persons shall be reinstated or listed onthe promotional list and offered promotions in the order ofdepartmental seniority, from highest to lowest.

(e) Any person certified to the appointing authority who,because of work-related illness, injury, or incapacity, is unable toimmediately begin a working test, shall be appointed in accordancewith Subparagraph (a) of this Paragraph. * * *B.(1) No person shall be eligible for parole consideration who

has been convicted of armed robbery and denied parole eligibilityunder the provisions of R.S. 14:64. Except as provided in Paragraph(2) of this Subsection, and except as provided in Subsections D andE of this Section, no prisoner serving a life sentence shall be eligiblefor parole consideration until his life sentence has been commuted toa fixed term of years. No prisoner sentenced as a serial sexualoffender shall be eligible for parole. No prisoner may be paroledwhile there is pending against him any indictment or information forany crime suspected of having been committed by him while aprisoner. Notwithstanding any other provisions of law to the contrary,a person convicted of a crime of violence and not otherwise ineligiblefor parole shall serve at least eighty-five seventy-five percent of thesentence imposed, before being eligible for parole. The victim orvictim's family shall be notified whenever the offender is to bereleased provided that the victim or victim's family has completed aLouisiana victim notice and registration form as provided in R.S.46:1841 et seq., or has otherwise provided contact information andhas indicated to the Department of Public Safety and Corrections,Crime Victims Services Bureau, that they desire such notification.

* * *Section 4. R.S. 15:824.2 is hereby enacted to read as follows:

§824.2. Programs to Reduce Recidivism FundA. The Programs to Reduce Recidivism Fund, hereinafter

referred to as the "fund", is hereby created in the state treasury. Interest earned on the investment of monies in the fund shall bedeposited in and credited to the fund. Unexpended andunencumbered monies in the fund at the close of each fiscal yearshall remain in the fund. Monies in the fund shall be appropriated,administered, and used solely and exclusively for the purposesprovided by this Section.

B. The fund shall be comprised of all monies appropriated,donated, or otherwise made available to provide funding for thepurposes set forth in the provisions of this Section. Any fundsrealized from a reduction in the amount of time a person convictedof a crime of violence is required to serve prior to being eligible forparole consideration as provided for in R.S. 15:574.4(B) shall also beappropriated to the fund. All of such monies required to be depositedin the state treasury in accordance with Article VII, Section 9(A) ofthe Constitution of Louisiana shall be deposited in the fund after firstmeeting the requirements of Article VII, Section 9(B) of the

Constitution of Louisiana relative to the Bond Security andRedemption Fund.

C. Monies in the fund shall be appropriated and used for thefollowing purposes:

(1) To defray the operational expenses of probation and paroleand reentry initiatives.

(2) To assist in establishing and reimbursing the operationalexpenses of local corrections rehabilitative programs that do thefollowing:

(a) Provide inmates housed in local facilities with fundamentalresources in the areas of employment, life skills training, and jobplacement.

(b) Provide the inmates with access to as many support servicesas possible to appreciably increase the likelihood of successfulreentry into society and to reduce recidivism.

D. The fund shall be administered by the Louisiana Commissionon Law Enforcement and the Administration of Criminal Justice andthe Department of Public Safety and Corrections, hereinafter referredto as "the administrators". Monies in the fund shall be distributed toprobation and parole, reentry initiatives, and local prison facilitiesthrough a grant program established by the administrators. Theadministrators shall allocate funds as necessary for the purposesprovided in Subsection C of this Section. The administrators shallpromulgate such rules, regulations, and procedures as are necessaryin administering the provisions of this Section.

Section 5. R.S. 15:827.1(E)(3)(b) is hereby repealed in itsentirety.

Section 6. The provisions of Sections 3 and 5 of this Act shallhave prospective application only and shall apply only to personsconvicted on or after the effective date of this Act.

Section 7. The Department of Public Safety and Correctionsshall measure and document cost savings from the implementation ofthis Act. The Department of Public Safety and Corrections shallestablish a baseline for measurement using the average number ofinmates incarcerated at each type of penal or correctional institutionas defined in R.S. 15:824 and at local parish jails or institutions inFiscal Year 2015-2016. The Department of Public Safety andCorrections shall provide information regarding the estimated savingsto the legislature. The Louisiana Legislature shall appropriate thesavings realized by the provisions of this Act to be deposited in thefund created by, and for the purposes set forth in, R.S. 15:824.2enacted in Section 4 of this Act.

Section 8. The provisions of Sections 1, 2, 6, 7 and this Sectionof this Act shall be effective August 1, 2016."

(2)(a) To obtain a refund pursuant to this Section, a properlycompleted request shall be submitted to the finance director for theparish of East Baton Rouge on forms provided by the financedirector. Within thirty days after the date that a properly completedrequest is received by the finance director, the finance director shallissue a refund check to the applicant or shall notify the applicant ofthe disallowance of the request.

(b) For purposes of this Section, a "properly completed request"means a request that includes the information required on the face ofthe request form and is signed.

(c) Within thirty days from receipt of the notification of adisallowed request, the applicant may resubmit a properly completedrequest to the finance director for reconsideration. The time periodsfor reconsideration of a disallowed request shall be the same as thetime periods for consideration of the initial request. Requests may besubmitted electronically with the approval of the finance director.

(d) Failure of the finance director to timely process and pay arefund in accordance with this Section shall entitle the applicant tointerest on the amount of the refund allowed in the properlycompleted request. Interest shall begin to accrue on the date theproperly completed request or reconsideration of a disallowed requestis received by the finance director at the rate established pursuant tothe provisions of R.S. 13:422.

(3) All sums remaining in the Misdemeanor Detention Fund onAugust 1, 2018 which are not subject any claim for refund shall bedistributed by the finance director as follows:

(a) One half shall be transferred to the East Baton Rouge ParishPublic Defender's Office to be used solely to provide twenty-fourhour, seven day per week service at the East Baton Rouge Parish Jail.

(b) One half shall be transferred to the East Baton Rouge ParishDistrict Attorney's Office to be used solely to provide twenty-fourhour, seven day per week service at the East Baton Rouge Parish Jail.

(4) Until all funds are distributed from the MisdemeanorDetention Fund, the finance director shall cause to be conductedannually an audit of the fund and the books and accounts relatingthereto, and shall file the same with the office of the legislatureauditor, where it shall be available for public inspection."

(a) Before the conclusion of the transaction all of thefollowing:

(i) A description of the good or service being offered.(ii) The cost of such good or service.(iii) That the transaction is being done by a third party

online hotel reservation seller.(b) Throughout the transaction process, in a manner that is

continuously visible to the consumer, the fact that the third partyonline hotel reservation seller is a third party seller and is notaffiliated with the person who owns the hotel or provides thehotel services or accommodations.

(2) As used in this Subsection,"third party online hotelreservation seller" means a person that sells, or offers for sale,hotel reservations on the Internet and is not affiliated with theperson who owns the hotel or provides the hotel services oraccommodations.

(3) A violation of this Subsection by a third party onlinehotel reservation seller shall not be considered a violation by theInternet provider."
