Section 1 General Information HORSE GRAZING LAND OF 6 ACRES (APPROX) TO LET AT UPPER WICKHAM LANE, WELLING SUITABLE FOR HORSE GRAZING Introduction The London Borough of Bexley is inviting informal rental offers over £3,500 per annum for the grant of a tenancy for grazing land of approximately 6 Acres at Upper Wickham Lane Welling. The closing date for offers is 12.00 noon on Friday 7th September 2018. Location The land is located in Upper Wickham Lane, Welling as shown on the enclosed plan. Description The land is fairly level and has the benefit of a purpose built field shelter and other structures erected by the previous tenant. Applicants should make their own enquiries as to the condition and suitability of these structures. The site benefits from boundary fencing and vehicular access from Upper Wickham Lane. Services There are water and electricity services on site. The tenant will be responsible for meeting the costs. Tenure The London Borough of Bexley is the freeholder of the site. The Council will grant to the selected applicant a tenancy for three years from a date to be agreed. Depending upon the activities/status of the applicant the Council may require the security of tenure provisions contained in part 2 of the Landlord and Tenant Act 1954 to be excluded from the tenancy. For details of the terms and conditions of the tenancy please refer to the enclosed Heads of Terms in Section 5. The ingoing tenant is to contribute £750 towards the Council’s costs of granting a tenancy. Planning Interested applicants are required to satisfy themselves as to the suitability of the land for their intended use and the need, or otherwise, for planning permission. You are also advised that if any new structures are proposed on the land planning permission must be applied for and landlord’s consent sought, prior to their erection. Viewing The land may be viewed from the adjoining highway at any time. Section 2 Conditions of sale and timetable Timetable In order to ensure that the transaction is processed as quickly and efficiently as possible the Council is looking to keep to the following timetable and failure to do so may result in the Council withdrawing from the transaction. Section 3 Submission of Offers Basis of Offer The Council is inviting rental offers over £3,500 per annum (Three thousand five hundred Pounds) for the land on the basis of a 3-year tenancy agreement. Interested applicants are advised to take note of the procedure laid down in this section as any offer not submitted in the prescribed from may not be considered. Interested applicants, whether they have inspected the land or not, shall be deemed to offer with full knowledge thereof and shall raise no requisitions or objections thereto. Selection Criteria – The Council are looking for offers for the land to not only be of financial benefit to the Council, but also to show that the proposed use of the land will benefit the surrounding community, that the land will be well managed and that recognised good horse husbandry practices will be used. Your offer will be assessed as follows.

Submission procedure Every person submitting an offer for the tenancy of the land must complete in full the attached Form of Offer and return it to the address below sealed in an envelope bearing one of the tender labels as enclosed with these particulars. No offers are to be submitted by facsimile or e-mail. Consideration of offers All offers received by the due closing date and time and submitted in accordance with the above procedure will be considered by the Council. It is expected that the successful tenant will be notified of the Council’s decision to proceed by the end of September 2018. The Council does not bind itself to accept any offer received and in no case shall a prospective tenant have a claim for expenses or other money incurred in connection with any submission nor will the Council be required to give any explanation of its assessment of offers or if it decides to withdraw from this offer process at any stage.

Bribery and Corruption Clauses If the Council in its sole discretion considers that in relation to the offer process there has or may or appears to have been the possibility that any party invited to tender has: a) Offered or given or agreed to give any person any gift or consideration of any kind as an inducement or reward for doing or forbearing to do or for having done of forborne to do any action, or: b) Shown or forborne to show favour or disfavour to any person or c) Committed any offence under the Prevention of Corruption Acts 1889, 1916 and the Prevention of Crime Act 2002 or has given or offered any fee or reward the receipt of which is an offence under Section 117(2) of the Local Government Act 1972, the Council may reject the offer, provided that such rejection shall be without prejudice to any other civil remedies available to the Council or any criminal liability which such conduct may attract.

Evidence of Identity

The Money Laundering Regulations 2017 requires that the Council obtain and hold identification and proof of address documentation. One identity document and two proof of address documents will be required if your offer is successful.

The identity document should be either a current passport or a valid UK driving licence. The two proof of address should be utility bills or similar.

References and Other Documents Required

A bank reference and also a personal/professional reference will be sought to verify your financial standing and experience of horse husbandry and land management skills. These will be required for the successful applicant. If the proposed community benefit is working with children and young people or vulnerable adults an up to date enhanced Disclosure and Baring Service check will need to be in place for all individuals working with them – copies will be required by the Council.

Heads of Terms

1. The Tenant

4. Term:

Three years.

5. Rent:

[subject to offer] payable quarterly in advance on 1st January, 1st April, 1st

July and 1st October each year

6. Use:

Horse grazing [and any community benefit activities as set out in the offer]

7. Repairs:

The tenant will be required to

a) put and keep the land in a good managed state

b) keep the land clear of all noxious weeds

c) maintain any buildings that are on the land in a good useable state of

repair and not to remove or erect any buildings/structures without the

prior written consent from the landlord

d) to maintain all of the fences and boundaries enclosing the land (where

not the responsibility of an adjoining owner) and to keep all bushes

and trees in good order. Removal of trees and bushes will require

landlord’s consent in writing.

proposed use is needed and apply for such consent, if required·

9. Exclusion of Security of Tenure:

Sections 24-28 of the Landlord and Tenant Act 1954 (dealing with matters of

security of tenure and rights of renewal) may be excluded from the letting. The

details of the lease will be confirmed once the offers have been considered.

10. Determination:

The tenancy can be determined by either the landlord or the tenant by the

giving of six months written notice at any time

11. Alienation:

The tenant will not be permitted to sub-let or assign the whole or any part of

the land.

12. Indemnity:

The tenant will indemnify the Council against claims arising for its presence

on the land and shall not cause a nuisance or disturbance to neighbours

adjacent to the land.

13. Signs:

The tenant will be permitted to erect a sign displaying its name and logo,

subject to agreement as to size and design. The tenant to be responsible for

obtaining any planning permission that may be required.

14. Insurance:

The tenant must hold sufficient and suitable insurance to cover the tenant’s

use of the land and activities. This is likely to include £10 million public

liability insurance. Evidence of Insurance should be supplied to the Council

annually.

15. Other Terms:

The lease will contain such other terms and conditions as the Council's

Head of Legal Services may consider necessary

16. Costs:

The tenant will be responsible for contributing to the Councils legal costs of

granting the tenancy which should be no more than £750.
