Introduction

We are very pleased to introduce You to theAllianz Horse and Rider Insurance Policyand thank You for insuring with Us.

Please read this Policy carefully to ensurethat it provides the cover You require. If theSchedule details do not agree with thedetails completed on your Statement ofFact/Proposal Form then please return itimmediately with a note of the changesthat should be made.

This policy (which includes and shall beread as one document with the Schedule,Endorsements and Statement ofFact/Proposal Form) evidences a contract ofinsurance between the Insured and Allianz.

We will, subject to the terms, conditions,limitations and exclusions of this Policy,indemnify You against liability which occursduring any Period of Insurance for whichYou have paid or agree to pay the premium.

This Policy is a legal document and shouldbe kept in a safe place.

Definitions

Any word or expression, whichis given a specific meaning inthis Policy, will have the samemeaning wherever it appears.

The Insured/You The person(s) named on the Scheduleunder Insured

We/Us/the Company Allianz p.l.c.

Permanent Loan An agreement whereby the Horse specifiedin the Schedule has been permanentlyloaned to You by the owner of the Horse,where You are financially responsible forthe Horse and where You are responsiblefor the Horse's stabling, grazing, health andgeneral care but where You are not theowner of the Horse.

LeaseA Lease is a conveyance or grant by a lessorto a lessee of possession of property, to lastfor a certain period of time and subject topayment.

Horse The Horse named on the Schedule,belonging to You (or is on Permanent Loanor Lease to You) or belonging to membersof your Immediate Family permanentlyresiding with You.

When You are only Riding the Horse (i.e.where the Horse does not belong to You oron Permanent Loan or Lease to You ), cover applies to any Horse that You ride.

Vet Veterinary surgeon registered with theVeterinary Council of Ireland.

InjuryA bodily injury or trauma causedimmediately by an accident. This does not include any Injury that happens over a period of time and that is contributed to in any way by a previous disease process inthe body.

IllnessSickness, disease or any changes to thenormal healthy physical state orappearance of the Horse.

RidingRiding, driving, leading, mounting,dismounting or handling the Horse.

Schedule The new business, endorsement or renewalSchedule and the benefits summary whichare the printed documents showing thedetails of your cover and any extraexclusions and clauses that apply to your Policy.

Market ValueThe price generally paid for:

- a Horse of the same age,breed, bloodline, sex andability as the Horse identified in the Schedule just before the Injury happened or the Illness first showed Clinical Signs.

OR- a Horse Trailer/ Horse Drawn

Vehicle, of the same age, typeand condition as the HorseTrailer or Horse DrawnVehicle identified in the Schedule just before the loss,theft or damage occurred.

Sum InsuredThe amount You have chosen to insure forand in the event of a loss the maximumamount We will pay.

Veterinary TreatmentThe cost of any visit, consultation,examination, advice, test, x-ray, ultra soundscan, legally prescribed medication,surgery, nursing and care required to treatan Illness or Injury, provided by a Vet, aveterinary nurse or another member of theveterinary practice under the supervision ofa Vet. Any form of diagnostic imaging otherthan x-rays and ultra sound scans willrequire pre-authorisation from the AllianzHorse and Rider Claims Department.

Period of InsuranceThe period shown on your Schedule and

any subsequent period for which We accepta renewal premium.

Your Vet The Vet or veterinary practice You employor use the services of to carry out theHorse’s treatment.

Veterinary Fees The amount Vets in general or referralpractices usually charge.

Clinical Signs Changes in the Horse’s normal healthystate, condition or appearance, or its bodily functions.

ExcessThe amount of any loss You must payyourself.

12 months365 days / 366 days (in a leap year)calculated from and including the date anInjury happens or the first Clinical Signs ofan Illness are noticed.

Our Vet The Vet We employ or use the services of toassess your claim, to carry out treatment tothe Horse or discuss the Horse’s treatmentwith Your Vet.

Immediate FamilyYour parent, brother, sister, son, daughter,spouse or partner all permanently residingwith You.

Spouse/PartnerMeans husband, wife or partner of theInsured in each of these relationships co-habiting and sharing household expenses or responsibilities.

Older Horse The Horse named on the Schedule,belonging to You (or is on Permanent Loanor Lease to You) or belonging to membersof your Household permanently residingwith You, where the Horse is aged 17 orolder at the inception or renewal of thepolicy.

Horse Trailer or Horse Drawn Vehicle The Horse Trailer or Horse Drawn Vehicledescribed on the Schedule.

Saddlery and Tack This means saddles, bridles, leathers, irons,harness and riding tack normally used onthe Horse while it is being used for theactivities shown on your Schedule. Thefollowing items are not included: rugs,blankets, hats, riders boots, jodhpurs, jacketsand human body protectors.

Replacement Value of Saddlery and TackThe price generally paid for new Saddleryand Tack of the same brand, make and typeas the Saddlery and Tack that has been lost,damaged, stolen or destroyed.

Complementary Treatment The cost of any examination, consultation,

advice, test and legally prescribedmedication for the following procedureswhere they treat an Illness or Injury:Hydrotherapy, acupuncture, chiropracticmanipulation, herbal medicine,homeopathy, neutraceuticals, osteopathy, physiotherapy, remedial farriery.

The treatment must be carried out either bya Vet or on the Vet’s written instruction to atherapist or farrier who holds an Irish orUnited Kingdom recognised qualification in the treatment of animals.

Maximum Benefit In the event of a loss the maximum amountpayable will be the amount stated in theSchedule.

Freeze Mark A permanent identity mark containingletters and numbers made on the Horse'sskin and recorded in the Horse passport.

Temporary Total Disablement Temporarily and totally preventing theInsured person from performing orattending any part of his or her usualbusiness profession or occupation or wherethe Insured person is not in gainfulemployment, he/she is confined to thehouse or hospital by a qualified medicalpractitioner.

Permanent Total DisablementThe permanent inability to attend anyoccupation or profession.

Clinical History A chronological record (computer printoutor photocopy of the original clinical notes)as made by the Vet(s) at the time of all visitsand consultations. This must includerecords of all legally prescribed medication.

Veterinary Certificate A standardised form used by all members ofVeterinary Ireland and the British EquineVeterinary Association giving details of thegeneral health of the Horse following a 2 stage or a 5 stage examination.

2 Stage Examination A standardised examination involving anoverall check of the Horse including anexamination of the Horse's eyes, heart,lungs and soundness. The Horse's skin isexamined for abnormalities, followed by anexamination of the heart and lungs at rest,the eyes in a darkened environment, thenthe Horse at walk and trot.

5 Stage Examination A standardised examination involving anoverall check of the Horse including anexamination of the Horse's eyes, heart,lungs and soundness. The Horse's skin isexamined for abnormalities, followed by anexamination of the heart and lungs at rest,the eyes in a darkened environment, thenthe Horse at walk and trot. This is followedby strenuous exercise, a period of rest, asecond trot up and foot examination carriedout by a Vet for the purpose of determining

suitability for an activity or activities. All 5stages must be carried out and if not thisfact to be stated with a reason why aparticular stage could not be carried out.

Horse Passport An identity record compulsory for all Horsesand ponies in Ireland under EuropeanCommunities (Equine Stud- Book andCompetition) Regulations 2004 (StatutoryInstrument 399 of 2004).

Microchip An identity chip inserted in to Horses. This is recorded with a barcode in the Horse passport.

Endorsement Any alteration to this Policy wording.

All other definitions as detailed in the Policy.

Misdescription This Policy will be voidable in the event ofmisrepresentation, misdescription or non-disclosure of any material facts i.e. thosecircumstances which may influence Us inour acceptance and assessment of thisinsurance. If You are in any doubt as towhether a fact is material or not pleasedisclose it. This condition applies atinception of your Policy, when a section isbeing added to your Policy and at renewaleach year.

General CareIf You own, Permanently Loan or Lease the Horse;

(a) You must take care of the Horse andtake all reasonable steps to maintainthe Horse's health. You must arrangeand pay for your Horse to have a yearlyhealth examination (including a dentalexamination) by a Vet and anytreatment normally recommended bya Vet to prevent Injury or Illnessincluding regular foot care.

(b) You must arrange and pay for theHorse to be kept vaccinated againsttetanus and flu and wormed asregularly as normally recommendedby a Vet. If You do not keep the Horsevaccinated and wormed, We will notpay any claims that result from anyIllness that would not have occurred if

the Horse had been vaccinated orwormed.

(c) Records of the above examinationsand vaccinations will be requiredbefore a claim is paid.

Use of Other HorsesIf You own, Permanently Loan or Lease theHorse that is the subject of this insurance,no cover applies for the use of any otherHorse.

Safety and Security You must take all reasonable precautions toprevent accidents, Injury, loss, theft ordamage. You must ensure anyone Ridingthe Horse has the experience to ride it andis able to ride it. They must only use theHorse for the activities listed in the groupor class of use You have chosen as set outon the Schedule.

ActivitiesYou must, at all times, insure the Horse forall the activities that it will be used, ortrained to be used for.

Review Your Sum InsuredYou must, at all times, insure the Horse forits current market value. It is yourresponsibility to ensure the sum insuredYou have chosen, and We have agreed forthe Horse, is kept up to date on your policy.You must review the sum insured on a

Policy Terms and ConditionsIf You do not observe the terms, conditions and endorsements of this Policy We maycancel your policy, refuse a claim and withdraw from any current claim.

regular basis to ensure it accurately reflectsthe market value of the Horse. If You havecover for the death of your Horse and inthe event of the Horse’s death, We will paythe Market Value of the Horse (or the suminsured if it is less). If the market value atthe time of death is lower than the suminsured shown on your Schedule, We willonly pay the market value and We will notprovide any refund of premium.

Change in Risk or CircumstanceYou must tell Us in writing IMMEDIATELY of any change which may affect thisinsurance or increase the risk of loss,damage or Injury, including change of use,change of activity etc. Failure to advise Usof such a change could invalidate the coverprovided or could result in a claim beingrejected or reduced. If You are in any doubtas to whether a change is material or notplease notify Us.

FraudIf any claim under this Policy is in anyrespect fraudulent, or if any fraudulentmeans or devices (including inflation orexaggeration of the claim, or submission offorged or falsified documents) are used byYou or anyone acting on your behalf toobtain any benefit under this Policy, allbenefit is forfeit.

Geographical Limits We will provide cover for the policysections and activities listed in the group

You have selected and are shown on theSchedule. The cover applies to insuredproperty:

- in the Republic of Ireland,- for up to 30 days during each

policy year for temporary visits tothe rest of Europe as long as thepurpose of the travel is not to seekVeterinary Treatment elsewhere,except where treatment is notavailable in the Republic of Irelandand pre-authorisation has beengranted by the Allianz Horse andRider Claims Department.

- while being transported in theRepublic of Ireland and whiletemporarily in Europe, thisincludes any journeys betweenthese areas.

Cancelling this PolicyYou may cancel the Policy at any timeby written notice.

We may cancel the Policy at any timeby issuing a written notice to You atyour last known address.

If there has been no claim on thepolicy We will return the premium forthe unexpired Period of Insuranceprovided same has been paid.

Other InsurancesIf at the time of any incident, which resultsin a claim under this Policy, there is any

other insurance covering the same liability,loss or damage, We will pay only ourrateable share.

Change in Terms and ConditionsIf, after We offer to renew your policy, Youtell us about or We discover somethingthat happened during an earlier Period ofInsurance or prior to insurance being takenout which could lead to a claim, We maychange the standard premium and Termsand Conditions and add exclusions backdated to the date your Policy renewed orwas incepted with Us.

1. Your Duties and Our Rights

What You must doYou must tell Us Immediately of any loss, damage, accident, Illness or Injury andgive details of how the loss, damage,accident, Illness or Injury occurred. Inaddition, You will be required to produce, atyour own expense, all necessarydocuments and information, includingdetails of the Horse's history and postmortem examination to support any lossand forward these to Us.

Send UsAny writ, letter, summons, notice of prosecution or other legal document Youreceive must be sent to Us, unanswered, on receipt.

Do Not NegotiateYou, or any other person insured under thisPolicy, or anyone else acting on your behalfmust not negotiate, admit or repudiate anyclaim without our written consent. Youmust tell us as soon as possible if anythinghappens which could lead to a claim.

2. We are entitled to

Defend or Settle Legal Action Take over and conduct in your name, or inthe name of any other person indemnifiedby this Policy, the defence or settlement ofany legal action.

Act to Recover PaymentTake proceedings at our own expense andfor our own benefit, but in your name, or inthe name of any other person indemnifiedby this Policy, to recover any payment Wehave made under this Policy.

Co-operation from YouReceive all necessary assistance from Youor any other person indemnified by thisPolicy.

Full Premium PaymentIn the event of a claim in the current Periodof Insurance, the full annual premiumbecomes due.

We reserve the right to request fullpayment of any outstanding premium priorto the claim being paid and/or to deductany outstanding premium from any claimpayment We may make to You

3. Dealing with Your Vet

Payment to Vet If We receive a request to pay the claim payment direct to a veterinarypractice or referral centre, We reserve theright to decline this request.

Veterinary Fees If the Veterinary Fees You are charged arehigher than the fees usually charged by ageneral or referral practice, We reserve the right to request an independent opinion

from a Vet that We choose. If the Vet Wechoose does not agree with the VeterinaryFees charged We may decide to pay onlythe Veterinary Fees usually charged by a general or referral practice.

Veterinary TreatmentIf We consider the Veterinary Treatment theHorse receives may not be required or maybe excessive when compared with thetreatment that is normally recommendedto treat the same Illness or Injury by generalor referral practices, We reserve the right torequest an independent opinion from a Vetthat We choose. If the Vet We choose doesnot agree with the Veterinary Treatment orComplementary Treatment provided Wemay decide to pay only the cost of theVeterinary Treatment that was necessary totreat the Injury or Illness, as advised by the Vet from whom We have requestedthe independent opinion.

Request for Information You agree that any Vet has your permissionto release any information We ask for aboutthe Horse. If the Vet makes a charge for this, You must pay the charge.

4. Disagreement over a Claim

This Policy shall be referred to an Arbitratoror if necessary to two Arbitrators, one to beappointed by each of the parties within onemonth after having being requested. The Arbitrators shall appoint an Umpire

who shall sit with the Arbitrators and in thecase of disagreement the Arbitrators shallsubmit to the decision of the Umpire. The making of an award shall be aCondition Precedent to any right of actionagainst Us. Differences not referred toarbitration within twelve calendar monthsfrom the date on which the differenceoccurred will be deemed to have beenabandoned.

NOTE: This condition does not affect yourright to refer any claim or query to theoffice of the Financial ServicesOmbudsman's Bureau.

Exclusions• Any amount if You do not own,

Permanently Loan or Lease the Horse.

• Any amount if the death or euthanasiaof the Horse occurs more than 12months after the date the Injuryhappened or the first Clinical Signs ofthe Illness were noticed, that resulted inthe death or euthanasia of the Horse.

• Any amount if Your Vet or Our Vetbelieves the Illness or Injury the Horse issuffering from can be treated.

• Any amount if Your Vet or Our Vetbelieves it is humane to keep the Horse alive.

• Any amount if the euthanasia of theHorse is carried out before You tell usabout your or Your Vet’s decision foreuthanasia, unless Your Vet believesthere was no time for You to tell usbecause the Horse was in so much painthat it needed immediate euthanasia.

• Any amount if the death or euthanasiaof the Horse results from:- an Injury that happened or Illness

that first showed Clinical Signs; or,- an Injury or Illness which is the

same as, or has the same diagnosisor Clinical Signs as, an Injury thathappened or an Illness which firstshowed Clinical Signs; or

Section 1: Death Cover 1A - Death of Horse From Injury or Illness

This section only applies when a Sum Insured for this cover is shown on the Schedule

We will indemnify You by payment for the death of the Horse or euthanasia of the Horse by aVet as a result of:

• an Injury or Illness that occurs or first shows Clinical Signs of occurring during the Periodof Insurance

• surgery to treat an Illness or Injury that occurred or first shows Clinical Signs of occurringduring the Period of Insurance; or

• legally prescribed medication to prevent an Illness or to treat an Injury or Illness thatoccurred or first shows Clinical Signs of occurring during the Period of Insurance.

In the event of a loss our maximum liability is limited to the Sum Insured stated on theSchedule or the Market Value of the Horse, whichever is lower, less the amount of the Excessstated in the Schedule in respect of each loss.

- an Injury or Illness that is caused by,relates to or results from an Injurythat happened or an Illness orClinical Sign which first showedClinical Signs,

before:a) the Horse’s cover started; orb) the date this section was added to

your insurance, no matter where the Injury Illness orClinical Signs were noticed or happenedin or on the Horse’s body.

• Any amount if the death or euthanasiaof the Horse results from:- an Illness first showing Clinical

Signs; or- an Illness which is the same as, or

has the same diagnosis or ClinicalSigns as, an Illness which firstshowed Clinical Signs; or

- an Illness that is caused by, relatesto or results from an Injury, Illnessor Clinical Sign,

which first showed Clinical Signs, within:a) the first 14 days of your first policy

year; or b) the first 14 days of the date this

section was added to your insurance; no matter where the Injury, Illness orClinical Signs were noticed orhappened in or on the Horse’s body.

• Any amount if the Horse’s conditiondoes not meet the current VeterinaryIreland and British Equine Veterinary Association (BEVA) Guidelines for thedestruction of Horses.

• Any amount if the death or euthanasiaof the Horse is deliberately caused by: - You, - any Immediate Family member,- any person living with You,- any person working for You,- any person looking after the Horse,- any person who has the Horse on

Permanent Loan or Lease to You.

• Any other financial loss, legalcompensation, costs or expenses thatresult from the death or euthanasia ofthe Horse.

• The cost of a post mortem examination.

• Any amount if the death or euthanasiaof the Horse results from an Injury or anIllness while taking part in an activity notshown as covered on your Schedule.

• Any amount if the death or euthanasiaof the Horse results from legallyprescribed medication unless it is givenby a Vet or under the direction of a Vet.

• Any amount if the death or euthanasiaof the Horse results from a vice whichthe Horse had or any behaviouraldisorder.

• Any amount for a mare's unborn foal,embryo or foetus.

• Any amount if the Horse is insuredunder section 1B Death from Injury(Older Horse).

Exclusions• Any amount if You do not own,

Permanently Loan or Lease the Horse.

• Any amount if the death or euthanasiaof the Horse happens more than 12months after the date of the Injury thatcaused the death or euthanasia.

• Any amount if Your Vet or Our Vetbelieves the Injury the Horse issuffering from can be treated.

• Any amount if Your Vet or Our Vetbelieves it is humane to keep the Horse alive.

• Any amount if the euthanasia of theHorse is carried out before You tell usabout your or Your Vet’s decision foreuthanasia, unless Your Vet believesthere was no time for You to tell Us because the Horse was in so much painthat it needed immediate euthanasia.

• Any amount if the death oreuthanasia of the Horse results from:- an Injury that happened or that first

showed Clinical Signs ; or- an Injury which is the same as, or

has the same diagnosis or ClinicalSigns as an Injury that happened;or

Section 1B – Death From Injury (Older Horse)This section only applies when a Sum Insured for this cover is shown on the Schedule

We will indemnify You by payment for the death of the Horse or euthanasia of the Horse by aVet as a result of:

• an Injury that occurs or first shows Clinical Signs of occurring during the Period of Insurance

Section 1A and Section 1BSpecial conditions that apply to these sections

• You must immediately arrange, atyour own expense, for a Vet toexamine and treat the Horse if itshows Clinical Signs of an Injury or an Illness.

• You must tell Us as soon as possible ifthe Horse shows any Clinical Signs ofan Injury or an Illness.

• If You or Your Vet decides oneuthanasia of the Horse, You must tellUs immediately. If We decide, We willrefer the case history to a Vet that Wehave chosen. If We request, You mustarrange for the Horse to go to anotherVet that We have chosen.

• If Your Vet and Our Vet do not agreethat the Illness or Injury the Horse issuffering from can be treated or thatit is humane to keep the Horse alive,We may employ or use the services ofanother independent Vet of ourchoice and approved by you. Theindependent Vet will examine theHorse and all parties will accept thisVet’s opinion.

• The period of 12 months will alwaysstart from the date in the Period ofInsurance:- the Injury first happened; or- the Illness or Clinical Signs were

first noticed; or

- an Illness with the same diagnosisor Clinical Signs as the Illness orClinical Signs that caused thedeath or humane destructionwere first noticed,

no matter how many times the sameIllness or the same Clinical Signs arenoticed in or on any part of theHorse’s body.

• If a number of Injuries, Illnesses, orClinical Signs are diagnosed as oneInjury or Illness, or it is found that theyare caused by, or relate to anotherInjury or Illness, the period of 12months will start from the date in thePeriod of Insurance that the first Injuryhappened or the first Clinical Signs ofany of the Illnesses were noticed.

• If We pay a claim under Section 1A -Death from Injury or Illness or 1B -Death from Injury (Older Horse) allcover under this Section will becancelled from the date of the Horse’s death. There will be nopremium refund.

• Following the death or euthanasia ofthe Horse, You must arrange and payfor a post mortem examination assoon as possible. We reserve the rightto request that this post mortemexamination be carried out by a

veterinary practice other than yournormal attending veterinary practice.

• We will not make any claim paymentuntil We receive evidence of your legalownership of the Horse as Well as aformal identification of the Horse, adeath certificate and post mortemreport from the Vet confirming thecause of death.

• Where the Horse is on PermanentLoan or Lease, we will require writtenconfirmation from the owner to statethat You are at a financial loss fromthe death of the Horse. We will alsorequire formal identification of theHorse, a death certificate and postmortem report from the Vetconfirming the cause of death.

Section 2 – Theft or Straying This section only applies when a Sum Insured for this cover is shown on theSchedule. Cover can only be selected where Advertisement and Reward Cover is also selected.

We will indemnify You by payment if the Horse is stolen or goes missing during the Period ofInsurance and is not found or does not return.

In the event of a loss our maximum liability is limited to the Sum Insured stated in theSchedule or the Market Value of the Horse, whichever is lower, less the amount of the Excessstated in the Schedule in respect of each loss.

Exclusions

• Any amount if You do not own,Permanently Loan or Lease the Horse.

• Any amount if You or the personlooking after the Horse has freelyparted with the Horse, even if trickedinto doing so.

• Any amount for the death of a mare'sunborn foal, embryo or foetus.

• Any amount if the theft or loss of theHorse involves dishonesty by - You, - any Immediate Family member,- any person living with You,- any person working for You,- any person looking after the Horse,- any person who has the Horse on

Permanent Loan or Lease to You.

• Any other financial loss, legalcompensation, costs or expenses as a result of the theft or straying of the Horse.

• We will not make any claim paymentuntil We receive evidence of your legalownership of the Horse.

• Where the Horse is on Permanent Loanor Lease, written confirmation from theowner to state that You are at afinancial loss from the theft or strayingof the Horse will be required.

• You must notify the Gardai or policeas soon as You discover the Horse hasbeen stolen or gone missing. Youmust also provide the Gardai or policewith the Horse's passport andmicrochip number and provideevidence to Us that You have done so.

• If the Horse is found or returns, Youmust immediately repay the amountWe have paid You.

• If We pay a claim under this section,all cover under this section will becancelled from the date of the theft orthe date the Horse went missing.There will be no premium refund.

• You must provide proof of advertisingfor the missing Horse (newspaperadvertisements, posters, etc) andoffer a reward for recovery of theHorse. The costs of this advertisingand reward can be claimed for underthe Advertising and Reward section ofthe Policy where this cover applies.

• No claim in this section will be paidunless the Horse has been missing fora minimum of 3 months.

If the Horse is stolen or goes missing during the Period of Insurance, We will indemnify Youin respect of the reasonable costs of advertising to try and find the Horse and in respect ofthe reward You have paid when the Horse is found.

In the event of a loss our maximum liability is limited to the Sum Insured stated in theSchedule or the Market Value of the Horse, whichever is lower.

Exclusions

• Any amount if You do not own,Permanently Loan or Lease the Horse.

• Any amount if the theft or loss of theHorse involves:- You- any Immediate Family member,- any person living with You,- any person working for You,- any person looking after the Horse,- any person who has the Horse on

Permanent Loan or Lease to You.

• Any reward to find the Horse which wasnot agreed with Us before the rewardwas set.

• Any reward paid to- any Immediate Family member,- any person living with You,- any person working for You,- any person looking after the Horse,- any person who has the Horse on

Permanent Loan or Lease to You.

• Any amount if You or the personlooking after the Horse has freelyparted with the Horse, even iftricked into doing so.

• Any reward not supported by asigned receipt giving the full nameand address of the person whoprovided information which led tothe recovery of the Horse. A writtenstatement from the person whoreceived the reward giving detailsof the circumstances which led tothe recovery will also be required.

Section 4 – DisposalThis section only applies when a Sum Insured for this cover is shown on theSchedule. Cover can only be selected where Death Cover is also selected.

We will indemnify You in respect of the cost to remove and dispose of the Horse’s carcassfollowing death or euthanasia as a result of an Injury that happens; or an Illness that firstshows Clinical Signs; during the policy year.

In the event of a loss our maximum liability is limited to the Sum Insured stated in the Schedule.

Exclusions

• Any amount if You do not own,Permanently Loan or Lease the Horse.

• Any amount if the death or euthanasiaof the Horse is not covered underSection 1A – Death from Injury orIllness or Section 1B Death from Injury(Older Horse).

• Any amount following death due to anIllness if the Horse is covered underSection 1B – Death from Injury (OlderHorse).

Section 5 – Third Party LiabilityThis section is only covered if the limit of indemnity is shown on your Schedule.

We will indemnify You against all sums which You shall become legally liable to pay for:

(i) damage to property other than property belonging to or under the control of;• You,• members of your Immediate Family,• any person living with You,• any person employed by You,

(ii) death, bodily Injury or illness to any person other than• members of your Immediate Family• any person living with You• any person employed by You

as a result of an accident during the period of insurance,a) involving the Horse, the Horse Trailer or the Horse Drawn Vehicle if You own,

Permanently Loan or Lease the Horse, orb) while You are Riding a Horse if You do not own, Permanently Loan or Lease the Horse.

The amount payable in respect of any one occurrence or all occurrences of a seriesconsequent on one original cause will not exceed the limit of indemnity stated on theSchedule inclusive of all legal fees.

Excluding Liability in Respect of:

• Any costs or expenses for defendingYou that We have not agreedbeforehand.

• Any compensation, costs and expensesfor which You are found legally liable topay as a result of any contract oragreement which You entered intowhich imposed on You liability whichYou would not have otherwise beenunder.

• Any compensation, costs and expensesif the property damaged belongs to oris under the control of any person whois a member of your Immediate Family,who lives with You or who is employedby You.

• Any compensation costs and expensesfor loss or damage to fences, walls,gates and agricultural crops.

• Any compensation, costs and expensesarising out of the ownership, possession

or use of a Horse Trailer in circumstanceswhere compulsory insurance or securityfor such vehicle is required under RoadTraffic Act Legislation.

• Any compensation, costs and expensesfor a Horse Drawn Vehicle on the publichighway if the Horse is not drawing it.

• Any amount if the Horse Drawn Vehicleis being used for training for, or takingpart in, flapping, trapping, racingcompetitions, trials or cross countryevents.

• Any compensation costs and expensesif the accident results from a stallionserving or attempting to serve a mare,or from any activity involving artificialinsemination.

• Any action for damage brought in aCourt of Law outside the Republic ofIreland.

• Air, water or soil pollution, unless it canbe proved that the pollution took placeimmediately after and as a result of anaccident involving the Horse, the HorseTrailer, or a Horse Drawn Vehicle.

• Any compensation, costs and expensesif You own, Permanently Loan or Leasethe Horse and if a person is Riding theHorse for professional lessons or Ridingat a riding establishment unless that

person is You or a member of yourImmediate Family.

• If You own, Permanently Loan or Leasethe Horse, any compensation costs andexpenses if the incident results fromthe business activities of a Ridingestablishment.

• Any compensation, costs and expensesif You do not own, Permanently Loan orLease the Horse and You have notfollowed instructions given to You bythe person responsible for the HorseYou are Riding.

• Any amount if the incident or Injurythat takes place is a result of yourbusiness activity, your profession, youroccupation or while You are working forsomeone, whether You are paid or not.

Section 6 – Saddlery and Tack This section only applies when a Sum Insured for this cover is shown on the Schedule.

We will indemnify You by payment or, at our option, by replacement or repair, if yourSaddlery and Tack is lost, stolen, damaged or destroyed during the Period of Insurance.

In the event of a loss our maximum liability is limited to the Sum Insured stated in theSchedule less the amount of the Excess stated in the Schedule in respect of each loss.

Exclusions

• Any amount in excess of €500 for any saddle or item of tack You do nothave formal proof of purchase for thatshows the make, model and the date ofpurchase.

• Any amount for rugs, clothing orpersonal effects.

• Any amount if the Saddlery and Tack islost or stolen when it is left unattended,unless it has been lost or stolen from:

- the locked boot or covered luggagearea or any other speciallydesigned covered area of a lockedvehicle; or

- any building that You live in thathas mortice deadlocks on allexternal doors; or

- a building or part of a building thatYou do not live in that has beenlocked with mortice deadlocks orequivalent locks on all doors andhas steel bars or steel grids on allwindows.

• Any amount for Saddlery and Tack Youdo not own or are not legallyresponsible for.

• Any amount if the Saddlery and Tack isdamaged or destroyed by wear andtear or the actions of moths, insects,vermin, pests or any other graduallyoperating cause.

• Any amount if the Saddlery and Tack isdamaged when it is being cleaned,dyed, repaired or restored.

• Any amount if the Saddlery and Tack isbeing used by a Riding establishmentor by someone for professional lessonsif they are not a member of yourImmediate Family.

• Any amount to have the Saddlery andTack adjusted to fit the Horse.

• Any amount if the Saddlery and Tack islost, stolen or damaged as a result ofany profession, trade or business.

We will indemnify You in respect;

(i) of the cost of Veterinary Treatment; and

(ii) if instructed by a Vet in writing, following a Veterinary examination, the cost of Complementary Treatment the Horse receives,

all to treat an Injury that happens or an Illness that first shows Clinical Signs during the Period ofInsurance.

In the event of a loss our maximum liability is limited to the Sum Insured stated in the Schedule lessthe amount of the Excess stated in the Schedule in respect of each Illness or Injury that is not relatedto any other Illness or Injury.

Exclusions

• Any amount if You do not own,Permanently Loan or Lease the Horse.

• The cost of any Veterinary Treatment orComplementary Treatment the Horsereceives after 12 months from the datethe Injury happened or the Illness firstshowed Clinical Signs.

• The cost of any medicines or materialsprescribed or supplied to be used after12 months from the date the Injuryhappened or the Illness first showedClinical Signs.

• The cost of any Veterinary Treatment orComplementary Treatment for:- an Injury that happened or Illness

that first showed Clinical Signs; or- an Injury or Illness which is the

same as, or has the same

diagnosis or Clinical Signs as, anInjury that happened or an Illnesswhich first showed Clinical Signs;or

- an Injury or Illness that iscaused by, relates to or resultsfrom an Injury that happenedor an Illness or Clinical Sign whichfirst showed Clinical Signs,before:a) the Horse’s cover started;

orb) the date this section was

added to your insurance.no matter where the Injury, Illness orClinical Signs were noticed orhappened in or on the Horse’s body.

• The cost of any Veterinary Treatment orComplementary Treatment for:- an Illness first showing Clinical

Signs; or

• The cost of any Veterinary Treatment orComplementary Treatment a Vetnormally recommends to preventInjury or Illness.

• The cost of any Veterinary Treatment orComplementary Treatment that Youchoose to have carried out, that is notrequired to treat an Injury or Illness,including any complications that arisefrom this treatment.

• The cost of any Veterinary Treatment orComplementary Treatment that resultsfrom a vice which the Horse had or anybehavioural disorder.

• The cost of vaccinations, castration, andremoving of wolf teeth, except the cost

of treating any complications caused bythese procedures.

• The cost of any Veterinary Treatment orComplementary Treatment if yourHorse is insured by Section 7B Vet Fees(Older Horse).

• The cost of any Veterinary Treatment orComplementary Treatment for anyInjury or Illness deliberately caused by - You, - any Immediate Family member,- any person living with You,- any person working for You,- any person looking after the Horse,- any person who has the Horse on

Permanent Loan or Lease to You.

• The cost of treatment, which is notVeterinary Treatment orComplementary Treatment, that Youcould carry out yourself, unless the Vetconfirms that a Vet or a member of aveterinary practice must carry this out,regardless of your personalcircumstances.

• Any costs for transporting the Horse toor from the place of VeterinaryTreatment or ComplementaryTreatment.

• The cost of any Veterinary Treatment orComplementary Treatment that resultsfrom an Injury or an Illness while takingpart in an activity not shown as coveredon your Schedule.

• The cost of any Veterinary Treatment orComplementary Treatment that YourVet and Our Vet do not agree.

• The cost of any Veterinary Treatment orComplementary Treatment if a claim hasnot been submitted within 12 months ofthe Horse receiving treatment.

• The cost of any Veterinary Treatment orComplementary Treatment for anIllness if the Horse is aged 17 years orover at the renewal of the policy.

• The cost of conditions relating toreproduction including fertility,pregnancy, foaling and treatment ofthe neonatal foal except where theattending Vet deems a birth to becomplicated and needing treatment inan immediate attempt to save themare’s life.

a) your Horse’s cover started; or,b) the date this section was added to

• The cost of:- stabling- grazing- feeding; or- any changes in the way You

look after the Horse,other than when the Horse ishospitalised.

• More than 50% of the livery and nursingcosts when the Horse is hospitalisedand with any claim for a period ofessential hospitalisation, We mayrequire an explanation from Your Vet asto the reason why hospitalisation isessential for treatment and the lengthof hospitalisation required.

• The cost of treatment, which is notVeterinary Treatment or ComplementaryTreatment, that You could carry outyourself, unless the Vet confirms that aVet or a member of a Veterinary practicemust carry this out, regardless of yourpersonal circumstances.

Section 7C– Emergency Vet FeesThis section only applies when a Sum Insured for this cover is shown on the Schedule.

If the Horse which You do not own, have on Permanent Loan or Lease is injured as a result ofan accident and needs immediate Veterinary Treatment We will indemnify You in respect ofthe cost of;- the Vet attending the scene of the accident,- Veterinary Treatment for the Horse at the scene of the accident and the following

24 hours,- moving the Horse from the scene of the accident to the place it is usually kept,

and - euthanasia by the Vet at the scene of the accident and removal of the carcass

from the scene of the accident.

In the event of a loss our maximum liability is limited to the Sum Insured stated in theSchedule less the amount of the Excess stated in the Schedule in respect of each Injury thatis not related to any other Injury.

Exclusions

• The cost of treating any Injury firstshowing Clinical Signs before theaccident.

• Any amount if a Vet does not attend thescene of the accident.

• The cost of a post mortemexamination.

• The cost of Veterinary Treatment forany Injury that occurred as a result ofan accident that happened before thedate of this particular accident.

• The cost of any Veterinary Treatmentfor any Injury deliberately caused by- You - any Immediate Family member,- any person living with You,- any person working for You,- any person looking after the Horse,

• The cost of any medicines or materialsprescribed or supplied to be used after24 hours from the time of the accident.

• The cost of any Veterinary Treatment ifa claim has not been submitted within12 months of the Horse receivingVeterinary Treatment.

We will indemnify You by payment if your Horse is injured or first shows Clinical Signs of anIllness, during the period of insurance, which results in your Horse never being able to takepart in any one of the activities set out in the Schedule.

In the event of a loss our maximum liability is limited to the Sum Insured stated in theSchedule or the Market Value of the Horse (less the residual value), whichever is lower, lessthe amount of the Excess stated in the Schedule in respect of each loss.

Exclusions

• Any amount if You do not own,Permanently Loan or Lease the Horse.

• Any amount if the permanent loss ofuse happens more than 12 monthsafter the date the Injury happened orthe Illness first showed Clinical Signs.

• Any amount for permanent loss of useif Your Vet and Our Vet do not agreethat the Horse will never be able to takepart in any one of the activities set outon the Schedule.

• Any amount for permanent loss of usecaused by:- an Injury that happened or Illness

that first showed Clinical Signs; or- an Injury or Illness which is the

• Any amount for permanent loss of useif the Injury or Illness results from anactivity not shown as covered onSchedule.

• Any amount for permanent loss of useif the Horse cannot breed.

• Any amount for permanent loss of useif the Horse is under 2 years of age or17 years old or older at the beginning ofthe Period of Insurance as set out inyour Schedule.

• Any amount if the permanent loss ofuse of the Horse results from a vicewhich the Horse had or any behaviouraldisorder.

• Any amount for permanent loss of useif the Horse is not allowed to take partin any show because of any regulationsabout Horses that have had anyoperation for a respiratory systemdisorder.

• Any amount for permanent loss of useunless the Illness or Injury preventsyour Horse from physically taking partin an activity listed on the Schedule.

• You must immediately arrange, at yourown expense, for a Vet to examine andtreat the Horse if it shows Clinical Signsof an Injury or an Illness.

• If it is Your Vet’s opinion that the Horsewill never be able to take part in anyone of the activities set out on theSchedule, You must send us a reportfrom Your Vet giving details of theHorse’s Illness or Injury and thereasons for the opinion.

• We may decide that We need Our Vetto agree with Your Vet that the Horsewill never be able to take part in anyone of the activities set out on theSchedule.

• If Your Vet and Our Vet do not agreethat the Horse will never be able totake part in any one of the activities setout on the Schedule, We may employor use the services of anotherindependent Vet who We chose andapproved by You. The independent Vetwill examine the Horse and all partieswill accept this Vet’s opinion.

• The period of 12 months will alwaysstart from the date in the policy year:- the Injury first happened;- the Illness or Clinical Signs were

first noticed; or- an Illness with the same diagnosis

or Clinical Signs as the Illness orClinical Signs that caused the

permanent loss of use were firstnoticed,

no matter how many times the sameIllness or the same Clinical Signs arenoticed in or on any part of the Horse’s body.

• If a number of Injuries, Illnesses, orClinical Signs are diagnosed as oneInjury or Illness, or it is found that theyare caused by, or relate to anotherInjury or Illness, the period of 12months will start from the date in thepolicy year that the first Injuryhappened or the first Clinical Signs ofany of the Illnesses were noticed.

• We will not make any claim paymentuntil We receive evidence of your legalownership of the Horse and formalidentification of the Horse.

• Where the Horse is on PermanentLoan or Lease, written confirmationfrom the owner to state that You are ata financial loss from the permanentloss of use of the Horse, as well asformal identification of the Horse willbe required.

• Once We have agreed the settlementof your claim, You must agree to havethe loss of use freeze mark placed onthe Horse. We will not make any claimpayment until We have receivedconfirmation the freeze mark has beendone. If You have decided to euthanase

• If the Horse is covered for 100% of thesum insured and We pay a claim for it,the Horse will continue to belong toYou. We will reduce the amount Wepay You by what the Horse is worth atthe date of payment.

• If We pay a claim under this section,this section will be cancelled from thedate of the loss. There will be nopremium refund.

Section 9 – Rider Personal Accident and Dental This section only applies if the benefit is shown on your Schedule.

We will pay up to the amount for the benefits selected as stated in your Schedule and also atthe end of this section less the amount of the Excess in respect of each loss if You are injuredor have to stay in hospital as a result of an accident, while Riding the Horse, during the Periodof Insurance.

In the event of death as a result of an accident, while Riding the Horse, during the period ofinsurance, We will pay your legal personal representatives.

If You own, Permanently Loan or Lease the Horse, ‘You’ also includes;

- any Immediate Family member,- any person living with You,- any person working for You.

Exclusions

• More than one of the benefits 1 to 5 asa result of one accident, as shown at theend of this section.

• Any amount if your death happensmore than 24 months after the dateYou were injured.

• Any amount for Permanent TotalDisability until at least 52 Weeks afterthe date of the accident.

• The first 7 days of Temporary TotalDisability for each accident or morethan 52 Weeks of the Temporary TotalDisability for each accident.

• More than 30 days Hospital benefit foreach accident.

• Any amount if You are under 5 yearsold.

• Any amount relating to a pre-existingmedical condition, Injury or Illness Youhad before the cover under this sectionwas added.

• Any amount if Injury or death resultedfrom suicide, attempted suicide or Youdeliberately injuring yourself.

• Any amount if the Injury or death wascaused because You deliberately putyourself in danger unless it was in anattempt to save someone's life.

Section 10 – Horse Trailers and HorseDrawn VehiclesThis section only applies when a Sum Insured for this cover is shown on the Schedule.

If the Horse Trailer or Horse Drawn Vehicle is lost, stolen, damaged or destroyed during thePeriod of Insurance We will indemnify You in respect of the:

• cost of repairing the Horse Trailer or Horse Drawn Vehicle if it is damaged to bring it back to the same condition it was in before it was damaged; or,

• market value of the Horse Trailer or Horse Drawn Vehicle if the cost of repair is more than it was worth or it is lost, stolen or destroyed.

In event of a loss our maximum liability is limited to the Sum Insured stated on the scheduleor the Market Value of the

(a) Horse Trailer, or

(b) Horse Drawn Vehicle,

whichever is lower, less the amount of the Excess stated in the Schedule in respect of each loss.

Exclusions

• Any amount if You do not own theHorse Trailer or Horse Drawn Vehicle.

• Any amount unless You provide us withevidence of your legal ownership of theHorse Trailer or Horse Drawn Vehicle.

• Any amount if your Horse Trailer orHorse Drawn Vehicle is damaged ordestroyed by wear and tear or theactions of moths, insects, vermin, pests,mildew, mechanical or electricalbreakdown, or any other graduallyoperating causes.

• Any amount if the Horse Trailer orHorse Drawn Vehicle is damaged ordestroyed when it is being cleaned,repaired or restored.

• Any amount if replacement parts oraccessories are not available.

• Any amount for tyres that are damagedby punctures, bursts, braking or are cut.

• Any amount if the Horse Drawn Vehicleis damaged while it is being used fortraining for, or taking part in, flapping,trapping, racing competitions or trialsor cross country events.

• Any other financial loss, legalcompensation, costs or expenses.

• Any amount if the Horse Trailer orHorse Drawn Vehicle is lost, stolendamaged or destroyed as a result ofany business activity, your profession,your occupation, or while You areworking for someone, whether You arepaid or not.

• Any amount if the Horse Trailer orHorse Drawn Vehicle is loaned toanyone outside your ImmediateFamily.

• Any compensation, costs andexpenses arising out of the ownership,possession or use of a Horse Trailer incircumstances where compulsoryinsurance or security for such vehicleis required under Road Traffic ActLegislation.

This policy does not cover the following:

Any Horse less than 30 days old.

Any amount if the Injury, Illness or incidentis shown as excluded on the Schedule.

Radioactive Contaminationa) Loss or destruction of or damage to any

property whatsoever or any loss orexpense whatsoever resulting orarising therefrom or any consequentialloss or,

b) Any legal liability of whatsoever naturedirectly or indirectly caused by orcontributed to by or arising from(i) ionising radiations or

contamination by radioactivityfrom any nuclear fuel or from anynuclear waste from thecombustion of nuclear fuel,

(ii) the radioactive, toxic, explosive orother hazardous properties of any explosive nuclear assembly or nuclear.

War and TerrorismNotwithstanding any provision to thecontrary within this insurance or anyendorsement thereto it is agreed thatthis insurance excludes liability, loss,damage, cost or expense ofwhatsoever nature directly orindirectly caused by, resulting fromor in connection with any of thefollowing regardless of any other

cause or event contributingconcurrently orin any other sequence to the loss;

(1) war, invasion, acts of foreign enemies,hostilities or warlike operations(whether war be declared or not), civilwar, rebellion, revolution, insurrection,civil commotion assuming theproportions of or amounting to anuprising, military or usurped power, or

(2) any act of terrorism. An act of terrorismmeans an act, including but not limitedto the use of force or violence and/orthe threat thereof, of any person orgroup(s) of persons, whether actingalone or on behalf of or in connectionwith any organisation(s) orgovernment(s), committed forpolitical, religious, ideological or otherpurposes including the intention toinfluence any government and/or toput the public, or any section of thepublic, in fear.

This endorsement also excludes liability,loss, damage, cost or expense ofwhatsoever nature directly or indirectlycaused by, resulting from or in connectionwith any action taken in controlling,preventing, suppressing or in anyway relating to (1) and/or (2) above.If the Company alleges that by reasonof this exclusion any liability, loss,damage, cost or expense is notcovered by this insurance the burden

Sonic BoomLoss or damage caused by pressurewaves from aircraft and other aerialdevices travelling at sonic or supersonicspeeds.

Deliberate or Criminal ActThis Policy does not provide cover for anyclaim resulting from deliberate or criminalacts by You or anyone acting on your behalfor with your consent or by your domesticemployee.

Unlawful ActsAny amount which results from You actingor behaving unlawfully. Any amount if You break the animal healthor importation laws or regulations of theRepublic of Ireland or United Kingdom.

DiseaseAny amount resulting from diseasestransmitted from animals to humans. Any amount if the Horse suffers from a notifiable disease as defined by theDepartment of Agriculture, Fisheries and Food at the time of the notification of the claim.

ConfiscationAny amount if the Horse is confiscated or destroyed under the order of anygovernment, public, local or any otherauthority.

Use by Riding SchoolAny amount which results from your Horsebeing used by a Riding centre/school forpublic use.

Business Trade or ProfessionThis Policy does not provide cover forany property or Horse used in connectionwith any business, trade or professionalpurpose. Any amount if the incident orInjury that takes place is a result of yourbusiness activity, your profession, youroccupation, or while You are working forsomeone, including voluntary workwhether You are paid or not.

Professional CompetitionsAny amount if You or the Horse are takingpart in any professional competition, or professional racing including point-to-point racing.

Veterinary Treatment AbroadAny amount for travel to seek VeterinaryTreatment elsewhere, except wheretreatment is not available in the Republic ofIreland and pre- authorisation has beengranted by the Allianz Horse and RiderClaims Department.

If thecover is motor insurance, the premiumcannot be refunded until the AllianzCertificate of Motor Insurance andInsurance Disc have been returned toAllianz. Governing law You and We may choose the law applicable tothis contract. It is hereby agreed that thiscontract is governed by Irish Law unless weagree with you otherwise in writing. The IrishCourts will have jurisdiction to hear any disputeother than any dispute which must be referredto arbitration under the arbitration clause ofthis policy.

Policy Alteration, Additional and Return Premiums Where Your policy is altered during any Periodof Insurance We will recalculate Your premium.This may result in an additional premium dueto Us or a return premium due to You.

A premium transaction charge may be appliedto all such alterations, as detailed in YourSchedule.

We will only charge or refund You provided thetotal amount, including the premiumtransaction charge, is greater than or equal tothe amount detailed in Your Schedule.

A government levy applies to all premiumcalculations.

Alteration to terms and conditions In the event of a claim we may advise you, at the time of your next renewal, of alteredpolicy terms and conditions which increaseyour premium and/or excess, and/or reduce cover.
